ANORDINANCEAMENDINGCHAPTER 8.26 OF THE MOSESLAKEMUNICIPALCODEENTITLED"FIRE ALARMS"
THE CITYCOUNCIL OF THE CITYOF MOSES LAKE,WASHINGTON DO ORDAIN AS FOLLOWS:
Section 1.Chapter8.26 of theMoses Lake Municipal Code entitled"Fire Alarms"is amended as follows:
8,26.010 Purpose:The purpose of this chapter is to attempt to reduce the number of false fire alarms
O experienced in the Cityof Moses Lake and recover part of the cost for responding tofalse firealarms.
8.26.020 False Alarm:False Alarm shall mean theactivation ofafire alarmand/orautomaticsprinkleralarmforotherthanafire,smoke scare,oran emergency building evacuation,whichmaybe caused bymechanicalfailure,malfunction,improper installation,lack of maintenance,or negligence of theownerorlesseeofafirealarmsystemortheiremployeesoragents.
8.26.030 Fire Department Response:For a Fire Department response to any false alarm the Fire ChiefshallinformtheFinanceDirectorandtheFinanceDirectorshallchargeandcollectfromthepersonhavingormaintainingsuchfireand/orautomaticsprinkleralarm system on premises owned oroccupiedbyhim/her,fees as follows:
A.For a response to premisesat which no other false alarm has occurredwithin the precedingthree(3)monthperiod,hereinafter referred to as a "firstresponse,"no fee shallbe charged,but theperson having or maintaining such fire alarm systemand/orautomatic sprinkler alarmsystemshall,within three(3)working days after notice to do so,make a written report to theFireChiefonformsprescribedbyhimsettingforththecourseofsuchfalsealarm,thecorrectiveactiontaken,whethersuch alarm has been inspected by an authorized serviceman,and such other information as theFire Chief may reasonably require todetermine thecauseofsuchfalsealarmandcorrectiveactionnecessary.
B.For a second response toa premises withinthree(3)months after a first response,no feeshallbecharged,buta written report shall be required as for a first response andthe Fire Chiefshallbeauthorizedtoinspectorcausetobeinspected,the alarm system and/or automaticsprinkleralarmsystematsuchpremises,prescribenecessary corrective action,and shallgivenoticetothepersonhavingormaintainingsuchalarmsystemoftheconditionsandrequire-

a premises within three(3)months after such second response,andforallsucceedingresponseswithinthree(3)months ofthelast response,a fee ofone hundreddollars($100)shall be charged,and if such thirdfalse alarm or any such succeeding falsealarmisasaresultoffailuretotakenecessarycorrectiveactionprescribedbytheFireChief,the Fire Chief may orderthedisconnectionof such alarm system and itshall be unlawful toreconnectsuchalarmsystemuntilsuchcarrectiveactionistaken;provided,thatnodisconnec-tionshall be ordered as toanypremises requiredby law tohave an alarmsystem inoperation.
D.Fora firstresponse caused bya failure ofmaintenancepersonnel to providepropernotificationtotheMosesLakeFireDepartmentthattesting,maintenance,or service work is to beperformedonafirealarmand/or automatic sprinkleror suppression system,a fee of fiftydollars($50)shall be charged totheservice company performing thework.
E.Second,and subsequent responses caused by thefailure toprovide proper notification shallresultinachargeofonehundreddollars($100)being assessed.
Section 2.The City Council declares that an emergency exists and this ordinance shall take effectimmediatelyasprovidedbylawupononereadingif2/3 of theentire CityCouncil present vote in favor of
passage.
