2065_00001ORDINANCE NO.2065 AN ORDINANCE CREATING MOSES LAKE MUNICIPAL CODE CHAPTER 19.55 ENTITLED "COMPREHENSIVE PLAN AND DEVELOPMENT REGULATION AMENDMENTS" THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON ORDAINS AS FOLLOWS: Section 1.Creation.There is created a new Moses Lake Municipal Code Chapter 19.55 entitled "Comprehensive Plan and Development Regulation Amendments"to provide: O 19.55.010 Purpose:The purpose of thischapter is toestablish the type of action and procedures for suggestingamendments and encouragingpublic participation for comprehensiveplan anddevelopmentregulationamendments. 19.55.020 Type of Action:Acomprehensive plan ordevelopment regulation amendment isa legislative action and shall be considered in accordance with theprocedures for such actions as setforthinthischapter. 19.55.030 Suggesting Amendments:Amendments to the comprehensive plan or development regulations may be suggested by any person,including but not limited toapplicants,citizens, hearing examiners and staff of other agencies byproviding the followingwritten information on a form approved by the Community Development Director to meet the docketing requirements of thischapter: A.Name,address and telephone number of the person,business,agency or other organization suggesting the amendment; B.Citation ofthespecifictext,map or otherillustration suggested to be amended; C.The suggested amendment; D.If a suggested amendment is to a plan or to both a plan and a development regulation,a statement ofhowthe amendment (1)promotes thepublic health,safety and welfare;(2)is consistent with or in conflict with other portions of thecomprehensiveplan;and (3)complieswithChapter 36.70A RCW,alsoknown as theGrowthManagementAct,and the Grant County countywide planning policies; O E.Ifa suggested amendment is only to the development regulations,a statement astohowtheamendmentcomplieswiththecomprehensiveplan. F.Except for a request made by a citydepartment or officer or governmental entity,afeeoftwohundreddollars($200)is required.AIIapplicants shall be responsible for the costs of any specialized studies including,but not limited to,trafficandtransportation,criticalareas and environmental impact statements associated with theirrequest. G.SEPA checklist. 19.55.040 Identified Deficiencies:Ifduring the review of any project permit application the cityidentifies any deficiencies in plans or development regulations,the identified deficiencies shall bedocketedonaformasprovidedinSection19.55.030,forpossible future plan or developmentregulationamendments."Deficiency"as used herein means the absence of required orpotentiallydesirablecontentsofacomprehensiveplanordevelopmentregulation. 19.55.050 Docketing Suggested Amendments:The Community Development Director shallcompileandmaintainforpublicreviewalistofsuggestedamendmentsand"identified deficiencies"to the comprehensive plan and the city's development regulations by appropriateclassificationandintheorderwhichsuchsuggestedamendmentswerereceived. 19.55.060 Timing and Order of Consideration of Suqqested Amendments: A.Suggested amendments tothecomprehensiveplan ordevelopment regulations shallbeconsideredatleastonceeachcalendaryear,but the comprehensive plan shallbeamendednomoreoftenthanonceeachcalendaryear,unless permitted by law,O except thatamendments may be considered more frequently for the adoption of ashorelinemasterprogram,in cases of emergency,or toresolve an appeal of anadoptedcomprehensiveplanfiledwithaGrowthManagementBoardorwiththecourt.The City Council shall initiate consideration of suggested amendments bymotionrequestingthePlanningCommissiontopreparearecommendation. B.Suggested amendments shall generally be considered bythe Planning Commissionintheorderreceived,although suggestions which concern the same property,groupofpropertiesorlandusetopicmaybecombined.AIIthe recommendations of thePlanningCommissionshallbeconsideredconcurrentlybytheCityCouncil.Beginning with items proposed for CityCouncil actionin2002,the annual deadlinesforsubmittingsuggestedplananddevelopmentregulationamendmentsshallbeJune30th,unless otherwisestated by the City Council.Allsuch requests shall beacteduponwithinforty-five(45)days of theirreceipt.Beginning withitems proposedforCityCouncilactionin2003,theannual deadline for submitting suggested plan amendments and suggested development regulation amendments shall be March 31",unless otherwisestated bythe City Council. C.The Planning Commission and City Council shall endeavor to consider suggestedplanamendmentsbetweenJanuaryandJuneandsuggesteddevelopment regulations between July and December of each year.Where amendments to both a plan and development regulations are suggested,or where an amendmentto the comprehensive plan would be implemented by an amendmentto the development regulations,such amendments may be considered concurrently. D.As appropriate,where an amendment of the comprehensive plan is granted by theCityCouncilandasubsequentrezoneoramendmenttodevelopmentregulationsis required,the Planning Commission mayconsiderthemandmake recommendations to the City Council for consideration concurrent with the final approval of the comprehensiveplan. 19.55.070 Public Participation:The public shall be made aware of the opportunity to suggest amendments andtocommenton suggested amendments throughmethodsincluding but not limited to direct mailings,newsletterand newspaper articles,legal advertisements,andnoticespostedinpublicplaces.Public notice requirements shall be as set forth in section 18.72.020 of thiscode. Section 2.Effective Date.This ordinance shall be in fullforce and effect five days after its passage and publication of its summary as provided by law.
