AN ORDINANCEAMENDINGCHAPTER 12.16 OF THE MOSES LAKEMUNICIPALCODEENTITLED"EXCAVATIONSAND OBSTRUCTIONS'
THECITYCOUNCIL OF THECITYOF MOSES LAKE,WASHINGTON DOESORDAINAS FOLLOWS:
Section 1.Amendment.Moses Lake MunicipalCode Chapter 12.16 entitled"Excavations and Obstructions"is amended as follows:
0 12,16.020 Permit -Terms and Conditions:The City Engineer or theCity Engineer's designee,referred tohereinastheEngineer,shall grantsuch permit onlyuponcompliancewiththe followingterms andconditions:
The party requestingsuch permit shall make application thereforinwritingand ifrequested todosobytheCityEngineer,shallfilewiththe Engineera site planshowingthelocation and planofthework,obstructionor otherthingdesiredtobe done or constructed,and thepublic right-of-way oreasement,referred to herein as thepublicplace,to be obstructedtogetherwitha fulldescriptionofthenatureofsuchwork,obstruction orotherthing.The Engineer shallexaminesuch applicationandplanandiftheEngineerapprovesthesame,may issue a permitforthework,whichpermitshallrequirethereplacinginaconditioncompliantwithcurrentcommunitydevelopmentstandardstheportionofthepublicplacewhichmaybeobstructed,disturbed,or affected in any way.Thepermitshallspecifythelocationofthepublicplaceinfrontof,through,under,on,or near whichsuchactsaretobeperformedordone,and the name of the public place,together with adescriptionoftheproposedworkoractstobedoneundersuchpermits,and the length oftimeallowedforthecompletionofthework.The acts and works permitted undersuch permit shallbeinspectedbytheEngineer,to insure the work or acts are performed to current communitydevelopmentstandards.Ifany publicplace referredtoin thischapter is disturbed inany way,thereplacingthereofinaconditioncompliantwithcurrentcommunitydevelopmentstandardsshallbeattheexpenseofthepartyprocuringthepermitandatalltimessubjecttothedirectionoftheEngineer,and thepublicplaceshallbe replaced and restoredtoa condition compliantwithcurrentcommunitydevelopmentstandardswithinthetimestatedandspecifiedbytheEngineer.Attheexpirationofthetimefixedbysuchpermit,or uponthecompletionofthework allowedtobe doneundersuchpermit,the Engineershall,if the Engineer deems advisable,have the right to do allworkandthingsnecessarytorestorethepublicplacetoaconditioncompliantwithcurrentcommunitydevelopmentstandards;and the party obtaining the permit shall be liable for theexpensethereof;provided thatthe Cityshall have a cause of action for allofits expenses andamountspaidoutupontheworktobecollectedinacivilactioninanycourtofcompetentjurisdiction.Nothing stated inthissection shallaffectinanywaythe duty of theperson acting underOsuchpermittoguaranteeandmaintaintheareadisturbedforone(1)year after returning itto aconditioncompliantwithcurrentcommunitydevelopmentstandardsandacceptanceoftheworksoperformedbytheEngineerorCityCouncilasthecasemaybe.
12.16.070 Egnd;Iftheworkpermitted necessitates excavation withinor thecutting into any publicplace intheCity,theEngineer may requirea bond in twicethe estimated cost of thework containing aclauseindemnifyingandholdingtheCityharmlessfromliabilityarisingoutofthepermittee'sactivities,a clause guaranteeing payment of all persons providing labor and materialson theactivityallowedbythepermitandaclauseguaranteeingthereplacementofthepublicplaceaffectedtherebyandprovidingthatthepermitteeshallputthesameinaconditioncompliantwithcurrentcommunitydevelopmentstandards,and within thetime specified by the Engineer,andmaintainsitinsuchconditionforaperiodofone(1)year after the completed job is accepted bytheCity.
12.16.090 On-goinq Bond:Any person,firm,or corporation engaged inthe business ofexcavation or anykindofworkwhichtendstoobstructthesidewalks,streets,highways,thoroughfares,alleys,orpublicplacesmay,in lieu ofthebond referred toin Section12.16.070,execute and filea bond insuchamountasmaybefixedbytheEngineerandapprovedbytheCityAttorney,conditionedasprovidedinSection12.16.070,provided,that whenever in thejudgment of the Engineer theamountofsuchbondbecomesinsufficient,a new or additional bond may be required.TheaforesaidbondinitiallyshallbeforanindefiniteperiodsubjecttotheCitybeinggivennolessthanthirty(30)days notice of cancellationand thatthe obligation of such bond shall survive itscancellationorexpirationforaperiodofone(1)year after acceptance bytheCityofanyworkforwhichsuchbondisgiven.
Section 2.This ordinance shall take effect and be in force five (5)days after its passage and publication ofitssummaryasprovidedbylaw.
