ANORDINANCEAMENDINGCHAPTER 12.44 OF THE MOSES LAKEMUNICIPALCODEENTITLED"STREET VACATION"
THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON DO ORDAIN AS FOLLOWS:
Section 1.Chapter 12.44 of the Moses Lake Municipal Code entitled "Street Vacation"is amended asfollows:
O 12.44.020 Processing Fee:A non-refundable fee oftwohundred dollars ($200)shallaccompanyeach and
every petitionfor a street vacation.The petition shall not be presented to the CityCouncil norprocessedfurtheruntilthefeehasbeenpaid.
12.44.030 Appraisal Fee:The petitioners,inadditiontopaying thetwohundred dollar ($200)processing fee,shall deposit with the City of Moses Lake a sum established bytheMunicipal Services Director orhisorhersuccessorintitle,but in no event less than four hundred dollars ($400).The cost ofappraisingthepropertysoughttobevacatedinordertoestablishtheappraisedvalueofthepropertyshallbebornebythepetitionersanddeductedfromthepetitionersdeposit.The balanceofthedeposit,after deducting the cost of the appraisal,shallbe returned to the petitioners.
12.44.040 Compensation:The twohundred dollar ($200)processing fee and thecost of the appraisal of thepropertysoughttobevacatedshallbepaidbythepetitionersinadditiontothecompensationforthepropertythatthecitymayrequirepursuanttoRCW35.79.020 ifthe property is vacated andregardlessofwhetherornotthevacationisactuallyapproved.
Section 2.The City Council declares that an emergency exists and this ordinance shall take effectimmediatelyasprovidedbylawupononereadingif2/3 ofthe entire City Council present vote in favor of
passage.
