ANORDINANCEAMENDINGCHAPTER 18.55 OF THE MOSES LAKEMUNICIPALCODEENTITLED"HOME OCCUPATIONS"
THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTONDO ORDAIN AS FOLLOWS:
Section 1.Chapter 18.55 ofthe Moses Lake Municipal Code entitled"Home Occupations"is amended asfollows:
18.55.040 General Reguirements:The general requirementsfor a home occupation are as follows:
A.There shall be no structuralalterationto accommodate the occupation.Entrance to thespacedevotedtotheoccupationshallbefromwithintheresidence,exceptwhenotherwiserequiredbylaw.
B.The use,including allstorage space,shall notoccupymore thantwohundred (200)squarefeetoftheresidence's floor area which is finished for living purposes including an attachedgarage.No home occupation shalloccupyan accessory building or a detached garage.
C.No home occupation shallhave anyoutsidestorage ofgoods and materials associated withthehomeoccupation.
D.Onlymembersofthefamilywho reside on thepremises and inany case no more than three(3)persons in any dwelling unit shall be engaged in theoccupation(s).
E.There shallbe no window display nor shall sample commoditiesbe displayed outside thebuilding.
F.Home OccupationSigns:
1.Signs identifying home occupations whichare unlighted,placed flatagainstthe structure,and which do not exceed two(2)square feet insize are permitted in the R-2Zone,SingleFamilyandTwoFamilyResidential,and the R-3Zone,Multi-familyResidential.
2.Signs identifying home occupationslocated in the R-1 Zone,Single Family Residential,are prohibitedexcept as required by law.Such signs,ifallowed,shall notexceed two(2)square feet in size except as maybe allowedby thischapter.
3.Signs identifying homeoccupations maybe permittedtoexceed two(2)square feet inOsizesubjecttothereviewandapprovalofthePlanningCommissionandafterithasbeenshownthatthesignwillnotadverselyaffectadjacentresidentialusesandthattheextrasizeisessentialtothesignbeingseen.
G.No materialor mechanicalequipment shall be used which willbe detrimental to theresiden-tialuse ofthe residence or adjoiningresidences because of vibration,noise,dust,smoke,odor,interference with radio or televisionreception,or otherfactor.
H.Materials or commoditiesdelivered toor from the residence which are of such bulk orquantityastorequiredeliverybyacommercialvehicleoratrailer,or theparking of cus-tomer's automobiles in a manner or frequency causing disturbance or inconvenience tonearbyresidencesorsoastonecessitateapublicparkinglotshallbeprima-facieevidencethattheoccupationisaprimarybusiness,and not a home occupation.
1.Examples of uses or occupationswhichmightnormallysatisfythe criteriaofthissectionare:barbers,"bedand breakfast"facilities,custom florists,beauticians,professional serviceproviders,dressmakers,photographers,homecanners,watchrepairers,licensed massagetherapists,and other similaruses.
J.The followingshallnotbe deemed permissibleuses or home occupations:nursing homes,massage parlors,woodworking and cabinet shops,household appliance,furniture andelectronicequipmentrepairshops,fumigationservicesshops,upholstering shops,car repairshops,smallengine repair shops,taxibusinesses,and other uses deemed as "similar"bytheCommunityDevelopmentDirectororothersimilarpositionoradesignee.
K.A home occupation issued toone person shallnotbe transferableto any other person norshallahomeoccupationpermitbevalidatanyaddressotherthantheoneappearingonthepermit
O L.Any person engaging ina home occupationshall register as a business underChapter 3.16ofthiscode.
Section 2.This ordinance shall takeeffectand be in force five (5)days after its passage and publicationofitssummaryasprovidedbylaw.
