2130_00001ORDINANCE NO.2130 ANORDINANCE ADOPTINGCHAPTER 18.73 OF THEMOSES LAKEMUNICIPALCODEENTITLED"CABARETSAND ADIJLTENTERTAINMENT" THECITY COUNCIL OF THE CITYOF MOSESLAKE,WASHINGTON DO ORDAINAS FOLLOWS: Section 1.Chapter18.73 of theMoses Lake Municipal Code entitled"Cabaretsand Adult Entertainment"isadoptedasfollows: 18.73.003 Puroose:It is the purpose of thisChapter to regulate adultentertainmentbusinesses topromotethehealth,safety,andgeneralwelfare ofthe citizens of Moses Lake,and toestablish reasonableOanduniformregulationsofadultentertainmentbusinesseswithintheCity.The provisionsof thisChapterhaveneitherthepurposeoreffectofimposingalimitationorrestrictiononthecontentof any communicative materials including sexually oriented materials.Similarly,itis notthe intentoreffectofthisChaptertorestrictordenyaccessbyadultstosexuallyorientedmaterialsprotectedbytheFirstAmendment,or todeny access by the distributors and exhibitorsofsexuallyorientedmaterialtotheirintendedmarketNeitherisittheintentoreffectofthisChaptertocondoneorlegitimizethedistributionofobscenematerial. 18.73.007 Findings: A.The operationofadult entertainment businesses has historically and regularly been accompa-niedbysecondary effects thatare detrimental tothepublic health,safety,moralsand generalwelfareofthecommunity.Such secondary effects include significant criminal activity andactivitiesinjurioustothepublichealth,safety,morals and general welfare of the community,detrimental effects on nearby businesses and residential areas and a decline in propertyvaluesintheareaoftheadultentertainmentbusinesses.This history of criminal and injuriousactivityincludesprostitution,narcotics and liquor law violations,breaches of the peace,assaults,employment or involvement of minors,sexual conduct between customers orbetweencustomersandentertainers,the opportunityfor the spread of sexually transmitteddiseases,use and distribution or obscenity,and thepresence withinthe industry ofindividualswithhiddenownershipinterestsandoutstandingarrestwarrants.Accordingly,thereis acompellingneedandinteresttoregulateadultentertainmentbusinessesasprovidedinthischaptertoprotectandpromotethepublichealth,safety,morals and general welfare of thecitizensofMosesLake. B.In theabsence of regulation,these activities occurregardless ofwhetheradultentertainmentispresentedinconjunctionwiththesaleofalcoholicbeverages. C.The resources available for responding to problems associated withadult entertainmentObusinessesarelimitedandaremostefficientlyandeffectivelyutilizedthroughalicensingandregulatoryprogram. D.The license fees required inthisordinance are necessary as reasonable fees imposed tohelpdefraythecostsofprocessingthelicenseapplicationsandthesubstantialexpensesincurredbyMosesLakeinregulatingtheadultentertainmentindustry. E.Licensing is a legitimate and reasonable means of accountabilityto ensure thatoperators ofadultentertainmentbusinessescomplywithreasonableregulationsandtoensurethatoperatorsdonotknowinglyallowtheirestablishmentstobeusedasplacesofillegalsexualactivityorsolicitation. F.Adult entertainmentbusinesses have historically engaged in practices that involve secretingownershipinterestsforsuchpurposesasmoneylaundering,skimming profits,and taxevasion.These hidden ownership interests have,on occasion,been held by individuals andentitiesreputedtobeinvolvedinorganizedcrime.To detect and discourage theinvolvementoforganizedcrimeintheadultentertainmentindustry,to effectivelydeploy its limited lawenforcementresources,and toeffectively protectthepublichealth,safety,morals,and generalwelfareofitscitizenry,thecitymustbe fullyapprised of the actual and controllinginterests ofadultentertainmentbusinessesandtheidentitiesandcriminalbackgroundsofpersonsresponsibleforthemanagementandcontrolofsuchbusinesses. G.To detect and discourage the involvement of organized crime in the adult entertainmentindustry,to prevent theexploitationof minors,to assure the correct identification of personsworkinginadultentertainmentbusinesses,to effectively deploy its limited law enforcementresources,and toeffectively protect the public health,safety,morals,and general welfare ofitscitizenry,the city must be fullyappraised ofthe identity,age,and criminal background ofmanagersinadultentertainmentbusinesses. O H.Itis necessaryto have a licensed manageron the premises ofan adultentertainmentbusinessduringallhoursofoperationsotherewillbeapersonresponsiblefortheoveralloperationofthebusiness,including the actions of customers,entertainers,and other employees.Tomonitortheactionsoftheseindividuals,a manager must be abletoobservethese individualsatalltimes. 1.It is necessary to license entertainers in the adult entertainment industry to prevent theexploitationofminors,to ensure that each such entertainer is an adult,toensure that suchentertainershavenotassumedafalsenamewhichwouldmakeregulationoftheentertainerdifficultorimpossible,and toensure thatsuchentertainersare not involved incriminalactivity. J.Contact between entertainers andpatrons of adult entertainment businesses facilitates sexualconduct,prostitution,transactionsinvolving controlledsubstances,and other crimes.Theconcernoverunlawfulsexualactivitiesandrelatedcrimesisalegitimatehealthconcernofthecitywhichdemandsreasonableregulationofadultentertainmentbusinessesinordertoprotectthehealthandwell-being ofthe citizens. Ordinance No.2130Page2 K.To prevent sexual conduct from occurring between entertainers and customers,customers mustbe prohibited from any stage where adultentertainmentoccurs and be prohibited from passing tips,gratuities,or other payments directly toentertainers performing on stage. L.Adult entertainmentbusinesses have historically attempted to prevent law enforcement and licensing officialsfromdetecting sexual conduct,prostitution,sale and distribution ofcontrolled substances,and other violations of law occurringon the premises by employing warning systems,maintaining a lowlevel oflighting,and other techniques.Itisnecessary,to effectively enforce thisordinance and to protect the public health,safety,morals and general welfareofthecity's citizenry,that adult entertainment businesses be required to maintain a minimum level of lighting,that warning devices and systems be prohibited,and that unannounced inspections be permitted by city licensing and law enforcement personnel. M.Adult arcades providebooths for individual viewing of live performances,videos,and films distinguished or characterized by an emphasis on nudity or sexual conduct.To detect and deter sexual conductby customers,torequiremaintenanceof clean and sanitary conditions,and toreduce thepotentialforthespread of sexually transmitteddiseases,itis necessary toregulatetheconfigurationandfacilityspecificationsofadultarcadesassetforthinthischapter, including but not limited to restricting the occupancy of a booth tooneperson. N.An adultarcade might attempt tocircumventthelimitof one person per booth by creating asmallroom,labeled a "minitheater"rather thana booth,inwhich two,three,or a small number of individuals would be able to view videos and films distinguished or characterized by anemphasisonnudityorsexualconduct.Moreover,traditional-sizedtheatersmight also show such videos or films.Customers have used both traditionaladult theaters and "minitheater" withinarcades as places toengage in sexual conduct.To detect and deter such conduct and reduce the potential forthespread ofsexuallytransmitteddiseases,it is necessary toregulate theconfiguration and facilityspecifications,as setforth inthischapter,of spaces used bymorethanoneindividualtoviewadultentertainment.Inparticular,itis necessary torequire thatany group viewingareafor such videos and filmshave a minimum of eight seats whichmay be accessed by customers without reservation inorderto prevent ordiminisha sense ofprivacy and intimacy which would be conducivetoandenablingofsexual conductbetween customers. O.To assure that minorsare not subjected toadultentertainment,itisnecessary toprohibitadult entertainment businesses from allowing adult entertainment performances,or pictorial representations ofadultentertainmentperformances displaying nudityorsexualconduct,from being visible from outside the business. P.To discourage customers of bars and other alcohol-serving businesses from moving toadult entertainmentbusinesses at twoa.m.for "afterhours"activities,and the increased likelihood of breaches of the peace and othercriminalconductthat arise from those customers,and to reduce the adverse secondary effects of adult entertainment businesses on minorsand the community,it is necessary to restrict the closing timeofadultentertainmentbusinesses. Q.The detrimental secondary effectsare serious and pose the greatest threatto the welfareof the citizens ofMoses Lake whenconductedinclose proximitytoplaces where minorsgather. The need toprotectminors fromthecriminaland otherunlawfulactivities associated with adult entertainment establishments is compelling.Regulation is necessary to ensure that adult entertainmentbusinesses are located a reasonabledistance away from places where minors regularlygather,to reduce the likelihood of minors becoming victims of crimes or gaining access to such businesses. R.Protecting the characterof residential neighborhoods is important tothewelfare ofthecitizens ofMoses Lake.Adultentertainment businesses are not compatible with residential neighbor- hoods due tothedocumented secondary effects.The setback from residential areas required by thisordinance are necessary to minimizethesesecondary effects. S.Adult entertainmentbusinesses have adverse secondary effects on theeconomic vitalityof nearbybusinesses.Adultentertainment businesses also cause declines in property values in both commercialand residentialareas thatare near such businesses. T.The adverse economic and social effects and the increased criminalactivity that adult entertainment businesses can bring to a community cannot be understated.Allowing concentration ofthese businesses only serves tofurther magnify the level ofthese secondary effects.The requirement for significant distance between these businesses willreduce these effects and willensure that no one area willbe burdened with a disproportionate number of these businesses. 18.73.010 Definitions:For thepurpose ofthisChapter and unless thecontextplainly requires otherwise,the following definitions are adopted: A."Adultcabaret or adultentertainmentbusiness"means anycommercialpremises,including any cabaret premises,towhich any member ofthepublic is invited oradmittedandwhere an entertainerprovides live adult entertainment to any member of thepublic. B."Adultentertainment"means: 1.Any exhibition,performance or dance of any typeconducted in a premises where such exhibition,pelformance,or dance involves a person who is unclothed or insuch costume, attire,or clothingas toexpose any portion ofthe female breast below thetopoftheareola or any portionofthepubicregion,anus,buttocks,vulvaor genitals,or wearing any device or coveringexposed toviewwhich simulates theappearance ofany portionof thefemale breast below thetop of the areolaor anyportionof thepubic region,anus,buttocks,vulva or genitals,or human male genitals in a discernibly turgidstate,even ifcompletelyand opaquelycovered;or OrdinanceNo.2130Page3 2.Any exhibition,performance or dance ofany type conducted in a premises where suchexhibition,performance or dance is distinguished or characterized by a predominantemphasisonthedepiction,description,simulationor relationto the following specifiedsexualactivities: a.Human genitals in a state ofsexual stimulationor arousal, b.Acts of human masturbation,sexual intercourse or sodomy,or c.Fondling or other erotictouchingof human genitals,pubic region,buttocksorfemalebreast;or O 3.Any exhibition,performance or dance which is intended tosexuallystimulateanymemberofthepublicandwhichisconductedonaregularbasisorasasubstantialpartofthepremisesactivity.This includes,but is not limited to,any such exhibition,performance ordanceperformedfor,arranged withor engaged in withfewer thanall members of thepubliconthepremisesatthattime,with separate consideration paid,either directly orindirectly,for such performance,exhibition ordance and which iscommonly referred toastabledancing,couch dancing,taxidancing,lap dancing,private dancing or straddledancing. C.Adult Entertainment Business"means an establishment towhich customers are invited orpermittedaccess,and which,for consideration of any kind,offers adult materials to suchcustomerswhenanylive,video,or filmmaterials are displayed to customers while on thepremises.Adult entertainment businesses include,but are not limited to,any adult mini-theater,adultmotionpicture theater,adult arcade,or liveadult entertainmentestablishments,as defined below. D."Adultarcade","adultpanorama theater"or "adult panorama"means any place towhich thepublicispermittedorinvitedandwherecoinoperatedorslugoperatedorelectronically,electrically,or mechanicallycontrolledstillor motion picture machines,projectors,or otherimageproducingdevicesaremaintainedtoshowimagestopersonsinboothsorviewing rooms where the images so displayed depict or describe "specifiedsexual activities"or"specifiedanatomicalareas." E."Adultmaterial"means any material,conveyed or communicatedby live performance,stillphotograph,printed or pictorial matter,motion picture film,slide,video cassette,digitalvideodisk,recorded graphic orvisual imagery,human conduct,oranyothermedium,which materialisintendedtoprovidesexualstimulationorsexualgratification,and which is distinguished orcharacterizedbyanemphasisonmatterdepicting,describing,or relating tospecified sexualactivitiesorspecifiedanatomicalareas."Adultmaterial"alsoincludes any instrument,device,orparaphernaliadesigned for use inconnection with specifiedsexual activities. F."Adult motionpicturetheater"means an enclosed or drive-in theater with a capacity of 8 ormorepersonsusedforpresentingmaterialdistinguishedorcharacterizedbyanemphasisonmattersdepicting,describing,orrelatingto"specifiedsexualactivities"or"specifiedanatomicalareas"for observationbypatronstherein. G."Adult mini theater"means an enclosed or drive-in theater used for presenting materialdistinguishedorcharacterizedbyanemphasisonmattersdepicting,describing orrelatingto"specifiedsexual activities"or"specified anatomical areas"forobservationby patronstherein, H."Adultpanorama theater"or"adultpanorama"means any placetowhichthepublic is permitted or invited and where coin operatedor slug operated or electronically,electrically,or mechani-callycontrolledstillormotionpicturemachines,projectors,or other image producing devices are maintainedtoshow images topersons in booths or viewingroomswhere the images sodisplayeddepictordescribe"specifiedsexualactivities"or "specifiedanatomicalareas." I."Applicant"means theindividualorentityseekinga cabaret license inthecityof Moses Lake. J."Applicantcontrolpersons"means all partners,corporate officers and directors and anyotherindividualsintheapplicant's business organizationwhohold a significantinterest inthe adultcabaretoradultentertainmentbusiness,based onresponsibility for management oftheadultcabaretoradultentertainmentbusiness. K."Cabaret"means anyroom,place or space whatsoever in thecity inwhich anymusic,singing,dancing,or other similar entertainment is permitted in connection with any hotel,restaurant,café,club,tavern,eating place,directly selling,serving,or providing thepublic,with or withoutcharge,food or liquor.The words "music and entertainment"as used herein,shallnot applytoradiosormechanicaldevices. L."Employee"means any and all persons,including managers,entertainers and independentcontractors,whowork in or at or render any services directly related totheoperation of anadultentertainmentbusiness. M."Entertainer means any person who provides live adult entertainment within an adultentertainmentbusinessasdefinedinthisSectionwhetherornotafeeischargedoracceptedforentertainment. N."Entertainment"means any exhibitionor dance ofany type,pantomime,modelingoranyotherperformance. O."Liquor"means allbeverages definedin RCW 66.04.200. Ordinance No.2130Page4 P."LiveAdult Entertainment Establishment"means any building orportion ofa buildingtowhich anymemberofthepublic is invited or admitted and where any employee or entertainer,on aregularbasisorasasubstantialpartofthepremisesactivity,conducts any exhibition,performance,or dance of anytypewhich contains: 1.Specified sexual activities; 2.Any display ofspecified anatomical areas;or 3.Any conduct intended to sexually stimulate any member of the public,including but not limited to any such exhibition,performance,or dance performed for,arranged with,orengagedinwithfewerthanallmembersofthepubliconthepremisesatthattime,with separate considerationpaid either directly or indirectly for such activity,and commonlyreferredtoastabledancing,couch dancing,taxidancing,lap dancing,private dancing,orstraddledancing. Q.'Manager"means anyperson who manages,directs,administers or is in chargeof theaffairs and/or conductof any portion of any activityinvolvingadultentertainmentoccurring atany adult cabaret or adult entertainment business,and includes assistant managers working with orunderthedirectionofamanagertocarryoutsuchpurposes. R."Operator"means any person applying for or operating,conducting,or maintainingany adult entertainment business. S."OperatorControl Person"means allpartners,corporate officers and directors and any other individuals inthe Operator's business organization whohold a significantinterest inthe adult entertainmentbusiness,based ontheresponsibilityformanagementof theadultentertainment business. T."Person"means any individual,partnership,corporation,trust,incorporated orunincorporated association,maritalcommunity,jointventure,governmental entity,or other entityor group of persons however organized. U."Member ofthe public"means any customer,patron,clubmember,or person,other than anemployeeasdefinedinthissection,who is invited or admitted toa cabaret. V."Public Place"means anyarea generally visibletopublieviewand includes streets,sidewalks, bridges,alleys,plazas,parks,driveways,parking lots,and automobiles,whether movingor not. W."Sexual Conduct"means any act of: 1.Sexual intercourse withinits ordinarymeaning,occurring uponany penetration,however slight; 2.Any penetration ofthe vaginaor anus,however slight,by an object; 3.Anycontact between persons,involvingthesex organs ofone person,whether clothed orunclothed,and the mouth or anus of another,whether clothed or unclothed; 4.Masturbation,manualor instrumental,of oneself orofone person by another;or 5.Touching ofthe sex organs or anus,whether clothed or unclothed,of oneself or ofone person by another. X."Specified sexual activities"means: 1.Human genitals ina state of sexual stimulation orarousal; 2.Acts ofhuman masturbation,sexual intercourse,or sodomy; 3.Fondling or other erotictouchingof human genitals,pubic region,buttocks,or female breast. Y."Specified anatomical areas"means: 1.Less thancompletelyoropaquely covered: a.Human genitals,pubic hair,vulva; b.Buttocks,anus;and Oc.Female breasts below a point immediately above the topof the areola;and 2.Human malegenitals in a discernibly turgidstate,even ifcompletelyor opaquely covered. 18.73.020 License Reguired: A.Itis unlawfulfor any person to conduct,manage or operate a cabaret unless such person is theholder of a valid and subsisting license fromthe citytodo so,obtained in the manner providedinthischapter. B.Itis unlawfulfor anyperson toconduct,manageoroperate an adult cabaretor adultentertain- mentbusiness unless such person is the holder ofa valid and subsisting license from thecity to do so,obtainedin the manner provided inthischapter. OrdinanceNo.2130Page5 C.It is unlawful for any entertainer,employee or manager to knowinglywork in or about,or toknowinglyperformanyserviceorentertainmentdirectlyrelatedtotheoperationofanunlicencedadultcabaretoradultentertainmentbusiness. D.Itis unlawfulforanyentertainerto perform inan adult cabaret or adult entertainment businessunlesssuchpersonistheholderofavalidandsubsistinglicensefromthecitytodoso. E.It is unlawful for any manager to work in an adult cabaret or adult entertainmentbusinessunlesssuchpersonistheholderofavalidandsubsistinglicensefromthecitytodoso. 18.73.030 License ProhibitedtoCertainClasses:No license shall be issued to: O A.Anatural person who has not attainedtheage of twenty-one(21)years,except thatlicenses may be issued to persons who have attainedtheage of eighteen (18)years with respect tocabaretswherenointoxicatingliquorsareservedorprovided. B.A person whose place ofbusiness isconductedbya manager or agent,unless such manageroragentpossessesthesamequalificationsrequiredofthelicensee,or in the case of amanagerofanadultcabaretoradultentertainmentbusiness,the manager has obtained amanager's license. C.A copartnership,unless allthe members thereofare qualified toobtain a license as providedinthischapter.Such license shallbe issued tothe manager or agent thereof. D.Acorporation,unless alltheofficersand directors thereofare qualifiedtoobtaina license asprovidedherein.Such license shallbe issued tothemanageror agent thereof. 18.73.040 Application: A.Cabaret License:Anyperson desiring a cabaret license required under the provisions ofthischaptershallfilewrittenapplicationwiththeCommunityDevelopmentDepartmentonformsprovidedbytheDepartmentforthatpurpose.Allapplicationsshallbe signed bythe applicantandnotarizedorcertifiedastrueunderpenaltyofperjury.A failure toprovide all informationrequiredontheformwillconstituteanincompleteapplicationandwillnotbeprocessed.TheCommunityDevelopmentDirectoruponpresentationofacompleteapplicationandbeforeactinguponthesameshallrefersuchapplicationtothepolicedepartmentforafullinvestiga-tionas tothetruthofthestatementscontained therein,and as toanyor allother matters whichwouldaidtheCommunityDevelopmentDirectorDepartmentindeterminingwhetherornotsuchapplicationshouldbegranted.After the policedepartment has reported back to theCommunityDevelopmentDirectortheresultofsuchinvestigation,and within fourteen (14)days ofthedate offilingofthecompleteapplication,iftheCommunityDevelopment DirectorissatisfiedthatthestatementscontainedinsuchapplicationaretrueandthattheapplicantOmeetsallrequirementsofthischapter,the Community Development Director shall issue thelicenseappliedfor,provided however,thatiftheapplicationdoes notmeet the requirementsofthiscode,thentheCommunity Development Director shall deny such license application. B.Adult Cabaret or Adult Entertainment Business License: 1.AIIapplications for an adult cabaret or adult entertainment business license shall besubmittedtotheCommunityDevelopmentDepartmentinthenameofthepersonorentityproposingtoconductanadultcabaretoradultentedainmentbusinessonthebusinesspremisesandshallbesignedbysuchpersonandcertifiedastrueunderpenaltyofperjury.AIIapplicationsshallbe submitted on a form supplied by the city,which shallrequirethefollowinginformation: a.For the applicant and for each applicantcontrol person,provide:Names,any aliases or previous names,driver's license number,ifany,social security number ifany,andbusiness,mailing,and residential address,and business telephone number. b.Ifa partnership,whether general or limited;and if a corporation,date and place ofincorporation,evidencethatitis in good standing under the laws ofWashington,andnameandaddressofanyregisteredagentforserviceofprocess. c.Whether theapplicantor any partner,corporate officer,or directorof theapplicantholdsanyotherlicensesunderthischapteroranylicenseforsimilaradultentertain-ment orsexuallyorientedbusiness,including motionpicture theatersand panoramas,from thecityor another city,countyor state,and ifso,thenames and addresses ofeachotherlicensedbusiness. d.A summary of the business history of the applicant and applicant control persons inowningoroperatingtheadultentertainmentorothersexuallyorientedbusinesses,O providing names,addresses and dates ofoperation for such businesses,and whetheranybusinesslicenseoradultentertainmentlicensehasbeenrevokedorsuspended,and the reason therefor, e.For the applicant and all applicant control persons,anyand allcriminal convictions orforfeitureswithinfiveyearsimmediatelyprecedingthedateoftheapplication,otherthanparkingoffensesorminortrafficinfractionsincludingthedatesofconviction,nature of the crime,name and location of court and disposition. f.For the applicantand allapplicant control persons,a description ofbusiness,occupa-tionor employment history for thethreeyears immediately preceding the date oftheapplication. Ordinance No.2130 Page 6 g.Authorization for thecity,its agents and employees toseek information toconfirm anystatementssetforthintheapplication. h.The location and doing-business-as name of the proposed adult cabaret or adult entertainmentbusiness,including a legal description ofthe property,street address, and telephonenumber,togetherwiththenameand address ofeach ownerand lessee of theproperty. i.Two(2)two-inch(2")bytwo-inch(2")color photographsof the applicant and applicant controlpersons,takenwithin six monthsofthedate of application showingonlythefull face. j.Acomplete set of fingerprints for theapplicant and each applicantcontrolperson,by Moses Lake police department employees. k.A scale drawing ordiagram showingtheconfigurationofthe premises forthe proposed adultcabaret or adult entertainment business,including a statement of thetotalfloor space occupied by the business,and marked dimensions of the interior of thepremises,Performance areas,seatingareas,manager'sofficeand stations,restroomsandserviceareasshallbeclearlymarkedonthedrawing.An applicationfor a license foranadultcabaret oradultentertainmentbusiness shall include building planswhich demonstrate conformancewith MLMC18.73.070. 2.Anapplication shall be deemed complete upontheapplicant's provisionofallinformation requestedabove,including identificationof"none"where thatisthe correct response,and theapplicant'sverification thatthe application is complete.The Community Development Director may request other information or clarification in addition tothat provided in a completeapplicationwhere necessary todetermine compliancewiththis chapter. 3.A non-refundableapplicationfee of two hundred fiftydollars ($250)must be paid at thetimeoffilinganapplicationinordertodefraythecostsofprocessingtheapplication.This is in addition toany fees imposed for other services performed by city departments for other services such as fingerprinting. 4.Each applicant-shallverify,under penalty of perjury thattheinformation containedin theapplicationistrue. 5.Ifany person or entityacquires,subsequent to theissuance of an adult cabaret or adult entertainmentbusiness license,a significant interest based onresponsibilityfor manage- ment or operation of the licensed premises or the licensed business,notice of suchacquisitionshallbeprovidedinwritingtothecityCommunityDevelopmentDepartment, no later than twenty-one(21)days following such acquisition.The notice required shall include the information required for the original adult cabaret or adult entertainment business license application. 6.The adultcabaret or adult entertainment business license,ifgranted,shall state onits face the name of the person or persons to whom it is issued,the expirationdate,the do- ing-business-asnameandtheaddressof thelicensedadultcabaretoradultentertainment business.The permit shallbe posted ina conspicuousplace at or near theentrance totheadultcabaretoradultentertainmentbusinesssothatitcanbeeasilyreadatanytimethebusinessisopen. 7.No person granted an adult cabaret or adult entertainment business license pursuant tothischaptershalloperatetheadultcabaretoradultentertainmentbusinessunderanamenotspecifiedonthelicense,nor shall any person operate an adult cabaret or adult entertainment business under any designation or at any location not specified on the license. 8.Upon receipt of the complete application and fee,the Community Development Director shall provide copies totheHealth Department,Fire Department,Police Department,and the Building Official for their investigation and review to determine compliance of the proposed adultentertainmentbusiness withthelaws and regulations which each depart- ment administers.Each department shall,withinthirty(30)days of the date of such application,inspect the application and premises and shallmake a written report tothe Community Development Director whethersuch application and premises comply withthe laws administered by each department.No license may be issued unless each depart- ment reports thatthe applicationand premises comply withthe relevant laws.Intheevent the premises is not yet constructed,thedepartments shallbase theirrecommendation as to premises compliance ontheirreview of the drawings submitted inthe application.Any adultentertainmentbusiness license approved priortopremises construction shalicontain a condition that thepremises may notopen for business until the premises have been inspected and determined to be in substantialconformance withthe drawings submitted with the application.A department shall recommend denial of a license under this subsectionifitfinds thattheproposedadult entertainment business isnot inconformance with the requirements ofthischapter or other law ineffect inthecity.Arecommendation for denial shallcite thespecific reason therefor,including applicablelaws. 9.Anadult cabaret oradultentertainmentbusiness license shall be issued bytheCommunity Development Director within thirty(30)days of the date of filinga complete license applicationand fee,unless the Community Development Director determines that theapplicanthasfailedtomeetanyoftherequirementsofthischapterorprovideany information required under this subsection or that the applicant has made a false, misleading or fraudulent statement of material fact on the applicationfor a license.The Community Development Director shallgrantan extensionof timein whichto provide Ordinance No.2130Page7 all information required for a complete.license applicationupon the request of theapplicant.IftheCommunity DevelopmentDirectorfindsthatthe applicant has failed tomeetanyoftherequirementsforissuanceofanadultcabaretoradultentertainmentbusinesslicense,theCommunityDevelopment Directorshalldeny theapplicationinwritingandshallcitethespecificreasonstherefor,including applicable law.Ifthe CommunityDevelopmentDirectorfailstoissueordenythelicensewithinthirty(30)days of the dateoffilingofacompleteapplicationandfee,the applicant shall be permitted,subject to allotherapplicablelaw,to operate the business for which the license was sought IftheCommunityDevelopmentDirectordeterminesthatthelicenseshouldhavebeendenied,the Community Development Director shall provide written noticeof such decision totheapplicantandshallscheduleahearingbeforeajudgeoftheMunicipalCourtforajudicialreviewoftheCommunityDevelopmentDirector's decision todeny thelicense.Such noticeOshallcontainawrittenstatementofthereasonswhythelicenseshouldbedeniedandshallcitethespecificreasonstherefor,including applicable laws.Atsuch judicialhearing,theCommunityDevelopmentDirectorshallsubmittheevidencereliedupontodeterminethelicenseshouldhavebeendenied,includingreports from theagencies and departmentscontactedbytheCommunityDevelopmentDirectortoreviewtheapplication.Ifthe courtdeterminestheCommunityDevelopmentDirectorhasestablishedonamoreprobablethannotbasisareasontodenythelicense,theburdenof going forward and establishingtheevidenceusedbytheCommunityDevelopmentDirectorisnotsufficienttomeetthatburdenshallshifttotheapplicantPendingsuchhearing,the applicant shall be permittedtocontinuetooperatethebusinessappliedforasprovidedabove. 10.Upon request,the Community Development Director willa schedule a pre-licensingconferencewithallpertinentCitydepartmentstoassisttheapplicantinmeetingtheregulationsandprovisionsofthisordinance. C.Adult Cabaret or Adult Entertainment Manager and Entertainer Licenses: 1.No person shallwork as a manager,assistant manager or entertainer at an adult cabaretoraduitentertainmentbusinesswithoutanentertainer'sor manager's licensefrom thecity.Each applicantfor a manager's or entertainer's license shall complete an application onformsprovidedbythecitycontainingtheinformationidentifiedbelow.A non-refundableapplicationfeeofonehundreddollars($100)shall accompany theapplication.A copyoftheapplicationshallbeprovidedtothepolicedepartmentforitsreview,investigation andrecommendation.Allapplications for a manager's orentertainer's license shall be signedbytheapplicantandcertifiedtobetrueunderpenaltyofperjury.The manager's orentertainer's license application shall require thefollowinginformation: a.The applicant'sname,home address,home telephonenumber,date and placeofbirth,fingerprints taken by Moses Lake police department employees,social securitynumber,and any stage names or nicknames used inentertaining, b.The name and address of each business at which the applicant intends towork. c.Documentation thatthe applicant has attained the age of eighteen (18)years.Any two(2)of the following shallbe accepted as documentation of age: i.A motor vehicle operator's Igense issued by any state bearing theapplicant'sphotographanddateofbirth; li.A state issued identification card bearing theapplicant's photograph and date orbirth; iii.An official passport issued by the United States ofAmerica; iv.An immigration card issued by theUnited States ofAmerica;or v.Any other identification that the city determines to be acceptable. d.Acomplete statement ofallconvictionsoftheapplicantfor any misdemeanor orfelonyviolationsinthisoranyothercity,county,or state within five (5)years immediatelyprecedingthedateoftheapplication,except parking violations or minor trafficinfractions, e.Adescription oftheapplicant'sprincipal activitiesor services tobe rendered. f.Two (2)two-inch(2")by two-inch(2")color photographs of applicant,takenwithinsix(6)months of the date ofapplicationshowingonlythefullface. O g.Authorization for the city,its agents and employees to investigate and confirm anystatementssetforthintheapplication. h.Every adult entertainer shall provide his or her license tothe adult cabaret or adultentertainmentbusinessmanagerondutyonthepremisespriortohisorherperfor-mance.The manager shall retain thelicenses oftheadult entertainers readilyavailableforinspectionbythecityatanytimeduringbusinesshoursoftheadultcabaretoradultentertainmentbusiness. 2.The CommunityDevelopment Director mayrequest additional information or clarificationwhennecessarytodeterminecompliancewiththischapter. 3.An adult cabaret or adultentertainmentmanager's or an adultentertainer'slicense shallbeissuedbytheCommunityDevelopmentDirectorwithinfourteen(14)days from thedatethecompleteapplicationandfeearereceivedunlesstheCommunityDevelopmentDirectordeterminesthattheapplicanthasfailedtoprovideanyinformationrequiredtobe Ordinance No.2130 Page 8 supplied according tothischapter,has made any false,misleading or fraudulent Ordinance No.2130 statement of material fact in the application,or has failed to meet any of the requirements for issuance ofa license under thischapter,IftheCommunity Development Director determines thatthe applicanthas failed toqualify for the license applied for,theCommunityDevelopmentDirectorshalldenytheapplicationinwritingandshallcitethe specific reasons therefor,including applicable laws.If the Community Development Director has failed toapproveordeny an application foranadultcabaretor adult entertain- ment business manager's license withinfourteen (14)days offilingofa complete applica- tion,the applicant may,subject toall other applicablelaws,commence work as an adult cabaret or adultentertainmentbusiness manager in a duly licensed adultcabaret or adult entertainment business.If the Community DevelopmentDirector determines that the license should have been denied,the CommunityDevelopment Directorshall provide written notice ofsuchdecision totheapplicantand shallschedule a hearing before a judge of the Municipal Court for a judicialreview of theCommunityDevelopment Director's decision to deny thelicense.Such noticeshallcontain a written statementof the reasons why the license should be denied and shall cite the specific reasons therefor,including applicablelaws.At such judicialhearing,the Community Development Director shall submit the evidence relied upon to determine the license should have been denied, including reports from the agencies and departments contacted by the Community Development Director to review the application.Ifthecourt determines the Community Development Director has establishedon a more probable thannot basis a reason todeny the license,the burden of going forward and establishing the evidence used by theCommunityDevelopmentDirectorisnotsufficienttomeetthatburdenshallshifttothe applicant.Pending such hearing,theapplicant maycontinuetowork as an adult cabaret oradultentertainmentbusinessmanagerinadulylicensedadultcabaretoradultentertain- ment business as providedabove. 4.An applicantfor an adult entertainer's license shall be issued a temporarylicense upon receiptofacompletelicense application andfee.Said temporarylicense willautomatically expire on thefourteenth (14th)day followingthefilingofthe complete applicationand fee, unless the Community Development Director has failed to approve or deny the license applicationin which case thetemporary license shall remain valid.Ifthe Community Development Director determines thatthelicense shouldhave been denied,theCommu- nityDevelopment Director shallprovide written notice ofsuch decision tothe applicant and shallschedule a hearing before a judge ofthe MunicipalCourtfor a judicialreviewofthe Community Development Director's decision todeny thelicense.Such notice shall contain a writtenstatement of the reasons why the license should be denied and shallcite thespecificreasonstherefor,including applicable laws.Atsuch judicialhearing,theCommu- nityDevelopment Director shallsubmit theevidence reliedupontodetermine the license shouldhave been denied,includingreports from theagencies and departments contacted by theCommunityDevelopment Director toreview theapplication.Ifthecourt determines theCommunity Development Director has established ona more probablethan not basis a reason to deny thelicense,the burden of goingforward and establishingtheevidence used by theCommunity Development Director is not sufficient to meet thatburden shall shift tothe applicant.Pending such hearing,the applicantmay continue to work as an adult entertainer in a duly licensed adult cabaret or adult entertaínment business asprovidedabove. 18.73.050 License Fees: A.Any person desiring to obtaina cabaret license shallfirst paya lícense fee of four hundred dollars ($400)per year. B.Any person desiringtoobtainan adult cabaret or adultentertainment business license shall first pay a license fee ofseven hundred dollars ($700)per year. C.Any persondesiring to obtain an adult cabaretor adultentertainmentmanager's license shall first pay a license fee of one hundred dollars ($100)per year. D.Any person desiring toobtain an adult cabaret oradultentertainment entertainer's license shall first pay a license fee ofone hundred dollars ($100)per year. 18.73,060 Apoeal: A.DenialofLicense.Anyperson aggrievedbytheaction oftheCommunity Development Director in refusing toissue or renew any license issued under thischapter shall have the rightto appeal such action to the City Council,or to such other hearing body as may hereafter be established by theCity Council for thehearing of license appeals,by filinga noticeof appeal withtheCommunityDevelopmentDepartment withinfourteen (14)days ofnotice ofthe refusal to issue or renew.The appeal shall be processed under MLMCChapter 20.11.The City Councilor other hearing body shall set a date for hearing such appeal,totake place within forty-five(45)days ofthedate of receipt of the notice ofappeal.Atsuch hearing theappellant and other interested persons mayappearand be heard,subjecttorules and regulations ofthe City Council or other hearing body.The City Council or otherhearing body shall render its decision on theappeal within fifteen (15)days followingtheclose oftheappeal hearing. B.Appeal to Superior Court.Any person aggrievedby the decision of the hearing examiner or hearing body may appeal to the superior court for a writ of review,prohibitionor mandate. 18.73.070 Standards ofConduct and Operation -Adult Cabaret or Adult Entertainment Business: A.Thefollowingstandards ofconduct must be adhered toby employeesofanyadultcabaret or adult entertainmentbusiness whileinany area inwhich members ofthepublic are allowedto be present: Ordinance No.2130Page9 1.Noemployee or entertainershall be unclothed or insuch less thanopaque and completeattire,costume orclothingso as to expose toview any portionofthefemale breast belowthetopoftheareolaoranyportionofthepubicregion,anus,buttocks,vulva or genitals,except upon a stage at least eighteen inches (18")above theimmediate floor levelandremovedatleasteightfeet(8')from thenearest member of thepublic. 2.No employee or entertainer mingling with members ofthepublic shallbe unclothed or inlessthanopaqueandcompleteattire,costume or clothing as described in subdivision 1ofthissubsection,nor shall any male employeeorentertainerat any timeappear with hisgenitalsinadiscerniblyturgidstate,even ifcompletely and opaquely covered,or wear oruseanydeviceorcoveringwhichsimulatesthesame. 3.No employee or entertainer mingling with members of thepublic shall wear or use anydeviceorcoveringexposedtoviewwhichsimulatesthebreastbelowthetopoftheareola,vulva,genitals,anus,any portion ofthepubic region,or buttocks. 4.No employeeor entertainershall caress,fondle or eroticallytouchany member ofthepublic.No employee orentertainershallencourage or permit any member ofthepublic tocaress,fondle or erotically touch any employee or entertainer. 5.No employee or entertainershall perform actual or simulated acts ofsexual conduct asdefinedinthischapter,orany act which constitutes a violationofChapter 7.48A RCW,theWashingtonMoralNuisancesStatute. 6.No employee or entertainer minglingwith membersofthepublicshall conduct any dance,performance or exhibition in or about the non-stage area of the adult cabaret or adultentertainmentbusinessunlessthatdance,performance or exhibition is performed at adistanceofnolessthanfourfeet(4')from any memberof thepublic. 7.No tiporgratuityofferedtoor accepted byanadult entertainer maybeoffered oracceptedpriortoanyperformance,dance orexhibitionprovided by theentertainer.No entertainerperforminguponanystageareashallbepermittedtoacceptanyformofgratuityoffereddirectlytotheentertainerbyanymemberofthepublic.Any gratuityoffered to anyentertainerpelforminguponanystageareamustbeplacedintoareceptacleprovidedforreceiptofgratuitiesbytheadultcabaretoradultentertainmentbusinessorprovidedthroughamanagerondutyonthepremises.Any gratuity or tip offered to any adultentertainerconductinganyperformance,dance or exhibition inoraboutthe non-stage areaoftheadultcabaretoradultentertainmentbusinessshallbeplacedintothehandoftheadultentertainerorintoareceptacleprovidedbytheadultentertainer,and not upon thepersonorintotheclothingoftheadultentertainer. O 8.No employeemayperform actual or simulatedacts of sexual conduct as defined in thischapter,or an act thatconstitutes a violationof chapter 7.48 RCW,Washington'smoralnuisancestatute,or any other provisions regulating offenses against public morals. B.At any adult cabaret or adultentertainmentbusiness,the following are required: 1.Cityemployees in theperformance oftheirduties shall be permitted into all areas ofthecabaretduringbusinesshoursanduponreasonablenoticetotheoperatorthereofforpurposesofmakinginspectionstoconfirmthecabaretisincompliancewiththischapterandallcitylawsincludingthebuildingcodesenforcedbythecityandallhealthandsafetycodes. 2.Admission must be restricted topersons of theage of eighteen (18)years or more.It isunlawfulforanyowner,operator,manager orother person in charge of an adult cabaretoradultentertainmentbusinesstoknowinglypermitorallowanypersonundertheminimumagespecifiedtobeinoruponsuchpremises. 3.Neither theperformance noranyphotograph,drawing,sketch or other pictorial orgraphicrepresentationthereofdisplayinganyportionofthebreastsbelowthetopoftheareolaoranyportionofthepubichair,buttocks,genitals,and/or anus maybe visible outside oftheadultcabaretoradultentertainmentbusiness. 4.No member ofthepublic shallbe permittedat any timeto enter into any of the nonpublicportionsoftheadultcabaretoradultentertainmentbusiness,whichshall include but arenotlimitedto:the dressing rooms of the entertainers or other rooms providedfor thebenefitofemployees,and the kitchen and storage areas;except thatpersons deliveringgoodsandmaterials,food and beverages,or performing maintenance or repairs to thepremisesorequipmentonthepremisesmaybepermittedintononpublicareastotheextentrequiredtoperformtheirjobduties. C.The responsibilities ofthemanagerof an adult cabaret or adult entertainmentbusiness shallincludebutarenotlimitedto: 1.A licensed manager shall be on duty at an adultcabaret or adult entertainment businessatalltimesadultentertainmentisbeingprovidedormembersofthepublicarepresentonthepremises.The name and license of the manager shall be prominently posted duringbusinesshours.The manager shall be responsible for verifying that any person whoprovidesadultentertainmentwithinthepremisespossessesacurrentandvalidenter-tainer'slicense, 2.The licensed manager on duty shall not be an entertainer. Ordinance No.2130 Page 10 3.The manager or an assistant manager licensed under thischapter shall maintainvisual observation of each member of thepublic at alltimes any entertainer is present orvideo or movie is showing in the publicor performance areas of the adult cabaret or adult entertainment business.Where there is morethanone performance area,or theperfor- mance area is of such size or configurationthatone manager or assistant manger is unable tovisuallyobserve,at alltimes,each adultentertainer,each employee,and each member of thepublic,a managerorassistant manager licensed underthischapter shall be provided foreach publicor performance area orportionof a public or performance area visuallyseparated from otherportions oftheadult cabaret or adult entertainmentbusiness. 4.The manager shallbe responsible for and shall assure thattheactions of members ofthe public,the adult entertainers and all other employees shallcomplywithall requirements of thischapter. D.Premises -Specifications: 1.Performance Area.The performance area of the adult cabaret or adult entertainment business where adult entertainment as described in MLMC§18.73.070.A.1 is provided shall be a stage or platform at least eighteen inches (18")in elevation above thelevel of the patron seating areas,and shall be separated by a distance ofat least eight feet (8') from allareas ofthepremises towhichmembers of thepublichave access.Acontinuous railingat least three feet (3')inheight and located at least eight feet (6')from allpoints of theperformancearea shallseparate the performance area and thepatronseatingareas.The stage and the entire interior portionof cubicles,rooms or stalls wherein adult entertainmentis providedmust be visible from the common areas ofthepremises and at least one manager'sstation.Visibilityshall not be blocked orobstructed by doors,curtains, drapes or any other obstruction whatsoever. 2.Lightina:Sufficientlightingshallbe provided and equally distributed throughoutthepublic areas of thepremises so thatallobjects are plainlyvisible at alltimes.A minimum lighting level of thirty(30)lux horizontal,measured at thirtyinches (30")fromthefloorand on tenfoot(10')centers is hereby established for allareas of theadultcabaret or adult entertain- ment business where members of the public are admitted. 3.Signg:A signat least twofeet (2')by twofeet (2'),with letters at least one inch (1")high shall be conspicuouslydisplayed inthe publicarea(s)ofthepremises statingthe following: THIS ADULTENTERTAINMENTBUSINESS18REGULATEDBYTHE CITYOF MOSES LAKE.ENTERTAINERSARE: A.NOTPERMITTED TO ENGAGEINANYTYPE OF SEXUAL CONDUCT B.NOTPERMITTED TOAPPEAR SEMI-NUDE OR NUDE,EXCEPT ON STAGE C.NOT PERMITTED TO ACCEPT TIPS OR GRATUITIES INADVANCEOF THEIR PERFORMANCE D.NOT PERMITTED TO ACCEPT TIPS DIRECTLY FROM PATRONSWHILE PER- FORMINGUPON ANYSTAGE AREA 4.Record Keepinq Reguirements: a.Allpapers,records,and thingsrequiredto be kept pursuant tothis chapter shall be open to inspection by theCityduring the hours whenthe licensed premises are openforbusiness,upontwo(2)days'writtennotice.The purpose of such inspections shall be todetermine whetherthepapers,records,and thingsmeet the requirements ofthischapter. b.Each adult entertainment business shall maintainand retain for a period oftwoyearsthename,address,and ageof each person employed orotherwiseretained orallowed toperform on the premises as an adultentertainer,including independent contractors and theiremployees,as an entertainer.This information shall be open toinspection by theCityduring hours ofoperationofthebusiness upon 24 hours'notice tothelicensee. 5.Inspections:In order to insure compliance withthis chapter all areas of licensed adult cabarets or adult entertainment business which are open to members ofthe public shall be open toinspection by cityagents and employeesduring thehours whenthe premises are open for business.The purpose of such inspections shall be to determine if thelicensedpremisesareoperatedinaccordancewiththerequirementsofthischapter.It is hereby expressly declared that unannounced inspections are necessary to insure compliance with this chapter. 6.Noperson shall operate or maintaina warning device orsystem forthe purpose ofwarning or aidingand abetting the warning of an entertainer,employee,customer,or other person that the police,health,fire or building inspector,or other public officialis approachingorenteredthepremises. E.Itis unlawful for any adultcabaretor adult entertainmentbusiness tobe operated or otherwise opentothepublic between the hours of 2:00 a.m.and 10:00 a.m. F.This chaptershall not be construed toprohibit: 1.Plays,operas,musicals,or other dramatic works thatare notobscene; Ordinance No.2130Page11 2.Classes,seminars and lectures which are held for serious scientific or educationalpurposesandwhicharenotobscene;or 3.Exhibitions,performances,expressions ordances thatare not obscene. These exemptions shall not applytothesexual conduct defined inMLMC18.73.010,orthesexualconductdescribedinRCW7.48A.010(2)(b)(ii)and (iii). G.Whether or not activity isobscene shall be judged by considerationof thefollowingfactors: 1.Whether theaverage person,applying contemporary communitystandards,wouldfindthattheactivitytakenasawholeappealstoaprurientinterestinsex;and 2.Whetherthe activitydepicts ordescribes ina patentlyoffensive way,as measured againstcommunitystandards,sexual conduct as described in RCW 7.48A.010(2)(b);and 3,Whether theactivitytaken as a whole lacks serious literary,artistic,political or scientificvalue. H.Location:An adult entertainment business is allowed only in theC-2 Zone.Adult entertain-ment businesses are prohibited in all other zones.Noadult entertainment business shallbelocated: 1.Within five hundred feet (500')of thefollowinguses,as measured property linetopropertyline: a.anyresidential zone; b.any public or private schoolor preschool,or any tradeor vocational schoolthatonaregularbasishasatleastonestudentundertheageofeighteen(18)years; c.any church orother religious facilityor institution; d.any park orany public facility; e.any property used for organizations,associations,facilities,and businesses whichprovide,as a substantial portionoftheiractivities,function,or business,the provisionofservicestochildrenand/oryouth,so thatthe premises of theorganization,facilityorbusinesswouldhavechildrenandyouthinattendanceoratthelocationduringapredominantportionoftheoperationalhoursofanadultentertainmentfacility; f.Anystate-licensed day care facility. 2.Within fifteen hundred feet (1500')of another adult entertainment business. 18.73.073 Mini-theaters and Motion PictureTheaters:Every mini-theater and motion picture theaterofferingadultentertainmentmustmeetthefollowingstandards: A.Seats must be equipped withimmovable armrests between theseats.Nobench seats allowingformorethanonepersoninaseatispermitted. B.Amanager orotheremployeemust walk throughthe theater portion of thebuilding atten (10)minute intervals when a film is showingand the lights are down.This employee and themanagerorownermustensurethatnosexualconductoccursinthetheater,eitherbypatronsoremployees. C.Fullhouse lights must comply with MLMC18.73.060.A,and must comeon for at least ten(10)minutes at theend ofeach feature. 18.73.076 Adult Arcades:Every adult arcade must meet the followingstandards: A.Every adult arcade must have a manager's station located in the common area of thepremises.Alladult arcade stations or booths must open tothepublic room so that the areaandoccupantinsidethebootharefullyandcompletelyvisiblebydirectlineofsighttothemanagerlocatedatthemanager'sstationwhichshallbe located at themainentrance way tothepublicroomcontainingthearcadestationsorbooths.Nocurtain,door,wall,merchandise,display rack,or other non-transparent enclosure,material,or application mayobscure in anywaythemanager's view of any portion of the activity or occupant oftheadult entertainmentestablishment. O B.The interiorof thepremises ofan adultarcade must be configured so there is an unobstructedviewfromthemanager's stationofevery area of thepremises towhichanypatron is permittedaccessexceptrestrooms.Restrooms maynot contain video reproduction equipment. C.Ifthe premises has two(2)or more managers'stations,thenthe interiorof the premises shallbeconfiguredsothereisanunobstructedviewofeveryareaofthepremisestowhichanypatronispermittedaccessfromatleastone(1)ofthe managers'stations.The view requiredinthissubsectionmustbebydirectlineof-sight from themanagers'station. D.The owners,manager,and any employees present inthepremises,must ensure thattheviewareaspecifiedinsubsectionsBandCremainsunobstructedbyanydoors,walls,merchandise,display racks,or othermaterialsatalltime,andthatno patron is permittedaccess toanyareaofthepremiseswhichhasbeendesignatedasanareainwhichpatronswillnotbepermitted. E.No viewing room may be occupied by more than one (1)person at any time. OrdinanceNo.2130 Page 12 18.73.080 License term-Assignment -Renewals: A.There shall be no proratingofthe license fees set out in MLMC18.73.050,and such licenses shallexpireonthe thirty-first(31")day of December ofeach year,except thatintheevent that theoriginal applicationis made subsequent to June 30th,then one-half(½)of the annual fee may be accepted forthe remainder of said year.Licenses issued under thischaptershallnot be assignable. B.Application for renewal of licenses issued hereunder shall be made to the Community Development Department no later thanthirty(30)days prior totheexpiration of adultcabaret or adultentertainment business licenses,and no later than fourteen (14)days prior to the expirationofcabaret licenses and adult cabaret or adultentertainment business manager and entertainer licenses.The renewal license shall beissued inthesame mannerand on payment ofthesame fees as foran original applicationunder thischapter.There shallbe assessed and collected by theCommunity Development Department,an additionalcharge,computed as a percentage of the license fee,on applicationsnot made onor before saiddate,as follows: Days Past Due Percent of License Fee 7 -30:25% 31 -60:50% 61 and over:75% C.The Community DevelopmentDirector shall renew a license upon applicationunless the CommunityDevelopment Director is aware of facts thatwould disqualify the applicant from being issued the license for which he or she seeks renewal,and furtherprovided that the applicationcomplies with all provisions of thischapter as now enacted or as the same mayhereafterbeamended. 18.73.090 License Susoension and Revocation -Hearing: A.The Community Development Director may,upon the recommendation of the chief of police orhis designee and as provided in subsection Bbelow,suspend or revoke any license issued underthe provisions ofthischapter atany timewhere thesame was procured by fraud orfalse representation of fact;or for the violationof,or failure to complywith,the provisionsof this chapter or any other similarlocal orstate lawby thelicensee or byany ofhis servants,agents or employees when thelicensee knew orshould have known ofthe violations committedby his servants,agents oremployees;orfor theconvictionofthelicensee ofanycrimeor offense involvingprostitution,promotingprostitution,or transactionsinvolving controlled substances (asthattermis defined in Chapter 69.50 RCW)committed on thepremises,or the conviction ofany of his servants,agents or employees of any crime or offense involving prostitution, promoting prostitution,ortransactionsinvolvingcontrolledsubstances (asthattermis defined inChapter69.50 RCW)committed on thepremises inwhich his cabaret is conducted when thelicensee knew orshouldhave known of theviolations committed by his servants,agents oremployees. B.A license procuredbyfraudor misrepresentation shall be revoked.Where other violationsof thischapterorotherapplicableordinances,statutes or regulations are found,the license shall be suspended for a periodof thirty(30)days upon the first such violation,ninety(90)days uponthesecond violation withina twenty-four(24)monthperiod,and revokedfor thirdand subsequent violationswithin a twenty-four(24)month period,not including periods of suspension. C.The Community Development Directorshall provide at least ten(10)days'priorwrittennotice to the licensee ofthedecision tosuspend or revoke thelicense.Such noticeshall inform the licensee ofthe righttoappeal thedecision tothehearing examiner or other hearing body and shallstate theeffective dateof such revocation or suspension and thegroundsfor revocation or suspension.The CityCouncilor other hearing body render its decision withinfifteen (15)days followingtheclose of theappeal hearing.Any person aggrievedby the decision of the CityCouncil or otherhearing body shall have theright toappeal the decision to the superíor courtby writofreview or mandatewithintwenty-one(21)days of thefilingoftheexaminefs writtendecision with the city CommunityDevelopment Department.The decision of the CommunityDevelopment Director shallbe stayed during the pendency of any appeal except as provided in subsection D below. D.Where the Moses Lake building officialor fire chief or their designees or the Grant County Health Districtfind thatany condition exists uponthe premises of a cabaret,adult cabaret or adult entertainment business which constitutesa threatofimmediate seriousinjuryor damage topersons or property,said official may immediately suspend any license issued under this chapter pending a hearing in accordance withsubsection C above.The official shall issue notice setting forth the basis for the action and the facts that constitutea threatof immediate serious injury or damage to persons or property,and informing the licensee of the right to appeal thesuspension to thehearing examineror other designated hearing body under the same appeal provisions setforthinsubsectionCabove;provided,however,thatasuspension based on threatof immediate serious injuryor damage shall not be stayedduring the pendencyofthe appeal. 18.73.100 Liquor Regulations:Any license issued pursuanttothis chapter shall be subject to any rules or regulations oftheWashingtonState Liquor Control Board relating tothesale ofintoxicating liquor. In the event of a conflict between the provisionsof thischapter and the applicable rules and regulations of the Washington State LiquorControl Board,the rules and regulations of the Washington State Liquor Control Board shall control. Ordinance No.2130Page13 18.73.110 Violationan Infraction:Anyperson violating any ofthe provisionsofthischapteris guiltyof aninfractionpunishablebyacivilpenaltyoftwothousanddollars($2,000)togetherwith allapplicableassessmentsandpenaltiesattachedtoinfractionstothefullestextentpermittedbylaw. 18.73.120 Nuisance Declared: A.Public Nuisance.Any adult cabaret or adult entertainmentbusiness operated,conducted,or maintained inviolation of thischapter orany law of thecityof Moses Lake or thestateofWashingtonshallbe,and thesame is,declared tobe unlawfuland a publicnuisance.The cityattorney may,in additiontoor in lieu of any other remedies set forth in thisOchapter,commence an action to enjoin,remove or abate such nuisance in the mannerprovidedbylawandshalltakesuchotherstepsandapplytosuchcourtorcourtsasmayhavejurisdictiontograntsuchreliefaswillabateorremovesuchpublicnuisance,andrestrainandenjoinanypersonfromoperating,conductingor maintainingan adult cabaretoradultentertainmentbusinesscontrarytotheprovisionsofthischapter. B.Moral Nuisance.Any adult cabaret oradultentertainmentbusiness operated,conductedormaintainedcontrarytotheprovisionsofChapter7.48A RCW,Moral Nuisance,shall be,and thesame is declared tobe,unlawful and a public and moral nuisance and the cityattorneymay,inadditiontoorinlieu ofanyotherremedies set forth herein,commenceanactionoractions,toabate,remove andenjoinsuch public and moralnuisance,or impose a civilpenalty,inthemanner provided by Chapter7.48A RCW. 18.73.130 Additional Enforcement:The remedies found in this chapter are not exclusive,and,thecitymayseekanyotherlegalorequitablerelief,including but not limited toenjoiningany acts orpracticeswhichconstituteorwillconstituteaviolationofanybusinesslicenseordinanceorotherregulationshereinadopted. 18.73,140 Severability:If any portion,provision,section or subsection of thischapter is found to beunenforceable,theremainingprovisions and portions ofthis chapter shallremaininfullforceandeffect. Section 2.The City Council declares that an emergency exists and this ordinance is deemed a publicemergencyordinancenecessaryfortheprotectionofpublichealth,public safety,public properly,or publicpeaceandshalltakeeffectimmediatelyasprovidedbylawupononereadingif2/3 ofthe entireCity Councilpresentvoteinfavorofpassage.
