2124_00001ORDINANCE NO.2124 ANORDINANCE AMENDINGCHAPTER 18.32 OF THE MOSESLAKEMUNICIPALCODEENTITLED"C-2,GENERAL COMMERCIALAND BUSINESS ZONE" THE CITYCOUNClL OF THE CITYOF MOSES LAKE,WASHINGTON DOORDAINAS FOLLOWS: Section 1.Chapter18.32 oftheMoses Lake MunicipalCode entitled"C-2,General Commercial and BusinessZone"is amended as follows: 18.32.260 Structures Over Easements or Right-of-Wav:No buildingor structureshall be constructed orOplacedoverdedicatedright-of-wayorovera public easement,providedthata buildingor structuremaybeplacedoverdedicatedright-of-wayor over a public easement afterwrittenpermission isgrantedbytheCommunityDevelopmentDepartment.If it is determined,after reviewingthebuildingpermitapplication,that the publichealth,welfare,and interest is not impaired,writtenpermissionfortheencroachmentshallbegranted.The decision may be appealed pursuant toMLMC18.32.330.This section shall not be construedtoprohibit permitted signage.Awnings mayprojectovercitysidewalkwhenattachedtobuildingssitedonapropertylinesubjecttoreviewandapprovaloftheBuildingOfficial.
