2033_00001ORDINANCE NO.2033 ANORDINANCE AMENDINGCHAPTER 18.32 OF THE MOSESLAKEMIJNICIPALCODEENTITLED"C-2,GENERAL COMMERCIALAND BUSINESS ZONE" THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON DO ORDAINAS FOLLOWS: Section1.Chapter 18.32 oftheMoses Lake MunicipalCodeentitled"C-2,General Commercialand BusinessZone"is amended as follows: 18.32.030 Examples ofPermitted Uses:The followingspecific and generallydescribed uses are listed asexamplesofthetypesofusesthatmaybelocatedintheC-2 zone.The list is not all inclusive. A.Retail and wholesale uses B.Offices C.Services D.Cultural,recreational,and entertainment uses E.Essential public services and utilitiesincluding buildings and structures F.Lodging,assembly,and food service G.Planned development districts H.Bankingand financialservices I.Repair and maintenance J.Storage,warehousing,and distribution K.Light manufacturing when conductedas part ofa retailsales outlet L.Private or public transportationsystems M.Accessory uses appurtenant toany primaryuses and nototherwiseprohibited. N.Locating steel sea or ocean-going containers marked withtheAmerican Bureau ofShipping'sOEmblemormeetingtheInternationalStandardsOrganizationstandardswhichcanbedetachedfromatrailer,chassis,orframe and,which were formerlyused fortransportingseaorocean-goingcargoor semi-trailerswhen intended tobe used as storage facilities or thelikeatconstructionsites.Constructionstoragefacilitiesmaybe located ten(10)days priortostartofconstructionandshallberemovedwithinten(10)days of finish of construction.Start ofconstructionshallbedefinedasten(10)days priortothephysicalpresence of constructionactivityonthesiteforwhichabuildingpermithasbeenissued.Finish ofconstructionshall bedefinedasthedateofissuanceofaCertificateofOccupancy. O.Adult familyhomes ina regularabode ofa person or persons providing personalcare,special care,room,and board to more thanone but not more than six adults who are not related bybloodormarriagetothepersonorpersonsprovidingtheservices.Adult familyhomes shallbelicensedbytheDepartmentofSocialandHealthServicesandacitybusinesslicenseshallberequired. P.Family day care homes providing care during part of thetwenty-fourhourdaytotwelve(12)or fewerchildren in thefamilylivingquarters oftheprovider'shome.Family day care homesshallbelicensedbytheStateofWashingtonDepartmentofSocialandHealthServicesandshalloperateincompliancewiththelicensedcapacityrequirementsforfamilydaycarehomes.Certification by the office ofchildcare policy licensor as providing a safe passenger loadingarea,and a citybusiness license shall be required.The building shallcomplywithallbuilding,fire,safety,and health code requirements;and the building and lotshallconformtothelotsize,building size,set backs,and lotcoverage standards of thezone,except for legal nonconform-ing structures. 18.32.040 Conditional Uses:The followingspecific and generallydescribed uses shall be permitted in theC-2 Zone only as a conditional use subject to the approval of the Planning Commission incompliancewiththeprovisionsofthischapterandChapter18.51 of thistitleentitled "ConditionalandUnmentionedUses." A,Churches B.Schools C.Hospitals D.Bulkstorage of hazardous,combustibleor explosive substances E.Airports,landing strips,heliports,and air transportationfacilities F.Recreational vehicleparks G.Keepingof livestock,poultry,rabbits,or bees for commercial or privatepurposes H.Any commercial use not on citysanitarysewer. I.Permanent storage facilities utilizingsteel sea or ocean-going containers marked withtheAmericanBureauofShipping'sEmblem ormeetingtheInternational Standard Organization's standards which can be detached from a trailer,chassis,or frame and,which were formerly used for transportingsea or ocean-goingcargowhen intended tobe used as storage facilities with thefollowing conditionsbeing required as a minimum: 1.Be used as an appurtenance tothe primary use,such primary use being situated in anenclosedadjoiningbuilding. 2.Be placed onconcrete,asphalt,or level,compacted,hard surface at alltimes. 3.Be paintedso as toblend inwiththe building towhichitis associated. 4.Not be visibleto the motoring public or from residentialneighborhoods immediately adjacent to the propertywhere it is located unless other measures are employed to mitigatethevisual impacts of the containersformerly used for transportingsea or ocean goingcargo,which measures shall be approvedby the Planning Commission,provided, thatthePlanning Commission does not need torequire mitigation measures ifit isfeltthat themotoringpublicor adjacent residential neighborhoods are not impacted. 5.Have a maximumallowable square footage of container storage area notto exceed five percent (5%)ofthegross floor area ofthe building with which thecontainer(s)is associ- ated.In noevent shall thenumberofcontainersallowedas appurtenantstorage facilities exceed three(3)in number. 6.Be located on premises as an appurtenant storage facility. 7.Not be stacked. 8.Abide by all set back requirements applicabletothe zone inwhich it is located. 9.The recipient of the conditionaluse permit is theonlyparty allowed to use the container. 10.The conditions as required by 1 through9 shall be met withinten(10)working days after the conditionaluse permit has been granted and the ten (10)day appeal period has expired. 11.If any additionalconditionsare specifiedby the Planning Commission,the Commission shallset a date for theconditionsto be met by the applicant. J.Temporary seasonal shortage facilitiesutilizingsteel sea or ocean-going containersmarked with the American Bureau of Shipping's Emblem or meeting the International Standard Organization's standards which can be detached froma trailer,chassis,or frame and,which were formerly used for transportingsea or ocean-goingcargo when intended to be used as storage facilities withthefollowing conditionsbeing required as a minimum: 1.Be used as an appurtenance to theprimaryuse;such primary use being situated in anenclosedadjoiningbuilding. 2.Be placed on concrete,asphalt,or level,compacted,hard surface at all times. 3.Not be visible to the motoringpublic or from residential neighborhoods immediately adjacent to the propertywhere it is located unless other measures are employed to mitigatethevisual impacts of thecontainersformerly used for transportingsea or ocean goingcargo,whichmeasures shall be approvedby thePlanningCommission,provided, thatthe Planning Commission does notneed torequire mitigation measures ifitis feltthat the motoringpublic or adjacent residentialneighborhoods are notimpacted. 4.Have a maximumallowablesquare footage ofcontainerstorage area notto exceed five percent (5%)of thegross floor area of thebuilding withwhichthecontainer(s)is associ- ated.Subjecttothesquare footage ofcontainer area togross floor area limitation,upon applicationfor a separate permit,up toanadditionalfifteen (15)containers may be allowed on a temporaryseasonal basis notto exceed ninety(90)days.The ninety (90)day period shall be specified bytheproponentinthe conditional use permit application.Aconditional use permit fora temporaryseasonal usage shall only be granted once in every twelve(12) month period for each location. 5.Be located on premises as an appurtenant storage facility. 6.Notbe stacked. 7.Abide by all set back requirementsapplicable to the zone in which itis located. 8.The recipientofthe conditional use permit is the only party allowedto use the container. 9.The conditions as requiredby 1through9 shall be metwithinten(10)working days after the conditionaluse permit has been granted and the ten (10)day appeal period has expired. 10.Ifany additional conditionsare specified by the Planning Commission,theCommission shall set a date for theconditionstobe met by theapplicant. 11.The use oftemporarystorage shallnotexceed ninety (90)consecutive days.The ninety (90)days shall begin after theconditionaluse permithas been grantedand the ten (10) day appeal periodhas expired.A conditionaluse permitshall onlybe granted once in everytwelve(12)monthperiodforeach location. I 12.A separate conditionaluse permitshall accompany each temporary,seasonal storageusagesought 13.Aseparate fee ofsixtydollars($60)per containershall be requiredtomitigateadditionalexpensestothecity. K.Other unmentioneduses ruledby the Planning Commissionto be a conditionaluse or usespermittedbyspecificprovisionofthischapterasaconditionaluse. LI.On-site hazardous waste treatmentand storage facilities incompliance withtheperformanceOstandardsoftheStateofWashingtonsitingcriteriaforon-sitehazardous wastetreatmentandstoragefacilitiesandtherequirementsofthischapter;providedthat,on-site hazardous wastetreatmentandstoragefacilitiesareaccessorytoandsubordinatetoaprimaryusewhichisageneratorofhazardouswaste. M.Residentialuses as an accessory use to a commercial structure,whether occupied by theowner,rented,leased,or occupied by a resident manager,watchperson,custodian,orattendantprovidedtheusedoesnotconflictwithgroundlevelcommercialfloorarea.Accessory use shall be defined as a use of the land or a portionof a building which isincidentalandsubordinatetotheprincipaluseofthebuilding.Accessory uses must belocatedonthesamelotastheprincipaluse. N.Multi-familyresidential uses (apartments)provided the use does notconflictwith groundlevelcommercialfloorarea. 18.32.050 Prohibited Uses:The followinguses shallbe prohibited in the C-2 Zone: A.Anyuse which does not or is not capable ofconformingwiththerequirementsofthischapter. B.Public nuisances as defined by Moses Lake Municipal Code Section18.06.485 C.Industrial uses D.Outside storage,collection,ordumpingofdismantled,partly dismantled,orwrecked vehicles,trailers,machinery,or theirparts. E.Outside storage orcollectionofanyjunk,scrap,garbage,unsightlymaterial,or debris except as maybe contained inapproved garbage collection containers. F.Abandoned structures or buildings ina state of disrepair. G.Removal ofsoil orothernatural materials for thepurpose of sale or use as fillmaterial,exceptthatexcavationforthepurposeofconstructionorlandscapingispermitted, H.Occupancy of a recreational vehicle outside of a recreational vehiclepark.Recreationalvehicleshallbedefinedasavehiculartypeunitwhichcanbetowed,hauled,or drivendesignedastemporarylivingquartersforrecreational,camping,or traveluses including butnotlimitedtotraveltrailers,camptrailers,truckcampers,and self-propelled motor homes.Arecreationalvehicleisnotamanufacturedhorneorafactorybuilthome. I.Wrecking yards,salvage yards,or junkyards J.Locating railroad cars and cabooses,semi-trailerswhen intended to be used as storagefacilitiesoranyotherunitwhichdetachesfromatrailer,chassis,or frame including car,truck,or van bodies or parts of bodies when intended to be used as storage facilities or the like,except for those steel sea or ocean-going containers allowedas a conditionaluse. K.Manufactured Home Parks 18.32.170 Buffer Strips:Site plan review by the Planning Commissionwillbe required for any contiguouscommercialandresidentialdevelopment.Buffer strips,in additiontothe perimeter landscapingrequirementsinChapter18.57,may be required by the Planning Commission to separatedevelopedcontiguouscommercialandresidentialusesfromeachotherinordertoeliminatenuisances.The Planning Commission may allowor requirescreening fences,walls,plantings,or berms or any combinationthereof.
