1992_00001ORDINANCE NO.1992 ANORDINANCE AMENDINGCHAPTER 18.67 OF THE MOSES LAKEMUNICIPALCODEENTITLED"PLANNEDDEVELOPMENT DISTRICT ZONE" THECITYCOUNCILOF THECITYOF MOSES LAKE,WASHINGTON DO ORDAINAS FOLLOWS: Section 1.Chapter 18.67 of the Moses Lake MunicipalCodeentitled"Planned Development DistrictZone"is amended as follows: 18.67.030 General Planned Development District Apolication Requirements: A.Pre-Application Conference: 1.Prior tosubmissionof a planneddevelopment district application and map(s),the propo-nent shall schedule a pre-applicationconference with the CommunityDevelopmentDirectorandrepresentativesofotheraffectedcitydepartments.The proponent shallpresentaconceptualplanoftheplanneddevelopmentdistrictincludingageneraloutlineoftheproposalrepresentedbysketchplans.The Community DevelopmentDirector willrespondinformallyandaddresspotentialitemsofconcerntoaidtheproponentinpreparingtheplanneddevelopmentdistrictapplicationandmap(s). 2.TheCommunityDevelopment Director shallfurnishtheproponent witha writtenreview oftheconferenceregardingtherelationshipoftheplanneddevelopmentdistricttotheComprehensivePlanandanyapplicablecityzoningordinances,design standards,andpolicies. B.Study Session:Prior tothe submissionof the planned development district application andmap(s)to the Planning Commissionfor action,the CommunityDevelopment Director shallscheduleaPlanningCommissionstudysession.The Community Development Director andtheplanneddevelopmentdistrictproponentshallpresenttheconceptualplanneddevelopmentdistricttothePlanningCommissionsothatthePlanningCommissionmaystudytheproposal. C.Planned Development District Acolication and Maps:The planned development districtapplicationandmap(s)shallbe filedwiththeCommunityDevelopment Department on formsprescribedbytheCommunityDevelopmentDepartmentTheapplicationshallbeaccompa-nied byeleven (11)copies oftheplanned development district application and map(s).A non-refundable feeof twohundred dollars($200)shallaccompanyeach and everyapplication for a preliminary planned developmentdistrictOD.Environmental Information:Environmental information shall be prepared and submitted inaccordancewiththeguidelinesestablishedundertheStateEnvironmentalPolicyActof1971, as amended and Chapter 14.04 ofthe Moses Lake Municipal Code entitled "EnvironmentalRegulations."Said information is a part ofand must accompany theplanneddevelopmentdistrictapplicationandmap(s). E.Variance(s):Requests forvariance(s)of cityDesignStandards and CommunityStreet andUtilityStandardsshallbesubmittedasapartofandmustaccompanytheplanneddevelop-ment district application and map(s).The Planning Commission shall recommendto theCouncilthattherequestedvariance(s)beeitherapproved,conditionallyapproved,ordenied.The Council shall either approve,conditionallyapprove,or deny the requested variance(s)based upon the recommendation ofthe Planning Commission and testimonypresented beforetheCouncil. Variance(s)of city Design Standards and Community Street and UtilityStandards shall belistedintheordinanceconditionallyapprovingandestablishingtheplanneddevelopmentdistrict. F.Comprehensive Plan:The planned development district shallbe consistent with the city'sComprehensivePlan. G.FindingsofFact:Everydecisionor recommendationmade under thischapterbythePlanningCommissionorCouncilshallbeinwritingandshallincludefindingsoffactandconclusionstosupportthedecisionorrecommendation. H.Subdivision Acoroval:Aplanned development district forwhichsubdivisionor binding siteplanOapprovalisrequiredmaybesubmittedasaPlannedDevelopmentDistrictShortPlat,aPlannedDevelopmentDistrictMajorPlat,or a Planned Development DistrictBindingSite Plan.Such a planned development districtshall be submittedand processed in conformancewiththeappropriatesubdivisionchapteroftheMosesLakeMunicipalCodeandtherequirementsofthischapter.Redundant procedures or technicalrequirementsshall be incorporated into therequirementsandproceduresoftheappropriatesubdivisionchaptersoastonotcreateunnecessaryhardshipordelay.Procedurally thepreliminaryand final planned developmentdistrictelementofaPlannedDevelopmentDistrictShortPlat,Major Plat,or Binding SitePlanmustbeapprovedbytheCouncilpriortotherequiredsubdivisionapprovals.Such approvalsmaybegivenconcurrentlybytheappropriateapprovingbody. l.Tges:Planned development districts shall be appropriately entitled,i.e.Planned UnitDevelopmentDistrict,Planned Unit Residential Development District,Planned Commercial Development District,or Planned Industrial Development District. 18.67.060 Referral to Other CityDepartments: A.Upon receipt of a complete and satisfactory preliminaryplanned development districtapplicationandmap(s),theCommunityDevelopmentDirectorshalldistribute copies of thepreliminaryplanneddevelopmentdistricttoeachofthefollowingoffices,departments,oragencieswithintwoworkingdaysofreceipt: 1.Public WorksDivision of theMunicipal Services Department 2.Fire Department 3.Police Department 4.Building Divisionofthe Community Development Department 5.Park and RecreationDepartment 6.PUD 7.Gas Company 8.Telephone Company 9.Cable Company B.Each department,office,or agency may file written recommendations with the Community DevelopmentDirectorwithinfifteen (15)days from thedate of filingof theplanneddevelop- ment district withtheCommunityDevelopment Department. C.The CommunityDevelopmentDirector maydetermine thata meetingshallbe heldtoresolve major issues identified as a result oftherecommendations.The proceedings and results of such a meetingshallbe documented byminutes. 18.67.070 Planning Commission Public Hearing:When theCommunity Development Director determines thatthecompleted planned development district application and map(s)is acceptabletheDirector shall set a date for a publichearing on the planned development district before the Planning Commission not less thantwenty(20)days nor morethanforty-five (45)days afterthe receipt of thecompleted planned developmentdistrict application. 18.67.080 Notice of Public Hearing:The CommunityDevelopment Director shall give noticeofthe time, location,and purpose of the public hearing in thefollowingmanner: A.At least one publicnoticeshallbe publishednotless thanten(10)days prior tothe hearing in a newspaper ofgeneralcirculationwithinthe cityand thearea wherethereal propertythatis proposed fortheplanned development district is located. B.Three (3)noticesshall be posted onor adjacent totheland proposedfora planned develop- ment district at least ten(10)days prior tothepublic hearing date. C.One (1)notice shallbe mailed toeach owner of propertywithin three hundred feet (300')ofthe property proposed for a planned development district at least ten(10)days priorto the public hearing, D.Ifthe owner of thereal propertywhich is proposed for a planned development districtownsanothertractoflandwhichliesadjacenttotherealpropertyproposedforaplanneddevelop- ment district,one (1)notice shall be mailed toeach owner of real property located withinthreehundredfeet(300')ofany portion of the boundaries of such adjacent located parcels of real property. 18.67.090 Planninq Commission Action: A.The Community Development Director shall transmitthe planned development district applicationand map(s),respective comments and recommendations from other offices, agencies,and city departments,and Community Development Department comments and recommendations tothePlanning Commission priortothe hearing. B.The Planning Commission shall review the planned development district application and map(s),municipalrecommendations,testimony,and exhibitssubmittedat the hearing and make recommendations to the Council to assure conformance of the proposed planned development district with the provisionsofthischapterand a determination that: 1.The planneddevelopmentdistrictshall becompatiblewith nearbydevelopments and uses. 2.Peripheral treatmentinsures propertransitionbetweenplanneddevelopment district usesandnearbyexternalusesanddevelopments. 3.Thedevelopment willbe consistent withtheComprehensivePlan and with thepurpose of a planned developmentdistrict. 4.The planneddevelopment district can be completedwithina reasonable periodoftime. C.The Planning Commissionshall recommend thattheCouncilapprove,conditionallyapprove,or disapprove an ordinanceproviding forthe establishment of a planned development district. 18.67.100 Preparation ofthe Planned Development District Ordinance: A.Upon Planning Commissionreviewofa planned development district application and map(s),theCommunityDevelopment Director shallprepare an ordinanceproviding forthe designationofthesubjectpropertyasaplanneddevelopmentdistrict.That ordinanceshallestablishtheplanneddevelopmentdistrictasafloatingdistricttobesuperimposedovertheexistingzoneandprovideforspecificmodificationsofthebulkanduseregulationsandperformance standards as provided for intheordinance.The ordinance shallspecifythespecific modifica-tionsto the underlyingzone's bulk regulations and performancestandards.The ordinanceshallprovidethattheapplicantortheapplicant'ssuccessor in interest shall be bound to the uses and modificationsspecifiedintheordinance. B.The ordinance providingforthedesignation ofthesubjectproperty as a planned developmentdistrictshallconditionallyapprovethepreliminaryplanneddevelopmentdistrict.The ordinanceshallonlyconferdevelopmentrightsupontheapplicantortheapplicant's successor in interest upon the submission and approval of a final planned development district applicationandmap(s)which shall be insubstantial conformity withthe preliminaryplanned developmentdistrictapplicationandmap(s).Approval fortheapplicanttoproceed withconstructionshallbecontingentuponreceiptandapprovalbytheCityCouncilofafinalplanneddevelopmentdistrictapplicationandmap(s). 18.67.120 FinalPlanned Development DistrictApplication and Map(s):Upon preliminary planneddevelop-mentdistrict approval,the applicantshallprepare a final planned developmentdistrict applicationandmap(s)as needed. The finalapplicationand map(s)shall be prepared in substantial compliance withtheapprovedpreliminaryplanneddevelopmentdistrictapplicationandmap(s);contain or depict allinformationOrequiredinthepreliminaryapplicationandmap(s);and shallincorporate anychanges required bytheCouncilingrantingpreliminaryplanneddevelopmentdistrictapproval. Preliminary map(s),ifsuitable,may be submitted as final map(s)withthefinal applicationiftheyaretobeunalteredorareabletobealteredtosatisfythefinalplanneddevelopmentdistrictmap(s)requirements. In addition,thefinal planned development district applicationand map(s)shall containand/ordepictthefollowinginformation: A.A titlereport from a titlecompany licensed todo business in the State of Washington datedwithinthirty(30)days ofthedate offilingofthefinalplanneddevelopment districtapplicationandmap(s)confirmingthatthe titleofthelands described and shownon theapplication and/ormap(s)is inthename of theownerssigningtheplanned development district applicationandmap(s)and/or instrument ofdedication. The holder of the owner's power.of-attorneymay sign the planned development districtapplicationandmap(s)and/or instrument of dedication provided thatthe titlecompanyconfirmsthatthepersonsigningthedocumentsisinfacttheholderoftheowner's power-of-attorneyand thattitletotheland is in the name ofthe person granting power-of-attorney. B.Three (3)completesets of preliminary constructionplans and specifications prepared by aprofessionalengineerlicensedbytheStateofWashingtonshowingallstreetandutilityim-provements requiredby the Councilin granting planned development districtapproval.Allconstructionplansandspecificationsshallbeinconformancewithcitydesignstandardsandthecommunitystreetandutilitystandards.Construction plans and specifications must beapprovedbytheCityEngineerpriortothesubmissionofthefinalplannedDevelopmentDistricttotheCouncilforapproval.O 1.Preliminary constructionplans and specificationsshallbe submitted in compliancewithChapter17.17.120 (AandB)oftheMoses LakeMunicipalCode entitledMajorSubdivision,subsection improvements. C.Required dedication ofall streets,rights-of-way,parks,playgrounds,easements,reservation,irrigation water rights-of-way,and any area to be dedicated topublic use,togetherwith anyrestrictionsorlimitationsthereonshallbesubmittedforCouncilapprovalandacceptanceasapartofthefinalplanneddevelopmentdistrictplanmap(s)or as a separate instrument ofdedication. D.A11covenants proposed to runwiththeland. E.A non-refundablefee oftwohundred andtwenty-fivedollars ($225)shallaccompanyeach and every application fora finalplanneddevelopment district approval. 18.67.130 Planning Commission Action:Withinforty-five(45)days offilingofthecompleteand satisfactoryfinalplanneddevelopmentdistrictapplicationandmap(s)withthe Community Development Department,the CommunityDevelopment Director shall set a date for Planning Commission review ofthefinal planneddevelopmentdistrictapplication and map(s).The Planning Commission shallreviewthefinal planneddevelopment district application and map(s)as to compliance with all termsof the preliminary approval and shall recommend to the Council that said planned development district be approved or disapproved. 18.67.180 Extension of Bond or Security Time Limit: A.The council may grant one (1)extension of any performance bond or approved security required bythischapter not toexceed one (1)year provided thattherequest for an extension is filed withtheCommunity Development Director at least sixty(60)days priorto theexpirationdateofthebondorsecurity. B.In the event that a timeextension is granted,a new performance bond or other approved securityshall be submittedin an amount sufficientto coverone hundred and fifty percent (150%)ofthecostofcompletingutilityand street improvements or landscaping improvements. The bond willbe updated with new estimates ofcost on alluncompleted improvements andallincreasedcostsshallbepassedontothebond. C.Departments issuing recommendations fornew performancebonds orapprovedsecurityshall not modify the terms and requirements of the bond or security other than to pass on all increased cost estimates as determinedby the Municipal Services Director to the bond orsecuritytocoverthecostofcompletingutilityandstreetimprovementsand/or landscaping improvements without thewrittenconsent oftheapplicant 18.67.210 Changes and Modifications: A.Major changes intheapprovedfinalplanned development district shall be considered as a newapplicationforpreliminaryplanneddevelopmentdistrictapproval.Majorchanges include,but are not limited to,the following: 1.Change in use. 2.Major change invehicular circulation system. 3.Increase indensity or relocation ofdensity pattem. 4.Change in exteriorboundaries except survey adjustments. 5.Increase in building height. B.The Community Development Directormayapprove changes inthefinalplanned development district which are minorand of a technicalnature and which are consistent withtheapproved plan. 18.67.220 Repeal ofPlanned Develooment District Ordinance: A.The Community Development Director shall prepare and submit totheCouncilan ordinance providingfor therepeal oftheordinanceestablishingthe planneddevelopmentdistrict upontheoccurrenceofthefollowing: 1.Afinalplanned development district applicationand map(s)has notbeen submitted within three(3)years ofadoptionoftheordinanceconditionally approving and establishingthe planned development district unless an applicationfor an extension has been approved by the Council. 2.Construction has notcommenced within two(2)years offinalplanned development district approvalor in compliancewiththe finalapprovedplanned development district construc- tionschedule unless an application for an extension has been approvedby the Council. B.Application for Time Extension: 1.Sixty (60)days prior tothefirstreading of an ordinance torepealtheordinanceestablish- ing the planned development district,the responsible party of record representing theplanneddevelopmentdistrictshallbenotifiedbycertifiedletterviaU.S.mallof the pending actionand shallbe afforded theopportunityto submitan application or an extension ofthe planned development district ordinance. 2.The Council may grant one (1)extension not to exceed one (1)year of the ordinance establishing theplanned development district. 3.Application for an extensionshall be made tothePlanningCommissionat least thirty(30)calendardays priorto thescheduled date ofa first reading ofthe repeal ordinance.A non-refundable applicationfee ofone hundreddollars ($100)shallaccompanyeach andeveryapplicationforanextension. 4.The applicationshall include a statement of mitigating and/or hardship circumstancesnecessitatingtherequestforanextension. 5.The Planning Commissionshall review the applicationforan extension andrecommendtotheCouncilthattheapplicationbeapprovedorrejected. 6.There shallbea firstreadingoftherepeal ordinance.Atthe first reading oftheordinancetheCouncilmaygranttherequestedextensionbasedupontherecommendationofthePlanningCommissionandtestimonygivenatthefirstreading. 7.Iftheextensionis approved,the repealing ordinancewillbe redocketed fora first readingattheterminationoftheone(1)year extensionperiod.Inthe event thata final planneddevelopmentdistrictapplicationandmap(s)has not been submitted withintheone (1)yearextensionperiodorintheeventthatconstructionhasnotcommencedwithintheone(1)year extension,thereshall be a first and second reading and adoptionofthe ordinancerepealingtheplanneddevelopmentdistrict Section 2.The City Councildeclares that an emergency exists and this ordinance shall take effectimmediatelyasprovidedbylawupononereadingif2/3 ofthe entire City Council present vote in favor ofpassage.
