1989_00001ORDINANCE NO.1989 ANORDINANCEAMENDINGCHAPTER 17.17 OF THE MOSES LAKEMUNICIPALCODEENTITLED"MAJORSUBDIVISIONS" THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON DOORDAINASFOLLOWS: Section 1.Chapter 17.17 of the Moses Lake Municipal Code entitled "MajorSubdivisions"is amended asfollows: 17.17.030 Preliminary Plat Conditions and Reauirements: A.General Conditions and Requirements: 1.The subdivisionshall make adequate provision for roads,streets,curbs,gutters,side-walks,street lightingcircuits,alleys,theextensionofmunicipalutilities(sewerand water),irrigation water right-of-ways,drainage ways,other publicways,public access,or anymunicipalimprovementsasdeemednecessaryinconformancewithCommunityStreetand UtilityStandards and city Design Standards ineffectat thetimeof plat approval. 2.The subdivisionshall front on a existingstreet.There shall be adequate access to allparcels.Streets shallbe improved tocitystandards.Street lighting shall be provided. 3.The subdivisionshallcomplywithallzoningand health regulations. 4.The subdivisionshallbe consistentwiththecity's ComprehensivePlan. 5.The subdivisionshallprovidefor irrigationwaterright-of-wayspursuanttoRCW 58.17.310 as now enacted or hereafter amended. 6.A street lighting plan as maybe requiredby theCityEngineer must be provided.The planmustbeapprovedbytheGrantCountyPUDandincludecertificationthatallstreetlightingfeeshavebeenpaidorthatarrangementsacceptabletothecityandthePUDhavebeenmadeforthepaymentoftherequiredfees. 7.Environmental informationshall be prepared and submitted in accordance with theguidelinesestablishedundertheStateEnvironmentalPolicyActof1971,as amended.Said information is a part ofand must accompany the preliminaryplatapplication. 8.Unless an applicant for a preliminaryplat approval requests otherwise,and the PlatAdministratoragrees,a preliminary plat shall be processed simultaneously with theapplicationforrezones,variances,planned unit developments,site planapprovals,andsimilarquasi-judicial oradministrativeactions to theextentthatprocedural requirementsapplicabletotheseactionspermitsimultaneousprocessing. 9.Every decision or recommendation made under thischapter by the Council or PlanningCommissionshallbeinwritingandshallincludefindingsoffactandconclusionstosupportthedecisionorrecommendation. 10.Preliminary plats of any proposed subdivision and dedication shallbe approved,disap-proved,orreturned totheapplicant formodificationwlthinninety(90)days from the dateoffilingunlesstheapplicantconsentstoanextensionofsuchtimeperiod;Provided,thatifanEnvironmentalImpactStatementisrequiredasprovidedinRCW43.21C.030,theninety(90)day period shall not include the timespent preparing and circulatingtheEnvironmentalImpactStatementbythelocalgovernmentalagency. 11.A platcertificatefrom a titlecompanylicensed to do business in the State of Washingtondatedwithinthirty(30)days ofthedate offilingofthefinal plat and application withthe PlatAdministratorconfirmingthatthetitleofthelandsasdescribedandshownontheplatisinthenameoftheownerssigningthesubdivisionplatorinstrumentofdedication. B.Specific Conditionsand Reguirements: L Prior tosubmissionofa majorsubdivisionpreliminaryapplicationandpreliminary plat,thesubdividerorthesubdivider'srepresentative shallschedule a pre-application conferencewiththePlatAdministratorandrepresentativesofotheraffectedcitydepartments.TheOsubdividershallpresentaconceptualideaoftheplat.The Plat Administrator and represen-tativesof affectedcitydepartments willrespond informally and address potential items ofconcernorclarificationtoaidthesubdividerinpreparingthemajorsubdivisionpreliminaryapplicationandpreliminaryplat. 2.The preliminary majorsubdivisionapplication and plat shallbe filedwith the Plat Adminis-tratoron forms prescribed by theCommunity Development Department.Said applicationshallbeaccompaniedbytwelve(12)copies of the preliminaryplat. 3.The preliminary plat shall be a neat and accurate drawing,stamped and signed by aregisteredprofessionallandsurveyorlicensedbytheStateofWashingtononreproducible material at a decimal scale.The platmap shall measure eighteen inches (18")by twenty-four inches (24").The preliminaryplat shallbe drawn in black permanentink on two(2) or more sheets ifthe scale necessary toaccommodate themapon one (1)sheet wouldundulycongestthedrawing. 4.A non-refundablefee of five hundred dollars ($500)shall accompany each and everyapplicationforapreliminarymajorsubdivision. 5.The subdividershallsubmita list ofthe names and addresses of allownersof recordofpropertywithinthreehundredfeet(300')of the external boundaries of the proposed subdivision.Inaddition,the subdividershallsubmita listofthenames and addresses ofallownersofrecordofrealpropertywithinthreehundredfeet(300')ofrealpropertywhichliesadjacenttotheexternalboundariesoftheproposedsubdivisionandisownedbythesubdivider. 6.The preliminaryplatshallcontainthe following: a.Name of proposed subdivision, b.Boundaries ofproposed subdivisionestablished by thepreliminary survey. c.Location and dimensionof allexisting and proposed streets,alleys,utilities,and right- of-ways and/oreasements on and adjacent to theproposed subdivision. d.Location and dimensions of allexisting and proposedirrigationwater right-of-waysonandadjacenttotheproposedsubdivision. e.Legal description ofland within the proposed subdivision. f.Any proposed land dedications. g.Name,address,and seal oftheregistered land surveyorwho made the preliminary survey. h.The date of the preliminary survey. i.Horizontal scale oftheproposed plat shall be no more thanone hundred feet (100')totheinch.Except thattheCityEngineer,subjectto a request priortoplatsubmittal,may approve an alternative plat map scale not to exceed one hundred feet (100')to the inch. j.Monuments found and established during the preliminary survey. k.Date map is prepared,scale,and northpointofthe map.Approximate proposed lot lines withtheirdimensions,including lot numbers and block numbers. l.Ifany oftheparcels can be furtherdividedor ifonly a portion ofa tractis being divided, location offuture streets,alleys,and lot lines shall be shown by dotted lines. m.Avicinitymapata scale ofnot morethan four hundred feet (400')totheinch.Except thatthe City Engineer,subject to a request prior to plat submittal,may approve analternativevicinitymapscaleexceedingfourhundredfeet(400')to the inch.The vicinitymap shall show alladjacent parcels.Itshall show how thestreets and alleys in theproposed subdivision may connect withexisting and proposed streets and alleys in neighboringsubdivisions or unplatted property to produce an advantageous development of the entire neighborhood. n.Provide recommended street names for approvat o.United States Bureau of Reclamation horizontal and vertical data including bench marks. p.A site plan on a separate sheet showing the following information: 1)Location and sizing ofexisting and proposed utilitiesincludingwater,sewer,storm drains,electricity,street lighting,and gas,telephone,cablevisionlines,and curb and sidewalk.Minimum size and scale shall be the same as the preliminary plat map. 2)Existing and proposedstructures and natural features and all proposed improve- ments withinand adjoiningtheproposed subdivision. 3)Topography ofthearea witha maximum oftwofoot (2')intervals of contours asrequiredbytheCityEngineer. 4)Present zoning classification on and adjacent to property. 5)Any proposed dedications for park land subject to the approval of the PlanningCommission. 6)Name(s)ofowner(s)oftheproposed subdivision. q.Any deed restrictions orcovenantsexistingorproposed shallbe drawnonthesite planandpreliminaryplatmap. 17.17.040 Referral to Other Departments,Agencies,and Offices:O A.Upon receiptofa complete and satisfactorypreliminary plat application,thePlat Administratorshalldistributecopiesofthepreliminaryplattoeachofthefollowingoffices,departments,oragencieswithintwo(2)working days from receipt: 1.Public UtilityDistrict 2.Gas Company 3.Telephone Company 4.Engineering Division oftheMunicipalServices Department (threecopies) 5.Fire Department 6.Building Division oftheCommunity Development Department 7.Grant County Health District 8.Any irrigation district withjurisdiction 9.Grant County Assessor 10.CommunicationsCompany B.The Plat Administrator shall further notifythe Police Department,Park and RecreationDepartment,and City Manager thata preliminaryplat has been received. C.Notice of the filing of a preliminary plat of a proposed subdivisionlocated in thecity andadjoiningthemunicipalboundariesthereofshallbegiventotheGrantCountyPlanningDepartment. D.Notice ofthefilingofa preliminary platofa proposedsubdivisionlocated adjacent tothe right-of-wayof a state highway shall be giventothe State Department of Highways. E.Each office,department,or agency shallfilewrittenrecommendationswiththe Plat Admini-strator within fifteen (15)calendar days from the date of filingof the preliminaryplat andapplicationwiththePlatAdministrator.Ifany such office,department,oragency fails tofile a writtenrecommendationwithinthe timelimitation,it may be presumed that such office,department,or agency has no recommendation. F.Ifthe preliminaryplat is found to be unacceptable,a certified letter shall be mailedtothesubdividerwithinthetimelimitationsestablishedbyRCW58.17.140. G.The Plat Administrator may determine thata meeting shall be held to resolve majorissuesidentifiedasaresultoftherecommendationsofotheroffices,departments,oragencies.Suchmeetingshallbeattendedbythoseoffices,departments,or agencies responsible for therecommendationsandmustincludetheapplicantandthePlatAdministrator.Theproceedingsandresultsofthemeetingshallbedocumentedbyminutes. 17.17.080 Planning CommissionAction: A.The Plat Administrator shall transmitthe application,the plat,respective comments andrecommendationsfromotherofficesandagencies,comments and recommendations from citydepartments,and Community Development Department commentsand recommendations tothePlanningCommissionpriortothehearing. B.The Planning Commissionshall reviewthe preliminaryplat,municipalrecommendations,testimony,and exhibitssubmitted at the hearingand make recommendationsthereonto theCounciltoassureconformanceoftheproposedsubdivisionwiththeComprehensivePlan,Zoning Ordinance,Community Street and UtilityStandards,and cityDesignStandards.ThePlanningCommissionshallrecommendtheCouncilapprove,conditionallyapprove,ordisapprovethepreliminaryplat. 17.17.130 Final Major Subdivision Plat Application: A.General Requirements: 1.The final major subdivision application and plat willbe filed with the Plat Administrator onformsprovidedbytheCommunityDevelopmentDepartment 2.Allrequiredstreet and utilityimprovements must beconstructedby theapplicantand mustbeacceptedbythecityorasubdivisionbondorotherapprovedsecurityshallbesubmitted inan amountsufficienttocoveronehundred and fiftypercent (150%)oftheestimatedcostofcompletingallrequiredutilityextensionsandstreetimprovementsasdeterminedbytheMunicipalServicesDepartment.Upon completionoftherequiredimprovements and prior toacceptance by the Council,the subdivider/developer must submit a maintenance bond or alternative security approved by the CityAttorney inan amount determined bytheCity Engineer and approved by the Municipal Services Director.The maintenance bond amount shall be one hundred percent (100%)of the actual cost of construction.An altemative security shallbe in an amountnot less than ten percent (10%)nor more than one hundred percent (100%)of the actual cost of construction.The amount shall be determined on a case by case basis based upon the City Engineer's estimated cost of repair ormaintenanceshouldrepair or maintenance be required.The subdividerldevelo- per shall submit documentation of thecost of constructionto the City Engineer for his review and approval and use in determining the required bond or altemative security amount Said bond shall be ineffect forone (1)year from thedate of acceptance. 3.Required dedication ofall streets,right-of-ways,parks,playgrounds,easements,reserva-tions,irrigation water right-of-ways,and any area tobe dedicated topublic use,together withany restrictions or limitations thereon shall be submittedas a part of thefinalplat. 4.The applicationshall be accompaniedby thefollowing: a.A plat certificatefroma titlecompanylicensed todo business intheState ofWashing- ton dated withinthirty(30)days ofthedate offilingofthefinal plat and application with thePlatAdministratorconfirmingthatthetitleof thelands as described and shownontheplatisinthenameoftheownerssigningthesubdivisionplatorinstrumentof dedication. b.Acertificate fromtheGrant County Treasurer indicating thatalltaxesandassessments on the propertyincluded in thefinal plat,subdivision,or dedicationhave been paid according totheprovisionsof RCW 58.08.030 and RCW 58.10.040 as now enacted or hereafter amended. c.A certificatefrom the city Finance Director indicating that there are no delinquent special assessments or liens on the property included inthe final plat,subdivision,ordedication. d.A check payabletothecityinthe amount of fourhundred dollars ($400)to cover thecostofcheckingthefinalplat, e.AIIcovenants proposed torun withtheland. 5.The final majorplat (twelvesets of prints plus theoriginal tracingand a reproduciblemylar copy)shall include all items in Section 17.17.130 B and any additional information and modifications requested inthe preliminary approval.The final plat shall be prepared in aneatandlegiblemannerinblackpermanentdrawinginkonhighgradetracingclothordraftingfilm.AIIdocuments,maps,and survey notes shall contain the name of the subdivision,the name(s)ofthe subdivider(s),thename ofthe registered land surveyorresponsibletothesubdivider(s).Thetrimmedsize ofthefinalplatshallbe eighteen inches (18")bytwenty-fourinches (24")with a one and a half inch (1 1/2")marginon the toporleftmarginandaonehalfinch(1/2")borderon theremaining three (3)margins.The final platshall be recorded on two(2)or moresheets ifthescale necessary toaccommodate the map on one (1)sheet would unduly congest the drawing. 6.The finalmajorsubdivisionplatshall be approved ordisapproved withinthetimelimitations as established by RCW 58.17.140. 7.Nofinal rnajor subdivision plat may be approved unlessthecitymakes a writtenfinding of fact that the proposed subdivisionis in conformancewith any applicable zoning ordi- nances,or other land use controlswhichmayexist. 8.No final majorplat shall be approved for any subdivisionwhichlies in whole or inpart in an irrigation district organized pursuant to Chapter RCW 87.03 unless there has been provided an irrigationwater right-of-way pursuant toRCW58.17.310 as now enacted or hereafter amended. B.SoecificReguirements: 1.The final plat shall clearlyshow thefollowinginformation: a.The lines and names of all streets or other publicways,parks,playgrounds andeasementsintendedtobededicatedforpublicuse,or granted for use of inhabitantsofthesubdivision, b.The lines and names of all existing or platted streets or other public ways,parks,playgrounds and easements adjacent to the final plat,subdivision,or dedication,including municipal boundaries,townshiplines,and section lines. c.The lengths and bearings ofallstraightlines,curveradii,arcs,and semi-tangents ofallcurves. d.Alldimensions along the lines ofeach lot,withthetruebearings and also any otherdatanecessaryforthelocationofanylotlinesinthefield. e.Suitable primary control points,approvedby theCity Engineeror descriptions andtiestosuchcontrolpoints,towhichalldimensions,angles,bearings,and similar data givenontheplatshallbereferred. f.The location ofall permanent monuments. g.The names ofallsubdivisionsimmediately adjacent thereto. h.The date,truenorthpoint,scale,datum plane,and date of survey, i.The boundary of the tract,thecourses and distances marked thereon,as determinedbyafieldsurveymadebyaregisteredandqualifiedlandsurveyorofthestateandtoclosewithanallowableerrornottoexceedonefoot(1')in five thousand feet (5,000')and nottoexceed one foot (1')intenthousand feet (10,000')in theCentral BusinessDistrict. j.The elevationsofallpermanentmonumentsbased on a datum plain approvedby theCityEngineer. k.Avicinitysketchmapofnotmore thanfour hundred feet (400')totheinch.Except thatOtheCityEngineer,subjecttoa request prior toplat submittal,may approvean alterna-tivevicinitymap scale exceeding four hundred feet (400')totheinch. I.Street names. m.Certification by registered land surveyorofaccuracy of plat and survey. n.Statement by owner dedicating streets,right-of-ways,and any sites for public use. o.Location and dimensions of all irrigation water right-of-ways. p.Provide legal description of theplat boundaries. q.Provide block and lot locations including dimensions and numberdesignations. 2.AIIlinear dimensions shall be giveninfeet and decimals ofa foot tothenearest hundredth. 3.The scale ofthe final plat shall be notmore thanone hundred feet (100')to the inch.Except thattheCityEngineer,subject to a request prior toplat submittal,may approve analternativeplatmapscalenottoexceedonehundredfeet(100')to the inch. 4.Ifthe plat constitutesa replat,the lots,blocks,streets,etc.,of the originalplat shall beshownbydottedlinesintheirproperpositionsinrelationtothenewarrangementoftheplat,thenew plat being so clearlyshown insolid lines as to avoidambiguity. 5.The finalplat shall be accompanied by improvement plans and specificationsincludingutilities,streets,grades,and appurtenances as provided for in Section 17.17.120,Improvements, 6.The subdivider's land surveyor shall set all requiredmonuments and shall stake all lotcornersasshownonthefinalplatbeforetheplatissubmittedforfinalapproval. 7.The final plat shall contain the legal description of the subdivision and the followingdedication,acknowledgment,and endorsement statementsshall appear in thefollowingsequenceinblackpermanentinkeitherbyhandormechanicaldevice: Dedication The owneroftheland described herein infee simpleis and The owner declares thisplat and dedicates tothepublic forever,allstreets,roads,alleys,easements orwhateverpublicpropertythereisshownthereonforanyandallpublicpurposesnotinconsistentwiththeusesshownonthisplat. Section 2.The City Council declares that an emergency existsand this ordinance shall take effectimmediatelyasprovidedbylawupononereadingif2/3 ofthe entire City Council present vote in favor of passage.
