AN ORDINANCE CREATING CHAPTER 5.50 OF THE MOSES LAKEMUNICIPALCODEENTITLED"TELECOMMUNICATIONUSE FEES"
THE CITY COUNCIL OF THE CITYOF MOSES LAKE,WASHINGTON DO ORDAIN AS FOLLOWS:
Section 1.Chapter 5.50 ofthe Moses Lake Municipal Code entitled "Telecommunication Use Fees"iscreatedasfollows:
5.50.010 Findinas:Infurtherance ofthe provisionsofthe RCW Chapter 35.99 and section 35A.21.245,Chapter 5.50 of thisCode was adopted.This chapter providesfor fees to be imposed andcollectedinconnectionwiththeoperationoftelecommunicationsystems,services,andfacilitieswithinthecity.
5.50.020 Chapter Supplemental:
A.The provisions of thischapter are supplemental to and not a replacement of other provisionsofthiscode.When required by thiscode or any other applicablelaw or regulation,entitiessubjecttotheprovisionsofthischaptershallobtainalllicensesandpermitsrequiredbysuchotherlawsorregulations,including a city business license,and maintain thosein a currentstatusasaconditionofbeingincompliancewiththischapterandChapter5.60.
B.Every cable televisionservice provider,whether theyare required toobtaina franchisefortheuseofcityrights-of-wayornot,shallbe requiredtoremit theappropriateutilitytaxonallgrossrevenues."Gross Revenues"means all amounts accrued by grantee inwhatever formandfromallsources,fromtheoperationofgrantee's cable system toprovide cableservicewithinthefranchisearea."GrossRevenues"shallinclude,without limitation,allamounts for allcableservices,including,but not limited to,basic,expanded basic,premium,and pay-per-viewservices,advertising sales and installation fees and charges."Gross Revenues"shallalsoincludeanyrevenuereceivedbyanyaffiliateofgranteewheresuchrevenueintheordinary
course of business has been paid or should have been paidtograntee from theoperation ofitscablesystemtoprovidecableservicewithinthefranchisearea.Byway of illustration andnotlimitation,this definition would include revenue derived from thesale of cable systemadvertisingtimebyanaffiliateofgrantee."Gross Revenues"shallnotinclude bad debt,salestaxes,orothertaxeswhichare collectedbygrantee on behalf of,and for payment to,the local,state or federal government.
5.50.030 Application Fees.Any portion ofthefollowing fees for processing applicationsor renewals notconsumedbycitystafforconsultantsintheprocessingofthetelecommunicationright-of-way useauthorizationapplicationsandrenewalsandfacilitiesleasesandrenewalswillberefundedtotheapplicant.The followingfees forprocessing telecommunicationright-of-wayuse authorizationapplicationsandrenewalsandfacilitiesleasesandrenewalsarecreated:
O Telecommunications license $1,000Renewaloftelecommunicationslicense$500Telecommunicationsfranchise$3,000Telecommunicationsfranchiserenewal$1,500Cablefranchise$4,000Cablefranchiserenewal$2,000
Section 2.This ordinanceshalltakeeffect and be in force five (5)days after its passage and publication of
