ANORDINANCEAMENDINGSECTIONS20.03.040 AND .050 OF CHAPTER 20.03OFTHEMOSESLAKEMUNICIPALCODEENTITLED"ADMINISTRATION"
THE CITY COUNCIL OF THE CITYOF MOSES LAKE,WASHINGTON DO ORDAINAS FOLLOWS:
Section 1.Chapter20.03 ofthe Moses Lake MunicipalCode entitled"Administration"isamended as follows:
20.03.040 Planning Commission:
A.The Planning Commission shall review and make recommendations on the following
applications and subjects:
1.Amendments to Comprehensive Plan.
2.Amendments tothe SubdivisionCode,Title 17.
3.Amendments to theZoning Cade,Title 18,or the Official Map(s).
4.Amendments tothe Environmental Regulations,Title 14.
5.Applications for Short and Major Subdivision variances pursuant to Sections 17.13 and17.17,
6.Appeals of Short Subdivision applications from the Plat Administrator pursuantto Chapter17.13.
7.Appeals ofapplicationsforHomeOccupationuses pursuanttoChapter 18.55.
8.Requests forpermittingofConditionaland Unmentioned Uses pursuanttoChapter18.51.
9.Appeals of staff decisions regarding Off-Street Parking pursuant toChapter 18.54.
10.Other actions requested or remanded by the CityCouncil.
11.Rezone requests pursuant to Chapter 18.81.
12.Subdivisionvariance requests pursuant toChapters 17.40.
13.Appeals of staff actions regardingbindingsite planapplicationsand site plan approvalpermitspursuanttoChapter18.49.
B.The Planning Commissionshall review and act on thefollowingapplicationsand subjects:
1.Site Study Analysis pursuant toSection 20.08.080,
2.Habitat Management Plan Review pursuant to Section 20.08.160.
3.Appeals of Municipal Services Director actions on data analysis pursuant to Section
20.08.070.
4.Extensions or continuations of Nonconforming Uses under Chapter 18.69.
5.Appeals of staff actions regarding landscaping pursuanttoChapter 18.57.
6.Appeals ofSEPA Determinations ofNon-SignificanceorSignificance underChapter 14.06.
C.The review criteria for certain ofthe actions are contained in section20.09.020,
20.03.050 Hearing Examiner:
A.The Hearing Examiner shall review and act on the followingsubjects:
1.Requests for variances of the requirements of theCity'sZoning Code,Title 18,such asstandardsanddimensionalrequirementslikeheight,width,size,setback and yardrestrictions,subjecttothelimitations of RCW 35A.63.110(2)as now enacted or hereafteramended,pursuant toChapter 18.80.
2.Appeals oftheactions of thezoning code enforcement officials oftheCitypursuant to theOCityzoningordinances.
3.Appeals of staff decisions regarding platting deemed insufficient pursuant to Section16.04.077.
B.The review criteriaand procedures forthe Hearing Examiner are contained inChapter 18.80.
Section 2.The City Council declares that an emergency exists and this ordinance shall take effectimmediatelyasprovidedbylawupononereadingif2/3 of theentire CityCouncil present vote in favor ofpassage.
