2026_00001ORDINANCE NO.2026 AN ORDINANCE CREATINGCHAPTER 2.30 OF THE MOSES LAKEMUNICIPALCODEENTITLED"EMERGENCY MEDICALANDAMBULANCESERVICE" THE CITYCOUNCIL OF THECITY OF MOSESLAKE,WASHINGTON DOORDAINASFOLLOWS: Section 1.Chapter 2,30 of theMoses Lake Municipal Code entitled "EmergencyMedical and AmbulanceService"is amended as follows: 2.30.010 Establishmentof Emergency Medicaland Ambulance Service:There isestablished an emergencymedicalandambulanceservicebytheCityofMosesLaketobeoperatedaccordingtothelicenseissuedbytheStateofWashington. 2.30.020 Service tobe Provided by Fire Deoartment:The emergency medical and ambulance serviceshallbeoperatedbytheMosesLakeFireDepartment. 2.30.030 Reciprocity and Mutual Aid:Emergency and non-emergency transportshallbe providedto otheragenciesaccordingtoanyreciprocalandmutualaidagreementsexecutedbetweentheparties. 2.30.040 EmergencyMedical andAmbulanceService Fund:There is established and created a specialfundtobeknownastheEmergencyMedicalandAmbulanceServiceFund.AnyandallrevenuesreceivedforemergencymedicalandambulanceservicesshallbecreditedtotheEmergencyMedicalandAmbulanceServiceFund.Allexpendituresoftheoperation,maintenance,andcapitalneedsofthecity's emergency medicaland ambulanceservice shall be paidout ofthe EmergencyMedicalandAmbulanceServiceFund. 2.30.050 Emergency Medical and Ambulance Service Rates:The rates for emergency medical andambulanceservicesshallbesetbyCityCouncilresolution.Rates shallbe set at a level tocovertheactualcostsincurredbythecityinoperatingtheemergencymedicalandambulanceserviceandmaybeamendedfromtimetotimebytheCityCouncilbyresolution.Additional service feesforprofessionalservices,medical supplies,and other items expended inthetransferortransportofthepatientshallbechargedatratesdeterminedbytheCityCouncil. 2.30.060 Billingfor Ambulance Service:Each personwhoutilizestheemergencymedical and ambulanceserviceshallbebilledbythecityattheratesetbyresolution.The CityManager shall establish aproceduretobillandcollectratesfortheemergencymedicalandambulanceservice.Under theprocedure,theCity may elect tobillthepatient directly or billthepatient'sinsurance companyandifthepatient's insurance does not cover allthe costs of ambulance service,billthe remainingbalancetothepatientdirectly.The City maycontractwith a billingservice to billand collecttheratesfortheemergencymedicalandambulanceservice. 2.30.070 Compliance withMedicare and Medicaid Reauirements:This chapter and thecharges for theemergencymedicalandambulanceservicehereundershallbeconstruedandimplementedinamannerconsistentwiththeapplicablemedicareandmedicaidrequirements.Ifany part of thischapterisfoundtoconflictwithmedicareandmedicaidrequirements,theconflicting partof thischaptershallbeinoperativetotheextendoftheconflictandsuchfindinganddeterminationshallnotaffecttheoperationoftheremainderofthischapter. 2.30.080 Severability:Ifany provision ofthischapteroritsapplicationtoanyperson or circumstance isheldinvalid,the remainder of this chapter or the application of the provisionto other persons orcircumstancesisnoteffectiveandtothisandtheprovisionsofthischapteraredeclaredtobeseverable. Section 2.The City Council declares that an emergency exists and this ordinance shall take effectimmediatelyasprovidedbylawupononereadingif2/3 of the entire CityCouncilpresent vote in favor ofpassage.
