ANORDINANCE AMENDINGCHAPTER 13.12 OF THE MOSES LAKEMUNICIPALCODEENTITLED"WATERAND SEWER RATES"
THE CITYCOUNCIL OF THE CITYOF MOSES LAKE,WASHINGTON DO ORDAINAS FOLLOWS:
Section 1.Chapter 13.12 of theMoses LakeMunicipal Codeentitled "Water and Sewer Rates"is amendedasfollows:
13.12.010 ResidentialWater Rates:
A.The following shall be themonthlyrate charge for water from the city water system from allresidentiallivingunitswithinthecorporatelimitsofthecityandoutsidethecorporatelimitsofthecityafterMay1,2000:

13.12.030 Residential Sewer Rates:
A.The following shallbe the monthlyratechargedcustomersresidingwithinthecorporate limitsofthecityandoutsidethecorporatelimitsofthecityforsewerservicefromthecitysewersystemforsingle-family dwellingsand each unit of a duplex with separate meters:flat rate,$24.30per monthafter May1,2000.
B.The followingshall be themonthly rate chargedcustomers residingwithin thecorporate limitsofthecityandoutsidethecorporatelimitsofthecityforsewerservicefromthecitysewersystemforsingle-familydwellings and each unit of a duplex with separate meters:flat rate,$25.05per month after May 1,2001.O13.12.035 Duplex Sewer Rates:
A.The followingshallbe themonthlyrate charged customers residing within the corporate limitsofthecityandoutsidethecorporatelimitsofthecityforsewerservicefromthecitysewersystemforduplexeswithonlyone(1)meterservingtwo(2)livingunitsorfortwo(2)livingunitsonasinglelotservedbyone(1)meter:flatrate,$49.50per monthafterMay 1,2000.
B.The followingshall be themonthly rate charged customers residing withinthe corporate limitsofthecityandoutsidethecorporatelimitsofthecityforsewerservicefromthecitysewersystemforduplexeswithonlyone(1)meterservingtwo(2)livingunitsorfortwo (2)livingunits
on a single lotserved byone (1)meter:flat rate,$51.00per month after May 1,2000.
13.12.040 CommercialSewer Rates:
A.The following shallbe the monthlyratecharged customers residingwithinthecorporatelimits
of thecityand outside thecorporatelimits ofthecityforall chargeablewater discharged into
thecitysewer system by commercialusers and dwellings with three (3)or more livingunits
served by one (1)meter after May1,2000:

C.For purposes of calculating sewer charges,chargeable water shall be defined as follows:
Chargeable water shall be measured by thewater consumed on thepremises,whateverthe
source of such water,and the same willbe metered either by a public utilitymeter or one
installed and maintainedby theowner ofthepremises at his own expense and approved and
inspected by thecity.As an option,if requested by the owner of the premises,thecitywill
install a water meter withthe cost forthemeter and installation being paidby the owner of the
premises in accordance with the charges assessed in MLMC 13.08.020 for water/sewer
connections.Under such circumstancesthewater meter becomes thepropertyof theownerofthepremisesandallcostsofreplacementandrepairaretheresponsibilityoftheownerof
the premises.In all circumstanceswhere thewater is metered by a privatelyownedwater
meter and is used todetermine sewer charges,thecityshallbe allowedaccess to the meter
in orderto read such meter.Wheretheuse ofwateris suchthata portion ofallthe water used
does not flowinto the sewer system,forwhateverreason,but is lost by evaporation,irrigation,
sprinklingor is used in manufacturing or in a manufacturedproduct,or is lost for whatever
reason,and the person incontrolprovidesproof ofthisfact and installs a meter or other mea-
suring device approved by thecityto measure the amount of water so used and so lost,or if
thecityis capable of determining the amountof sewage entering thecity's sewer system by
someothermechanicalmeans,thiswater may be deducted fromthe actualwater consumption
used incalculatingthesewer charge.
The sewer charges for triplexesand apartments,mobilehome parks,schools,hospitals and
other commercial establishments withincreased usage for irrigation,only iftheirlandscaping
exceeds five thousand(5,000)square feet,shall be computedon theaverage consumption
during theprevious non-irrigationseason,unless theuser elects toinstall,at his expense,anapprovedmeasuringdevicetomeasurewaternotenteringthesewersystem.When a user
has a swimmingpool or coolingunits dischargingto thesanitary sewer,he must install an
approved meter to determine theamount of water exempt fromsewer charges during the
irrigation season.The irrigationseason shallbe definedas theperiodinwhichstatements are
mailed for the AprilthroughNovember billingcycles.
D.Sewer rates for commercial uses discharged into the sewer system may be separatelydeterminedbytheCityCouncil,based uponboth volume and chemical characteristicsof thesewage.The City Council reserves the privilege to require pre-treatment of any materialdischargedintotheseweragesystem,or toprohibitdischarge into thesystem ofindustrialwastesthat,because of either volume or concentration,willoverload existing seweragefacilities.
E.AIIair-conditioning and refrigeration unitsthat are installed,replaced or thathave capacityincreasedaftertheeffectivedateoftheordinancecodifiedinthischaptershallberequiredtoinstallrecirculatingunits.Disposal may notbe accomplishedby discharging into thesanitarysewersystem.
13.12.085 Service Charge:
A.The servicechargeforallwater turn-onsortum-offsafter4 p.m.and before 8 a.m.and atanyothertimewhichisnotanormalworkingdayforthecityshallbethirtydollars($30).This feeisinadditiontothefeeimposedbythissection.
B.A delinquent servicecharge of seven dollars ($7)willbe assessed on each water,sewer,orgarbageaccountoranycombinationofwater,sewer orgarbage service whichis billedon one(1)account ifnotpaid and receivedbytheFinance Department,UtilitiesDivision,by 5 p.m.onthedaypriortodateshownuponthedelinquentnoticeprovidednoextensionsaregrantedassetforthinSection13.12.053.Theassessment of theseven dollars ($7)delinquentservicechargeshallbewaivedonceacalendaryearoneachandeveryaccountAnadditionaldelinquentservicechargeoftwelvedollars($12)willbe assessed oneach water,sewer,orgarbageaccountoranycombinationofwater,sewer,orgarbage servicewhich is billedonone(1)account if not paid by thedate and timeshown upon the delinquent notice provided noextensionsaregrantedassetforthinSection13.12.053.The seven dollar ($7)and twelvedollar($12)service charges are subject tothelimitations of Subsections F and G ofSection13.12.060.Ifwater service is terminatedfor non-payment of theaccount,the twelvedollar($12)charge shall include turningthe water back on from 8 a.m.to4 p.m.on normal cityworkingdaysprovidedtheoccupantdoesnotchange.This fee is in addition to the feeimposedbySubsectionC.
C.A service fee of eight dollars ($8)shall be added to each new water,sewer,or garbageaccountoranycombinationofwater,sewer or garbage service which is billed on one (1)account.A service fee of eight dollars ($8)shall be added for each change of service toanotheroccupant.This fee shallinclude one (1)water turn-onifapplicable from 8 a.m.to 4p.m.on normal cityworkingdays.
Section 2.The City Council declares that an emergency exists and this ordinance shall take effectimmediatelyasprovidedbylawupononereadingif2/3 of theentire City Council present vote in favor ofpassage.
