ANORDINANCE CREATINGCHAPTER 10.40 OF THEMOSESLAKEMUNICIPALCODEENTITLED"VEHICLE IMPOUNDS AFTER CERTAIN ARRESTS ANDCITATIONS"
THE CITYCOUNCIL OF THE CITYOF MOSESLAKE,WASHINGTON DO ORDAINAS FOLLOWS:
Section 1.Chapter 10.40 of the Moses Lake Municipal Code entitled "Vehicle Impounds After CertainArrestsandCitations"is created as follows:
10.40.010 Authoritv -Period ofImpoundment:
A.This chapter is created pursuant toRCW46.55.120 and .240 as now enacted or hereafteramended.
B.Whenever thedriver of a vehicleis arrested or cited for a violationof RCW46.20.005,46.20.015,46.20.342,46.20.420,46.61.502,or46.61.504,thevehicleissubjecttoimpound-mentat thedirectionofa police officer.
C.Whenever the driver of a vehicle is arrested or cited for a violationof RCW46.20.005,46.20.015,46.20.342,46.20.420,46.61.502,or46.61.504,thenthevehicle may be releasedassoonasalltherequirementsofSection10.40.020(A)are satisfied.
D.The vehicle impounded shall onlybe released as provided in Section 10.40.020 (B)if thevehicleisimpoundedbecausethedriverisarrestedorcitedforaviolationof;
1.RCW46.20.342(1)(c)andtheWashington DepartmentofLicensing's records showthatthedriverhasbeenconvictedone(1)timeofa violationof RCW 46.20.342 or similarlocalordinancewithinthepastfive(5)years,or
2.RCW46.20.342(1)(c)and theWashingtonDepartment of Licensing'srecords showthatthedriverhasbeenconvictedtwo(2)or moretimes of a violation of RCW46.20.342orsimilarlocalordinancewithinthepastfive(5)years,or
3.Aviolationof RCW46.20.342(1)(a)or (b)andthe Washington Department ofLicensing'srecordsshowthatthedriverhasnotbeenconvictedofaviolationofRCW46.20.342(1)(a)or (b)or similarlocal ordinancewithinthepast five (5)years,or
4.Aviolationof RCW46.20.342(1)(a)or (b)andtheWashington Department of Licensing'sOrecordsshowthatthedriverhasbeenconvictedofaviolationofRCW46.20.342(1)(a)or(b)or similarlocalordinancetwo(2)or moretimeswithinthepast five(5)years.
10.40.020 Redemption of Imoounded Vehicles:Vehiclesimpounded by thecity shall be redeemed onlyunderthefollowingcircumstances:
A.Only the registered owner,a person authorized by the registered owner,or one who haspurchasedthevehiclefromtheregisteredowner,who produces proof of ownership orauthorizationandsignsareceipttherefor,may redeem an impounded vehicle.A personredeemingavehicleimpoundedpursuanttoSection10.40.010 must,priorto redemption,establish that he or she has a valid driver's license and is in compliance with RCW48.30.020.A vehicle impounded pursuant to subsection D of Section 10.40.010 can bereleasedonlypursuanttoawrittenorderfromthecourt
B.Any person so redeeminga vehicleimpounded bythecityshall pay thetowingcontractorforcostsofimpoundmentremoval,towingand storage priortoredeemingsuch vehicle,exceptasprovidedforbysubsectionCofthissection.Such towingcontractorshallaccept paymentasprovidedinRCW46.55.120(1)(b)as nowenactedor hereafter amended.IfthevehiclewasimpoundedpursuanttoSection10.40.010 and was being operated by theregisteredownerwhenitwasimpounded,it maynot be released toany person untilallpenalties,finesorforfeituresowedbytheregisteredownerhavebeensatisfied.
C.Any personseeking toredeem a vehicle impounded as a resultof a parking ortrafficcitationhasarighttoahearingtocontestthevalidityofanimpoundmentortheamountofremoval,towing,and storage charges as provided in RCW 46.55.120.
10.40.030 Post-Impound Hearing Procedure:Hearings required pursuant to RCW46.55.120 shallbe heldinDistrictCourtpursuanttostatelaw.
Section 2.Thisordinanceshall takeeffectand be in force five (5)days after its passage and publicationofitssummaryasprovidedbylaw.
