AN ORDINANCEAMENDINGCHAPTER 16.16 OF THE MOSES LAKEMUNICIPALCODEENTITLED"MOVINGBUILDINGS"
THE CITY COUNCIL OF THE CITYOF MOSES LAKE,WASHINGTON DO ORDAINASFOLLOWS:
Section 1.Chapter 16.16 of theMoses Lake Municipal Code entitled "Moving Buildings"is amended asfollows:
16.16.010 Structure -Definition:Structure,as used inthischapter,means any house,building,or structureOovertenfeet(10'),in length or height,on any three sides.Any structure travelingonly on theinterstateorstateroutesthroughthecityisexemptfromthischapter.Allstructures regulated bytheWashingtonStateDepartmentofLaborandIndustriesdefinedas"manufactured homes","factory-built housing","commercial coach","recreational park trailer",or similarunits are exemptfromthischapter.
16.16.020 Permit Required toMove Structure:Nostructure shall be moved over,along,or across any street
or alley of the city unless the person moving such structure has previously secured a permit fromtheBuildingOfficial,and unless such person has a valid structure mover's license and has on filewiththecityanindemnitybondorliabilityinsuranceasprovidedinthischapter.
16.16.030 Written Application -Filinq:The application for a permit shall be filed with the BuildingOfficialatleastsevendaysbeforetheintendedmovingdate.The application shall contain information onthefollowing:
A.Description ofstructureto be moved,including size and weight;
B.Present location of structure;
C.Location towhich structure willbe moved;
D.Over what streets and/oralleys thestructure willbe moved;
E.Name of owners of structure;
F.Name of person,firm,and/or corporation doing the moving;
G.Purpose ofthe move;
H.Other information requiredby the Building Official.
16.16.040 Duties of BuildinqOfficial:
A.Upon receiving an application,the Building Official shall make or cause to be made,aninvestigationintothemannerofmovingthestructure,the inconvenience caused,the compli-
ance with allordinances of the city,laws ofthestate,and laws oftheUnited States.After theinvestigation,theBuilding Officialshall approve or reject the application.If approved,theBuildingOfficialshallinformthePublicWorksDepartment,thePolice Department,and otherinterestedpartiesofthedateoftheintendedmoveandroute(s)to be used.The BuildingOfficialshallthenissuethepermit.
B.If the application is rejected,the Building Official shall notify the applicant and specify thegroundsforrejection.The applicant may appeal thedecision totheCity Council by filing awrittenrequestwiththeBuildingOfficialwithintendaysofreceivingtherejection.
16.16.050 Fees for Permits:The fee fora permit tomove any structure shall be one hundred dollars ($100)for the first five (5)blocks or any part thereof,over which the structure is to be moved,and tendollars($10)for each additional block or part thereof.Additionally,the applicant shall reimbursethecityforanyandallexpensesitmaybeputtoinconnectionwithsuchmoving,including theexpenseofmovingitsapparatusandequipment,such as trafficlights and police and fire signals,for the passage ofsuch structure.
16.16.060 Structure Mover's License:No person or persons shall undertake to move any structure on thestreetsofthecitywithoutfirsttakingoutastructuremover's license,issued bytheBuildingOfficialonapplicationtherefor,thefee forwhich shall be fiftydollars ($50)per year.This license shall notbetransferableandshallentitletheholdertoengageinthegeneralstructuremovingbusinessinthecity,on filingan indemnity bond or certificate ofliabilityinsurance,as provided in thischapter,and upon compliance with all other provisions of this chapter.
O 16.16.070 Indemnity Bond orCertificate of LiabilityInsurance to be Filed:Itis unlawfulfor any person,firm,or corporation to undertake to moveany structure on the streets or alleys of the city unless anduntilanindemnitybondorcertificateofliabilityinsurancehasbeenfiledwiththecity,to beapprovedbytheCityAttorneyastoform,in the sum of five hundred thousand dollars singlecombinedlimitThecityshallbeindemnifiedagainstanyandalldamagetothestreets,sidewalks,gutters,and other property of the city,and against any and all damages and claims for damagesarisingdirectlyorindirectlyasaresultoftheallegedcarelessnessornegligenceofthemover,orthemover's employees.Any contractor having procured a structure mover's license may file ageneralbondorcertificateofliabilityinsurancetocoveranyandalljobsofstructuremovingoverwhichheoritshallhavesupervision,and indemnifying the cityas set forth in thissection.Thisbondorcertificateofliabilityinsuranceshallbegoodfortheperiodofthelicense,and not toexceedoneyear.Intheevent such general bond or certificate of liabilityinsurance is onfile,suchstructuremovershallnotberequiredtofileanadditionalindemnifyingbondorcertificateofliability
insurance.At alltimesthe cityshall be protected byan indemnifying bond or certificate of liability
insurance inthe sum of five hundred thousanddollars single combined limitover and above theamountofanyandallclaimsfiled,or legal actions instituted against the cityon account of alleged
negligence of such structure mover,or the mover'semployees,
16.16.080 Time and Manner of Moving:AIIstructures tobe moved pursuant tothe provisions of thischapter
shall be moved at such timesas willleast inconvenience thegeneral public,the Police Department
and other interested parties.The timeof moving willbe fixed by theBuildingOfficial.Allstructuresshallbemovedinaprudentmannerandallblocks,tackle,cable,rollers,and otherparaphernaliashallbeusedandguardedsoasnottoinjurepersonsorproperty.AII streets and other city
property shall be left in as good condition as priorto such moving.It is theduty of the structure
mover to leave thestreets clear of all rubbish or materials used for or caused by such structuremoving.Structure moversshall complywith all existing ordinances and state and federal laws
relating toand governing theremoval oftelephoneand telegraphwires when the removal is made
necessary for the movingofany structure upon any street or alley.
16.16.090 Violation -CivilPenalty:Any person violating any of the provisions of thischapter is deemed tohavecommittedacivilinfractionasprovidedinChapter1.08 ofthiscode.Violation ofthischapterbyanylicensedcontractorinthestructuremovingbusinessshallbesufficientgroundsfortherevocationofsuchlicensebytheBuildingOfficial.The Building Officialshall provide,withinthreebusinessdays,written notice tothe licensee specifying the violation.The licensee shall have therighttoappealtherevocationtotheCityCouncilwithintendaysofnoticetothelicensee.Notice
of appeal is tobe filedwith theBuilding Officialwithinthespecified period.
Section 2.This ordinance shall takeeffect and be inforce five (5)days after its passage and publication of
its summary as provided by law.
