2023_00001ORDINANCE NO.2023 AN ORDINANCE AMENDINGCHAPTER 8.14 OF THE MOSESLAKEMUNICIPALCODEENTITLED"NUISANCES" THE CITYCOUNCIL OF THE CITYOF MOSES LAKE,WASHINGTON DOORDAINAS FOLLOWS: Section 1.Chapter 8.14 of the Moses Lake Municipal Code entitled "Nuisances"is amended as follows: 8.14.010 Definitions.The wordsand phrases used inthis chapter,unless the context otherwise indicates, shall have the following meanings: A."Correct"means to abate,repair,replace,remove,destroy or otherwise remedy thecondition in question bysuch means and insuch a mannerand tosuch extentas thecomplianceofficer, in his judgment,determines is necessary in the interest ofthe general health,safety andwelfareofthecommunity. B."Code Compliance Officer"means the CityManager's designee. C."Health Officer"means the Director of theGrant CountyHealth District or his designee. D."Responsible Person"means any agent,lessee,or other person occupying or having charge orcontrolofany premises. E."Buildingmaterials"means and includes lumber,plumbingmaterials,wallboard,sheet metal,plaster,brick,cement,asphalt,concrete block,roofing materials,cans of paint and similarmaterials. F."Premises"means any building,lot,parcel,real estate,or land,or portionof land,whetherimprovedorunimproved,including adjacent sidewalks and parking lanes.(Ord.1529,1992) G."Membrane"means a tarpaulin,banner,fabric,orother sheeting,madeof cloth,plastic,vinyl, paper or other similar material. 8.14.030 Nuisance Defined.Each ofthefollowingconditions,unlessotherwisepermittedbylaw,is declared toconstitutea public nuisance,and whenever theCode ComplianceOfficer determines that anyoftheseconditionsexistuponanypremisesorinanystream,drainage way orwetlands,theofficer may require or provide for the abatement thereofpursuant tothischapter. A.The existence of anytrash,dirt,filth,and carcass ofanyanimal,waste shrubs,accumulationoflawnoryardtrimmingsorotheroffensivematter. B.Defective oroverflowingsepticorsewage systems,and the existence ofany noxious,foul,orputridliquidorsubstancewhichposesahealthhazardorcreatesanoxiousador. C.Any man-caused pool of standing or stagnant water,except stormdrainage systems,which serves as a breeding area for insects. D.Accumulation ofgarbage,decaying vegetation,manure,dead animals,orothernoxiousthingsinastreetoralley,or on public or private property toan extent injurious tothepublic health asdeterminedbytheHealthOfficer. E.AIIotheracts,failure toact,occupations,oruse ofproperty whichis determined bytheHealthOfficertobeamenacetothehealthofthepublic. F.AIIlimbs oftrees whichare less thanseven (7)feet abovethesurfaceofanypublicsidewalk, ortwelve(12)feet above thesurface of anystreet, G.Allbuildings,other structures,or portions thereofwhich have been damaged by fire,decay,neglect,or have otherwise deteriorated or become dilapidated so as to endanger the safetyofthepublic. H.All explosives,flammable liquids,and other dangerous substances stored or used in anymannerinviolationoftheUniformFireCode. I.The keeping or harboring of any dog,fowl,or other animalwhich by frequent or habitualhowling,yelping,barking,crowing,or in the makingof other noises,annoys or disturbs thepublic,orthe habitual allowingofdogs kept at any one address to run at large inviolation ofChapter6.05 of theMoses Lake Municipal Codeentitled"Animal Control". J.Making or causingto be made by any means whatsoever any noise ofany kind which is aviolationofChapters8.28 oftheMoses Lake Municipal Code entitled "Noise Control". K.The frequent,repetitive,or continuous sound made byanysecured,unsecured,or deterioratedmembrane,or sheet metal,being moved by thewind or other source,which unreasonablyinterfereswiththepeace,comfortand repose of adjacent property owners or possessors. L.Dumping,throwing,placing,leaving or causing or permitting to be dumped,thrown,placed orleft,anyfilth,paper,cans,glass,rubbish,trashgarbage,grass trimmings,shrub trimming,andshrubberyofanykind,inor uponanystreet,alley,sidewalk,ditch,or public orprivate propertyofanotherinthecity. M.The erecting,maintaining,using,placing,depositing,leaving or permittingtobe or remainin or uponanyprivatelot,building,structureorpremises,orinoruponanystreet,alley,sidewalk,park,parkway or other public or private place.in thecity,any one or more of thefollowing disorderly,disturbing,unsanitary,fly-producing,rat-harboring,disease-causing places, conditions orthings: 1.Any putrid,unhealthy or unwholesome bones,meat,hides,skins,or whole or any part of any dead animal,fish or fowl,or waste parts of fish,vegetable or animal matter in anyquantity;but nothing herein shall prevent the temporaryretention of waste in approvedcoveredreceptacles. 2.Any privies,vaults,cesspools,sumps,pits or like places which are not securely protectedfromfliesandrats,or which are foul or malodorous. 3.Anyfilthy,litteredortrash-covered dwellings,cellars,house yards,barnyards,stableyards, factoryyards,vacant areas in the rear of stores,vacant lots,houses,buildings or pre-mises. 4.Anyanimalmanure in any quantity which is not securely protected from flies or weather conditions,or which is kept or handled in violation of any ordinanceof thecity. 5.Any poison oak or poison ivy,Russian thistleor other noxious weeds,as defined by Chapter 8.22 ofthe Moses Lake MunicipalCode entitled "Noxious Weed Control"whether growing or otherwise;but nothingherein shall prevent thetemporaryretention of such weeds in approved covered receptacles. 6.Anybottles,cans,glass,ashes,smallpieces ofscrap iron,wire,metal articles,bric-a-brac, broken crockery,broken glass,broken plasterand allsuch trash,or abandoned material, unless it is kept in approved covered bins orgalvanizediron receptacles. 7.Any trash,litter,rags,accumulations or empty barrels,boxes,crates,packing cases,mattresses,bedding,excelsior,packing hay,straworother packing material,lumber not neatly piled,scrap iron,tinorother metalnotneatly piled,or anything whatsoever inwhich flies orrats may breed or multiplyorwhichmay be a fire hazard. N.The permitting to remain outside any dwelling,building,or other structure,or within any unoccupied or abandoned building,dwelling,or other structure,in a place accessible tochildren,any abandoned,unattended,or discarded ice chest,refrigerator or other airtight contained,whichdoes not have thedoor,lid or other locking device removed. O.Any pit,hole,basin or excavation which is unguarded or dangerous to life or has been abandoned,or is no longer used for the purpose constructed,or is maintained contrarytostatutes,ordinances,or regulations. P.Anywell or storage tankpermitted to remain on any publicor private property without being securely closed or barring any entrance or trapdoor thereto,or withoutfillingor capping any well. Q.The repair orabandonmentof anyautomobile,truck,or other motor vehicle of anykind upon thepublicstreets oralleysofthe city. R.The keeping or permittingthee×istence of anybees or other insects,reptiles,rodents,fowl, oranyotheranimals,domestic orwild,inanymanner contrarytolaw,orwhich affect thesafety ofthe public. S.The existence ofanyfence,other structure,or thingon private or publicpropertyabuttingorfrontinguponanypublicstreet,sidewalk,or place,whichis sagging,leaning,fallen,decayed or is otherwisedilapidated and creatingan unsafe condition. T.The existence ofanyvine,shrub,or plant growing on,around,or infront of any fire hydrant, utilitypole,utilitybox,or any other applianceor facility provided for fire protection,public orprivateutilitypurposesinsuchawayastoobscurefromvieworimpairaccessthereto. U.Except foranydesignated public park land,naturalarea,or environmentally sensitivearea,or any undeveloped parcels of land not adjacent to developed areas or which are used for agriculturalpurposes,allgrasses,weeds,orother vegetation growing orwhich has grown and died,which is determined tobe a fire or safety hazard or a nuisance to persons,shall not exceed twelveinches (12")in height measured above the ground. 1.The above exceptionmay be waived and additionalmaintenance requiredby the Code Compliance Officer if he determines such action is necessary to protect thesafety of persons or adjoining property. 2.AIImaintenance shall be done in a manner so that soilstabilitywill not be disrupted or disturbed.Grass,weed,or vegetation control shall not include plowing,discing,orscrapingthesoiltoeliminatethegrasses,weeds,or other vegetation unless a soil stabilization plan,which willminimize blowing dust and maintainsoil stability and which shall be approved by the city prior to any plowing,discing,or scraping,is implemented immediately. V.The existenceofany dead,diseased,infected,or dyingtree,shrub,orothervegetationwhich may pose a danger to vegetation,crops,property,or persons. W.The existence of any accumulationof materials or objects in a location when the sameendangersproperty,safety or constitutes a fire hazard. X.The depositing or burning or causing tobe deposited or burned inany street,alley,sidewalk,parkway or other public place which is open totravel,of any hay,straw,paper,wood,boards,boxes,leaves,manure or other rubbishor material. Y.The storage or keeping on any premises for more thanthirtydays ofany used or unusedbuildingmaterialsasdefinedinSection8.14.010 (B),whose retail costnewwouldexceedonehundreddollars,withouta special permit from thebuildingofficial,provided,thatnothing herein shal rohibitsuch storagewithouta permitwhen done inconjunction witha construction projectforwhichabuildingpermithasbeenissuedandwhichisbeingprosecuteddiligentlytocompletion. 2.Prohibit such storage without a permit upon the premises of a bona fide lumber yard,dealer in building materialsorother commercialenterprise when the same is permittedunderthezoningordinanceandotherapplicablelaws, 3.Makelawfulanysuchstorage orkeeping whenitis prohibitedbyotherordinancesorlaws, Z.The existenceon any premises ofany unused and abandoned trailer,house trailer,automo-bile,boat or other vehicle or major parts thereof. AA.The keeping or maintenance in anyarea on private property which is clearly visible from apublicstreet,sidewalk,park orother public area anyaccumulation,collectionoruntidystorageofanyofthefollowing:old appliances or parts thereof;old iron,steel,aluminum or othermetal;inoperable vehicles,vehicle parts,machineryor equipment;mattresses,bedding,clothing,rags or cloth;straw,packing materials,cardboard or paper,tincans,wire,bottles,glass,cans,barrels,bins,boxes,containers,ashes,plaster or cement;or wood.This determination shallnot applytoconditionscompletelyenclosedwithina building or fencing soasnottobevisiblefrompublicproperty. BB.The keeping,permittingor harboringofany fowl,rabbits,hoofed or cloven footed animals. CC.The depositingof any debris,vegetation,lawn clippings,lumber piles,wood piles,auto parts or bodies,garbage and the like,or storing of any material of any kind,provided that in residential zones thatshall include garbage cans or refuse containersin the alleysofthe city,except on garbage pickup day. DD.The existence of graffiti,which is defined as a defacing,damaging,ordestructive inscription,figure or design painted,drawn or the like,on theexteriorofany building,fence,gate,orotherstructuresoronrocks,bridges,trees,or otherreal or personal property. EE.The locating ofautomobiles,trucks,recreational vehicles,trailers,boats,or any othervehicles,vessels,or thelikeforthepurposeofadvertising its sale on property located inany commercial or industrial zone not ownedby the seller. FF.The permittingof any conditionor situationwhere the soil has been disrupted,disturbed,ordestabilizedsoastoallowblowingdusttoexist GG.The existence on any premise any unsecured,unused,or abandoned building or structures. Section 2.This ordinance shall take effect and be in force five (5)days after its passage and publicationofitssummaryasprovidedbylaw.
