AN ORDINANCEAMENDINGCHAPTER 18.28 OF THE MOSES LAKEMUNICIPAL
CODE ENTITLED"C-1,CENTRAL BUSINESSDISTRICT ZONE"
THE CITYCOUNCIL OF THECITYOFMOSESLAKE,WASHINGTON DO ORDAINAS FOLLOWS:
Section 1.Chapter 18.28 ofthe Moses Lake Municipal Code entitled"C-1,CentralBusiness District Zone"
is amended as follows:
18.28.030 Examples of Permitted Uses:The following specific and generally described uses are listed asexamplesofthetypesofusesthatmaybelocatedintheC-1 zone.The list is not all inclusive.
A.Retail uses
B.Governmental offices
C.Service uses
D.Professional offices
E.Cultural,recreational,and entertainmentuses
F,Lodging,assembly and foodservices
G.Planned development districts
H.Essential publicservices and utilities including buildings and structures
I.Accessory uses appurtenant to any primary uses and not otherwiseprohibited.
J.Banking and financial services
K.Locating steel sea orocean-going containers marked withtheAmerican Bureau ofShipping'sEmblemormeetingtheInternationalStandardsOrganizationstandardswhichcanbedetachedfromatrailer,chassis,or frame and,which were formerly used for transportingseaorocean-goingcargo or semi-trailers when intended tobe used as storage facilities or thelikeatconstructionsites.Construction storage facilities may be located ten(10)days priortostartofconstructionandshallberemovedwithinten(10)days of finish of construction.Start ofconstructionshallbedefinedasten(10)days priortothephysicalpresence ofconstructionOactivityonthesiteforwhichabuildingpermithasbeenissued.Finish ofconstructionshallbe
defined as thedate of issuance of a Certificate of Occupancy.
L.Adultfamily homes in a regularabode ofa person or persons providing personal care,special
care,room,and board to morethanone but not morethansix adults who are not related bybloodormarriagetothepersonorpersonsprovidingtheservices.Adultfamily homes shallbelicensedbytheDepartmentofSocialandHealthServicesandacitybusinesslicenseshallberequired.
M.Family day care homes providing care during part of the twenty-four(24)hour day to twelve(12)or fewer children in the family livingquarters of the provider's home.Family day carehomesshallbelicensedbytheStateofWashington,Department of Social and Health
Services and shall operate in compliance with the licensed capacity requirements for familydaycarehomes.Certification by the office of child care policy licensor as providing a safe
passenger loading area,and a citybusiness license,shall be required.The building shallcomplywithallbuilding,fire,safety,and health code requirements;and the building and lotshallconformtothelotsize,building size,set backs,and lot coverage standards of thezone,except forlegal nonconformingstructures.
18.28.040 Conditional Uses:The following specificand generallydescribed uses shallbe permittedintheC-1 Zone only as a conditional use subject to the approval of the Planning CommissionincompliancewiththeprovisionsofthischapterandChapter18.51 ofthistitleentitled"Conditional
and UnmentionedUses."
A.Churches
B.Schools
C.Hospitals
D.Gasoline stations
E.Any permitted development overtwo(2)acres in size
F.Open sale lots when conducted in conjunction with the principal use which must be in anenclosedadjoiningbuilding
G.Keeping oflivestock,poultry,rabbits,or bees
H.Bulk storage of hazardous,combustible,or explosive substances
I.Any commercial use not on citysanitary sewer.
J.Other unmentioneduses ruledby the Planning Commission to be a conditionaluse or usespermittedbyspecificprovisionofthischapterasaconditionaluse.
K.Residential Uses as an accessory use to a commercial structure provided theydo not conflictwithgroundlevelcommercialfloorarea
L.On-site hazardous waste treatmentandstorage facilities incompliance with the performance
standards oftheState of Washingtonsitingcriteriaforon-site hazardous waste treatmentand
storage facilities andtherequirementsofthischapter;provided that,on-site hazardous wastetreatmentandstoragefacilitiesareaccessorytoandsubordinatetoaprimaryusewhichisageneratorofhazardouswaste.
18.28.050 Prohibited Uses:The followinguses shall be prohibited intheC-1Zone:
A.Anyuse whichdoes not or is not capable ofconforming with the requirementsofthischapter.
B.Public nuisances as defined by Moses LakeMunicipal Code Section 18.06.485
C.Industrial uses
D.Outsidestorage,collection,ordumpingofdismantled,partlydismantled,orwreckedvehicles,
trailers,machinery,or theirparts.
E.Outsidestorageor collection ofanyjunk,scrap,garbage,unsightly material,or debris except
as may be contained in an approvedgarbage collectioncontainer.
F.Abandoned structures or buildings ina state of disrepair.
G.Removal of soilor other naturalmaterials for thepurpose ofsale or use as fillmaterial,exceptthatexcavationforthepurposeofconstructionorlandscapingispermitted.
H.Occupancy oftrailersor recreational vehicles
I.Warehouses not connected toa retail outlet
J.Wrecking yards,salvage yards,or junkyards
K.Mobile home parks,manufactured home parks,or recreationalvehicle parks
L.Locating any sea orocean-goingcontainers which can be detached from a trailer,chassis,or
frame and,which were formerly used fortransportingsea orocean-going cargo,railroadcars
and cabooses,semi-trailerswhen intended tobe used as storage facilities or anyother unit
which detaches from a trailer,chassis,or frame including car,truck,or van bodies orparts of
bodieswhen intended to be used as storage facilities or the like.
18.28.160 BufferStrips:Site plan review bythe Planning Commissionwillbe required for any contiguous
commercialand residentialdevelopment Buffer strips,in addition tothe perimeter landscaping
requirements in Chapter 18.57,may be required by the Planning Commission to separate
developed contiguous commercialand residential uses from each other in order to eliminate
nuisances.The Planning Commissionmayallowor require screening fences,walls,plantings,orbermsoranycombinationthereof.
Section 2.This ordinance shall take effectand be in force five (5)days afterits passage and publication of
its summaryas providedby law.
