AN ORDINANCE CREATING A PUBLIC FACILITIES DISTRICT PURSUANT TO RCW 35.57,INCLUDINGTHE AUTHORITY TO ACQUIRE,CONSTRUCT,OWN,FINANCE,ANDOPERATE AREGIONALCENTER
WHEREAS,The CityofMoses Lake isa municipal corporation operated as a non-charter codecity,organizedandexistingunderandbyvirtueofthelawsoftheStateofWashington,and
WHEREAS,pursuant to RCW 35.57,public facilities districts may be created in any city,which district shall
be co-extensive withthe boundaries of the city,and shall be created by the legislative authorityofthe cityin
which the proposed district is located;and
WHEREAS,once a public facilities district is created by adoption of resolutions providing for the creation ofsuchdistrictbythelegislativeauthorityofthecityinwhichtheproposeddistrictislocated,the district shall be
governed by a Board of Directors,consisting offive (5)members as follows:
1.Two (2)members appointed bythe legislative authority ofthe cityto serve forfour-year staggered terms,which members shall not be members of thelegislative authority.
2.Three (3)members appointed by thelegislative authority of thecity,based on recommendations from
local organizations,to serve for four-year staggered terms;and
WHEREAS,once a public facilitiesdistrictis created and the Board ofDirectors appointed,the publicfacilitiesdistrictisauthorizedtoacquire,construct,own,remodel,maintain,equip,re-equip,repair,finance,andoperateoneormoreregionalcenters."Regional Center"means a convention,conference,or special eventscenter,oranycombinationoffacilities,andrelatedparking facilities,servingaregionalpopulation constructed,improved,or rehabilitated after the effective date of Chapter 165,Laws of 1999 (codifiedas RCW 35.57),at
a cost of at least ten milliondollars ($10,000,000)including debt service;and
WHEREAS,as authorized by state statute,RCW 82.14.390,and subject to certain restrictions,a publicfacilitiesdistrictmayimposea0.033 percent sales and use tax that is deducted from the amount of thetaxotherwiserequiredtobecollectedandpaidovertotheStateDepartmentofRevenueunderchapter82.08
or 82.12 RCW;and
WHEREAS,as authorized by state statute,Chapter35.57,and subjectto certain restrictions,a publicfacilitiesdistrictmayissue30-year general obligation bonds and may also issue 30-year revenue bonds to fund therevenue-generating facilities that itoperates,and;
WHEREAS,as authorized by state statute,RCW 35.57,and subject tocertain restrictions,a public facilities
district may impose,only ifvoter-approved,a 0.2 percent sales and use tax;and
WHEREAS,as authorized by state statute,RCW 35.57,a public facilities district may levyand fixa tax of notmorethanfivepercent(5%)or one cent on twentycents orfraction thereoftobe paid bytheperson whopaysanadmissionchargetoaregionalcenter;and
WHEREAS,the CityCouncil ofthe Cityof Moses Lake finds that it is in the public interest tocreate a publicfacilitiesdistrictco-extensive with the boundaries fo the city;and
WHEREAS,theCity Council of the CityofMoses Lake desires toset forth certain principles relating totheMosesLakePublicFacilitiesDistrictanditsBoard,Now,Therefore,
THE CITYCOUNCIL OF THE CITYOF MOSES LAKE,WASHINGTON DO ORDAINAS FOLLOWS:
Section 1.Formation of Public Facilities District:
A.Pursuantto RCW 35.57,thereis hereby created a public facilities district,to be known as the Moses LakePublicFacilitiesDistrict,co-extensivewiththe boundaries of the Cityof Moses Lake,with allthe powersandauthoritysetforthintheprovisionsofRCW35.57,including any amendments thereto,including,toacquire,construct,own,finance,and operate a reg¡onal center.
B.Members of the Board of Directors need not be residents of the Cityof Moses Lake.Members shall notincludeanymemberoftheMosesLakeCityCouncil.Members should include persons withexperienceintheconvention,hospitality,and tourismindustries.
C.The City Council declares the following principles shall apply tothe Moses Lake Public Facilities DistrictanditsBoard:
1.Pursuant tostate law,the Moses Lake Public Facilities District is authorizedtoacquire,build,own,O and operate a "regionalcenter".Regionalcenter means a convention,conference,or specialeventscenter,or combination,and related parking facilities serving a regional population,constructed at a cost of at least ten rnillion dollars ($10,000,000),including debt service.
2.Every effort shall be made to ensure that a regional center is a first class facilitythat providesbenefittothecitizensoftheCityofMosesLake,and is located withinthe Central Business District.
3.While new taxes are authorized by state legislation allowing the Moses Lake Public FacilitiesDistricttobeformed,theCouncil declares thatnew taxes shall not be utilized by the District inconnectionwitharegionalfacilitywithoutpriorconsultationandapprovaloftheMosesLakeCityCouncil.Unless otherwise approved bythe CityCouncil,the Moses Lake Public Facilities Districtfundingsourcefromtaxesitmayimposeshallbelimitedtoimposinga0.0333 percent sales andusetaxthatisdeductedformthestatesalestax(whichis not an additionaltax,but a deductionfromanexistingtaxthatwouldotherwisebepaidtothestate).
4.The CityCouncil declares its intention,consistent with and subjectto itsdetermination ofthe publicinterest,to cooperate with the Moses Lake Public Facilities District in the development andoperationofaregionalfacility.Cooperation maytake theform of providing monetary and in-kindcontributiontotheMosesLakePublicFacilitiesDistrictandenteringintointerlocalagreementsprovidingforcapitaland/or operating funding.Initially,the Council declares thattheCityShouldmakeavailableandtheMosesLakePublicFacilitiesDistrictshouldusetheservicesoftheCity'sFinanceDirectorasatreasurer,and thattheFinance Director should be an ex officiomemberoftheBoardoftheMosesLakePublicFacilitiesDistrictintheformofroutinelegalseries(fororganizationandroutinemattersforthefirstyear)and meeting room space.In addition,theCouncilrecognizesthatinorderfortheDistricttoCollectmoniesformthe0.0333 sales and usetaxre-apportionment thatitmust be matched from other public or private sources toa thirty-threepercent(33%)oftheamountcollected,and thatthe Council agrees,consistentwith and subjecttoitsdeterminationofthepublicinterest,to provide matching monies and/or other qualifyingcontributions.The Council declares thatany Citymonies contributed totheDistrictshall be subjecttothetermsofaCouncilapprovedinterlocalorotheragreementwiththeDistrict,and be limitedtohotel-motel tax receipts,unless otherwise approvedby Council.
5.The Public Facilities District shall perform a marketdemand and feasibilitystudy for thedowntown
area referenced in Section 1,Item C.2 above priorto forwarding a decision on whether to moveforwardwiththeplanningandconstructionofaregionalcenterrecommendationtotheCityCouncil.The CityCouncil willthendecide on whetherto authorize matching funds forthe purposeofmovingforwardwiththeplanningandconstructionofaregionalcenter.
6.Inconnection withthedevelopment and operation of a regionalfacility,everyeffort shallbe madetoobtainprivatefundsandtopartner,consistent with and subject to the public interest,private
developer(s),ifthisachieves public goals and maximizespublic benefit.
7.Public Facilities Districtactivity shall be done inan open,accountable,public manner consistentwithpublicinterest.The Board shallcomplywith the Open Public Meetings Act.All meetings oftheBoardshallbeopentothepublic,except when executive sessions are necessary.
8.The Public Facilities District shallreport not less thanquarterly,and otherwise as directed,to theCouncilontheDistrict's activities.The report shall include a report on all financial matters,and
other items as may be requested by the Council.
Section 2.Severability:Ifany section,subsection,sentence,clause,phrase,orwordofthisordinance should
be held tobe invalidorunconstitutionalby a courtof competent jurisdiction,such invalidityor unconstitutional-
itythereofshall not affect thevalidity or constitutionality of any other section,subsection,sentence,clause,phrase,orword of thisOrdinance.
Section 3.This ordinance shall take effect and be in force five (5)days after its passage and publication of-
its summary as provided by law.
