ANORDINANCEAMENDINGSECTIONS 18.80.090 AND .150 OF CHAPTER 18.80OFTHEMOSESLAKEMUNICIPALCODEENTITLED"HEARINGEXAMINER"
THE CITYCOUNCIL OF THE CITYOF MOSES LAKE,WASHINGTON ORDAINS AS FOLLOWS:
Section 1.Sections 18.80.090 and 18,80.150 of Chapter 18.80 ofthe Moses Lake MunicipalCode entitled"Hearing Examiner"is amended as follows:
18.80.090 Duties:
A.The Hearing Examiner shall be empoweredto hear and decide any and all requests for avarianceofthecityzoningordinances,pursuant tothe limitations of RCW 35A.63.110(2).AnydecisionoftheHearingExaminer,on a variance,shall be final and conclusive unless suchdecisionisappealedassetfrothin18.80.150(A).The Council shallthenhear anyappeal oftheHearingExaminerwithintwenty(20)days of such request.For theCouncil to overturn adecisionoftheHearingExaminer,itwillrequire a vote of a simple majority plus one of thememberspresentattheCouncilmeeting.
B.The Hearing Examiner shall be empowered to hear and decide any and all other mattersreferredtotheHearingExaminerinthiscode.
18.80.150 Acceal of Hearinq Examiner's Decision:
A.Any party whofeels aggrievedby theExaminer's decision maysubmitan appeal inwritingtotheCommunityDevelopmentDepartmentwithinten(10)daysfrom thedate thefinaldecisionoftheHearingExaminerisrendered,requesting a review of such decision.The CommunityDevelopmentDepartmentwillsubmittheappealtotheCityCouncilforconsideration.
B.Suchappeal shall be upon therecord establishedand made atthe hearing heldbytheHearingExaminer.Whenever a decision of theHearing Examiner is reviewed bytheCouncil pursuanttothissection,other parties of record may submit written memoranda in support of theirpositions.In addition,the Councilshallalloweach side no morethan fifteen (15)minutes oforalpresentation.However,no new evidence or testimonyshall be presented totheCouncilduringsuchoralpresentation.The Council shall accept,modify,or reject any findings orconclusions,orremandthedecision oftheHearing Examiner forfurther hearing;provided thatanydecisionoftheCouncilshallbebasedontherecordofthehearingconductedbytheHearingExaminer;however,the Council may publicly request additional information of theappellantandtheHearingExamineratitsdiscretion.
C.Uponsuch writtenappeal being filedwithin thetimeperiod allotted and upon paymentoffees
as required,a reviewshallbe held bytheCouncil.Such review shall be held inaccordancewithappealproceduresadoptedbytheCouncilbyresolution.
D.Further action by theHearing Examiner shall be within thirty(30)days ofthe reconsiderationrequest.
E.Appeals of the Examiner's decision on mattersotherthana variance of thezoning ordinancesshallbeheardasprovidedintheportionofthiscodeempoweringtheHearingExaminertohearsuchmatters.
Section 2.The City Council declares that an emergency exists and this ordinance shall take effectimmediatelyasprovidedbylawupononereadingif2/3 of the entire CityCouncil present vote in favor ofpassage.
