AN ORDINANCEAMENDINGCHAPTER 16.32 OF THE MOSES LAKEMUNICIPALCODEENTITLED"RADIOANTENNA"
THE CITYCOUNCIL OF THE CITYOF MOSES LAKE,WASHINGTON DO ORDAINAS FOLLOWS:
Section 1.Chapter 16.32 ofthe Moses Lake MunicipalCode entitled"Radio Antenna"is amendedas follows:
16.32,010 Specifications for Installation:From and after the effective date of the ordinance codified in thischapter,noperson,firm,orcorporationshallinstall,construct,erect,maintain,use,orhave withinthecityanyoutsideradioantenna,mast,pole,or other structure,whether intended for use inconnectionwiththereceptionortransmissionofradio,or otherwise,whichshall be so located,O positioned or constructed that the same shall be incontact with or in dangerous proximityto,anyelectriclightorpowertransmissionlineorwire,or any telephone or telegraphline orwire,orsothatthesamemaybecomechargedwithelectricityotherthanradiofrequencyenergy,or mountedon,supported by,or attached to any chimney,flue,or smoke pipe or inserted inany vent,outlet,
or exhaust pipe or otherwise be hazardous or dangerous to persons or property.Each such
antenna or similar device shall be mounted,supported,and installed separatelyand independentofanyotherappurtenanceoraccessoryofthebuildingorstructureuponorinconnectionwithwhichthesameshallbeinstalled.
16.32.020 Permit -Fee:Nosuch radio antenna or other device as described in Section 16.32.010 shall beconstructed,erected,or installed inthecity unless a permit thereforhas first been obtained fromthecityBuildingOfficial.Applications for such permits shall be made tothe BuildingOfficialandshallbeinwriting.A fee assessed in accordance with the applicable version of the UniformBuildingCodeshallbechargedforeachsuchpermit,tobe paid at thetimeofapplication therefor.Temporary installations for the purpose of finding the best location for the antenna or for thedemonstrationofappliancesorsimilarpurposesshallfullyconformtotheordinancesofthecity,but may be made upon notice to the Community Development Director,which notice may beverbalorinwritingandshallgivetheaddressofthepremiseswheresuchinstallationisbeingmadeandthenameoftheoccupantthereof.No fee shall be payable or permit required forsuchtemporaryinstallations,but upon the same being made permanent a permit shall be obtainedthereforandfeepaidasprovidedinthissection.Notemporaryinstallation shall continue for morethanthirty(30)days and upontheexpirationofsuch timeshall be considered permanent and apermitobtainedandfeepaid.Satellite dishes under six (6)square feet inarea are exempt fromthepermitrequirements.
16.32.030 Inspection:Upon completion of theinstallation of any such antenna orsimilardevice,noticeshallbegiventotheBuildingOfficial,whereuponsuch installation shall be inspected by the BuildingOfficialoranauthorizedrepresentative.If upon inspection such installation is found to be inviolationofanyordinanceofthecity,thesame shallbe,withinten days,so alteredas tocomplywithsuchordinancesorbeentirelyremoved.
16.32.040 Amateur Broadcasting Stations:Operators of amateur radio broadcasting stations who holdlicensesforsuchstationsfromtheFederalCommunicationsCommissionshallobtainapermitandpaythefeeasprovidedinSection16.32.020 for theoriginal antenna erected foreach such station.Written notice of any change in location or structure of such original antenna or of theerection of
any other or additional antenna,which noticeshallgive the address of the premises upon whichsuchantennaislocated,the name of the occupant thereof,a brief description of the changesbeingmade,and which notice shall be signed by holderof the permit forthe originalantenna,shallbegiventotheBuildingOfficialwithinfive(5)days after such change is made,whereupon suchantennashallbeinspectedasprovidedinSection16.32.030.No fee other thanfor the originalantennashallbepayableforsuchamateurradiobroadcastingstations.
Section 2.This ordinance shall take effect and be inforce five (5)days after its passage and publication of
