ANORDINANCEAMENDINGTITLE 19 OF THE MOSES LAKEMUNICIPALCODEENTITLED"GROWTH MANAGEMENT"
THE CITY COUNClL OF THE CITYOF MOSES LAKE,WASHINGTONDOORDAINAS FOLLOWS:
Section 1.Title 19of theMoses Lake MunicipalCode entitled"Growth Management"is amended as follows:
Section 2.Classificationand Designation of Resource Lands and CriticalAreas and Regulations for theConservationandProtectionofResourceLandsandCriticalAreas
O 19.03.010 Statutory Authorization:The legislature of the State of Washington has,in RCW 36.70A.060,mandated local governments who planunder 36.70A.040 to adopt development regulationstoensuretheconservationandagricultural,forest and minerallands and to adopt developmentregulationsprecludinglandusesordevelopmentthatisincompatiblewithcriticalareasdesignatedunderRCW36.70A.170.
19.03.020 Findings of Fact:
A.Growth management,resource land conservation,and criticalareas protectionshare problemsrelatedtogovernmentalcostsandefficiency.
B.Sprawl and the unwise developmentof resource lands or critical areas susceptible tonaturalhazardsmayleadtoinefficientuseoflimitedpublicresources,jeopardizeenvironmentalresourcefunctionsandvalues,subject persons and property to unsafe conditions,and affecttheperceivedqualityoflife.
C.The cost to remedy theloss of resource lands orcriticalareas is greater thanconservingandprotectingthemfromlossordegradation.
D.The inherent economic,socialand cultural values ofresource lands and criticalareas shouldbeconsideredinthedevelopmentofstrategiesdesignedtoconserveandprotectsuchlands.
E.This ordinanceimplements the goalsand policies ofthe Resource Lands and Critical AreasElementoftheComprehensivePlan.
19.03.030 Purcose:It is the purpose of this ordinance to promote the public,health,safety,and generalwelfareinareasassociatedwithspecificresourcelandsandcriticalareas.Itis further intendedtopromotetheconservationofresourcelandsandpromotetheenhancementandpreservationofcriticalareasbyavoidingorminimizingadverseimpactsfromconstructionanddevelopment.O This ordinance shallalso implement the goals and policies of the State ofWashington GrowthManagementAct(s)of1990and 1991 throughtheclassificationand designation ofresource landsandcriticalareasandthedevelopmentandimplementationofregulationstoconserveresourcelandsandprotectcriticalareasinthepublic'sinterest and welfare.It is not the intent of thisordinancetodenyareasonableuseofprivateproperty,buttoassure thatdevelopmentonornearresourcelandsorcriticalareasisaccomplishedinamannerthatisenvironmentallysensitivetotheresourcesofthecommunity.
19.03.040 _Goals:
A.Classifyand designate critical areas and resource lands.
B.Conserve theinherent economic,social,and culturalvalues of resource lands.
C.Protect environmentallysensitivecritical areas and thefunctions theyperform.
D.Protect aquifer recharge areas.
E.Preserve natural forms offloodand stormwater control.
F.Protect human life and health from damage due togeologically hazardousareas.
G.Protect and maintainfish and wildlife habitat conservation areas for rare,threatenedorendangeredspecies.
H.Develop appropriate regulatory and non-regulatory options and strategies.
19.03.050 Definitions:
O A.Agricultural Lands -lands thatare not already characterizedby urban growth and are of long-term commercial significance for the commercial production of horticultural,viticultural,floricultural,dairy,apiary,vegetable,or animal products,orof berries,grain,hay,straw,turf,seed,livestock,and Christmastrees not subject toexcise tax.
B.Aauifer Recharge Areas -areas whichserve as critical groundwaterrecharge areas and whicharehighlyvulnerabletocontaminationfromintensivelanduseswithintheseareas.
C.Building Setback Line -means the distance beyond which the footprint or foundation of thebuildingorstructureshallnotextend.
D.,City-means the Cityof Moses Lake,Washington,a municipalcorporation.
E.Contaminant -means any chemical,physical,biological,or radiological material thatis notnaturallyoccurringandisintroducedintotheenvironmentbyhumanaction,accident,ornegligence.

F.Commercial Significance,Long-Term -means the growingcapacity,productivity,and soilcompositionofthelandforlong-term commercialproduction,in consideration with the land'sproximitytopopulationareas,and the possibility ofmore intense use oftheland.
G.CriticalAreas -an area or combinationof areas which includewetlands,aquifer recharge
areas,frequently flooded areas,geologically hazardous areas,and fish and wildlifehabitat
conservationareas
H.Data Maos -means a series of maps thatare maintainedby the Community DevelopmentDivisionoftheMunicipalServicesDepartmentforthepurposeofgraphicallydepictingtheboundariesofresourcelandsandcriticalareas.
I.Erosion Hazard Areas -areas which are vulnerable to erosion due to naturalcharacteristicsincludingvegetativecover,soil texture,slope gradient,orwhich have been induced byhuman
activity.Areas which have been rated as severe or very severe for building site development
on slopes by the United States Department of Agriculture SoilConservation Service Soil
Surveyfor Grant County (Jan.1984)are included withinthisdefinition.
J.Fish andWildlifeHabitat Areas -areas which,in a natural state,serve as an important habitat
for locally important species,including,but not limited to,riparianecosystems,naturally
occurringponds under twenty(20)acres;or areas in which rare,threatened,or endangered
species have a primaryassociation.
K.Freguentiv Flooded Areas -areas within the City of Moses Lake which are determined to be
at risk of having one percent (1%)or greater chance of experiencing a flood in any one (1)
year,with those areas defined and identified on the Federal Emergency Management
Administration (FEMA)Flood Insurance Rate Maps for the CityofMoses Lake.
L.GeologicallyHazardousAreas -areas designated withintheCityofMoses Lake which are not
suited for siting commercial,residential,orindustrial development because oftheirsusceptibil-
ity to erosion,sliding,earthquake,or other geologicalevents.These areas shall include
erosion hazard areas,landslide hazard areas,and seismic hazard areas.
M.Habitat Management Plan -means a report prepared by a qualified wildlifebiologist for themanagementoffishandwildlifehabitatareas.
N.Hazardous Substance -means any material thatexhibitsany ofthecharacteristics or criteria
of hazardous waste,inclusive ofwaste oiland petroleum products,and which further meets
thedefinitions of "hazardouswaste"pursuant toWAC 173-303.
O.Hillsides -geologicfeatures with slopes of fifteen percent (15%)or greater.
P.Landslide Hazard Areas -areas which are susceptibleto riskof mass movement due to acombinationofgeologic,topographic,and hydrologic factors.
Q.Mineral Lands -lands that are not already characterizedbyurban growthand are oflong-term
commercial significancefor the extraction ofaggregate and mine resources,including sand,
gravel,and valuable metallicsubstances.
R.Seismic Hazard Areas -areas which are susceptible tosevere damage from earthquakes as
a result of groundshaking,slope failure,settlement,or soil liquefaction.
S.Species of Local Importance -means a species of animal which are of local concerndue to
theirpopulationstatus ortheirsensitivitytohabitat manipulation.This termalso includes game
species.
T,Sop_e-means an inclined ground surface,theinclination of which ís expressed as a ratio orpercentage.The percentage is determinedby the followingformula:
V (Vertical Distance)/H (Horizontal Distance)x 100 =Slope %
U.Wildlife Biologist -means a person having a minimumof a Bachelor's degree in wildlife
biology,wildlife science,wildlifeecology,wildlife management,or zoology.
19.03.060 Data Maps:The data maps maintainedby the Community Development Department shall be
utilizedas a general guide todetermine the location and extent of resource lands and critical areas
within the city limits.The data maps shall be consulted when a development application is
received to determine ifthe siteis within any areas shownas resource lands or critical areas.It
shallbe theresponsibility ofthe applicantto notifythecity of anyresource lands orcritical areas
which are onornear thesite ofthe development application.The exactlocation of resource lands
and criticalareas shall be determined by a site analysis conducted by a qualified professional
using therequirementsfound within thischapter.
19.03.070 Interpretation of Data Maps:The Municipal Services Director is charged with the administration
of the City of Moses Lake Zoning Ordinance for the purpose of interpreting data maps.An
affected property owneror otherparty with standinghas a right to appeal theMunicipal Services
Director's determination tothePlanning Commission.
Alldevelopment applications are required toshow the boundary(s)ofallresource lands andcritical
areas on a scaled drawing prior tothe development application being considered complete for
processing purposes.
19.03.080 ADolicabilitv:Alldevelopment proposals located within resource lands or criticalareas shall
comply with the provisions of thischapter,including butnot exclusive to:
A.Building permitfor anynew construction

B.Any shoreline management permit as authorized under RCW 90.58.
C.Site plan review
D.Subdivision,shortsubdivision,plannedunitdevelopment,or bindingsiteplan
E.Zoningvariance orconditional use permit
19.03.090 Site Analysis:When an applicationfor development,permit,orlicense is receivedbythecity,theapplicationshallindicatewhetheranyresourcelandorcriticalareaislocatedonthesite.TheMunicipalServiceDirectororthedirector's designee shall inspect the site and evaluate theinformationprovidedbytheapplicantTheMunicipalServicesDirectorordirector's designeeshallOevaluatetheproposalandmakeadeterminationifasitestudyanalysisisrequired.Ifitis deter-mined that a site study analysis is required,the Municipal Services Director shall notify theapplicantinwritingoftherequiredstudy.A site study analysis shall include a comprehensive siteinventoryandanalysis,a discussion of the potential impacts fromtheproposed development andspecificmeasuresoralternativesdesignedtomitigateanypotentialadverseimpactsoftheapplicant's proposal on and off-site.
19.03.100 Acceals:Anydecision ofthe Municipal ServiceDirector in theadministration ofthischapter maybeappealedtothePlanningCommission.Such appeal shallbe inwritingand mustbe submittedtothecitywithinten(10)days from thedate oftheadministrator'sdecision.
19.03.110 Agricultural Lands:
A.General:Agricultural lands of long-term commercialsignificanceare identified by theUSDASoilConservationServiceclassificationsystemofprimeanduniquefarmlandssoils.Primeanduniquefarmlandsaredefinedasfollows:
1.Prime Farmlands -lands withthebest combination of physical characteristics for produc-tionand isavailable forthese uses as determined by theUSDA SollConservation Service.
2.UniqueFarmlands -lands otherthanprime farmlandthat are used fortheproduction ofspecifichighvaluefoodandfibercropsasdeterminedbytheUSDASoilConservationService.
B.Development Standards:Notapplicable,Inaccordance with RCW 36.70A.170,thecitydoesnothaveagriculturallandsoflong-term commercialsignificance.
19.03.120 Forest Lands:
O A.General:Forest lands oflong-term commercial significance are identified bytheWashingtonStateDepartmentofRevenuelandgradesscheme(WAC 458-40-530).
B.Develooment Standards:Not applicable.In accordance with RCW 36.70A.170,thecitydoesnothaveforestlandsoflong-term commercial significance.
19.03.130 Mineral Lands:
A.General:Mineral landsoflong-term commercialsignificanceare identified bytheWashingtonStateDepartmentofNaturalResources(DNR)Division of Geologyand Earth Resourcesmineralresourcelandclassificationsystem.
B.Development Standards:Notapplicable.Inaccordance with RCW 36.70A.170,thecitydoesnothaveminerallandsoflong-term commercialsignificance.
19.03.140 Aguifer Recharge Areas:
A.General:Discharge in tothe groundwater ofthecity shall not contribute contaminantsnorfacilitatedegradationofrechargeareas.Development approvals shall ensure thatall bestmanagementpracticesareemployedtoavoidcontributingpollutantsintoaquiferrechargeareas.The requirement for a site analysis shall be based on detailed information onthefollow-ing items:
1.Hydrogeologic susceptibilitytocontamination and contaminationloading potential
2.Depth togroundwater
3.Hydraulic conductivity and gradient
4.Soil (texture,permeability,and containment attenuation)
B.Development Standards:
1.A site analysis shallbe utilizedto determine the existingwater qualityfor establishing abaselinewhichshallserveasaminimumstandardthatshallnotbefurtherdegradedbyproposeddevelopment.
2.Development approvals shallensure thatallbest management practices are employedtoavoidintroducingpollutantsintotheaquifer.This includes thecomplete collection anddisposalofstormwater.
C.Hvdrogeologic Assessment Required:A hydrogeologic assessment shallbe requiredfor thefollowinglanduses:
1.Hazardous substance processing and handling

2.Hazardous waste treatment and storage facility
3.Wastewater treatmentplant sludge disposal
4.Solid waste disposal facility
D.Hydrogeologic Assessment Requirements:A hydrogeologic assessment shall be submittedbyafirm,agent or individual with documentable environmental expertise.At a minimum,thefollowingparametersshallbeconsidered:
1.Documentable informationsources
2.Geologicdata pertinent towell logs or borings used to identify information
3.Ambient groundwater quality
4.Groundwater elevation
5.Recharge potential of facilitysite
6.Currentdata on wells and any springs located within one thousand feet (1,000')of thefacility
7.Surfacewater location and potentialrecharge
8.Watersupply source for thefacility
9,Analysis and discussion oftheaffects oftheproposedproject on thegroundwaterresource
E.Findinas and Consideration ofApproval:Ahydrogeologic assessment must demonstrate that
theproposed use doesnot presenta threatofcontamination totheaquifer system.Successful
demonstration of these findings warrants approval under thissection.
19.03.150 Frequentiv Flooded Areas:
A.General:Areas which are prone toflooding and are identified ina reportconductedforthecity
by the Federal Emergency Management Administration dated January 5,1989 and areidentifiedontheFloodInsuranceRateMapsshallbesubjecttotherequirementsofthis
section.
B.Development Standards:Alldevelopment within floodhazard areas shall be subject totherequirementsofthecitymunicipalcode,Chapter 18.53 -Flood Hazard Areas.
19.03.160 Geologically Hazardous Areas:
A.General:Geologically hazardous areas are areas thatare susceptible to erosion,sliding,
earthquake,or other geologicalevents and pose a threat to thepublichealth,safety,and
welfare.The siting of residential,commercial,or industrial development withinthese areas is
a potentialhazard.These areas include steep slopes,landslide-erosion hazard areas,and
seismic hazard areas
B.Development Standards:
1.Applications for development activity within designated hillsides offifteen percent (15%)slope and greater shall be accompaniedby a geotechnicalreport prepared by a geologist
or geotechnical engineer licensed as a CivilEngineerwith the State of Washington.
2.Applications for development activitywithindesignated landslide or erosionhazard areasshallbeaccompaniedbyageotechnicalreportpreparedbyageologistorgeotechnical
engineerlicensed as a CivilEngineer with the State ofWashington.
3.Applications for development activity proposedwithindesignated seismic hazard areas
shallbe accompaniedby a geotechnical report prepared by a gealogistor geotechnical
engineer licensed as a CivilEngineer withtheState of Washington.
C.Geotechnical Report Reguirements:A geotechnical report required under thís section shall
include,at a minimum,the followinginformation:
1.Topographic maps at a minimumscale of 1:2400 (1inch =200 feet).Slope ranges shall
be clearlydelineated in increments of 15-25%,25-40%,and 40%or greater.
2.Site history,including description of prior gradingand clearing,soil instability,or slope
failure.
Ifa valid geotechnicalreporthas been prepared within the previous two(2)years for aspecificsiteandtheproposedland-use development and site conditions have not
changed,thereport may be utilizedwithoutthe requirement fora newgeotechnicalreport.
D.GeotechnicalReoort Assessment:If itis satisfactorilydemonstrated withinthegeotechnical
reportthathillsides of fifteen percent (15%)slope or greater,landslide and erosion hazard
areas,and or seismic hazard areas do notexist on thesite,the requírements of this section
shall be waived.If itis determined within thegeotechnical reportthata potentialthreatto
publichealth,safety,and welfare existsfromdevelopmentof thesite,thentheapplicant shall
prepare a geologic hazard plan.

E.Geologic Hazard Plan:The geologic hazard plan shall include discussion of the potentialimpactsfromtheproposeddevelopmentandspecificmeasuresoraltemativesdesignedtomitigateanypotentialadverseimpactsoftheapplicant's proposal on and off-site.ThePlanningCommissionshallreviewthegeologichazardplanandmakeadeterminationifthedevelopmentproposalwarrantsapproval,conditionalapproval,or denial.The PlanningCommissionshallconsiderthefollowingareasintheirdetermination:
1.Percentage ofsite proposed to be disturbed bydevelopment
2.Locationofdevelopment on site
3.Design proposed for the development
4.Constructiontype proposedfor the development
19.03.170 Fish and Wildlife Habitat Areas:
A.General:Fish and wildlifehabitat areas are thoseareas identified as being ofcriticalimpor-tancein themaintenance and preservation of fish,wildlife,and natural vegetation.Areaswhichareidentifiedorclassifiedasfishandwildlifehabitatareasshallbesubjecttotherequirementsofthissection.Fishand wildlifehabitat areas are identified as follows:
1.Areas with which federalor state endangered,threatened,and sensitive species of fish,wildlife,and plants have a primary association and which,if altered,may reduce thelikelihoodthatthespecieswillmaintainandreproduceoverthelongterm.
2.Habitats and species of local importance,including areas with state listed monitor orcandidatespeciesorfederallylistedcandidatespecieshaveaprimaryassociationandwhich,ifaltered,may reduce thelikelihood thatthe species willmaintainand reproduceoverthelongterm.
3.Naturally occurringponds undertwenty(20)acres and theirsubmerged aquaticbeds thatprovidefishorwildlifehabitat.
4.Lakes,ponds,and streams plantedwith game fish bya governmentalagency.
5.State natural area preserves and naturalresource conservationareas.
B.Development Standards:For allregulatedactivity proposed on a site which contains or iswithinthreehundredfeet(300)offish and wildlife habitat,a habitat assessment shall berequiredandshallbepreparedbyaprofessionalwildlifebiologist.The habitat assessmentshallinclude,at a minimum,the following:
1.An analysisand discussion ofspecies or habitats known orsuspected tobe located onthedevelopmentsiteandorwithinthehabitatecosystem.
2.A site planwhich clearlydelineates the criticalfishand wildlifehabitats found.
C.Habitat Assessment Review:Ahabitat assessment reviewshallbe forwarded for review andcommenttoagencieswithexpertiseorjurisdictionontheproposal,including,but not limitedto:
1.WashingtonDepartment of Wildlife
2.WashingtonDepartment of Fisheries
3.Washington Department ofNatural Resources
4.U.S.Fish and WildlifeService
Comments received fromreview agencies within forty-five (45)days of thesubmittal of theassessmentshallbeconsideredbytheMunicipalServicesDepartment.If it is determined,based upon thecomments received,thatcritical fishand wildlifehabitat does notoccur on orwithinthreehundredfeet(300')of the site,the development may proceed without anyadditionalrequirementsunderthissection.If it is determined thata criticalfishand wildlifehabitatoccursonorwithinthreehundredfeet(300ofthesite,a habitat management plan shallbeprepared.
D.Habitat Management Plan:Habitat management plans required under this section shall bepreparedbyaprofessionalwildlifebiologist.The habitat management plan shallinclude,ataminimum,the following:
1.Analysis and discussion on the project's effectson critical fish and wildlife habitat.
2.An assessment and discussion on special management recommendations which havebeendevelopedforspeciesorhabitatlocatedonthesitebyanyfederalorstateagency.
3.Proposed mitigationmeasures which could minimizeor avoid impacts.
4.Assessment and evaluation of theeffectiveness ofmitigationmeasures proposed.Uponreviewofthehabitatmanagementplanbyappropriatefederalandstateagencies,comments received from the agencies withinforty4ive (45)days ofthesubmittalof theproposedplanshallbeconsideredbythecityand,ifmitigation is recommended,maybeincorporatedintoconditionsofprojectapproval.If it is determined,based on the com-ments received,thata project or proposal willresult in the net loss of criticalfish andwildlifespecies,the project or proposalmay be denied.

E.Habitat Management Plan Review:The Planning Commission shall discuss the potential
impacts from the proposed development and specific measures or alternatives designed to
mitigate anypotential adverse impacts of the applicant's proposal on and off-site.The Plan-
ningCommissionshallreviewthehabitat management plan and make a determination ifthedevelopmentproposalwarrantsapproval,conditionalapproval,or denial.
F.Buffer Requirements:ThePlanning Commission,uponthe reviewof thehabitatmanagement
plan,shall require buffer areas based upon thehabitat management plan.The buffer areasbythePlanningCommissionwouldservetomitigateimpactstocriticalfishandwíldlifehabitat
areas.
19.03.180 Existing Structures and Develooments:Lawfullyexistingstructures built priorto theadoption of
this ordinance shall be exempt from the termsof this ordinance.Developments/subdivisions
previously approvedpriortothe adoption of thisordinance andtherequest for building permits on
lots in these developments/subdivisions shall need no additional review as required by this
ordinance for a period of five (5)years after the passage of this ordinance.Develop-
ments/subdivisionsapproved after the adoptionof thisordinance and the request for building
permitson lots inthese developments/subdivisions shallneed no additional review as requiredby
this ordinancefor a period offive (5)years after theapproval ofthedevelopment/subdivisions.
Requests forbuildingpermitson property which is unplattedshallrequirea review underthe terms
ofthisordinance.
19.03.190 Warning and Disclaimer of Liability:This ordinance does not imply that land outside resourcelandsandcriticalareasoractivitiesthatarepermittedwithinsuchareaswillbefreefromexposure
or damage resultingfrom catastrophic natural disasters whichcan,and will,occur on rare
occasions.This ordinance shall not impose or create any liabilityon the part of the City of Moses
Lake,elected or appointedofficials,and or employeesthereof,for any damages that result from
reliance on thisordinance oranyadministrativedecision lawfullymade hereunder.
Section 3.Classificationand Designation of Wetlands and Regulations fortheConservationand Protection
of Wetlands
19.06.010 Statutorv Authorization:The legislature of the State of Washington has,in RCW 36.70A.060,
mandated local governments who planunder 36.70A.040to adopt development regulations to
ensure the conservation of agricultural,forest,and mineral lands and to adopt development
regulations precluding land uses ordevelopmentthatis incompatible withcriticalareas desígnated
underRCW 36.70A.170.
19.06.020 Findings of Fact:
A.Growthmanagement,resource land conservation,andcriticalareas protection share problems
related to governmental costs and efficiency.
B.Sprawl and the unwise development ofresource lands or critical areas susceptibleto natural
hazards may lead to inefficient use of limited public resources,jeopardize environmental
resource functions and values,subjectpersons and property to unsafe conditions,andaffect
the perceived quality of life.
C.The cost to remedytheloss ofresource lands or critical areas is greaterthanconserving and
protectingthem from loss or degradation.
D.The inherent economic,social,and culturalvalues of resource lands and critical areas should
be considered in the development of strategies designed toconserve and protect such lands
E.This ordinance implements thegoalsand policies ofthe criticalareas element oftheCompre-
hensive Plan
19.06.030 Purpose:It is the purpose of this ordinance to promote the public,health,safety,and general
welfare inareas associated withwetlands.Itis further intended topromote the enhancement and
preservation of critical areas by avoiding or minimizingadverse impacts from constructionand
development.This ordinance shall also implement the goals and policiesof the State of
Washington GrowthManagement Act(s)of 1990 and 1991 throughtheclassificationand desig-
nation of wetlands andthedevelopmentand implementation of regulations toprotect wetlands in
the public's interest and welfare.It is nottheintent ofthisordinancetodeny a reasonable use of
private property,butto assure thatdevelopment on ornearwetlandsis accomplished in a manner
that is environmentallysensitive tothe resources of the community.
19.06.040 _Ggals:The general goal of theseregulations is toavoid impacts towetlandswhere such avoid-
ance is feasible and reasonable.Where such impacts are unavoidable,the standards of this
ordinance seek tominimize impacts on wetlands as a result of land development by:
A.Maintaining and enhancingthebiological and physical functions and values of wetlands.
B.Maintaining the naturalvalue of wetlands to control flooding and storm water runoff through
thestorage and regulation of natural flow.
C.Providing opportunitiesfor recreation,scientificstudy,and natural resources education.
D.Providing forreasonable buffers around wetlands in order tostabilizesoil,filter suspended
solids and excess nutrients,moderate impacts from storm water runoff,providea local habitat
forwetlandplant and animalcommunities,and to reduce or minimize intrusions from humans
and domestic animals.
E.Implementing the goals,objectives and policiesofthe State ofWashingtonGrowthManage-
mentAct,theState Environmental Policy Act,and theCityof Moses Lake's Comprehensive
Land Use Plan.

19.06.050 Definitions:

D.Clearing -means theremoval ofbrush,grass,ground cover,orothervegetative matter from
a site which exposes thesurface ofthesite.
E.CompensatoryMitigation -means mitigation for wetland losses or impacts resulting fromalterationofwetlandsand/ortheirbuffers.Itincludes,butis notlimitedto,creation,enhance-ment,and restoration
F.Creation -means the producing or formingof a wetland throughartificialmeans from anupland(non-wetland)site.
G.Designated Wetland -means those lands identified throughthe classification processestablishedbythischapter.
H.Development -means alteration (see definition for Alteration)
I.Earth/Earth Material -means naturallyoccurring rock,soil,stone,sediment,organicmaterial,orcombinationthereof.
J.Enhancement -means actions performedto improve the conditionof existing degradedwetlandsand/or buffers so that the functionsthey provide are of a higher quality(e.g.,increasing plantdiversity,increasing wildlifehabitat,installingenvironmentally compatible ero-sion controls,removing non-indigenous plant or animal species,removingfill material orgarbage,etc.).
K.Erosion -means thewearingawayoftheearth's surface as a result ofthemovement ofwind,water,or ice.
L.Excavation -means themanualand or mechanical removalof earth material or fill,
M.Existing and Onaoina Aqricultural Activities -means thoseactivitiesconducted on landsdefinedinRCW84.34.020(2),and thoseactivities involved in theproduction of crops andOlivestock,including butnotlimited tooperationand maintenanceof farm and stock ponds ordrainageditches,irrigation systems,changes between agriculturalactivities,and normaloperation,maintenance orrepairof existing serviceable structures,facilities or improved areas.Activities which bring an area into agriculturaluse are not part of an ongoing activity.Anoperationceasestobeongoingwhentheareaonwhichitwasconductedhasbeenconvertedtoanon-agricultural use or has lain idlemorethanfive(5)years andso long thatmodificationstothehydrologicalregimearenecessarytoresumeoperations,unless the idle land isregisteredinafederalorstatesoilsconservationprogram.
N.Fill/FillMaterial-means a deposit of earth material,placed by human or mechanical means,and which is not defined as solidwaste accordingtoRCW 70.95.
O._Fjlng -means theact of placing fillmaterial on anysurface.
P.Grading-means any excavating,filling,clearing,leveling,or contouring ofthe groundsurfaceofasite.
Q.In-KindMitigation-means to replace wetlands withsubstitutewetlands whose characteristicsandfunctionsandvaluesareintendedtoreplicatethosedestroyedordegradedbyaregulatedactivity.
R.Mitigation -means toavoid,minimize,or compensate foradverse wetland impacts.
S.Out-of-Kind Mitigation -means to replace wetlands whose characteristics do not closelyapproximatethosedestroyedordegradedbyaregulatedactivity.
T.Permanent Erosion Control-means continuous on-site and off-site control measures thatareneededtocontrolconveyanceordepositionofearth,turbidity,or pollutantsafter development,construction,or restoration.
U.Restoration -means the re-establishment of a viable wetland from a previously filled ordegradedwetlandsite.
V.Significant Impact -means a meaningfulchange or recognizable effect to the ecologicalfunctionandvalueofawetland,which is noticeable or measurable,resulting in a loss ofwetlandfunctionandvalue.
W.Single-Family Residenceor Dwellinq-means a buildingorstructure,or portion thereof,whichisdesignedforandusedtoprovideaplaceofresidenceforhumanhabitation.
X._Sit_g-means anyparcel orcombinationof contiguousparcels,or right-of-way or combinationofcontiguousrights-of-way under theapplicant's ownership or control where the proposedprojectimpactsawetland(s).
Y.Sjop_e-means an inclined earth surface,the inclination of which is expressed as the ratio ofhorizontaldistancetoverticaldistance,

Z.Substrate -means thesoil,sediment,decomposing organicmatter,or combination,located
on the bottom surface ofthe wetland.
AA.Utilitv Line-means pipe,conduit,cable,orother similar facilitybywhich services are conveyed
tothepublic or individual recipients.Such servicesshall include,but are notlimitedto,water
supply,electric power,gas,and communications.
BB.Wetland(s)-means areas that are inundated or saturated by surface water or groundwater
at a frequency and duration sufficient to support,and that under normalcircumstances do
support,a prevalence of vegetation typicallyadapted for life in saturated_soil conditions.
Wetlands generally include swamps,marshes,bogs,and similar areas.Wetlands do notincludethoseartificialwetlandsintentionallycreatedfromnon-wetland sites,including but not
limited to,irrigation and drainage ditches,grass lined swales,canals,detentionfacilities,re-tention facilities,wastewater treatmentfacilities,farm ponds,and landscape amenities.
However,wetlands include thosewetlands intentionally created to mitigateconversionof
wetlands.
CC.Wetland Buffer Zone -means a designated area contiguousor adjacent to a wetland thatis
required for the continued maintenance,function,and structuralstability ofthe wetland.
DD.Wetland Class -means theU.S.Fish andWildlifeServicewetland classification scheme using
a hierarchy ofsystems,subsystems,classes,and subclasses todescribe wetland types.
EE.Wetland Specialist-is a person with a minimumofa four (4)yeardegree inwildlifesciences,
biology,environmentalscience,or an equivalent academic background who also has
experiencein performingwetland delineations,analysisofwetland functions and values and
project impacts,and wetland mitigation and restoration techniques.The person must be
familiar with the Federal Manual for Identifying and Delineating Jurisdictional Wetlands,and
theCityof Moses Lake Wetlands Ordinance.
19.06.060 Data Maps:The Community Development Department shall utilize the National Wetlands
Inventory(NWI)maps andanyotherrelated information and maps as a general guide todetermine
the location and extent ofwetlands withinthe citylimits.The data maps shall be consultedwhen
a development applicationis received to determine if the site is within any areas shown aswetlands.Itshallbe theresponsibilityof theapplicant tonotifythe cityofany wetlands which are
on or near the site of thedevelopmentapplication.The location of wetlands shall be determined
by a wetlandanalysis report conducted by a wetlands specialist using the requirements found
within thischapter.
19.06.070 Interpretation of Data Maps:The CommunityDevelopment Director ischargedwiththeadminis-
trationof theCity of Moses Lake's Zoning Ordinance for the purpose of interpreting data maps.An affected property owner or other party with standing has a right to appeal the Community
Development Director's determination to thePlanning Commission which is further appealable to
theCity Council.
AIIdevelopment applications are required to show the boundary(s)of all wetlands on a scaled
drawing priortothedevelopment application being considered completeforprocessing purposes.
19.06.080 Applicabilitv;Alldevelopment proposalslocated withinoradjacenttoan affected wetland(s)shall
comply with the provisions ofthis chapter,including but not exclusiveto:
A.Building permitfor any new construction
B.Any shoreline management permit as authorizedunder RCW 90.58
C.Siteplan review
D.Subdivision,short subdivision,planned unitdevelopment,or binding site plan
E.Zoning variance or conditional use permit
19.06.090 Site Analysis:When an applicationfora development permit or license is received bythecity,the
application shall indicate whether the proposal is within twohundred feet (200')of an affected
wetland(s)area.If it is indicated on the application thatan adjacent wetland or affectedwetland
is present,a wetland analysis reportshallbe filed,unless the Division determines thata wetland
is not adjacenttoorwithinan affected wetland on thesite.Ifthedata maps and/or theapplication
do notindicate thepresence ofa wetland,but there are other indications thata wetlandmaybe
present,the CommunityDevelopment Director or designee shall make a determination whether
a wetland analysisreport shall be required.
19.06.100 Wetland Analvsis Report:Awetland analysis report shallbe submitted tothe Community Devel-
opment Department for review of a proposal for activitywhich lies adjacentto or within an affected
wetland.The purpose of the wetland analysis reportis to determine the extent and functían of
wetlands to be impacted by the proposal.
19.06.110 Acceals:Any decision of the Community Development Director in the administrationof this
chapter maybe appealedto thePlanning Commission.Such appeal shall be in writingand must
be submitted to the citywithin ten(10)days from thedate of the Director's decision,which is
further appealable to the CityCouncil.
19.06.120 Wetlands Classification and Ratings Guidelines:A wetland rating and classificationshall be
established based upon a completed delineation report prepared by a wetland specialist to
determine boundary,size,function,and value.Guidelinesfor preparing a wetland delineation
reportare defined inSection 19.06.150 ofthis chapterand theFederal Manualfor Identifyingand
Delineating Jurisdictional Wetlands.Guidelinesfor rating wetlands are defined inthe Washington
Ordinance2134Page9
State Department of Ecology Four-Tier Wetlands Rating System for Eastern Washington.Wetlands shallbe classifiedinaccordance withtheWashington Departmentof Ecology Four-TierWetlandsRatingSystemandisasfollows:
A.CategoryI Criteria:
1.Documented habitat recognized byfederal orstate agenciesforthreatenedorendangeredplant(orpotentiallyextirpatedplant),animal,or fish species;or
2.Documented Natural Heritage wetland sites or high qualitynativewetlandcommunitieswhichqualifyasNaturalHeritagewetlandsites;or
3.Documented habitatof regional(Pacific Coast)or national significanceformigratorybirds;or
4.Regionally rare native wetlandcommunities;or
5.Wetlands with irreplaceable ecological functions;or
6.Documented wetlands of local significance.
B.Categorv IICriteria:
1.Wetlands thatsatisfy no CategoryI criteriaand are;
2.Documented habitat recognized byfederal or state agencies for sensitive plant,animal,orfishspecies;or
3.Documented priorityspecies or habitats recognized by state agencies;or
4.Wetlands with significantfunctionswhich may not be adequately replicated throughcreationorrestoration;or
5.Wetlandswithsignificanthabitat value;or
6.Documented wetlands of local significance.
C.CategoryIIICriteria:
1.Wetlands that satisfy no Category I,II,or IVcriteriaand are;
2.Wetlands withsignificanthabitat value;or
3.Documentedwetlands of local significance.
D.Category IVCriteria:
1.Wetlands that satisfyno CategoryI,II,or Illcriteria and are;
2.Wetlands less thanone (1)acre and hydrologically isolated and comprisedofone (1)vegetated class that is dominatedbyone (1)species;or
3.Wetlands less thantwo(2)acres and hydrologically isolated,withone(1)vegetatedclass.
E.Category V Criteria:
1.Wetlands thatsatisfy no Category I,II,III,or IVcriteriaand are,
2.Wetlands thatare directly associated withthe shorelineofMoses Lake and comprised ofonevegetatedclassthatisdominated(greaterthaneighty (80)percent areal cover)byCattailand/or Spike Rush and thewidthof the wetland is less thanfive (5)feet.
19.06.130 Requlated Activities:AIIdevelopment proposals requiring a land-use permit or license,unlessotherwisespecificallyexemptedbySection19.06.140,shallbe regulatedpursuantto therequire-ments of thischapter.The followingregulated activitiesina wetland and or its associated bufferareasfollows:
A.Removing,excavating,disturbing,or dredging
B.Dumping,discharging or fillingwith any material.
C.Draining,flooding,or disturbingthe water level orwater table.
D.Alteration of the size of anystructure orinfrastructure except repair of an existingstructure orinfrastructure,where the existingsquare footage or foundation footprint is not altered.
E.Destruction oralterationof vegetation throughclearing,cutting,intentional burning,shading,or planting vegetation thatwould alter thenatural characteristics of a wetland.
19.06.140 Exempt Activities:The followingactivities shallbe exempt from the provisions of thischapter:
A.Existing and on-goingagriculturalactivities,as defined in thischapter.
B.Maintenance,operation,normal repair of existingroads,streets,utilitylines,and associatedstructures,providedthatreconstruction ofanysuchfacility does not extend outside thescopeofanydesignatedeasementorright-of-way.

C.Normal maintenance and reconstruction of structures,provided that reconstruction maynot
increase theexisting ground coverage.
D.Site studywork such as surveys,soil logs,and other related activitiesnecessary for the
submittal ofa land-use application.
E.Activities determined by the CommunityDevelopment Director as having minimaladverse
impact on wetlands,such as sport fishing or hunting,scientific or educational programs.
19.06.150 Wetlands Analysis Report Requirements:
A.Awetland analysis reportshallbe preparedbya qualified wetland specialistinaccordancewith
the Uniform Federal Manual for Identifying and Delineating Jurisdictional Wetlands and
submitted totheCommunity Development Department for review for any proposals adjacent
to orwithin an affectedwetland area.
B.Within forty-five (45)days of the submittal of the wetlands analysis report,theCommunity
Development Department shall determine the appropriate wetland category,buffering
requirement,and potentialmitigationbased uponthe recommendationofthewetlands report
analysis.The wetlandanalysis report shallbe fonwardedfor review and commenttoagencies
with expertiseorjurisdictionon the proposal,including,but not limited to:
1.Washington State Department of Fish and Wildlife
2.WashingtonState Department of Natural Resources
3.U.S.Fish and WildlifeService
Comments received from review agencies within forty-five (45)days ofthe wetland analysis
report shall be consideredby theCommunity Development Department.
19.06.160 BufferAreas:FollowingtheDepartment's determinationofthecategory ofwetland associatedwith
the proposal,theappropriate buffer widthsshall be determined.Wetland bufferzones shall be
evaluated for alldevelopment proposalsadjacentto a wetland(s)inorder toprotect the ecological
function and value ofthe wetland.Except as otherwise permitted by thischapter,the buffer areas
shall consistof an undisturbedarea of existingnativevegetation and non-native vegetation.The
following minimum buffer widthsshall be required for thefollowingwetlandcategories:

19.06.170 Buffer Alteration:The aforementioned buffer widths may be reduced,with the exception of
Category 5 Wetlands,ifthesite demonstrates thatthe adjacent land is,and willremain,densely
vegetated,and that the intensity of the proposed land use for the development site does not
contribute to a "netloss".The Planning Commissionshall review requests for buffer alterations
and approve,conditionallyapprove,or deny therequest based on staffcommentsand comments
received pertinent to the proposal from agencies withexpertise or jurisdictionon the proposal,
including,but not limited to:
A.Washington State Department ofWildlife
B.Washington State Department of Fisheries
C.Washington State Department ofNatural Resources
D.U.S.Fish andWildlifeService
At no time shall the minimumbuffer be less than fiftypercent (50%)ofthe widthsestablished
under thissection.
19.06.180 Permitted Uses in Buffer Areas:The followingactivities are permitted within a wetlaÀdbuffer:
A.Wells and necessary appurtenances including a pump,pump house.Access to the welland
pump house shall be allowed.
B.Liftstations and necessary appurtenances.Access totheliftstation shall be allowed.OC.Pervious trailsand associated viewing platforms.
19.06.190 Alteration ofWetlands:Alteration ofwetlands maybe allowed when allsignificantadverse impacts
towetland functions and values can be shown to be fullymitigated.
19.06.200 Mitigation Plan Submittal Requirements:Followingsubmittal of any proposed alterations to
wetland and buffer areas,theapplicantshall submit tothe department a wetland mitigation plan
substantially in the followingform:
A.Conceptual Phase:A conceptual compensatory mitigationplan shall be submitted to the
department.In cases in which environmentalreview is required,a thresholddetermination
may notbe made priortodepartment review oftheconceptualmitigationplan.The conceptual
mitigationplan shall include:

1.Generalgoalsof thecompensatory mitigationplan,includingan overallgoalof no net lossofwetlandfunctionandacreage,and tostrive for a net resource gain in wetlands overpresentconditions
2.Approximate site topographyfollowingconstruction
3.Location of proposedwetland compensationarea
4.General hydrologic patterns on thesite following construction
5.Nature of compensation,including wetlandtypes(in-kindand out-of-kind),general plantselectionandjustification,approximate projectsequencingand schedule,and approximatesizeofthenewwetlandbuffer
6.A conceptual maintenance plan
B.Detailed Phase:Following approvalof theconceptualmitigation plan by the department,adetailedmitigationplanshallbesubmittedtothedepartment.The detailed plan shall contain,at a minimum,the followingcomponents:
1.Text and map oftheexistingconditionofthe proposed compensationarea,including:
a)Existing vegetation community analysis
b)Hydrological analysis,including topography,of existingsurface and significant sub-surface flowsinto and out of the area in question
c)Soils analysis providing both Soil Conservation Service mapping and data providedbyon-site verified determinations
d)Detailed description of flora and fauna existingonthesite
e)Description of existing site conditionsinrelation tohistoric conditionsfor those siteswhichhavebeenrecentlyalteredordegraded
2.Text and map of the proposedalterations tothecompensationarea,including:
a)Relationship of theprojecttothe watershed and existing water bodies
b)Topography ofsite using one foot contourintervals
c)Water level data,including depth and duration of seasonally highwater table
d)Water flow patterns
e)Grading,fillingand excavation,including a description of imported soils
f)Irrigation requirements,ifany
g)Water pollutionmitigationmeasures duringconstruction
h)Aerial coverage of planted areas to open water areas (ifany open water is to bepresent)
i)Appropriate buffers
The compensationplanshall include detailed site diagrams,topographicmaps showingslopepercentageandfinalgradeelevations,and any other drawings appropriate toshowconstructiontechniquesoranticipatedfinaloutcome.The plan shall provide for elevationswhichareappropriateforthedesiredhabitattype(s)andwhich provide sufficient tidalprismandcirculationdata.
3.Aschedule shall be provided showing dates for beginning and completing themitigationproject,including a sequence of constructionactivities.
C.Approval of the detailedmitigation plan shall be signifiedby a notarized memorandum ofagreementsignedbytheapplicantandDirectorofthedepartment,and recorded with theGrantCountyAuditor.The agreement shall refer toallmitigation requirements fortheproject.
D.Approval of the detailed mitigation plan shall occurpriortotheissuance ofbuilding permits orOotherdevelopmentpermits.Nodevelopment activityshall occur on the site priortoapproval.Required mitigation may also be required prior to issuance of permits or priorto commencingdevelopmentactivity.Timing of required mitigation shall be determined on a case by casebasis.
19.06.210 Criteria for ComoensatoryMitigation:The applicantshalldevelop a plan thatprovides for con-struction,maintenance,monitoring,and contingencies of the replacement wetland.In addition,theapplicantand landowner shall meet thefollowingcriteria:
A.The restored,created,or enhanced wetlandshall be as persistentas the wetlanditreplaces.
B.The applicant shall demonstrate sufficient capability tocarryout the compensation project.
C.The compensation area shall be provided withpermanent protection and managementtoavoidfurtherdevelopmentordegradationandtoprovideforthelongtermpersistenceofthecompensationareaasdesigned.

19.06.220 Criteria for Compensation Location and Timine ofCompensatory Mitigation:In cases in whichit
is determined thatcompensatory mitigation is appropriate,thefollowingshallapply:
A.Compensatory mitigationshall be providedon-site,except where on-site mitigation is not
scientificallyfeasible orpractical due tophysicalfeatures ofthesite.The burden ofproof shall
be on the applicantto demonstrate thatmitigation cannot be provided on-site.
B.When compensatory mitigationcannotbe provided on-site,mitigation shall be provided inthe
immediate vicinityofand within thesame watershed as thepermittedactivity.
C.Compensatorymitigationshallduplicate theoverallvalues and standards of thewetlandtobe
replacedand shall include at 50%in-kind compensation mitigationunless itcan be demon-
strated bytheapplicantthatthe overall wetland values of themitigationarea and adjacent orconnectingwetlandscanbeenhancedbyahigherpercentageofout-of-kind mitigation.
D.Onlywhen itis determined by thedepartment thatA,B,and C above are inappropriate and/or
impractical shall off-site compensatory mitigationbe considered.
E.Mitigation projects shall be completed concurrentwith other activitieson the site,unless a
phased schedule is agreed uponbetween thedepartment and theapplicant
19.06.230 Wetland Replacement Criteria:Where wetlands are altered,theapplicant shall meettheminimum
requirements of this section.When it is proposed to alteror eliminate a wetland,theapplicant
shallbe required to replace the affected wetland.A reduction in overallwetlandarea is allowed
ifapproved by the Department.Therecommended ratiosfor replacement andor compensation
for Type 1,II,III,IV,and Vare as follows:

19.06.240 Existino Structuresand Develooments:Lawfullyexistingstructures built priorto theadoptionof
thisordinance shall be exempt from the termsof thisordinance.Developments/subdivisions
previously approved priortotheadoptionofthisordinance and the request for buildingpermits on
lots in these developments/subdivisions shall need no additional review as required by this
ordinance for a period of five (5)years after the passage of this ordinance.Develop-
ments/subdivisionsapproved after the adoptionof thisordinance and the request for building
permitson lots in these developments/subdivisions shallneed no additionalreview as requiredby
this ordinance for a periodof five (5)years afterthe approvalof the development/subdivisions.
Requests forbuildingpermits on propertywhichis unplatted shall require areviewunderthe terms
ofthisordinance.
19.06.250 Waming and Disclaimer of Liability:This ordinancedoes not implythatland outside wetlands or
activitiesthatare permittedwithinsuch areas willbe free from exposure or damage resulting from
catastrophic natural disasters whichcan,and will,occur on rare occasions.This ordinance shall
not impose or create any liabilityon the part of the City of Moses Lake,elected or appointed
officials,and/oremployeesthereof,for any damages that result from reliance on this ordinance
or anyadministrativedecision lawfullymade hereunder.
Section 4.Comprehensive Plan and Development Regulation Amendments
19.55.010 Purpose:The purpose of this chapter is to establishthe type of action and procedures for
suggesting amendments and encouraging public participation for comprehensive plan and
development regulation amendments.
19.55.020 Tvoe of Action:A comprehensive plan or development regulation amendment is a legislative
actionandshall be considered in accordance withtheproceduresfor such actionsas set forth in
thischapter.
19.55,030 Suggesting Amendments:Amendments to the comprehensiveplan ordevelopment regulations
may be suggested by any person,including but not limited to applicants,citizens,hearing
examiners and staff of other agencies by providing the followingwritten information on a form
approved by the CommunityDevelopment Director to meet the docketing requirements ofthis
chapter:
A.Name,address and telephonenumber of theperson,business,agencyorother organization
suggestingthe amendment;
B.Citationofthespecifictext,mapor other illustration suggested to be amended;
C.The suggested amendment;
D.If a suggested amendment is to a plan or to both a plan and a development regulation,a
statement of how theamendment (1)promotes the publichealth,safety and welfare;(2)is
consistent withor inconflict withotherportions ofthecomprehensive plan;and (3)complies
withChapter 36.70A RCW,also known as the Growth Management Act,and theGrant County
countywideplanning policies;

E.Ifa suggested amendment is onlytothedevelopmentregulations,a statement as tohowtheamendmentcomplieswiththecomprehensiveplan.
F.Except for a request made by a citydepartment or officer or governmental entity,a fee of twohundreddollars($200)is required.Allapplicantsshall be responsible for the costs of anyspecializedstudiesincluding,but not limited to,trafficand transportation,criticalareas andenvironmentalimpactstatementsassociatedwiththeirrequest

19.55.040 Identified Deficiencies:Ifduring the reviewof any project permit application thecity identifies anydeficienciesinplansordevelopmentregulations,theidentified deficienciesshall be docketed onaformasprovidedinSection19.55.030,for possible future plan or development regulationamendments."Deficiency"as used herein means the absence ofrequired or potentiallydesirablecontentsofacomprehensiveplanordevelopmentregulation.
19.55.050 Docketing Suggested Amendments:The Community Development Director shall compileandmaintainforpublicreviewalistofsuggestedamendmentsand"identifieddeficiencies"tothecomprehensiveplanandthecity's development regulations byappropriate classificationand intheorderwhichsuchsuggestedamendmentswerereceived.
19.55.060 Timing and Order of Consideration of Suggested Amendments:
A.Suggested amendments to the comprehensive plan or development regulations shall beconsideredatleastonceeachcalendaryear,but the comprehensiveplan shall be amendednomoreoftenthanonceeachcalendaryear,unless permittedby law,except thatamend-ments may be considered more frequentlyfor the adoption ofa shoreline master program,incasesofemergency,ortoresolve an appeal of an adopted comprehensive planfiled with aGrowthManagementBoardorwiththecourtTheCityCouncilshallinitiateconsiderationofsuggestedamendmentsbymotionrequestingthePlanningCommissiontopreparearecommendation.
B.Suggested amendments shall generallybe considered by the Planning Commission in theorderreceived,although suggestions which concern thesame property,groupof propertiesorlandusetopicmaybecombined.AIIthe recommendations ofthe Planning CommissionshallbeconsideredconcurrentlybytheCityCouncil.Beginning withitems proposed for CityCouncilactionin2002,theannual deadlines forsubmittingsuggested plan and developmentregulationamendmentsshallbeJune30th,unless otherwise stated bytheCityCouncil.AIIsuchrequestsshallbeacteduponwithinforty-five(45)days of theirreceipt.Beginning withitemsproposedforCityCouncilactionin2003,theannual deadline for submittingsuggestedplanamendmentsandsuggesteddevelopmentregulationamendmentsshallbeMarch31*,unlessotherwisestated by the CityCouncil.
C.The Planning Commission and City Council shall endeavor to consider suggested planamendmentsbetweenJanuaryandJuneandsuggesteddevelopmentregulationsbetweenJulyandDecemberofeachyear.Where amendments to both a plan and developmentregulationsaresuggested,or where an amendment to the comprehensive plan would beimplementedbyanamendmenttothedevelopmentregulations,such amendments may beconsideredconcurrently.
D.As appropriate,wherean amendment ofthecomprehensiveplan is granted bytheCityCouncilandasubsequentrezoneoramendmenttodevelopmentregulationsisrequired,thePlanningCommissionmayconsiderthemandmakerecommendationstotheCityCouncilforconsider-ationconcurrentwiththefinal approvalofthecomprehensive plan.
19.55.070 Public Participation:The public shallbe made awareof theopportunity tosuggest amendmentsandtocommentonsuggestedamendmentsthroughmethodsincludingbutnotlimitedtodirectmailings,newsletter and newspaper articles,legal advertisements,and notices posted in publicplaces.Public notice requirements shallbe as set forth in section 18.72.020 ofthiscode.
Section 2.This ordinance shall takeeffectand be inforce five (5)days after its passage and publication ofitssummaryasprovidedbylaw.
