2072_00001ORDINANCE NO.2072 AN ORDINANCE CREATING CHAPTER 13.09 OF THE MOSES LAKEMUNICIPALCODEENTITLED"CROSS-CONNECTION CONTROL" THE CITYCOUNCIL OF THE CITYOF MOSES LAKE,WASHINGTON DO ORDAIN AS FOLLOWS: Section 1,Chapter 13.09 ofthe Moses Lake Municipal Code entitled"Cross-Connection Control"is createdtoprovideasfollows: 13.09.010 Purpose:The purpose of thisordinance,in conjunction with thecurrent edition of the State ofOWashingtonAdministrativeCode246-290-490,is to protect the public water system fromcontaminationviacross-connections.Controlling and preventing cross-connections is accom-plished by either removingthecross-connectionor installing an approved backflow preventer. 13.09.020 Responsibility: A.Under theprovisions ofWAC 246-290-490,thepurveyor's(Water Division)responsibility forcross-connection control shall begin at the water supply source,include allthe public watertreatment,storage,anddistribution facilities,andend atthe pointof deliveryto theconsumer'swatersystem. B.When,in accordance withthis chapter,an approved backflow preventer is required for thesafetyofthecitywatersystem,the Water Division shall ensure that cross-connectionsbetweenthedistributionsystemandaconsumer's water system are eliminated or controlledbytheinstallationofanapprovedreducedpressurebackflowassembly(RPBA)orair gap thatprovidespremisesisolation. C.The Water Divisionshall givenotice inwriting totheproperty ownerwhen premises isolationprotectionisrequired. D.Plans shallbe submittedtotheWater Divisionfor review and approval priortotheinstallationofanyreducedpressurebackflowassemblyorairgapthatprovidespremisesisolation. E.Allapproved backflow assembly and airgap installations requiredbythe Water DivisionshallbeinspectedbyaStateCertifiedCross-Connection Control Specialist from theWater Division. F.Allreduced pressure backflow assemblies shall be tested by a Washington State certifiedtesterontheCity's approved Backflow Assembly Tester listprior tobeing placed inservice. O 13.09.030 High Health Cross-Connection Hazards Requiring an Approved Reduced Pressure BackflowAssemblyorAirGap:In addition to Table 9 of WAC 246-296-490,allwater tanker trucks,flushtrucks,onboardtanksand allothervessels supplying water toconstruction equipment or activitiesshallrequireanapprovedreducedpressurebackflowassemblyorairgap. 13.09.040 Flushing Sewers:There shall be no direct unprotected connection between a fire hydrantorotherpotablewaterconnectionandanysanitaryorstormsewerforthepurposeofflushing. 13.09.050 Use of Privately Owned Backflow Preventers on Temporary Connections:The proprietor of aprivatelyownedbackflowpreventershallsubmitacopyofthecurrent(withinthe previous 12monthperiod)backflow assembly test performed by a Washington State certified testeron theCity's approvedBackflowAssembly Tester listpriortoitbeing connected totheCitywater system.If an acceptable report showing passing results cannot be furnished,the assembly shall beretestedinaccordancewithstateandCityregulations.Test reports shall be provided totheWaterQualitySpecialistwhoadministerstheCrossConnectionControlProgram. 13.09.060 Backflow Preventer Rental Fee:When backflow preventers are required bythischapterto protecttheCity's water system and provided bythe Cityfortemporaryconnections,therentalfee shall bebilledasfollows: A.The rental fee shall be four dollars ($4)per day for the entire time thatthe renter has thebackflowpreventer,regardless ofwhether it is used or not B.Any damage to the backflow preventer while inthe possession ofthe renter shall be itemizedandincludedwiththerentalfee. 13.09.070 Installation and Maintenance: A.All costs associated with purchase,installation,inspections,testing (byWashington Statecertifiedtester),replacement,maintenance,parts,and repairs tobackflow preventers are thefinancialresponsibilityofthepropertyowner. B.Backflow preventers,used for temporaryconnections,owned and rented out by the CitywillbetestedandmaintainedbytheCity.These costs are included inthe rental fee. 13.09.080 Notice to Cease Violation:Any person,firm,or corporation found tobe violatingany provision ofthischaptershallbeservedbytheAdministrativeAuthoritywithwrittennoticestatingthenatureoftheviolationandprovidingareasonabletimelimitforthesatisfactorycorrectionthereof.Theoffendershall,within theperiod oftimestated in such notice,permanently cease allviolations. 13.09.090 Penalty for Continued Violation:Any person,firm,or corporation who continues any violationbeyondthetimelimitprovidedforinSection13.09.080 is deemed to have committed a civilinfraction,and upon conviction thereof,shall be subjectto a C-2 penalty and punishable as defined in Chapter 1.08 of the Moses Lake Municipal Code.Failure or refusal to comply shall alsoconstitutegroundsfordiscontinuingwaterservicetothepremisesuntilsuchrequirementshavebeensatisfactorilymet. Section 2.This ordinance shall takeeffect and be in force five(5)days after its passage and publication ofitssummaryasprovidedbylaw.
