AN ORDINANCE AMENDINGCHAPTER 8.08 OF THE MOSES LAKEMUNICIPALCODEENTITLED"GARBAGE COLLECTION"
THE CITYCOUNCIL OF THE CITYOF MOSES LAKE,WASHINGTON DO ORDAINAS FOLLOWS:
Section 1.Chapter 8.08 of the Moses Lake Municipal Code entitled"Garbage Collection"is amended asfollows:
8.08.060 Container Regulations:
A.It shall be the duty of every person in possession,charge or in control of any dwelling,flat,roominghouse,apartment house,or eating place or in possession,charge,or control of anyshop,place of business,ormanufacturingestablishmentat alltimes,to keep orcause to bekept,portable containers or garbage cans of approved size,type,and construction,and todepositorcausetobedepositedtherefusetherein.Additionally,plastic garbage bags maybeutilizedinaccordancewithsubsectionBinlieuoforinadditiontousingportablecontainers
or garbage cans.
B.Containers or garbage cans shall be constructed in such a manner as tobe strong,not easilycorrodible,rodent-proof,in-sect-proof,and of not less than fifteen-gallon and not more thanthirty-two(32)gallon capacity,and shall have two handles at the sides thereof.Refuse orgarbagecontainersshallnotbefilledwithdishwaterorotherliquidorsemiliquidkitchenwastes,whichare properly disposable down sanitarydrains.Such containersand garbage
cans shall be kept in a sanitary condition with the outside thereof clean and free fromaccumulativegreaseanddecomposingmaterial.Plastic bags containingputrescible wasteshallbeplacedinacontainerorgarbagecan.Plastic bags containing nonputrescible waste
do not necessarily have to be placed in a container or garbage can.
C.In residential neighborhoods every container or garbage can on the day designated forcollection,shall be kept ina place accessible tothe collector of garbage and refuse.Wherealleyaccessisavailable,allcontainers shallbe placed atthe alleyline.Where noalleyaccessisavailable,allcontainers shall be placed atthe curb line on theday designated for collectionandonallotherdaysshallberemovedfromstreetview.Commercial accountsshall have theircontainersplacedinalocationaccessibletothecollectorofgarbageandrefuse.Safety andmaneuverabilityofthecollectorofrefuse's vehicles shall be prime considerations,but not theonlyconsiderations,in determining accessibility.The Sanitation Technician shall be thedeterminerofaccessibilityafterconferringwiththecollectorofgarbageandrefuse.IfthereisadisputebetweentheSanitationTechnicianandthecollectorofgarbageandrefuseastoOaccessibility,the City Manager shall make the determination as to whether a location Ísaccessible.The decision of the City Manager shall be final.The collector of garbage andrefuseshallpickupallcommercialaccountswherethecontainerislocatedwhetherthelocationisonprivateorpubliclyownedproperty.
D.Each container shall be kept clean inside and out so that no odor nuisance shall exist,itshallbetheresponsibilityoftheownerofthecontainerorgarbagecantokeepsuchcontainerorgarbagecancleanunlessthisresponsibilityisalteredbycontractbetweenthecityandthecollectorofgarbageandrefuse.In such a situation,the contract shall control.The areaaroundthecontainersshallbekeptinaneatandsanitarycondition.The SanitationTechnicianshallplacetagsongarbagecontainersfoundtobeinviolationofthissubsectionandnotifythepropertyownerwhentheareasaroundthecontainerarenotbeingkeptinaneatandsanitarycondition.Alltags and notifications shall be dated and signed by the Sanitation Technician.Two or more violations ofthis provision of thissection shall subject the person responsible tothepenaltiesdescribedinChapter1.08 ofthiscode.
E.Those containers found to be defective or illegal (defectivebottoms,crushed so that lidswillnotfit,fifty-fivegallon barrels,waste baskets,paper drums)or any other containers that arefoundtobeillegalshallbesubjecttoimpoundinganddisposal.Ifa container received twoviolationswithinathirty-dayperiod,the Sanitation Technician of the citywill impound it.
The container shall be stored by the citynot to exceed tendays.Ifafter ten days the ownerhasnotclaimedandagreedtorepairtheillegalcontainer,itwillbe disposed of bythe city.Theimpoundmentofanillegalcontainershallnotrelievetheownerfromcompliancewithregulationsinthischapter.
F.No garbage or refuse container or garbage can shall contain earth,rocks,or heavy refuse.Any container requiring a man to lift it shall not exceed sixty-five (65)pounds in totalweightofcontainerandrefuse.
O G.Customers must restrain vicious dogs beyond reach of the garbage containers and preventanyinterferencewiththepickupmanonthisaccount.
H.Large,suitable containers for collection.of garbage and refuse may,with the approval of theSanitationTechnician,be used inthe business and commercial zones.Such containersshallbesuppliedbythecollectorofgarbageandrefuseifthecollectorofgarbageandrefuseissorequiredbyhiscontractwiththecity,however,thatdoes not preclude any person from owningtheirowncontainer(s)iftheyso desire.
I.Compactors for industrial and commercial users shall have a double stage pump capable ofdevelopingapressureofatleast1600psi.The pressure on the ram face shall be a minimumof40psi.Compression ratio shall be a minimum of3:1.The Sanitation Technician shallapproveallcompactorsusedforcommercialorindustrialuses.These compactorsshall bedesignedtobecompatiblewithlocalsanitationtransportationequipment.
J.Allcontainers,compactors,and dumpsters shall comply with the Consumer Products Safety
Commission laws and regulations.
K.Itshall be the duty of every person in possession,charge,or control of any dead animaloruponwhosepremisesthesamemaybelocated,to forthwithcause the same to be removedanddisposedofbythecollectorofrefuse.
L.No person shallplace theirgarbage,rubbish,refuse,solid waste,or other waste material in
the containeror garbage can of another.
Section 2.This ordinance shall take effect and be inforce five (5)days after its passage and publication of
its summary as provided by law.
