ANORDINANCE AMENDINGCHAPTER 12.12 OF THE MOSES LAKEMUNICIPALCODEENTITLED"SIDEWALKCONSTRUCTION"
THE CITY COUNCIL OF THE CITYOF MOSES LAKE,WASHINGTON DO ORDAIN AS FOLLOWS:
Section 1.Chapter 12.12 ofthe Moses Lake MunicipalCode entitled "Sidewalk Construction"isamended asfollows:
12.12.060 Dutyto Maintain Sidewalks:The duty and expense ofmaintaining sidewalkswithinthecorporateOlimitsofthecityinagoodstateofrepair,free from obstructions and in a clean condition,shalldevolveupontheowneroroccupierofthepropertyabuttinguponthesidewalk;Provided thattheowneroroccupierofthepropertyabuttingthesidewalkmayplaceorgivepermissiontoplaceitemssuchassmalltables,chairs,flower pots,and benches on thesidewalkin the C-1 Zone,Central Business District inthe firstthreefoot (3')area measured from the property linewherethesidewalksareninefeet(9')or greater.Advertising and signs and thelike are not permitted withthisauthorizationunlessotherwiseallowedbylaw.
Section 2.This ordinance shall take effect and be in force five (5)days after its passage and publication ofitssummaryasprovidedbylaw.
