ANORDINANCEAMENDINGCHAPTER16.32 OF THE MOSESLAKEMUNICIPALCODEENTITLED"RADIOANTENNA"
THE CITY COUNCIL OF THE CITYOF MOSES LAKE,WASHINGTON DO ORDAINAS FOLLOWS:
Section 1.Chapter 16.32 ofthe Moses Lake Municipal Code entitled "Radio Antenna"is amended asfollows:
0 16.32.020 Permit -Fee:No such radio antenna or other device as described in Section 16.32.010 shallbeconstructed,erected,orinstalled in thecityunless a permit thereforhas first been obtainedfromtheBuildingOfficial.Applications for such permits shall be madetotheBuildingOfficialand shallbeinwriting.A fee assessed in accordance with the applicableversionof the Uniform BuildingCodeshallbechargedforeachsuchpermit,to be paid at the timeof applicationtherefor.Temporary installations for the purpose of finding the best location for the antenna or for thedemonstrationofappliancesorsimilarpurposesshallfullyconformtotheordinancesofthecity,but may be made uponnoticatothe Finance Director,which noticemaybe verbal or inwritingandshallgivetheaddressofthepremiseswheresuchinstallationisbeingmadeandthenameoftheoccupantthereof.No fee shallbe payable orpermitrequired for such temporaryinstallations,butuponthesamebeingmadepermanentapermitshallbeobtainedthereforandfeepaidasprovidedinthissection.Notemporaryinstallation shallcontinue for morethanthirty(30)days andupontheexpirationofsuchtimeshallbeconsideredpermanentandapermitobtainedandfeepaid.
16.32.030 Inspection:Upon completionof the installation of any such antenna orsimilardevice,notice inwritingthereofshallbegiventotheBuildingOfficial,whereuponsuch installation shallbe promptlyinspectedbytheBuildingOfficialorhisauthorizedrepresentative.If upon inspection suchinstallationisfoundtobeinviolationofanyordinanceofthecity,thesame shall be,within tendays,so altered as to complywithsuch ordinances or be entirely removed.
16.32.040 Amateur Broadcasting Stations:Operators of amateur radio broadcasting stations who holdlicensesforsuchstationsfromtheFederalCommunicationsCommissionshallobtainapermitandpaythefeeasprovidedinSection16.32.020 fortheoriginalantenna erected foreach such station.Written noticeof any change in location or structure ofsuch originalantenna or oftheerection ofanyotheroradditionalantenna,which notice shallgivethe address of thepremises upon whichsuchantennaislocated,thename oftheoccupantthereof,a brief description ofthechanges beingmade,and whichnoticeshall be signed by holder ofthepermit for theoriginal antenna,shallbeOgiventotheBuildingOfficialwithinfive(5)days after such change is made,whereupon suchantennashallbeinspectedasprovidedinSection16.32.030.No fee other than forthe originalantennashallbepayableforsuchamateurradiobroadcastingstations.
Section 2.The City Council declares that an emergency exists and this ordinance shall take effectimmediatelyasprovidedbylawupononereadingif2/3 of the entire City Council present vote in favor ofpassage.
