AN ORDINANCEAMENDINGCHAPTER 17.13OF THE MOSES LAKEMUNICIPALCODEENTITLED"SHORT SUBDIVISIONS"
THECITYCOUNCIL OF THE CITYOF MOSESLAKE,WASHINGTONDOORDAINAS FOLLOWS:
Section1.Chapter 17.13 of theMoses LakeMunicipalCode entitled"ShortSubdivisions"is amended asfollows:
17.13.030 PreliminaryPlatConditionâand Requirements:
A.General Conditionsand Requirements:
1.The subdivisionshall make adequate provision for roads,streets,curbs,gutters,side-walks,street lighting circuits,alleys,extension of municipalutilities(sewerand water),drainage ways,irrigationwaterright-of-ways,otherpublic ways or anymunicipal improve-ments as deemed necessary in conformance with city Community Street and UtilityStandardsandcityDesignStandardsineffectatthetimeofplatapproval.
2.The subdivisionshall front on a existing street There shall be adequate access toallparcels.Streets shallbe improved tocity standards.Street lighting shallbe provided.
3.The subdivisionshallcomplywith allzoning and health regulations.
4.The subdivisionshallbe consistent with the city's Comprehensive Plan.
5.Environmentalinformation shall be prepared and submitted in accordance withtheguidelinesestablishedundertheStateEnvironmentalPolicyActof1971,as amended.Said information is a part ofand mustaccompanythe preliminary plat application.
6.The subdivisionshall provideforirrigationwaterright-of-ways pursuant toRCW 58.17.310asnowenactedorhereafteramended.
7.A street lighting planas maybe required by theCityEngineer mustbe provided.The planmustbeapprovedbytheGrantCountyPUDandincludecertificationthatallstreetlightingfeeshavebeenpaidorthatarrangementsacceptabletothecityandthePUDhavebeenmadeforthepaymentofrequiredfees.
8.The subdivisionshallnothavebeen previouslydivided ina shortsubdivision withinthe lastfive(5)years and will not be further divided in any mannerunless such proposedOresubdivisioncomplieswithallprovisionsrelatingtomajorsubdivisionsineffectatthetimethefurthersubdivisioniscommenced.
9.Unless an applicant for a preliminary plat approval requests otherwise,and the PlatAdministratoragrees,a preliminary plat shall be processed simultaneously with theapplicationforrezones,variances,planned unitdevelopments,site plan approvals,andsimilarquasi-judicialoradministrative actionstotheextentthatproceduralrequirementsapplicabletothoseactionspermitsimultaneousprocessing.
10.Everydecision or recommendationmade under thischapter by theCouncilor PlanningCommissionshallbeinwritingandshallincludefindingsoffactandconclusionstosupportthedecisionorrecommendation.
11.Preliminary plats of any proposed short subdivision shall be approved,disapproved,orreturnedtotheapplicantformodificationwithinthetimelimitationsestablishedbyRCW58.17.140.
12.In the event thatthe short subdivisiondoes not border upon adjacent property to whichmunicipalutilitieshavebeenextendedoruponadjacentpropertyfrontinguponimprovedstreets,theproperty ownermayrequest a variance totheshortsubdivisionprovisions formunicipalimprovementsasdeemednecessary.In lieuofthecompletionoftheextensionofmunicipalutilities(sewerand water)and the completion of street improvements,acovenanttothelandtitlemaybecreated.Said covenant shallpledge theproperty ownertoinstallmunicipalimprovementsasdeemednecessaryatsuchtimeastheadjacentpropertyisimprovedbytheinstallationofmunicipalutilitiesand/or at such timeas theimprovementofstreetsuponwhichtheadjacentpropertyisfrontingoccursasanysucheventisdeemedtooccurinthesolediscretionofthePlatAdministrator.Said covenantshallalsopledgethepmpertyownertoparticipateinanyfuturelocalimprovementdistrictsforsuchimprovements.
13.Atthediscretion of thePlat Administrator,therequirementthata preliminary short plat besubmittedmaybewaived.Subject to theapproval of the Plat Administrator,a short platwithoutimprovementsmaybesubmittedasafinalplatforreviewandapproval.
14.A plat certificatefrom a titlecompany licensedtodo business in the State ofWashingtondatedwithinthirty(30)days ofthedate offilingofthefinalplat and applicationwiththe PlatAdministratorconfirmingthatthetitleofthelandsasdescribedandshownontheplatisinthenameoftheownerssigningthesubdivisionplatorinstrumentofdedication.
B.Specific Conditions and Requirements:
1.Prior tosubmissionofa shortsubdivisionpreliminaryapplicationand preliminaryplat,the
subdividerorthesubdivider's representative shall schedule a pre-applicationconference
with thePlatAdministrator and representatives of other affected citydepartments.The
subdividershallpresenta conceptualidea oftheplat.The Plat Administrator andrepresen-
tativesofaffectedcitydepartments willrespond informallyand address potential itemsof
concemtoaid thesubdividerin preparingtheshortsubdivisionpreliminaryapplicationand
preliminaryplat.
2.The preliminary short subdivision applicationand platshallbe filedwiththePlat Adminis-
tratoron forms prescribed bytheCommunityDevelopment Department The application
shallbe accompaniedbytwelve(12)copies ofthepreliminary plat.Atthediscretion ofthe
Plat Administrator,the requirement thattwelve (12)copies of the preliminaryplat be
submitted may be waived.Processing of the preliminaryplat may require fewer than
twelve(12)copies of the plat.
3.The preliminary plat shall be a neat and accurate drawing,stamped and signed by a
registered professionalland surveyorlicensed by theStateofWashington onreproducible
materialat a decimal scale.The platmapshall measure eighteen inches (18")by twenty-
four inches (24").The preliminaryplat shall be drawn in black permanent ink on two(2)
or more sheets ifthescale necessary toaccommodate the map on one (1)sheet would
undulycongest thedrawing.
4.A non-refundable fee ofthreehundred dollars ($300)shall accompany each and every
applicatiori for a preliminaryshort subdivision.
5.The preliminary plat shall contain the following:
a.Name of proposedsubdivision.
b.Boundaries of proposedsubdivisionestablished by the preliminary survey.
c.Location anddimension ofallexistingand proposed streets,alleys,utilitiesand right-
of-waysand/oreasements on and adjacent totheproposed subdivision,
d.Location anddimensions ofallexistingand proposed irrigation water right-of-wayson
and adjacent to theproposed subdivision.
e.Legal description of land withintheproposed subdivision.
f.Any proposed land dedications.
g.Name,address,and seal ofthe registered land surveyorwho made the preliminary
survey.
h.The date ofthe preliminary survey.
i.Horizontal scale of theproposed platshallbe notmorethanone hundred feet (100')
to theinch.ExceptthattheCityEngineer,subject to a request priorto platsubmittal,
may approvean alternativeplat map scale nottoexceed one hundredfeet (100')tothe
inch.
j.Monuments found and established during the preliminarysurvey.
k.Date map is prepared,scale,and north point of the map.Approximate proposed lot
lines with theirdimensions,including lot numbers and block numbers.
I.Ifanyofthe parcels can be further divided or ifonlya portion ofa tractis being divided,
location offuturestreets,alleys,and lot lines shall be shown by dotted lines.
m.A vicinitymapat a scale of notmore thanfour hundred feet (400')totheinch.Except
thattheCityEngineer,subjecttoa request prior to plat submittal,may approve an
alternative vicinity map scale exceeding four hundred feet (400')to the inch.The
vicinity map shall show alladjacent parcels.It shallshow how thestreets and alleys
inthe proposedsubdivision mayconnectwith existing and proposed streets andalleys
in neighboringsubdivisions or unplatted property to produce an advantageous
development ofthe entire neighborhood.
n.Provide recommendedstreet names for approval.
o.United States Bureau of Reclamation horizontal and vertical data including bench
marks.
p.A site plan on a separate sheet showing the followinginformation:
1)Location andsizing ofexisting and proposed utilitiesincluding water,sewer,storm
drains,electricity,gas,street lighting,curbs and sidewalks,telephone,and
cablevision lines.Minimumsize and scale shall be thesame as the preliminary
plat map.
2)Existing and proposed structures and naturalfeatures and allproposed improve-
mentswithin and adjoiningthe proposed subdivision.
3)Topography ofthe area witha maximumof twofoot (2')intervals of contours asrequiredbytheCityEngineer.
4)Present zoning classificationon and adjacenttoproperty.
5)Any proposed dedications for park land subject tothe approval of the PlanningCommission.
6)Any deed restrictionsor covenants existing or proposed shall be drawn on thesiteplanandpreliminaryplatmap.
17.13.040 Referral toOther Departments.Agencies,and Offices:
A.Uponreceipt of a complete and satisfactory preliminary plat application,thePlat Administratorshalldistributecopiesofthepreliminaryplattoeachofthefollowingoffices,departments,oragencieswithintwo(2)working days from receipt:
1.Public UtilityDistrict
2.Gas Company
3.Telephone Company
4.Engineering Division of the MunicipalServices Department (threecopies)
5.Fire Department
6.Building Division oftheCommunity DevelopmentDepartment
7.Grant CountyHealth District
8.Anyirrigation districtwithjurisdiction
9.GrantCounty Assessor
10.Communications Company
B.The Plat Administrator shall further notify the Police Department,Park and RecreationDepartment,and CityManager thata preliminary plat has been received.
C.Notice of the filing of a preliminary plat of a proposed subdivisionlocated in the city andOadjoiningthemunicipalboundariesthereofshallbegiventotheGrantCountyPlanningDepartment.
D.Notice ofthe filingofa preliminary plat ofa proposed subdivision located adjacenttotheright-of-way ofa state highwayshall be given totheState Department of Highways.
E.Each office,department,oragency shall filewrittenrecommendationswith thePlatAdminis-tratorwithineight(8)calendardays from thedateoffilingofthepreliminary plat and applicationwiththePlatAdministrator.Ifany such office,department,or agencyfails tofile a writtenrecommendationwithinthetimelimitation,it may be presumed thatsuch office,department,oragency has no recommendation.
F.Ifthe preliminary plat is found to be unacceptable,a certifiedletter shall be mailedto thesubdividerwithinten(10)calendar days of receipt oftheapplication.
G.The Plat Administrator may determine thata meetingshallbe held toresolve majorissuesidentifiedasaresultoftherecommendationsofotheroffices,departments,or agencies.Suchmeetingshallbeattendedbythoseoffices,departments,or agencies responsible for therecommendationsandmustincludetheapplicantandthePlatAdministrator.The proceedingsandresultsofthemeetingshallbedocumentedbyminutes.
17.13.050 Variances:
A.The subdivider may make applicationtothe Plat Administrator on forms prescribed by theCommunityDevelopmentDepartmentforavarianceofanyprovisioncontainedinthistitle,provided thatthe request is received priorto thepreliminary short plat approval by the PlatAdministrator.
B.The PlatAdministrator shallforward thevarianceapplicationtothePlanning Commission,TheOPlanningCommissionshallreviewthevariancerequestatitsnextregularmeetingandshallrecommendthattheCouncilapprove,conditionallyapprove,or disapprove the varianceapplication.
C.A variance may be granted in conformancewithall of the followingconditions and require-ments:
1,There are special physical circumstances or conditions affecting said real property suchthatstrictapplicationoftheprovisionsofthistitlewouldcauseanunusualandunneces-sary hardship on thesubdivider.
2.The granting of the variance will not be detrimental to the public welfare or injurious tootherpropertyinthevicinity.
3.In grantingvariances,theCouncilmayrequiresuch conditionsas willsecure,in so far aspracticable,the objectives of therequirement varied.Any variance authorized shall beenteredintheminutesoftheCounciltogetherwiththecircumstancesthatjustifythevariancegranted.
D.Upon receipt of a Planning Commission recommendation the Council at its next regular
meeting shall consider and adopt or reject the Planning Commission's recommendation withrespecttothevarianceapplication.
E.A preliminary short plat accompanied by an application for a variance shall not be approvedbythePlatAdministratoruntilsuchtimeastheCouncilapproves,conditionallyapproves,ordisapprovestheapplicationforavariance.Application for a variance totheprovisionsofthistitleshallconstituteapprovalinwritingbytheapplicantforasixty(60)day extensionofthesholtsubdivisionpreliminaryplatapprovalperiodassetoutinSection17.13.030 (A9)ofthischapter.
F.Ifthe short plat has not been completed and has not been recorded and filedwiththe GrantCountyAuditorwithintwelve(12)months ofthedate of preliminaryshort plat approval,thevarianceshallbecomenullandvoid.Ifan extensionofthepreliminaryshort plat is granted,
said variance shall run concurrentlywith theshort plat extension.
17.13.070 Preliminary Short Subdivision Application Review Procedures:
A.Upon receipt oftheshortplatapplication,thePlat Administrator shallwithinthetimelimitations
established by RCW 58.17.140,respond tothe applicantin one of thefollowing manners:
1.Preliminary approval is granted as submitted.
2.Preliminary approvalis granted with modificationsrequested.
3.The proposed subdivisionis denied and reasons stated.
4.Preliminary approval is withheld untilPlanning Commission and/or Council approvalof
dedications or variance requests.
B.Theshort subdivisionpreliminary applicationshall require approvalofthe Plat Administrator
and the City Engineer indicated by theirdated signatures thereon to be valid.
C.The decision of the Plat Administrator shallbe final,unless an appeal by any aggrievedparty
is made tothePlanning Commissionwithinten (10)calendar days of thedate of decision of
the Plat Administrator.Said appeal shall be in writingto the Planning Commission and
submitted throughtheCommunityDevelopment Department.TheCommunityDevelopment
Department shallrecordand date thereceiptof thatappeal.The Planning Commissionshall
act on thatappeal withinforty (40)days unless an extension is agreed to in writingby theapplicant.The decision of the Planning Commission shall be final and conclusive unless,
withinten (10)days,anyaggrievedparty fileswiththe Finance Director a written appeal.The
Council shall hear thatappeal within twenty(20)calendar days of the date ofappeal.
D.Approval ofthepreliminaryplat shallconstituteapproval fortheapplicant/subdividertodevelop
construction plans andspecificationsforallfacilitiesand improvements andtopreparethefinal
plat.
17.13.110 FinalShort Subdivision Plat Application:
A.General Requirements:
1.The final short subdivisionapplicationand platwillbe filedwiththePlat Administrator onformsprovidedbytheCommunityDevelopmentDepartment.
2.AIIrequired street and utilityimprovements must be constructed by theapplicantand must
be accepted by the City of Moses Lake or a subdivisionbondor other approved security
shallbe submitted in an amount sufficientto cover one hundred and fiftypercent (150%)
ofthe estimated cost ofcompletingallrequired utilityextensions and street improvements
as determined by theMunicipalServices Director.Upon completion oftherequired public
improvements and prior to acceptance by the Council,the subdividerldeveloper must
submita maintenance bond or alternative security approved by the City Attorney in an
amountdetermined bytheCityEngineer andapproved bytheMunicipal Services Director.
The maintenance bond amountshall be one hundred percent (100%)oftheactual cost of
construction.Analternative securityshallbe inan amount not less thanten percent (10%)
nor morethan onehundred percent (100%)oftheactualcost ofconstruction.The amount
shall be determined on a case by case basis based upon the City Engineer's estimated
cost of repair ormaintenanceshouldrepair or maintenancebe required.The subdivider/
developer shall submit documentation ofthe cost ofconstructionto the City Engineer for
his reviewand approval and use in determiningthe required bond oralternative security
amount.Said bond shall be in effectfor one (1)year from thedate ofacceptance.
3.The instrumentof dedication ofallstreets,right-of-ways,parks,playgrounds,easements,
reservations,irrigation water right-of-ways,and any area to be dedicated to public use,
togetherwith any restrictions or limitations thereonshall be submittedas a part of the final
plat.
4.The applicationshall be accompaniedby thefollowing:
a.A platcertificate from a titlecompany licensed todo business intheState ofWashing-tondatedwithinthirty(30)days ofthedate of filingofthefinal platand application withthePlatAdministratorconfirmingthatthetitleofthelandsasdescribedandshownontheplatisinthenameoftheownerssigningthesubdivisionplatorinstrumentofdedication,
b.Acertificate fromtheGrantCountyTreasurer indicating thatalltaxesand assessmentsonthepropertyincludedinthefinalplat,subdivision,or dedication have been paidaccordingtotheprovisionsofRCW58.08.030 and RCW 58.10.040 as nowenactedorhereafteramended.
c.A certificate from the city Finance Directorindicating thatthere are no delinquentspecialassessmentsorliensonthepropertyincludedinthefinalplat,subdivision,ordedication.
d.A check payable to thecityinthe amountof two hundred dollars ($200)tocover thecostofcheckingthefinalshortplat,
e.AIIcovenants proposed torunwiththeland.
5.The final short plat [twelve(12)sets ofprints plus theoriginal tracingand a reproduciblemylarcopy]shall include allitems inSection 17.13.030 (84)and any additionalinformationandmodificationsrequestedinthepreliminaryapproval.At the discretion of the PlatAdministrator,therequirementthattwelve(12)copiesofthe final platbe submitted maybewaived.Processing of the final plat may requirefewer thantwelve(12)copies.
Thefinal plat shall be prepared in a neat and legible mannerin blackpermanent drawinginkonmylardraftingfilm.AIIdocuments,maps,and survey notes shallcontainthenameofthesubdivision,the name(s)of the subdivider(s),the name of the registered landsurveyorresponsibletothesubdivider(s).The trimmedsize of the final plat shall beeighteeninches(18")by twenty-fourinches (24")with a one and a halfinch (1½")marginonthetoporleftmarginandaonehalfinch(1/2")border on the remainingthree(3)margins.The final plat shall be recorded on two(2)or moresheets ifthescale necessarytoaccommodatethemaponone(1)sheet wouldunduly congest thedrawing.
6.Thefinal shortsubdivisionplat shallbe approved ordisapproved withinthetimelimitationsestablishedbyRCW58.17.140 from the date of filing of the final plat with the PlatAdministrator.This timeperiod shall be binding unless the applicant consents to anextensionoftimeinwriting.
7.No finalshort subdivisionplatmay be approvedunless thecitymakes a writtenfindingoffactthattheproposedsubdivisionisinconformancewithanyapplicablezoningordi-nances,or other landuse controlswhich may exist
8.Nofinalshort subdivisionplat shallbe approvedfor any subdivisionwhichlies in wholeorinpartinanirrigationdistrictorganizedpursuanttoChapterRCWB7.03 unlessthere hasbeenprovidedanirrigationwaterright-of.waypursuant to RCW58.17.310as nowenactedorhereafteramended.
B.Specific Reguirements:
1.The final plat shallclearly showthefollowing information:
a.The lines and names of all streets or other public ways,parks,playgrounds andeasementsintendedtobededicatedforpublicuse,orgranted for use of inhabitantsofthesubdivision.
b.The lines and names of allexisting or platted streets or other public ways,parks,playgrounds and easements adjacent to the finalplat,subdivision,or dedication,includingmunicipalboundaries,townshiplines,and section lines,
c.The lengths and bearings of allstraightlines,curve radii,arcs,and semi-tangents ofallcurves.
d.AIIdimensions along the lines of each lot,withthe true bearings and also any otherdatanecessaryforthelocationofanylotlinesinthefield,
e.Suitableprimary controlpoints,approved bytheCity Engineeror descriptions and tiesOtosuchcontrolpoints,towhichalldimensions,angles,bearings,andsimilar data givenontheplatshallbereferred.
f.The location ofallpermanent monuments.
g.The names ofallsubdivisionsimmediately adjacentthereto.
h.The date,true north point,scale,datum plane,and date ofsurvey.
i.The boundary ofthetract,thecourses and distances markedthereon,as determined
by a field survey made by a registered andqualifiedland surveyorof the state and to
close with an allowableerrornottoexceed one foot (1')infivethousandfeet (5,000')and not toexceed one foot (1')in tenthousandfeet (10,000')inthe Central Business
District
j.The elevations of allpermanent monumentsbased on a datum plainapproved by the
City Engineer.
k.Avicinitysketch map of not morethanfour hundred feet (400')totheinch.Except thattheCityEngineer,subjecttoa request priortoplat submittal,mayapprovean alterna-
tivevicinity map scale exceedingfourhundredfeet (400')totheinch,
l.Street names.
m.Certificationby registered land surveyor ofaccuracy of platand survey.
n.Statement byowner dedicating streets,right-of-ways,and any sites for publicuse.
o.Location and dimensions ofall irrigation water right-of-ways.
p.Provide legal description of the plat boundaries.
2.AIIlinear dimensions shall be given infeet and decimals ofa foot tothenearest hundredth.
3.The scale of the final plat shall be not morethan one hundred feet (100')to the inch.
Exceptthatthe City Engineer,subject toa request priortoplat submittal,may approve analternativeplatmapscalenottoexceedonehundredfeet(100')totheinch.
4.Iftheplatconstitutes a replat,thelots,blocks,streets,etc.,oftheoriginal platshall be
shown by dotted lines in theirproper positionsin relation tothenew arrangementof the
plat,the new platbeing so clearly showninsolidlines as toavoidambiguity.
5.The final plat shall be accompanied by improvement plans and specifications including
utilities,streets,grades,and appurtenances as provided for in Section 17.13.100,
Improvements.
6.The subdivider's land surveyorshall set all required monuments and shallstake all lot
corners as shownon the final plat before the plat is submittedfor final approval.
7.The final plat shall contain the legal description of the subdivisionand the following
dedication,acknowledgment,and endorsement statements shallappear in thefollowing
sequence inblackpermanent inkeither by hand or mechanicaldevice:

The ownerof theland described herein infee simpleis .The owner declares thisplat
and dedicates tothepublic forever,allstreets,roads,alleys,easements orwhatever publicproperty there is
shownthereonfor any and allpublic purposes not inconsistent withtheuses shown on thisplat.

8.Submit all lot,block,and boundary closures to the City Engineer with the final platsubmittal.
17.13.120 Final Plat Review Procedure:
A.Upon receiptof thefinalsubdivision applicationand plat,thePlat Administrator shall,withintwo(2)workingdays ofreceipt,distribute copies toalloffices,departments,andagencies receivingthepreliminaryplat.Each office,department,or agency shall file written recommendationsOwiththePlatAdministratorwithinfifteen(15)calendar days fromthedate of filingof thefinalplatwiththePlatAdministrator.Ifanysuch office,department,or agency fails tofile a writtenrecommendationwithinthetimelimitation,it maybe presumed thatsuch office,department,or agency has no recommendation.
Alloffices,departments,and agencies issuing recommendations for final plat approval shallnotmodifythetermsofpreliminaryplatrecommendationswithoutthewrittenconsentofthesubdivider.
B.Within fifteen (15)daysoffilingof thefinal plat theCity Engineershallreview thefinal plat andsubmittothePlatAdministratorawrittenreportwithrespecttothefollowingconditions:
1.That the proposedfinal plat bears therequired certificatesand statements of approval.
2.That a titlereport furnished by the subdivider confirms the titleof the land and theproposedsubdivisionisvestedinthenameoftheownerwhosesignatureappearsontheplatcertificate.
3.Thatthefacilities and improvementsrequired tobe provided by thesubdividerhave beencompletedoralternativelythatthesubdividerhassubmittedwiththeproposedfinalplataperformancebondorothersecurityinconformancewithSection17.13.100 ofthischapter.
4.Thattheplat is technicallycorrect as certifiedbythe land surveyorresponsible for theplat.
C.Within fifteen (15)days of filing ofthe final plat,the Grant County Health Districtor otheragencyfurnishingsewagedisposalandsupplyingwatershallreviewthefinalplatandsubmittothePlatAdministratorawrittenreportrecommendingapprovalordisapprovalofthefinalplatastotheadequacyoftheproposedmeansofsewagedisposalandwatersupply.
O D.Withinfifteen (15)days of filingofthe finalplat theappropriateirrigationdistrict servingorfromwhichtherealpropertyisentitledtobeservedwithirrigationwatershallreviewthefinalplatandsubmittothePlatAdministratorawrittenreportrecommendingapprovalordisapprovalofthefinalplatastotheadequacyoftheproposedmeansofthedeliveryofirrigationdistrictentitlementwaterandastotheadequacyoftheproposedmeansofremovalofirrigationwastewater.
E.Final Plat Approval:
1.The Plat Administrator shall approveordisapprove thefinal platwithinthetimelimitationsestablishedbyRCW58.17.140,unless the subdivider consents to an extension of thattimeperiodinwriting.
2.\fthePlat Administrator finds thatthesubdivisionproposed forfinalplatapproval conforms
toalltermsofthepreliminary plat approval,therequirements ofRCW Chapter 58.17,other
applicablestate laws,and anyotherrequirements,thePlat Administrator shallapprove the
final plat.
3.The decision of the Plat Administrator shall be final,unless an appeal by any aggrieved
partyis madetothePlanning Commissionwithin ten(10)days ofthe date of decision of
the Plat Administrator.Said appeal shall be in writing to thePlanning Commission and
submittedthroughthe Community Development Department.TheCommunityDevelop-
mentDepartment shall date andrecord thereceipt ofsaidappeal.The Planning Commis-
sionshallact on thatappeal withinforty (40)calendar days unless an extension is agreed
toin writingby theapplicant.The decision ofthePlanning Commissionshall be final and
conclusive unless,withinten (10)days,anyaggrievedparty files with the Finance Director
a written appeal.The Council shallhear thatappealwithintwenty(20)days ofthedate of
appeal.
4.Acertificateofoccupancyshall notbe issued untilthefinalshort plathas been recorded
withtheGrant CountyAuditor.
17.13.140 FilingFinal Plat:
A.Upon receipt ofall required final plat fees theplat shall be signed by thefollowingofficials:

B.The Plat Administrator shall transmittheoriginalmylarplattotheCountyAuditor forfinal filing.
Onereproducible copyshallbe forwarded withtheoriginaltobeconfirmed and returned totheCityEngineerfortheCityEngineer'srecord.One paper copy shallbe filed with theCounty
Assessor.
Section 2.The City Councildeclares that an emergency exists and this ordinance shall take effect
immediately as provided by law upon one reading if2/3 ofthe entire CityCouncil present vote in favor of
passage.
