C.Unmetered residential water services within thecorporate limitsof the cityand outsidethecorporatelimitsofthecityshallbebaseduponthefollowingratescheduleafterJune1,2003: BillingCycle Flat Rate November throughMarch $17.90permonth AprilthroughOctober $35.80 per month 13.12.015 Dwellinqs With Two LivingUnits: A.The following shallbe themonthlyratecharged forwaterfrom thecitysystem for a dwellingwithtwo(2)separate livingunits withinthecorporate limitsofthe cityand outside thecorporatelimitsofthecitywithonlyone(1)meterservingtwo(2)livingunitsor for two(2)houses on asinglelotservedbyone(1)meter after June 1,2003: Amount Used(incubic feet)Water Rate 0-1,000 $35.80permonth Over 1,000 $.59per 100 cu.ft.or portion thereof B.The following shall be the minimum monthlyamounts charged according tothesizeofeachmeterinservicetoadwellingwithtwo(2)separate livingunits with onlyone (1)meter to theOlivingunitorfortwo(2)houses on a single lot served by one (1)meter within thecorporatelimitsofthecityandoutsidethecorporatelimitsofthecityafterJune1,2003: Meter Size Minimum Charge Water Delivered for Minimum(ininches)per Calendar Month (incubic feet) 3/4 or smaller $35.80 1,000 1 $41.70 2,000 1½$59.40 5,000 2 $147.90 20,000 13.12.020 Commercial Water Rates: A.The following shall be the monthly rate charged for water from the city water system forcommercialusersanddwellingswiththree(3)or more livingunits served by one (1)meterwithinthecorporatelimitsofthecityandoutsidethecorporatelimitsofthecityafterJune1,2003: Amount Used(incubicfeet)Water Rate 0-500 $30.20 per month Over500 $.59per 100 cu.ft.or portionthereof B.The followingshall be the minimum monthly amounts charged accordingto each meter in serviceforcommercialusers and dwellings withthree(3)or more livingunits served by one(1)meterwithinthe corporate limits ofthecityandoutside the corporate limitsofthecityafterJune1,2003: Meter Size Minimum Charge Water Delivered for Minimum (ininches)perCalendar Month (incubic feet 3/4 or smaller $30.20 500 1 $33.15 1,000 1½$42.00 2,500 2 $86.25 10,000 3 $145.25 20,000 4 $233.75 35,000 6 $322.25 50,000 8 $558.25 90,000 10 $912.25 150,000 13.12.030 Residential Sewer Rates:The followingshall be the monthly rate charged customers residing within the corporate limits ofthe city and outside thecorporate limitsofthecity for sewer service from the city sewer system for single-familydwellings and each unit of a duplex withseparate meters:flat rate,$26.25per month afterJune 1,2003, 13.12.035 Duplex Sewer Rates:The followingshall be themonthlyrate charged customers residing within thecorporate limits of thecityand outside the corporate limitsof the city forsewer service from thecitysewer system forduplexes with only one (1)meter serving two(2)livingunits or for two ,(2)livingunits on a singlelot served by one (1)meter:flat rate,$52.50per monthafter June 1, 2003, 13.12.040 Commercial Sewer Rates: A.The followingshallbe the monthlyrate charged customers residing withinthe corporate limits of thecityand outside the corporate limitsof thecityfor all chargeable water discharged into thecity sewer system by commercial users and dwellings with three (3)or more livingunits served by one (1)meter afterJune 1,2003: Amount Used (incubic feet)Sewer Rate 0-1,000 $27.60per monthminimum Over 1,000 $.96 per 100 cu ft.or portionthereof B.For purposes of calculating sewer charges,chargeable water shall be defined as follows: Chargeablewater shallbe measured bythewater consumedon the premises,whatever the source of such water,and the same willbe metered either by a public utilitymeter or oneinstalledandmaintainedbytheownerofthepremisesathisownexpenseandapprovedand inspected by the city.As an option,ifrequested by the owner of the premises,the city will install a watermeterwiththe cost for the meterand installation being paid by theowner of thepremisesinaccordancewiththechargesassessedinMLMC13.08.020 for water/sewer connections.Under such circumstances the water meter becomes the property oftheowner of thepremises and allcosts of replacementand repairare theresponsibility ofthe ownerof thepremises.In allcircumstances where thewater is metered by a privately ownedwater meter and is used to determine sewer charges,the cityshallbe allowed access tothemeter inordertoread such meter.Where theuse ofwater is such thata portion ofallthewater used does notflowintothesewer system,forwhatever reason,but is lost byevaporation,irrigation, sprinklingor is used in manufacturing or in a manufactured product,oris lost for whatever reason,and the person in control provides proof of thisfact and installs a meter orother mea- suring device approved by the citytomeasure theamountofwater so used and so lost,or if the city is capable of determining the amountof sewage enteringthecity'ssewer system by some other mechanicalmeans,thiswater maybe deducted from theactualwater consump- tionused incalculating the sewer charge. The sewer charges fortriplexesand apartments,mobile home parks,schools,hospitals andothercommercialestablishmentswithincreasedusageforirrigation,only iftheirlandscapingexceedsfivethousand(5,000)square feet,shall be computed on theaverage consumptionduringthepreviousnon-irrigation season,unless theuser elects toinstall,at his expense,anapprovedmeasuringdevicetomeasurewaternotenteringthesewersystem.When a userhasaswimmingpoolorcoolingunitsdischargingtothesanitarysewer,he must install anapprovedmetertodeterminetheamountofwaterexemptfromsewerchargesduringtheirrigationseason.The irrigation season shallbe defined as theperiod inwhichstatementsaremailedfortheAprilthroughNovemberbillingcycles. C.Sewer rates for commercial uses discharged into the sewer system may be separately O determined by theCityCouncil,based upon both volume and chemicalcharacteristicsof thesewage.The City Council reserves the privilege to require pre-treatment of any materialdischargedintotheseweragesystem,or to prohibitdischarge into the system of industrialwastesthat,because of either volume or concentration,will overload existing seweragefacilities. D.Allair<onditioning and refrigeration units thatare installed,replaced or thathave capacityincreasedaftertheeffectivedateoftheordinancecodifiedinthischaptershallberequiredtoinstallrecirculatingunits.Disposal may not be accomplished by discharging into thesanitarysewersystem. Section 2.This ordinance shall takeeffect and be inforce five (5)days after its passage and publication ofitssummaryasprovidedbylaw. Adopted by theCityCouncil and signed by its Mayor on May 13,2003.
