AN ORDINANCE AMENDINGCHAPTER 8.14 OF THE MOSES LAKEMUNICIPALCODEENTITLED"NUISANCES"
THE CITYCOUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON DO ORDAINAS FOLLOWS:
Section 1.Chapter 8.14 of the Moses Lake Municipal Code entitled "Nuisances"is amended as follows:
8.14.070 Abatement by the City:
O A.In allcases where theCode Compliance Officerhas determined to proceedwithcorrection,
thenten (10)days after giving notice,thecity shall have the ability,in additiontoany otherremedyprovidedinthischapterandnotasanalternativemeansofabatementtotheexclusionofothers,to abate the nuisance identified by the Code Compliance Officer in the noticeprovidedtocorrectthenuisanceasprovidedherein.
B.Aviolation of thischapter may be subject toabatement by thefollowingmeans:
1.Summarily,bya restraining order or injunction issued by a court ofcompetent jurisdiction;or
2.Awritten notice of theCode Compliance Officersent by return receiptmail totheowner,as such appears on therolls of the county assessor,which notice shall state thattheCityCouncilwillconsiderforadoption,after not less than ten (10)days from thedate ofthatnotice,a resolution which shall describe theproperty involved by street address or parcelnumberandtheconditioninviolationofthischapterandrequiretheownertomaketheremovalordestructionofsuchcondition.Such notice shall state theowner may appearbeforetheCityCouncilatthetimeitconsiderssuchresolutionandthatwillbetheowner'sonlyopportunitytoprotesttheproposedactionoftheCityCounciltoabatethenuisanceasprovidedinthissection.Such noticeshallfurther provide thatshouldtheCityCounciladoptsuchresolutionitmaydirectthereinthedestructionorremovaloftheconditioninviolationofthischapteristobeaccomplishedbycityforcesorcontractorsandthatallcosts,direct and indirect,ofsuch work shallbe charged totheowner.Ifsuch removal ordestructionisnotmadebytheownerafterthenoticeisgiven,theCityCouncil may byresolutionpassednotlessthanten(10)daysfrom thedate ofthenotice,cause thecitytomaketheremovalordestructionthereofasprovidedhereinandprovidethatthecostthereofshallbecomeachargeagainsttheowneroftheproperty.This debt shall becollectibleinthesamemannerasanycivildebtowingtothecity.
O Section 2.The City Council declares that an emergency exists and this ordinance is deemed a public
emergency ordinance necessary for the protection of public health,public safety,public property,or p lic
peace and shall takeeffect immediately as provided by law upon one reading if2/3 ofthe entire CityCoupresentvoteinfavorofpassage.
