AN ORDINANCE AMENDINGCHAPTER 6.05 OF THE MOSES LAKEMUNICIPALCODEENTITLED"ANIMALCONTROL"
THE CITYCOUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON DOORDAIN AS FOLLOWS:
Section 1.Chapter6.05oftheMoses Lake Municipal Code entitled"AnimalControl"is amended as follows:
6.05.040 License Fee and Taq:The license fee shall be in the sum of five dollars ($5)per year forneuteredmaledogsandspayedfemaledogs,and thirtydollars ($30)per year for non-O neutered male and unspayed female dogs.Upon the payment of such license fee to theFinanceDirectororhisdesignee,and upon being shown proof of a current rabies vaccination,it shall be the duty of the Finance Director or his designee to issue a license to the partymakingapplicationtherefor.
A.The license shall expire on the first day of January next succeeding the date of theissuancethereofandthetimefixedfortheissuingofalicenseshallcommenceonthefirstdayofJanuaryofeachyearandnolicenseshallbeissuedtoexpireatanyothertimethanthatdate.The license fee shallbe paidin fullforany year or part thereof.
B.The Finance Director or his designee shall,together with thelicense,furnish a suitable tagwhichshallbewornbythedogforwhichsuchlicenseisissuedandshallbefastenedtosuchdoginsuchmannerthatitcaneasilybeinspectedatalltimesbycityauthorities.LosttagswillbereplacedbytheFinanceDirectororhisdesigneeuponapaymentofanadditionalfeeoftwoandonehalfdollars($2.50).
C.Allpersons must present a current rabies vaccinationreceipt before a city dog license canbeobtained.
D.Pursuant to RCW Chapter 16.08,the city is required to regulate and issue certificatesofregistrationfordangerousdogs.Such certificate shall be issued on an annual basis withnoprorationofthefeeprovidedforhereinforlessthanafullyear's registration of adangerousdog.The annual license periodshall extend from January 1 throughDecember31ofeachcalendaryear.Itshall be thedutyof each ownertoobtaina current registrationforadangerousdogpriortoJanuary1ofeachlicensingperiodorthecostofregistrationshallbedoubled.The annual fee for registration of a dangerous dog shall be threehundreddollars($300).
6.05.050 Kennel License Required:No person,group of persons,or business entity shall own,keep,O or harbor more thanthree(3)dogs or four (4)cats or any combinationthereofof more thanfour(4)animals,of six (6)months of age or older or engage in the commercialbusiness ofbreeding,buying,selling,trading,trainingor boarding cats or dogs or both cats and dogswithouthavingobtainedakennellicensefromtheFinanceDirectororhisdesignee.
A.The kennel license shallexpireon thefirst day of January next succeeding the date of theissuancethereof.The timefixed for the issuing of a license shall commence on the firstdayofJanuaryofeachyearandnolicenseshallbeissuedtoexpireatanyothertimethanthatdate.The license fee shall be paid in fullfor any year or part thereof.
B.The yearly fee for licensing a kennel shall be fiftydollars ($50)whichshall be the onlybusinesslicensefeethecityrequiresofkennelowners.
C.This section shall not apply toand willnot be construed to require a kennel license for alicensedveterinariantooperateananimalclinicorhospital.
D.This section shall notapply toand willnot be construedto require a kennel license for anypetshopwhichsellsanimalsoflessthansix(6)months ofage.
E.Kennel licenses shall not be issued for use inareas zoned R-1 and R-2.
6.05.175 License and Permit Issuance and Revocation:
A.The Cityof Moses Lake may revokeany animalpermit or license iftheperson holdingthepermitorlicenserefusesorfailstocomplywiththischapter,the regulationspromulgatedbytheCityofMosesLake,or any law governingthe protectionand keeping of animals.
B.Any person whose animalpermit or license is revoked shall,withinten(10)days thereafter,O humanely dispose of all animals owned,kept,or harbored by such person and no part ofthepermitorlicensefeeshallberefunded.
C.It shall be a condition of the issuance of any permit or license that the City of Moses Lakeshallbepermittedtoinspectallanimalsandthepremiseswhereanimalsarekeptatanytimeandshall,ifpermissionfor such inspection is refused,revoke the permitor license oftherefusingowner.
D.If the applicant has withheldor falsifiedany information on the application,the City ofMosesLakeshallrefusetoissueormayrevokeapermitorlicense.
E.No person who has been convicted ofcrueltytoanimals shall be issued a permit or licensetooperateacommercialanimalestablishment
F.Any person having been denied a license or permit may not reapply for a period of thirty(30)days.Each reapplication shall be accompanied by a twentydollar ($20)fee.
G.Any dog impounded under the provisionsof this chapter shall not be released until theownerofsuchdogshallhavepaidallfeesandchargesdue.
6.05.180 Records:
A.It shall be theduty of theAnimal Control Officer tokeep,or cause tobe kept,accurate anddetailedrecordsoftheimpoundmentanddispositionofalldogscomingintohiscustody
and of all reports of animal bites reported tohim.
B.It shall be theduty of theFinance Director or his designee to keep a record of the namesofallpersonstowhomlicensesareissuedwiththenumberofeachlicenseandwhether
for a male or female dog and whether the male dog has been neutered or the female dogspayed.
Section 2.The City Council declares that an emergency exists and this ordinance shall take effect
immediately as provided by law upon one reading if2/3 of theentire City Council present vote in favor of
passage.
