1508_00001ORDINANCENO.1508 AN ORDINANCEAMENDINGCHAPTER 13.12 OF THE MOSESLAKEMUNICIPALCODEENTITLED"WATERAND SEWER RATES" THE CITYCOUNCILOF THE CITYOF MOSESLAKE.WASHINGTONDO ORDAINASFOLLOWS: Section 1.Chapter 13.12 oftheMoses Lake Municipal Code entitled"Waterand Sewer Rates"is amendedasfollows: 13.12.040 CommercialSewer Rates: A.The following shall be the monthlyrate charged customers residing within the corporatelimitsofthecityandoutsidethecorporatelimitsofthecityforallchargeablewaterdischargedintothecitysewersystembycommercialusersanddwellingswiththreeormoreIMngunîtsservedbyonemeter: Amount Used (incubic feet)Sewer Rate 0-1,000 $17.60per month minimumOver1,000 $.56 per 100 cu ft.or portionthereof B.For purposes of calculating sewer charges,chargeable water shall be defined as follows:Chargeablewatershallbe measured bythe water consumedon thepremises,whatever thesourceofsuchwater,and the same willbe metered either by a publicutilitymeter or oneinstalledandmaintainedbytheownerofthepremisesathisownexpenseandapprovedandinspectedbythecity.As an option,ifrequested bythe ownerofthe premises,the citywillinstallawatermeterwiththecostforthemeterandinstallationbeingpaldbytheownerofthepremisesinaccordancewiththechargesassessedInMLMC13.08.020 for wa-ter/sewer connections.Undersuch circumstancesthe water meter becomes thepropertyoftheownerofthepremisesandallcostsofreplacementandrepairaretheresponsibilityoftheownerofthepremises.Inallcircumstanceswherethewater is metered bya privatelyownedwatermeterandIsusedtodeterminesewercharges,the city shall be allowedaccesstothemeterinordertoreadsuchmeter.Where the use of water is such thataportionofallthewateruseddoesnotflowintothesewersystem,forwhateverreason,butislostbyevaporation,irrigation,sprinklingor is used in manufacturingor ina manufacturedproduct,oris lostforwhateverreason,and the person incontrol providesproofof thisfactandinstallsameterorothermeasuringdeviceapprovedbythecitytomeasuretheamountofwatersousedandsolost,or ifthe cityis capable of determiningthe amountofsewageenteringthecity's sewer system by some other mechanical means,this water may bedeductedfromtheactualwaterconsumptionusedincalculatingthesewercharge. The sewercharges fortriplexes and apartments,mobilehome parks,schools,hospitalsandothercommercialestablishmentswithincreasedusageforirrigation,onlyiftheirlandscapingexceedsfivethousandsquarefeet,shallbe computed on the average consumptionduringthepreviousnon-irrigationseason,unlessthe user elects to install,at his expense,anapprovedmeasuringdevicetomeasurewaternotenteringthesewersystem.When a userhasaswimmingpoolorcoolingunitsdischargingtothesanitarysewer,he must install anapprovedmetertodeterminetheamountofwaterexemptfromsewerchargesduringtheirrigationseason.The irrigation season shallbe defined as the perlodinwhich statementsaremailedfortheAprilthroughNovemberbillingcycles. C.Sewer rates for commercial uses discharged into the sewer system may be separatelydeterminedbytheCityCouncil,based upon both volume and chemicalcharacteristicsofthesewage.The CityCouncilreserves the privilegeto requirepre-treatmentof any materialdischargedintotheseweragesystem,or to prohibitdischarge into the systemof Industrialwastesthat,because of either volume or concentration,will overload existing seweragefacilities. O D.AIIair-conditioning and refrigerationunitsthat are installed,replaced or that have capacityincreasedaftertheeffectivedateoftheordinancecodifiedinthischaptershallberequiredtoinstallrecirculatingunits.Disposal may not be accomplished by discharging into thesanitarysewersystem. Section 2.This ordinance shall take effect and be in force five (5)days afterits passage and publication as provided by law.
