2139_00001ORDINANCE NO.2139 ANORDINANCE AMENDINGCHAPTER 13.04 OF THEMOSESLAKEMUNICIPALCODEENTITLED"SEWER REGULATIONS" THE CITYCOUNCILOF THE CITY OF MOSES LAKE,WASHINGTON DO ORDAINAS FOLLOWS: Section 1.Chapter 13.04 of theMoses Lake Municipal Code entitled "SewerRegulations"is amended asfollows: 13.04.003 Purpose:The purpose of thischapter is toset forth uniform requirements fordischargers intotheOCityofMosesLake's PubliclyOwnedTreatment Works (POTW)and enables the CitytoprotectpublichealthinconformitywithallapplicableLocal,State and Federal laws relating thereto.Theobjectivesofthischapterare: A.To prevent the introduction of pollutants into the POTW thatwillinterferewith the normaloperationofthesystemorcontaminatetheresultingmunicipalbiosolids. B.To preventtheintroduction ofpollutants intothe POTW thatdonotreceiveadequatetreatmentinthePOTWandthatwillpassthroughthesystemintoreceivingwatersortheatmosphereorotherwisebeincompatiblewiththePOTW. C.To ensure thatthequality of the POTW biosolids is maintained at a level that allowsits useanddisposalincompliancewithapplicablestatutesandregulations. D.To improve theopportunitytorecycle and reclaim wastewater and biosolids from the POTW. E.To enable the City to comply with its State Waste Discharge Permit (SWDP)conditions,biosolids use and disposal requirements,and any other Federal or State laws to which thePOTWissubject This Chapter provides for the regulationofdischarges into theCity's POTW throughthe enforce-ment of administrative regulations. 13.04.005 Abbreviations:The followingabbreviations,when used inthisChapter,shallhave thedesignatedmeaning: BOD -Biochemical Oxygen Demand. COD -Chemical Oxygen Demand. mg/L -Milligrams Per Liter,generally interchangeable with Parts Per Million(PPM)in water treatmentcalculations. POTW -Publicly Owned Treatment Works. SIU -Significant Industrial User. SWDP -State Waste Discharge Permit. TDS -Total Dissolved Solids. TSS -Total Suspended Solids. 13.04.010 Definitions:Unless the contextspecifically indicates othenWise,the meaning of termsused inthechaptershallbeasprovidedinthissection: A."BOD"means the quantity ofoxygenutilizedin the biochemical oxidationof organic matterunderstandardlaboratoryproceduresduringfive(5)days at 20°Celsius,usually expressed as a concentration (e.g.,mg/L). B."BuildingDrain"means thatpart of thelowest horizontal pipingof a drainage system whichreceivesthedischargefromsoil,waste,and other drainage pipes inside thewalls of thebuildingandconveysittothebuildingsewerbeginningtwo(2)feet outside the buildingwall, C."Building Sewer"means theextension from the building drain to the publicsewer or otherplaceofdisposal, D."Domestic Wastewater"meanswaterthatcarries human wastes,including kitchen,bath,and O laundrywastesfrom residences,buildings,industrialestablishments,orother places,togetherwithsuchgroundwaterorsurfacewaterinfiltrationasmaybepresent. E."Domestic User"means any person who contributes,causes,or allows the discharge ofwastewaterintothePOTWthatissimilarinvolumeand/or chemical make-up to domesticwastewater. F."Garbage"means solidwastes from the preparation,cooking,and dispensing of food;andfromthehandling,storage,and sale of produce. G."Industrial User"means any non-domestic source of wastewater discharged tothe POTW. Ordinance No.2139 Page 2 H."Industrial Wastewater"means water or liquid-carried waste from industrial or commercial processes.These wastes may result fromany process oractivityofindustry,manufacture,trade,or business;from thedevelopment ofanynaturalresource;orfrom animal operations such as feed lots,poultry houses,or dairies. I."Interference"means a discharge by an industrial user,alone or in conjunction with dis- charges by other sources,thatinhibits or disrupts the POTW,its treatmentprocesses,oroperations,or its biosolids processes,use,or disposal;and that causes a violation of anyrequirementoftheCity's SWDP in accordance with Local,State,and Federal regulations. J."May"means permissive as allowed by theCity Manager,City Council,Municipal Services Director,or the DOE. K."Medical Waste"means isolation wastes,infectious agents,human blood and blood products,pathologicalwastes,sharps,body parts,contaminatedbedding,surgicalwastes,potentially contaminatedlaboratory wastes,and dialysiswastes. L "Municipal Services Director"is the director who is responsible to the City Manager formanagementofthePublicWorksDivisionandtheEngineeringDivision,thesupervisionof departmentalemployees,andfortheeffective administration,construction,and developmentofpublicworks,engineering,and related publicfacilities.The Municipal Services Director maydesignate representatives toassist him/her inthe performance of these duties. M."Natural Outlet"means any outlet into a watercourse,pond,ditch,lake,or other body ofsurfacewaterorgroundwater. N."Noncontact Cooling Water"means water used for cooling that does not come into direct contact with any raw material,chemical,intermediate product,waste product,or finished product. O."Owner,"includes anypartowner,jointowner,tenantin common,jointtenant,tenantbytheentirety,of thewhole,or a partofsuch buildingor land. P."Pass Through"means a discharge that exitsthePOTW intowaters oftheUnitedStates in quantities or concentrations,alone or inconjunctionwithadischarge or discharges fromother sources,thatcause a violationofany requirementof theCity'sSWDP,including an increase in themagnitude or duration ofa violation. Q."Person"means anyindividual,firm,company,association,society,corporation,or group. R "pH"means a measurement oftheacidity or alkalinity ofa solution,expressed in standard units. S."POTW"includes any devices or systems used inthecollection,storage,treatment,recycling, and reclamation ofmunicipalsewage orindustrial wastes of a liquidnatureand anyconvey- ances thatconvey wastewater toa POTW Treatment Plant. T "Pretreatment Standards"meansgeneral discharge prohibitions,City's specific limitations on discharge,State standards,or the NationalCategorical Pretreatment Standards for anyspecificpollutant,whichever standard is most stringent. U."Pretreatment"meansthe reductionof theamountof pollutants,the elimination of pollutants, or the alterationof the nature of pollutant properties in wastewater priorto,or in lieu of, introducing such pollutants into thePOTW.This reduction or alteration can be obtained by physical,chemical,or biological processes;byprocess changes;or by other means,except by dilutingtheconcentration of thepollutantsunless allowed byan applicable pretreatment standard. V."Public Sewer"means a sanitary sewer inwhich allowners ofabutting propertieshave equal rights,and is controlled by public authority. W."Sanitary Sewer"means a sewer that carries sewage,and to which storm water,surface water,and groundwater are not intentionally admitted. X."Sewage"(commonlyreferred toas Wastewater)means a combinationof the water carried wastes from residences,business buildings,institutions,and industrial establishments; togetherwith such groundwaters,surface waters,and stormwaters as may be present. Y."Sewer"means a pipe orconduitfor carryingsewage. Z."Shall"defines a mandatoryrequirement. AA."Significant Industrial User"meansall users subjectto Categorical Pretreatment Standards under40 CFR 403.6 and 40 CFR chapter I,subchapter N;and (2)Anyother industrial user that discharges an average of25,000 gallons per day or moreof process wastewater tothe POTW (excludingsanitary,noncontactcooling andboiler blowdownwastewater);contributes a processwastestream that makes up5 percent ormoreoftheaverage dryweather hydraulic or organiccapacityofthePOTW treatmentplant;or is designated as Ordinance No.2139Page3 such bytheControl Authorityas defined in 40 CFR 403-12(a)on thebasisthattheindustrial user has a reasonable potentialfor adverselyaffectingthePOTW's operationor for violating any pretreatment standard or requirement in accordance with 40 CFR.8(f)(6). BB."SlugLoad or Slug"means any discharge at a flow rate orconcentration thatcould cause aviolationoftheProhibitedDischargeStandardsofthisChapteroranydischargenotofaroutine,regular,or episodic nature,including but not limited to an accidental spill or anoncustomarybatchdischarge. CC."Storm Drain"shall mean a sewer thatcarries storm and surface waters and drainage,butexcludessewageandpollutedindustrialwastes. DD."Total Dissolved Solids"means theportion oftotalsolids inwater orwastewater thatpassesthroughaspecificfilter. EE."Total Suspended Solids"means solids thatare either floating or are suspended in water, sewage,or otherliquids;and thatare removable by laboratory filtering. FF."Wastewater Discharge Permit"means a permit required for every SIU.Permits are issuedtoanamedpersonataspecifiedlocation,granting the privilege of discharging SIUWastewaterintothePOTW.NoSIU shall discharge wastewaterinto the POTW withoutfirstobtainingaWastewaterDischargePermitfromtheCityofMosesLakeandtheWashingtonStateDepartmentofEcology, GG."Watercourse"means a channel inwhich a flowof water occurs,either continuouslyorintermittently. 13.04.020 Unlawfulto Deposit Certain Wastes Upon Public or Private Propertv:It is unlawfulfor any persontoplace,deposit,or permitto be deposited inan unsanitary manner upon publicor privatepropertywithintheCity,or in any area under thejurisdictionof theCity,any human or animalexcrement,garbage,or other objectionablewaste. 13.04.030 Discharge of Sewage in Natural Outlets:Itis unlawfultodischarge toany natural outlet withintheCity,or in any area under the jurisdictionof the City,any sanitary sewage,industrial wastes,orotherpollutedwaters,except where suitable treatment has been provided in accordance withsubsequentprovisionsofthischapter. O 13.04.040 Use of Privies and Sectic Tanks:Except as permitted by Grant County Health Department,itisunlawfultoconstructanyprivy,privyvault,septictankwith drain field,cesspool,or other facilityintendedtobeusedforthedisposalofsewage. 13.04.045 Private Svstems:Private sewer systems,septictankswithdrain field,and onsite disposal systemsareprohibitedfornewsubdivisions. 13.04.050 Prohibited Waters:No person shall discharge or cause to be discharged any storm water,groundwater,surface water,roof runoff,swimming pool water,subsurface drainage,noncontactcoolingwaterinsignificantvolumes,orunpollutedindustrial process waterstoany sanitary sewer. 13.04.060 Storm Drainage:Storm water,swimming pool water,groundwater,and all other unpolluteddrainageshallbedischargedtoaspecificallydesignatedstormdrain,natural outlet,or onsitedisposalapprovedbytheCityand/or Department of Ecology.Industrial noncontact cooling waterorunpollutedprocesswatersmaybedischarged,toa stormdrain,natural outlet,or onsite disposal upon approvalbythe Cityand/or Department of Ecology. 13.04.070 ProhibitedWastes:Except as providedin thischapter,no person shalldischarge orcause tobedischargedanyofthefollowingdescribedtypesofwastewatertoanypublicsewer.AnywastewaterexceedingthefollowinglimitationsshallbesubjecttothereviewandapprovaloftheMunicipalServicesDirector,City Council,and/orDepartment of Ecology. A.Wastewater from anyplating shops,auto repair shops,auto wash racks,mechanical shops,commercial kitchens or from any other industrial user thatmay potentially discharge TSS,oilsandgreases,or totalmetals in concentrationsthat may exceed theCity,State,or FederaleffluentlimitationsfordischargetothePOTW.Wastewater from these uses may be allowedtoconnecttothePOTWprovidinganapprovedpretreatmentmethod,such as and approvedinterceptor,is installed. O Exemptions:Commercial kitchens that do not generate grease or solids,such as thosewithoutdeepfryersorextractionhoods,orthosethatcan be proven tobe under the limits ofMLMC13.04.070 (C),may be exemptfrom thissection.These operations may include butarenotlimitedto;bakeries,coffeelespresso shops or stands,juicebars,delicatessen,fruitandvegetablemarkets,sandwich bars,muffin shops,pretzel shops,and bagel shops. B.Heat in amounts thatwillinhibit biological activity in thePOTW resulting in interference,butinnocaseheatinquantitiesthatthetemperatureatthePOTWexceeds40°C (104°F)unlesstheCityapproves,inwriting,alternatetemperature limitsupon request ofthePermittee. C.Anywastewater thatmay contain: 1.In excess of 100 mg/L offats,oils,or greases of animalsor vegetable origin. Ordinance No.2139Page4 2.Inexcess of100mg/Lofpetroleumoil,nonbiodegradable cuttingoil,or products ofmineraloilorigininamountsthatwillcauseinterferenceorpassthroughand/or; 3.Anysubstance thatmaysolidifyorbecome discernibly viscous at temperaturesabove 0°C (32°F)causing or contributing toobstructionofwastewater flows at anypoint inthe POTW, or resulting in interference. D.Any pollutant thatmay create a fire or explosivehazard in the POTW,either alone or by interaction,including but not limitedtowaste streams with a closed-cup flashpointofless than140°F (60°C)using thetestmethods specified in40 CFR 261,21,40 CFR 403.5(b)(1),or arecapableofcreatingapublicnuisance,WAC 173-216-060(2)(b)(ii). E.Anysolid orviscous substance thatmaycause obstruction,pass through,or other interfer- ence withtheoperation of the POTW such as,but not limited to grease,garbage with particles greater thanone-half inch in any dimension,medical waste,ashes,cinders,rock,sand,mud,straw,shavings,metal,glass,rags,feathers,tar,plastics,wood,paunch manure,bones,hair,hides or fleshings,entrails,wholeblood,concrete,spent time,stone or marbledust,shavings,grass clippings,spent grains,spent hops,waste paper,asphalt residues, residues from refining or processing of fuel,lubricating oil,or polishing wastes. F.Any wastewater that has a pH lower than 6.0 or higher than 11.0,or that has any other corrosive propertycapable of causing damage or hazard to structures,equipment,orpersonnelofthePOTW. G.Anywastewater thatcontains dangerous wastes as defined inChapter 173-303 WAC(listed,characteristic,orcriteriawastes).The MunicipalServices Directorand theWashington State Department of Ecology,Eastern Region Dangerous Waste Unit,shall be notifiedof adangerouswastedischarge.Anyone who has discharged a dangerous waste shall comply with therequirements contained herein within 30 days of becoming aware ofa discharge of dangerous waste tothe POTW.Such notificationshall include: 1.The name of the dangerous waste as set forth in Chapter 173-303 WAC. 2.The dangerous waste number. 3.The typeofdischarge (continuous,batch,or other). H.Any wastewater thatcontains a toxicorpoisonoussubstance insufficient quantitytoinjure or interfere with anyPOTW process,constitutinga hazard tohumans or animals,or creating any hazard inthereceivingwaters of thePOTW. I.Anywastewater thatcontains suspended ordissolved solidsof such character and quantity thatunusual attentionorexpense isrequired tohandle such materialsatthe POTW treatmentplant. J.Anywaste materials,including oxygen demanding waste materials (BOD,COD,etc.)thatarereleasedineitheraslugloadorcontinuousdischargeofsuchvolumeorstrengthastocauseinterferencetothePOTW. K.Any noxious or malodorous gas or substance capable of creating a public nuisance. L.Anywastewater thathas a five(5)day BODgreater thanthree hundred (300)milligrams perliter. M.Anywastewater thatcontainsmore thanthree hundred and fifty(350)milligramsper liter of TSS. N.Any unacceptableamounts of TDS that willcause an interference withthe normal operation of the POTW.Limitations for TDSwillbe set afterthe Department of Ecology and the City of Moses Lake reviewengineering reports from the prospective discharger investigatíng alternativesto reduce TDS in theeffluent. O.Wastewater thathas an average dailyflowgreater than two(2)percent ofthe daily sewageflowoftheCity. P.Any wastewaterwith objectionablecolor thatis not removed in the treatmentprocess such as dyewaste and vegetable tanningsolutions. Q.Any truckedorhauled pollutants. R.Noncontact coolingwater in significantvolumes. S.Stormwater and other indirect inflowsources. T.Wastewater significantlyaffectingsystem hydraulic loading that does not require treatment or wouldnot be affordeda significant degree of treatmentby the system. 13.04.075 Pretreatment Facilities:The Municipal Services Director may require theownerto provide,atthe owner's expense,suchpretreatment as maybe necessary toreduceobjectionablecharacteristics or constituents towithinthemaximumlimitsprovided forinSection 13.04.070,or tocontrol the Ordinance No.2139Page5 quantitiesand rates of discharge of such wastewater.Plans,specifications,and any otherpertinentinformationrelatingtoproposedpretreatmentfacilitiesshallbesubmittedfortheapprovalbytheMunicipalServicesDirectorandbytheWashingtonStateDepartmentofEcology;and nodischargefromsuchfacilitiesshallbecommenceduntiltheapprovalsareobtainedinwriting.Where pretreatmentfacilities are provided for any wastewater,theyshallbe maintained continu-ously in satisfactoryand effective operationbytheownerat theowner's expense. 13.04.120 Manholes:The MunicipalServices Director may requirethe ownerofanyproperty served byaObuildingsewerthatcarriesindustrialwastestoinstallasuitablecontrolmanholeinthebuildingsewertofacilitateobservation,sampling,and measurement ofthewastes.Such manhole,shallbeaccessibleandsafelylocated,and shallbe constructedinaccordance withplansapprovedbytheMunicipalServicesDirector.The manhole shall be installed by the ownerat theowner'sexpense,and shall be maintained by theowner so as to be safe and accessible at alltimes. 13.04.130 Tests and Analysis:AIImeasurements,tests,and analysisof the characteristics ofwastewatertowhichreferenceismadeinSection13.04.070 shall be performed bya Department of Ecologyaccreditedlaboratoryanddeterminedinaccordancewith"StandardMethods forthe ExaminationofWaterandWastewater,"andshallbe determined at thecontrol manhole provided for inSection13.04.120,or uponsuitablesamples taken at thecontrolmanhole.In theevent thatno specialmanholehasbeenrequired,thecontrolmanhole shall be considered to be the nearest down-stream manhole inthe publicsewer tothepoint at which thebuilding sewer is connected.WhenrequestedbytheMunicipalServicesDirector,a user shallsubmit information onthenature andcharacteristicsofitswastewatertoassurefullcompliancewiththischapter.The MunicipalServicesDirectorisauthorizedtoprepareaformforthispurposeandmayperiodicallyrequireuserstoupdatethisinformation.Samples takentomeetthe requirementsofthischaptershall berepresentativeofthevolumeandnatureofthetestparameters,including representative samplingofanyunusualdischargeordischargecondition.Allcosts associated with testingand analysisshallbebornebytheuser. 13.04.140 Wastewater Discharge Permit:Statements contained in Sections 13.04.050 through 13.04.070shallnotbeconstruedaspreventinganywastewaterdischargepermitbetweentheCityCouncil,Department of Ecology,and any industrial user whereby an industrial waste of unusual strength or character may be approved by theCity Council and/orDepartmentof Ecology for treatment,subjecttopayment thereforbytheindustrial user. 13.04.145 Discharge toSewerSystem Without Physical ConnectiontoSewer System:Regularor intermit-tentdischarge ofwastewatertothePOTW by anyonenotphysically connected tothePOTW maybepermitted.Authoritytoso discharge may onlybegranted bytheMoses Lake CityCouncilwhenOtheCouncildeterminesthatthedischargeshallnothaveanydeleteriousordamagingeffectsonthehealthandwelfareoftheCity'sresidents and that the discharge willbe in the City's bestinterests. A.Permission todischarge wastewatertothePOTW shallbe upon such termsand conditionsdeemedappropriatebytheCityCouncilasfollows:The permitshall,contain,ata minimum,provisionsthat: 1.Require the paymentof therate as set by the City Council. 2.Set limitations on thequantityand qualityofthewastewater. 3.State thatthepermit isterminablebytheCityCouncilatwillwithinthirty(30)days ofwrittennoticebytheCitytothedischarger. 4.Provide whereand howthewastewater is to be discharged tothePOTW. 5.Require periodictestingof thewastewater accordingtothe standards established by theCity. B.The permission to discharge wastewater to the POTW shall include the requirement toexecuteanextraterritorialutilityextensionagreementuponformspreparedbytheCityifthewastewaterisgeneratedfromasiteoutsidethecorporatelimitsoftheCityunlesstheCityCouncilentersintotherecordafindingthatthewastewaterdischargerisincapableofexecutingsuchanagreementasdistinguishedfromthewastewaterdischarger's reluctancetoexecutetheagreement.The CityCouncilmay issue a waiver ifsuch a waiver is inthebestinterestsofthecitizensoftheCityofMosesLake. 13.04.150 Installation and Connection ofToilet Facilities With Sewer: A.The ownerof allhouses,buildings,or propertiesused for human occupancy,employment,recreation,or other purpose,situated within twohundred feet (200')of a public sanitaryseweroftheCity,is required at theowner's expense toconnectsuch facilitiesdirectlywiththeCitysewerwithinsix(6)months after the date of officialnotice todo so.Provided thattheconnectionshallnotberequiredifthecostofmakingtheconnection,including thepriceofobtainingaprivatewayofnecessityasauthorizedbyRCW8.24,exceeds fourthousanddollars($4,000).Determination of the cost of makingtheconnectionshall bemadebytheMunicipalServicesDirector.The owner can appeal the decision tothe CityCouncilwithinten(10)days of the decision of the Municipal Services Director.ThedecisionoftheCityCouncilshallbefinal.Furthermore,ifa person is not requiredtomakeaconnectionbecauseofcost,atsuch timeas thesepticsystemfails,eitherthetankorthedrainfield,theconnectiontotheCity'ssewer system shall be requiredand made. Ordinance No.2139 Page 6 B.For sewer regulations in areas outside the City limits,refer toGrant County Health District Ordinance No.91-1,Sewage Waste Disposaland the Washington State Departmentof Health Chapter 246-272 WAC,On-Site Sewage Systems. 13.04.160 Permit Requirements: A.No unauthorized person shalluncover,connect to,open into,use,alter,or disturb any public sewer or appurtenance without first obtaining theappropriate permitsfrom the Municipal Services Director. B.No SIU shall discharge wastewater into the POTW without first obtaininga wastewater discharge permit from the Municipal ServicesDirector. C.The Municipal Services Director may require other users to obtain wastewater discharge permits as necessary tocarry outthe purpose ofthischapter. D.The Municipal Services Director may requireanyperson discharging intothePOTW toinstall and maintain a suitable storage and flow control facility,on their property and at their expense,toensure equalization offlow.Awastewater discharge permitmay be required and issued solely forflowequalization. E.Anyviolation ofthetermsand conditions of a wastewater discharge permit shall be deemed a violation of thischapter and shall subject thewastewater discharge permittee tosanctions set out in Sections 13.04.310 through 13.04.330 of this chapter.Obtaining a wastewater discharge permit does not relieve a permitteeofits obligation to complywith allFederal and State pretreatment standards or requirements,or with any other requirements of Federal, State,and Local law. 13.04.170 Aoolication for Permit -Fee: A.Permit:The owneror owners agent shall make application forsewer service.The permitapplicationshallbesupplementedbyanyplans,specifications,orother information required by the Municipal Services Director. B._Fees:The followingfees may be required for the connection and use of the City's sanitary sewer: 1.At the timean application for sewer service is filedwiththe City,theapplicant shall pay apermitfeeassetforthintheapplicableUniformPlumbingCodeforbuildingsewers. 2.An applicant fora Wastewater Discharge Permit shallpay at thetimeofapplication for thepermitthecostofinvestigatingandprocessingthepermitperMosesLakeMunicipalCodeChapter3.54. 3.Wastewater Discharge Permit renewal feesper Moses Lake MunicipalCodeChapter3.54. 4.WastewaterDischarge Permit annualfees per Moses Lake MunicipalCode Chapter3.54. 5.Permitfeesto workintheright-of-way,oronproposedorexisting municipal improvements, in accordance withChapter 12.16 of theMoses LakeMunicipal Code. 6.Sewer System Development Fees per Chapter 3.62.020 of the Moses Lake Municipal Code. 13.04.175 Inspections:The applicant forthebuildingsewer permit shall notifytheBuildingOfficialwhen thebuildingsewerisreadyforinspection.The applicant shall notifytheMunicipal Services Director when any building sewer willbe connectedto thePOTW and is readyforinspection. 13.04.180 Expense of Installation:Allcosts and expenses incident totheinstallation and connectionofthebuildingsewertothePOTWshallbebornebytheowner.Ownership of thebuilding sewer from the City sewer main to thebuilding remainswiththe property owner.The owner shallindemnify the Cityfrom any loss or damage thatmay directly or indirectly be occasioned bythe installation of the building sewer. 13.04.190 Separate Sewer forEach Building:A separateand independent building sewer shall be provided for every building,each with separate connectionto the POTW,with the following exceptions: A.When a building stands at the rear of another on an interior residential lot and no sewer is available or can be constructedto the rear building throughan adjoining alley,court,yardor driveway,thebuilding sewer from thefront building may be extended totherear buildingand thewhole considered as one buildingsewer or; B.When separate buildings are an integral part ofa singlebusiness or industry or; C.Whenseparate buildings are underthesameownershipand located on the same lotorwithin a single binding site plan. 13.04.200 New Buildings:Oldbuildingsewers may be used inconnection withnewbuildingsonlywhen they meet all requirements of thischapter and theState BuildingCodes,as verified by theBuilding Official. Ordinance No.2139Page7 13.04.290 Right of Entrv:The Municipal Services Director,Building Official,or theirdesignees,shall bepermittedtoenteruponallpropertiesforthepurposeofinspection,observation,measurement,sampling,and testing inaccordance withtheprovisions of thischapter. 13.04.310 Notice toCease Violation:Any person found tobe violating any provisionofthischapter shall beservedbytheCitywithwrittennoticestatingthenatureoftheviolationandprovidingareasonabletimelimitforthesatisfactorycorrectionthereof.The offender shall,permanently cease allviolationswithintheperiodoftimestatedinsuchnotice. 13.04.320 Penaltv for Continued Violation:Any person who continues any violationbeyond the timelimitprovidedforinSection13.04.310 is deemed to have committed a civil infraction,and uponconvictionthereof,shall be subject toa C-1 penalty and punishable as defined inChapter 1.08 oftheMosesLakeMunicipalCode,Each day inwhichany such violation shall continue is deemedaseparateoffense.Failure or refusal to comply shall also constitute grounds for discontinuing sewer service to the premises until the Municipal Services Director determines that suchrequirementshavebeensatisfactorilymet. 13.04.330 Liabilityfor Expense or Damage: A.Damage resulting from an accident orfrom unauthorizedor improper use of sewer facilitiesshallbecomeanobligationagainsttheagencyorpersoncausingsuchdamage.
