2143_00001ORDINANCE NO.2143 AN ORDINANCEAMENDINGTITLE 17 OF THE MOSES LAKEMUNICIPALCODEENTITLED"SUBDIVISIONS" THE CITYCOUNCILOF THE CITYOF MOSESLAKE,WASHINGTONDO ORDAINAS FOLLOWS: Section 1.Title 17 of the Moses Lake MunicipalCode entitled "Subdivisions"is re-adopted as follows: Section 2.GeneralProvisions 17.04.010 Short Title:This titleshallbe known as theSubdivision Ordinance of the city. 17.04.020 Puroose:The purpose of thistitleis toregulate the subdivision of land and topromotethehealth,O safety,and generalwelfareinaccordance withstandards establishedbythecityand thestate topreventtheovercrowdingofland;to lessen congestion in the streets and highways;toprovide foradequatelightandair;to facilitate adequate provision for water,sewage,park and recreationareas,sites for schools and school grounds,and other public requirements;toprovide for properingressandegress;and to require uniform monumenting of land subdivisions and conveying byaccuratelegaldescription. 17.04.030 Jurisdiction:These subdivisionregulations shall apply toallsubdivisions ofland located withinthecorporatelimitsofthecity, 17.04.040 Administrative Authority:There is established regulationsrelated to the municipal approvalordisapprovalofsubdivisionsordedications.The administrator is designated and assigned theadministrativeandcoordinatingresponsibilitiescontainedinthistitle,pursuant tothelaws ofthestateasamended. 17.04.050 Failure ofPlanninq Commission toAct:Ifinany instance the Planning Commissionfails toact orcarryoutitsresponsibilitiesaccordingtotheregulationscontainedinthistitle,the CityCouncilshall assume all the duties of the Planning Commission as specified inthistitlerelating tothe applica-tionconcerned. Section 3.Definitions 17.09.010 Generallv:As used inthistitle,thefollowingwords or phrases shall have thefollowingmeaning. 17.09.020 Binding Site Improvement Plan:Binding Siteimprovement Plan means a drawing tothescalespecifiedhereinwhichidentifiesandshowstheareasandlocationsofallstreets,roads,improve-ments,utilities,open spaces,and any other matters specifiedherein;contains inscriptions orattachmentssettingforthsuchappropriatelimitationsandconditionsfortheuseofthelandasareestablishedpursuanttothischapter,and contains provisions making any development be inconformitywiththesiteplan. 17.09.030 M:Block means a group of lots,tractsor parcels withinwelldefined and fixed boundaries. 17.09.040 Certificate of Secreaation:Certificateof Segregation means a written certificate,on a formprovidedbythePlanningDivisionoftheMunicipalServicesDepartment,thata legally describedportionoflandislocatedwithinandproperlyrelatedtoanapprovedBindingSiteImprovementPlanandwhichmustaccompanyanybuildingpermitapplicationforconstructiononsaidlegallydescribedportionofland. 17.09.045 City Engineer:CityEngineer means theproperlycredentialed Municipal Services Director or theproperlycredentialeddesignee. 17.09.050 Comprehensive Plan:Comprehensive Plan means the plans,maps,texts,and reportswhichcomprisetheofficialdevelopmentplanasadoptedbytheCouncilinaccordancewithRCW35.63, 17.09.060 Construction Plans:Construction plans means the maps or drawings and specificationsaccompanyingaplatshowingthespecificlocationanddesignofimprovementstobeinstalledorconstructedinthesubdivision. 17.09.070 County Auditor:County Auditor is theGrantCounty Auditor. 17.09.080 County Treasurer:CountyTreasurer is the Grant County Treasurer, 17.09.090 Dedication:Dedication meansthedeliberate appropriation of land by an owner for any generalandpublicuses,reserving to hirnself no other rights than such as are compatiblewith the fullexerciseandenjoymentofthepublicusestowhichthepropertyhasbeendevoted.The intentiontodedicateshallbeevidencedbytheownerbythepresentmentforfilingofafinalplatorshortplatshowingthededicationthereon;and the acceptance by the public shall be evidenced by theapprovalofsuchplatforfilingbytheappropriategovernmentalunit. 17.09.100 Division of Land:Division of land means the division of any parcel of land into two(2)or moreparcels. 17.09.110 Easement:Easement means a grant of one (1)or more of the property rights by the propertyownertoand/or for theuse by the public,thecity,a corporation,or another person or entity. 17.09,120 Final Plat:Final plat means thefinal drawing of thesubdivision and dedication prepared for filingforrecordwiththecountyauditorandcontainingallelementsandrequirementssetforthinthistitle. 17.09.130 Imorovements:Improvements mean anystreet and utility(sewerandwater)required ingrantingshortplat,major plat,or binding site improvement plan approval inconformance withCommunityStreetandUtilityStandardsandcityDesignStandards. Ordinance No.2143Page2 17.09.140 Land Surveyor:Land surveyor means an individual registered inaccordance with theprovisionsofRCW18.43 and licensed toperformland surveys. 17.09.150 M:Lease means a contract or agreement whereby one partygrants toanother party general or limited rights,title,or interest in real property.This definition is intended to applytothoseagreementswhichareordinarilyconsidered"groundleases"and shall not applytothosewhich areordinarilyconsidered"space leases." 17.09.160 _L_ot:Lot means a fractional part ofdivided lands having fixed boundaries,being of sufficient areaanddimensiontomeetminimumzoningrequirementsforwidthandarea.The termshall include tracts or parcels. 17.09.170 Maintenance Bond:Maintenance bond means any security or surety approved bytheCityAttorney thatmay be accepted bythe Council as a guarantee thatimprovements requiredas a part ofanyapplicationfordevelopmentwillfunctionasrequiredforaone(1)year period of timefollowing acceptance by theCouncil. 17.09.180 MaiorSubdivision:Majorsubdivision means the division orredivision of land into ten(10)or more lots,tracts,parcels,sites,or divisionsand/or thedivisionor redivision of land into lots,tracts,parcels,sites,or divisionsexceedingfour acres in totalland area for thepurpose of sale,lease, ortransferof ownership. 17.09.190 Performance Bond:Performance bond means any security or surety approved by the CityAttorneythatmaybeacceptedbytheCouncilasaguaranteethatimprovementsrequiredasapart of any applicationfor development are satisfactorily completed within a specified period of time. 17.09.200 Planning Commission:Planning Commission means thebody created pursuant toChapter 2.48. 17.09.210 2 at:Plat means a map or representation ofa subdivisionshowing thereon thedivision ofa tractorparceloflandintolots,blocks,streets,and alleys,or other divisions and dedications. 17.09.220 Plat Administrator:Plat Administrator means theMunicipal Services Director,or the Municipal Services Director's designee charged with administering land development regulations. 17.09.230 Preliminarv Plat:Preliminary plat means a neat and approximate drawing of a proposed subdivision showingthegeneral layout of streets and alleys,lots,blocks,and other elements of a subdivision consistent with therequirements of thischapter.The preliminaryplat shall be the basis for the approval or disapproval of thegeneral layout ofa subdivision. 17.09.240 Principal Building:Principal building shall mean the principal structure on a lot or building site designed or used to accommodatethe primary use towhich the premises are devoted. 17.09.250 Right-of-Way:Right-of-way means a permanent dedication topublic use of a strip of land to be used for public roads,bikeways,sidewalks,mass transit,utilities,or similarrelated public uses. 17,09.260 Segregation:Segregationmeans thedivision of land into two(2)ormore leasehold agreements. 17.09.270 Short Plat:Short Plat means a map or representation ofa short subdivision. 17.09.280 Short Subdivision:Short subdivisionmeans the divisionorredivision of land intonine (9)or fewer lots,tracts,parcels,sites,ordivisions forthe purpose ofsale,lease,or transferof ownership not exceeding four (4)acres in totalarea. 17.09.290 Subdivider:Subdivider means a person,firm,or corporation that undertakesto create a major subdivision,a short subdivision,or a binding site improvement plan.When improvements areinvolvedandtheCommunityStreetandUtilityStandardsarereferredto,thesubdivider shallbe consideredtobe the same as the contractor. 17.09.300 SubdivisionBond:Subdivision bond shall mean any security or surety approved by theCity Attorney that may be accepted by theCouncilas a guarantee that improvements required as a conditionof preliminaryand/orfinal plat approvalare satisfactorilycompleted. 17.09 310 Tract:Tract means a parcelof land preparedfor subdivisionor subdividing. Section 4.Short Subdivisions 17.13.010 Purpose:The procedures regulating short subdivisions are established toprovide forthe orderly ancl efficient division of land on a smallscale;to promote the public health,safety,and general welfare,and tosubstantiallycomplywiththe provisions ofRCW Chapter 58.17. 17.13.020 Scoce:The division or redivisionof land into nine (9)or fewer lots,tracts,parcels,sites,or divisions forthe purpose ofsale or lease or transferof ownership notexceeding four (4)acres in totalarea and whichhas not been divided into a short subdivisionwithina period offive (5)years is subjectto thischapter. 17.13.030 Preliminary Plat Conditions and Requirements: A.General Conditions and Reauirements: 1.The subdivisionshall make adequate provision for roads,streets,curbs,gutters,side- walks,street lighting circuits,alleys,extension of municipal utilities (sewerand water), drainage ways,irrigationwater right-of-ways,other publicwaysor any municipal improve- ments as deemed necessary in conformance with city Community Street and Utility Standards and city Design Standards in effectat thetimeof plat approval, Ordinance No.2143Page3 2.The subdivision shall front on a existing street.There shall be adequate access toallparcels.Streets shallbe improved tocity standards.Street lightingshall be provided. 3.The subdivision shall complywith allzoningand health regulations. 4.The subdivision shall be consistent with thecity'sComprehensivePlan. 5.Environmental information shall be prepared and submitted in accordance withtheguidelinesestablishedundertheStateEnvironmentalPolicyActof1971,as amended.Saidinformation is a part of and must accompanythe preliminaryplatapplication. O 6.The subdivision shall provide forirrigationwater right-of-ways pursuant to RCW 58.17.310 as nowenacted or hereafter amended. 7.Astreet lightingplan as may be required by theCityEngineer must be provided.The planmustbeapprovedbytheGrantCountyPUDandincludeceltificationthatallstreetlightingfeeshavebeenpaidorthatarrangementsacceptabletothecityandthePUDhavebeenmadeforthepaymentofrequiredfees. 8.The subdivision shall not have been previouslydivided ina short subdivision withinthelastfive(5)years and willnot be further dividedin any manner unless such proposedresubdivisioncomplieswithallprovisionsrelatingtomajorsubdivisionsineffectatthetimethefurthersubdivisioniscommenced. 9.Unless an applicant for a preliminaryplat approval requests otherwise,and thePlatAdministratoragrees,a preliminary plat shall be processed simultaneouslywith theapplicationforrezones,variances,planned unit developments,site plan approvals,andsimilarquasi-judicial or administrative actions totheextentthat procedural requirementsapplicabletothoseactionspermitsimultaneousprocessing. 10.Every decision or recommendation made under thischapter by theCouncil or PlanningCommissionshallbeinwritingandshallincludefindingsoffactandconclusionstosupportthedecisionorrecommendation. 11.Preliminaryplats of any proposed short subdivision shall be approved,disapproved,orreturnedtotheapplicantformodificationwithinthetimelimitationsestablishedbyRCW58.17.140. 12.In theevent thattheshort subdivision does not border uponadjacent propertytowhichmunicipalutilitieshavebeenextendedoruponadjacentpropertyfrontinguponimproved O streets,theproperty owner may request a variance totheshort subdivision provisions formunicipalimprovementsasdeemednecessary.In lieuofthecompletionoftheextensionofmunicipalutilities(sewerand water)and the completion of street improvements,acovenanttothelandtitlemaybecreated.Said covenantshallpledgethe propertyownertoinstallmunicipalimprovementsasdeemednecessaryatsuchtimeastheadjacentpropertyisimprovedbytheinstallationofmunicipalutilitiesand/or at such timeas theimprovementofstreetsuponwhichtheadjacentpropertyisfrontingoccursasanysucheventisdeemedtooccurinthesolediscretionofthePlatAdministrator.Said covenantshallalsopledgethepropertyownertoparticipateinanyfuturelocalimprovementdistrictsforsuchimprovements. 13.Atthe discretion ofthePlatAdministrator,therequirement thata preliminary short platbesubmittedmaybewaived.Subjectto the approval ofthePlat Administrator,a short platwithoutimprovementsmaybesubmittedasafinalplatforreviewandapproval. 14.A platcertificatefroma titlecompany licensed to do business intheState of Washingtondatedwithinthirty(30)days ofthedate offilingofthefinal plat andapplicationwiththePlatAdministratorconfirmingthatthetitleofthelandsasdescribedandshownontheplatisinthenameoftheownerssigningthesubdivisionplatorinstrumentofdedication. B.Specific Conditions and Reguirements: 1.Prior tosubmission of a short subdivision preliminary application and preliminary plat,thesubdividerorthesubdivider'srepresentative shall schedule a pre-application conferencewiththePlatAdministratorandrepresentativesofotheraffectedcitydepartments.Thesubdividershallpresentaconceptualideaoftheplat.The Plat Administrator and represen-tativesof affected citydepartmentswillrespond informallyand address potential items ofconcerntoaidthesubdividerinpreparingtheshortsubdivisionpreliminaryapplicationandpreliminaryplat. O 2.The preliminaryshort subdivision applicationand plat shallbe filed withthe Plat Adminis-tratoron forms prescribed bythe Community Development Department.The applicationshallbeaccompaniedbytwelve(12)copies of the preliminary plat.At thediscretion ofthePlatAdministrator,the requirement thattwelve(12)copies of the preliminary plat besubmittedmaybewaived.Processing of the preliminary plat may require fewer thantwelve(12)copies of theplat. 3.The preliminary plat shall be a neat and accurate drawing,stamped and signed by aregisteredprofessionallandsurveyorlicensedbytheStateofWashingtononreproduciblematerialatadecimalscale.The plat map shall measure eighteen inches (18")by twenty-four inches (24").The preliminary plat shallbe drawn in black permanent ink on two(2)or more sheets ifthescale necessary to accommodate themap on one (1)sheet wouldundulycongestthedrawing. Ordinance No.2143Page4 4.A non-refundable fee ofthreehundred dollars ($300)shall accompany each and everyapplicationforapreliminaryshortsubdivision. 5.The preliminaryplatshallcontain the following: a.Name ofproposed subdivision. b.Boundaries of proposed subdivision established by the preliminary survey. c.Location and dimension ofall existing and proposedstreets,alleys,utilitiesand right-of-ways and/or easements on and adjacent to the proposed subdivision. d.Location and dimensions of allexisting and proposed irrigation waterright-of-waysonandadjacenttotheproposedsubdivision. e.Legal description ofland within theproposed subdivision. f.Any proposed land dedications. g.Name,address,and seal of the registeredlandsurveyorwho made the preliminary survey. h.The date of the preliminary survey. i.Horizontal scale of the proposed plat shallbe not more than one hundred feet (100')to the inch.Except thatthe City Engineer,subjectto a request priorto plat submittal, mayapprovean alternativeplatmapscale notto exceed one hundred feet (100')tothe inch. j,Monuments found and established during the preliminary survey. k.Date map is prepared,scale,and north point of themap.Approximate proposedlot lines withtheirdimensions,including lotnumbers and blocknumbers, l.Ifanyofthe parcels can be further divided or ifonlya portion of a tractis being divided, location of future streets,alleys,and lotlines shall be shown by dotted lines. m.Avicinitymap at a scale ofnotmorethanfour hundred feet (400')tothe inch.Except thattheCity Engineer,subject to a request prior to plat submittal,may approve analternativevicinitymapscaleexceedingfourhundredfeet(400')to the inch.The vicinitymap shall show all adjacent parcels.Itshallshow how thestreets and alleys intheproposedsubdivisionmay connectwithexisting and proposed streets and alleys in neighboring subdivisions or unplatted property to produce an advantageous development oftheentire neighborhood. n.Provide recommended street names forapproval. o.United States Bureau of Reclamation horizontal and verticaldata including bench marks. p.A site plan on a separate sheet showingthe followinginformation: 1)Location and sizingofexistingand proposed utilitiesincludingwater,sewer,storm drains,electricity,gas,street lighting,curbs and sidewalks,telephone,and cablevision lines.Minimum size and scale shall be thesame as the preliminary plat map. 2)Existing and proposedstructures and natural features and allproposedimprove- ments within and adjoiningthe proposed subdivision. 3)Topography of thearea with a maximum of twofoot (2')intervals of contoursasrequiredbytheCityEngineer. 4)Present zoning classificationon and adjacent to property. 5)Any proposed dedications for park land subject to the approval of the Planning Commission, 6)Anydeed restrictions or covenants existing or proposed shallbe drawn on the site plan and preliminaryplatmap. 17.13.040 Referral toOther Departments,Agencies,and Offices: A.Upon receiptofa completeand satisfactorypreliminaryplat application,thePlat Administrator shall distribute copies of thepreliminary plat to each of the followingoffices,departments,or agencies within two(2)working days from receipt: 1.Public UtilityDistrict 2.Gas Company 3.Telephone Company 4.Engineering Divisionof the Municipal Services Department(threecopies) Ordinance No.2143Page5 5.Fire Department 6.BuildingDivisionoftheCommunityDevelopment Department 7.GrantCountyHealthDistrict 8.Any irrigation district with jurisdiction 9.GrantCountyAssessor 10.Communications Company B,The Plat Administrator shall further notify the Police Department,Park and RecreationDepartment,and CityManager thata preliminary plat has been received. C.Notice of the filing of a preliminaryplat of a proposed subdivision located in the cityandadjoiningthemunicipalboundariesthereofshallbegiventotheGrantCountyPlanningDepartment D.Notice ofthefilingofa preliminary plat of a proposed subdivision located adjacenttotheright-of-wayofa state highway shall be giventotheState Department of Highways. E.Each office,department,oragencyshallfilewrittenrecommendationswiththePlat Administra-torwithineight (8)calendar days from the date of filingofthepreliminaryplat and applicationwiththePlatAdministrator.Ifany such office,department,or agency fails tofile a writtenrecommendationwithinthetimelimitation,it maybe presumed thatsuch office,department,or agency has no recommendation. F.If the preliminaryplatis foundto be unacceptable,a certified letter shall be mailed to thesubdividerwithinten(10)calendar days of receipt of the application. G.The Plat Administrator may determine thata meeting shall be held to resolve major issuesidentifiedasaresultoftherecommendationsofotheroffices,departments,oragencies.Suchmeetingshallbeattendedbythoseoffices,departments,or agencies responsible for therecommendationsandmustincludetheapplicantandthePlatAdministrator.The proceedingsandresultsofthemeetingshallbedocumentedbyminutes. 17.13.050 Variances: A.The subdivider may make applicationto the Plat Administrator on forms prescribed by the O Community Development Department fora variance of any provision contained in this title,provided that the request is received priortothe preliminaryshort plat approval by the PlatAdministrator. B.The Plat Administrator shallforwardthevariance application tothePlanning Commission.ThePlanningCommissionshallreviewthevariancerequestatitsnextregularmeetingandshallrecommendthattheCouncilapprove,conditionally approve,or disapprove the varianceapplication. C.Avariance may be granted in conformance with allofthefollowing conditionsand require-ments: 1.There are special physical circumstances or conditionsaffectingsaid real property suchthatstrictapplicationoftheprovisionsofthistitlewouldcauseanunusualandunneces-sary hardship onthesubdivider. 2.The grantingofthe variancewillnot be detrimental tothepublicwelfareor injurious tootherpropertyinthevicinity. 3.In granting variances,the Council mayrequiresuch conditionsas willsecure,in so far aspracticable,the objectivesofthe requirementvaried.Any variance authorized shall beenteredintheminutesoftheCounciltogetherwiththecircumstancesthatjustifythevariancegranted. D.Upon receipt of a Planning Commission recommendation the Council at its next regularmeetingshallconsiderandadoptorrejectthePlanningCommission'srecommendation withrespecttothevarianceapplication. E.A preliminary short plat accompanied by an application for a variance shallnot be approvedbythePlatAdministratoruntilsuchtimeastheCouncilapproves,conditionallyapproves,orOdisapprovestheapplicationforavariance.Application for a variancetotheprovisions of thistitleshallconstituteapprovalinwritingbytheapplicantforasixty(60)day extensionoftheshortsubdivisionpreliminaryplatapprovalperiodassetoutinSection17.13.030 (A9)of thischapter. F.Ifthe short plat has not been completed and has not been recorded and filed with the GrantCountyAuditorwithintwelve(12)months of the date of preliminary short plat approval,thevarianceshallbecomenullandvoid.Ifan extension of the preliminary short plat is granted,said varianceshallrun concurrently with the short plat extension. 17.13.060 Dedications:In theeventthat theshort plat includes a dedication ofstreets,right-of-ways,parks,playgrounds,easements,reservations,irrigationwater right-of-ways,or any area tobe dedicatedtopublicuse,thePlat Administrator shall fonward theinstrument of dedication togetherwithanyrestrictionsorlimitationsthereontotheCouncilforapproval.The Council shall approve theinstrumentofdedicationpriortoanyshortplatapprovalbythePlatAdministrator.Submission of Ordinance No.2143Page6 an instrument of dedication shallconstituteapproval inwritingbytheapplicantfor a sixty (60)day extensionofthe short subdivision preliminaryplat approval period as set out inSection 17.13.030 (A9)ofthischapter.AIIdedicationsshall be recordedas partof theplat. 17.13.070 Preliminary Short SubdivisionAoplication Review Procedures; A.Uponreceipt ofthe short platapplication,the Plat Administrator shallwithinthetimelimitations established by RCW 58.17.140,respond to the applicantinone of the following manners: 1.Preliminary approval is grantedas submitted. 2.Preliminary approval is grantedwith modifications requested. 3.The proposed subdivisionis denied and reasons stated. 4.Preliminary approval is withhelduntilPlanning Commission and/orCouncil approval ofdedicationsorvariancerequests. B.The short subdivision preliminary applicationshallrequireapprovalof the Plat Administrator and the City Engineer indicated bytheirdated signaturesthereon to be valid. C.The decision of the Plat Administrator shall be final,unlessan appeal by any aggrieved party is made tothePlanning Commission within ten (10)calendar days ofthe date ofdecision of the Plat Administrator.Said appeal shall be in writingto the Planning Commission and submittedthroughtheCommunity Development Department.The Community Development Department shall record and date the receiptofthat appeal.The Planning Commission shall act on thatappeal within forty (40)days unless an extension is agreed to in writingby the applicant The decision ofthe Planning Commissionshall be finaland conclusive unless, within ten(10)days,anyaggrievedparty files with the Finance Director a written appeal.The Council shall hear thatappeal within twenty(20)calendar days ofthedate of appeal. D.Approvalofthepreliminaryplatshallconstituteapprovalfortheapplicant/subdividertodevelop construction plans andspecifications forallfacilities and improvements and toprepare thefinal plat. 17.13.080 Expiration of Preliminarv Plat: A.Approval ofanypreliminary shortplat shall expireand become null andvoid one (1)year after thedate of preliminary platapproval. B.The Plat Administrator may grantone(1)extensionof thepreliminary platapproval fora period nottoexceed one (1)year provided thattherequest for an extension is filed at least thirty(30) days before theexpirationof theone (1)year period from the date of theplat's preliminary approval. 17.13.090 Appeals:Any decision approving or disapproving any preliminary short plat shall be reviewable for unlawful,arbitrary,capriciousor corruptaction or non-action by writ of reviewbefore theSuperiorCourtofGrantCounty.Said application for a writof review shall be made to thecourtwithinthirty(30)days from any decision to be reviewed.The cost oftranscriptionof all records ordered certified by thecourt for such reviewshallbe borne by the party seeking reviewin theSuperiorCourtandnotranscriptsorrecordsshallbepreparedorprovidedpriortoreceiptof payment for them. 17.13.100 Imorovements: A.Followingapproval ofthe preliminary plat bythePlat Administrator,the applicant shallfilewith thePlat Administrator,three(3)complete sets of preliminaryconstructionplansand specifica- tions prepared by a professional engineer licensed by theState of Washington showing all street and utilityimprovements as required bythe Plat Administrator ingranting approvalofthepreliminaryplat.The constructionplans and specifications shall be accompanied by aminimumplancheckfeeaspertheratescheduleestablishedbytheCityEngineer.All construction plans and specificationsshallbe inconformancewithcityDesign Standards and the Community Street and UtilityStandards.Sheet size shall be twenty-fourinches (24")x thirty-sixinches (36")andshall have a border ofone inch (1")on the leftmargin and one half inch (1/2")on theremainingthree(3)margins.The scale shall be fivefeet (5')vertically unless grades exceed ten percent (10%)and forty feet (40')horizontally. B.The preliminary construction plans and specificationsshall be forwarded tothe CityEngineer within two(2)workingdays ofreceipt bythe Plat Administrator.Withintwenty(20)calendar daysoffilingoftheplans withthePlat Administrator theCityEngineer shallapprove,condition- allyapprove,or disapprove the plans.The subdivider shallsubmitone (1)set of permanent reproducible mylarand three (3)sets ofspecificationswhich have been approved for theCity Engineer's signature,records,and use. C.After the City Engineer has approvedtheconstruction plans and specifications,thesubdivider shallcompleteand install allstreet andutilityimprovements required bythePlat Administrator in grantingpreliminary plat approvalprior tofilingofthefinal plat.A one (1)year maintenance bond shall be required intheamount ofone hundred percent (100%)oftheconstructioncost. D.The Engineering Division of the Municipal Services Department or a licensed professional engineer or engineeringfirm hired bythe city shall be responsibleforthe inspection of all subdivision improvements to insure conformance withtheapprovedplans and specifications. The subdividershall deposit an inspection feeintheamountoftwoanda half percent(21/2%) OrdinanceNo.2143Page7 ofthe estimated constructioncost.The inspection fee shallbe based on theactualcost oflabor,materials,and equipment plus fifteen percent (15%)for overhead.Ifthefinalcost is lessthantheamountdeposited,the difference willbe refunded. E.In lieu ofcompleting and installing all required street and utilityimprovements priorto filingofthefinalplatwiththePlatAdministrator,thesubdividermaypost a subdivisionbond or otherapprovedsecurityinaformsatisfactorytotheCityAttorney,Thesubdivisionbondorapprovedsecurityshallbeinanamountequaltoonehundredfiftypercent(150%)oftheestimatedcostasdeterminedbytheMunicipalServicesDirector,ofsuch improvements requiredbythePlatAdministratoringrantingapprovalofthepreliminaryplat,Intheeventthatallstreetand utilityimprovementsarenotcompletedwithinthetimelimitspecifiedinthesubdivisionbondorOapprovedsecurity,the bond or security may be forfeitedand the citymay undertake theinstallationandcompletionofallrequiredstreetandutilityimprovements. 1.AII street and utility improvements listed in the subdivision bond must be installed,completed,and accepted bythecitywithin one (1)year ofapproval ofthefinal platby thePlatAdministrator. 2,The Plat Administrator may grant one (1)extension ofthe subdivision bond fora period nottoexceedone(1)year provided thatsaid request for an extension is filed with the PlatAdministratoratleastsixty(60)calendar days prior totheexpiration date ofthe bond. 3.Intheevent that a timeextension isgranted,a new subdivision bond or other approvedsecurityshallbesubmittedinanamountsufficienttocoveronehundredandfiftypercent(150%)ofthecostofcompletingutilityextensions and street improvements.The bond willbeupdatedwithnewestimatesofcostonalluncompletedimprovementsandallincreasedcostestimatesshallbepassedontothebond.Iftheseincreased costs are notacceptedbythesurety,then the cityshall foreclose on the bond and the plat will be held in abey-ance.Departments issuing recommendations for new subdivision bonds or otherapprovedsecurityshallnotmodifythetermsandrequirementsofthebondorsecurityotherthantopassonallincreasedcostestimatesasdeterminedbytheMunicipalServicesDirectortothebondorsecuritytocoverthecostofcompletingutilityextensionsandstreetimprovementswithoutthewrittenconsentoftheapplicant. F.Acertificateofoccupancyforpermittedconstructionshall not be issued priarto complying withthefollowingrequirements: 1.Street and utilityimprovements have been constructed to CommunityStandards andacceptedbytheCityCouncil. 2.The finalshort plat has been recorded withthe Grant County Auditor.O 3,Upon final inspection that the building or structure complies with the provisions of theUniformBuildingCode. 17.13.110 Final Short Subdivision Plat Application: A.General Requirements: 1.The final shortsubdivisionapplicationand platwillbe filedwith the Plat Administrator onformsprovidedbytheCommunityDevelopmentDepartment. 2.Allrequiredstreet and utilityimprovements must be constructed bytheapplicantand mustbeacceptedbytheCityofMosesLakeorasubdivisionbondorotherapprovedsecurityshallbesubmittedinanamountsufficienttocoveronehundredandfiftypercent(150%)oftheestimated cost of completing allrequired utilityextensionsandstreet improvements as determined bytheMunicipalServices Director.Upon completionoftherequiredpublicimprovementsandpriortoacceptancebytheCouncil,the subdividerldeveloper mustsubmitamaintenancebondoralternativesecurityapprovedbytheCityAttorneyinanamountdeterminedbytheCityEngineerandapprovedbytheMunicipalServicesDirector.The maintenance bond amount shallbe one hundred percent (100%)oftheactualcost ofconstruction.An alternativesecurity shall be inan amountnot less thantenpercent (10%)normore thanone hundred percent (100%)oftheactual costof construction.The amountshallbedeterminedonacasebycasebasisbasedupontheCityEngineer's estimatedcostofrepairormaintenanceshouldrepairormaintenanceberequired.The subdivider/developer shall submit documentationof thecost of constructiontotheCity Engineer forhisreviewandapprovalanduseindeterminingtherequiredbondoralternativesecurityamount.Said bond shall be in effect for one (1)year from thedate of acceptance. 3.The instrumentof dedication of allstreets,right-of-ways,parks,playgrounds,easements,O reservations,irrigation water right-of-ways,and any area to be dedicated to public use,togetherwith any restrictions or limitations thereonshall be submitted as a part of thefinalplat. 4.The application shall be accompanied by the following: a.Aplat certificate from a titlecompany licensed todo business intheState ofWashing-tondated withinthirty(30)days ofthedate of filingofthefinal plat and applicationwiththePlatAdministratorconfirmingthatthetitleofthelandsasdescribedandshownontheplatisinthenameoftheownerssigningthesubdivisionplatorinstrumentofdedication. Section 5.Major Subdivisions 17.17.010 Purpose:The procedures regulating major subdivisions are established toprovide for theorderlyandefficientdivisionoflandwithinthecity;to promote the publichealth,safety,and generalwelfare,and tosubstantiallycomplywiththe provisions of RCW Chapter 58.17. 17.17.020 Scope:The division or redivision of land into ten (10)or more lots,tracts,parcels,sites,ordivisionsand/or the division or redivision of land into lots,tracts,parcels,sites,or divisionsexceedingfour(4)acres intotalland area forthe purpose ofsale,lease,ortransferof ownership.Any land which has been divided under theshort subdivision procedures withinfive(5)years.AIIshallbewithinthescopeofthischapter. 17.17.030 Preliminary Plat Conditions and Reauirements: A.General Conditionsand Requirements: 1.The subdivision shall make adequate provision for roads,streets,curbs,gutters,side-walks,street lightingcircuits,alleys,theextensionofmunicipalutilities(sewerandwater),irrigation water right-of-ways,drainage ways,other public ways,public access,or anymunicipalimprovementsasdeemednecessaryinconformancewithCommunityStreetandUtilityStandardsandcityDesignStandardsineffectatthetimeofplatapproval. 2.The subdivision shall front on a existing street.There shall be adequate access to allparcels.Streets shall be improved tocitystandards.Street lighting shall be provided. 3.The subdivision shall comply with all zoning and health regulations. 4.The subdivisionshall be consistent withthecity'sComprehensive Plan. 5.The subdivisionshallprovide for irrigationwater right-of-ways pursuant toRCW 58,17.310 6,s re t gahinedp nhereañaeyrbaemreend bythe CityEngineer must be provided.The planmustbeapprovedbytheGrantCountyPUDandincludecertificationthatallstreetlightingfeeshavebeenpaidorthatarrangementsacceptabletothecityandthePUDhavebeenmadeforthepaymentoftherequiredfees. 7.Environmental informationshall be prepared and submitted in accordance with theguidelinesestablishedundertheStateEnvironmentalPolicyActof1971,as amended.Said information is a part of and must accompany the preliminary plat application. 8.Unless an applicant for a preliminary plat approval requests otherwise,and the PlatAdministratoragrees,a preliminary plat shall be processed simultaneouslywith theapplicationforrezones,variances,planned unit developments,site plan approvals,andsimilarquasi-judicial oradministrativeactions to theextentthat procedural requirementsapplicabletotheseactionspermitsimultaneousprocessing. C.Notice of the filingof a preliminary plat of a proposed subdivision located in the city andadjoiningthemunicipalboundariesthereofshallbegiventotheGrantCountyPlanningDepartment. D.Notice of thefiling ofa preliminary plat ofa proposed subdivision located adjacent tothe right-of-way of a state highway shall be given tothe State Department of Highways. E.Each office,department,or agency shall filewritten recommendations withthePlat Administra-torwithinfifteen (15)calendar days from thedate offilingof thepreliminaryplat andapplicationOwiththePlatAdministrator.If any such office,department,or agency fails to file a writtenrecommendationwithinthetimelimitation,itmay be presumed thatsuch office,department,or agency has no recommendation. F.If the preliminary plat is found to be unacceptable,a certified letter shall be mailed to the -subdivider within the timelimitations established by RCW 58.1T140. G.The Plat Administrator may determine thata meeting shall be held to resolve major issuesidentifiedasaresultoftherecommendationsofotheroffices,departments,or agencies.Suchmeetingshallbeattendedbythoseoffices,departments,or agencies responsible for therecommendationsandmustincludetheapplicantandthePlatAdministrator.Theproceedingsandresultsofthemeetingshallbedocumentedbyminutes. Ordinance No.2143Page14 17.17.050 Variances: A.The subdivider may make application to the Planning Commission for a variance of anyprovisioncontainedinthistitle,provided that the request is received concurrentlywith theproposedsubdivisionordedication.Such application shall include any and all details necessary tosupporttheapplication.Allvariance requests must be forwarded totheCouncilforapprovalwiththepreliminaryplatandthePlanningCommission's recommendation. B.The Councilshallnotgranta variance ofthesubdivisionregulations unless itshall findthatallofthefollowingconditionsexistineachcaseofarequest: 1.There are special physicalcircumstancesorconditionsaffectingsaid real property such thatstrict application of the provisions of this titlewould cause an unusual and unneces-sary hardship on thesubdivider. 2.The granting ofthevariance willnotbe detrimental to the public health,safety,orwelfare or injurious toother propertyinthevicinity. 3.Ingranting variances,theCouncilmayrequiresuch conditionsas willsecure,inso far aspracticable,theobjectives of the requirement varied.Any variance authorizedshall beenteredintheminutesoftheCounciltogetherwiththecircumstancesthatjustifythevariancegranted. C.If a major plat has not been approved as final within three(3)years after thevariance is granted,thatvariance shall become null and void.Ifan extensionto the preliminary plat is granted,said varianceshall run concurrently withthepreliminaryplat extension. 17.17.060 Planning CommissionPublic Hearinq:When thePlat Administrator determines thatthecompleted subdivision application and preliminary plat is acceptable,thePlat Administrator shall set a date for a publichearing before thePlanning Commission. 17.17.070 Notice of Public Hearing:The Plat Administrator shall give notice of the time,location,and purpose of thepublichearing inthefollowing manner: A.Atleast one public notice shallbe published not less thanten (10)days priortothehearing in a newspaper ofgeneralcirculation within the cityand the area where thereal property that isproposedtobesubdividedislocated. B.Three (3)noticesshallbe posted on or adjacentto the land proposed for subdivision at least ten(10)days priortothe public hearing date. C.One(1)notice shall be mailedtoeach ownerofpropertywithinthree hundred feet(300')ofthepropertyproposedforsubdivisionatleastten(10)days prior to thepublic hearing. D.If the owner ofthe real property whichis proposedfor subdivision owns another parcelorparcelsofrealpropertywhichliesadjacenttotherealpropertyproposedtobesubdivided,one(1)notice shall be mailedto each owner of real propertylocated within threehundred feet (300')of any portion oftheboundaries ofsuch adjacentlocated parcels ofreal property owned by theowner of the real property proposed to be subdivided. E.Notice shall be sent totheGrantCounty Planning Department and totheState Department of Highways respectivelyif the subdivision is adjacent to municipalboundaries or if thesubdivisionisadjacenttoastatehighway. 17.17.080 Planning Commission Action: A.The Plat Administrator shall transmitthe application,the plat,respective comments andrecommendationsfromotherofficesandagencies,commentsand recommendationsfromcity departments,andCommunityDevelopment Department commentsand recommendations tothePlanningCommissionpriortothehearing. B.The Planning Commission shall review the preliminary plat,municipal recommendations, testimony,and exhibits submitted at thehearing and make recommendationsthereon tothe Council to assure conformance ofthe proposed subdivision with the Comprehensive Plan, Zoning Ordinance,Community Street and UtilityStandards,and city Design Standards.The Planning Commission shall recommend the Council approve,conditionally approve,or disapprove the preliminary plat 17.17.090 CityCouncil Action: A.Upon receipt of a Planning Commission recommendation,the Council at its next regular meeting,shall set a date for a public meeting to be scheduled for theCouncil'snextregular meeting.The Council shall considerand adoptor rejectthePlanning Commission's recom-mandation withrespect to the general and specific requirements ofthischapter. B.IftheCouncil,afterconsidering therecommendationat a public meetingdeems necessary achangeintherecommendationofthePlanningCommission,sucha changeshall not be made untilthe Council holds a public hearing to considertheirown recommendations.The hearing before the Council shall be given publicnotice and conductedinthemanner prescribed for the Planning Commission. C.Council approval of thepreliminaryplatshall constitute approval for the applicant/subdivider to developconstructionplans and specificationsfor all facilitiesand improvements andto prepare thefinal plat Ordinance No.2143 Page 15 17.17.100 Expiration of Preliminary Plat: A.Approval ofany preliminarymajorplat shall expire and become nulland voidthree(3)yearsafterthedateofpreliminaryplatapproval. B.The Council may grant one (1)extensionof thepreliminary plat approvalfor a period not toexceedone(1)year provided that the request for an extension is filedat least thirty(30)calendar days before theexpirationof thethree (3)year period and uponshowingthattheapplicanthasattemptedingoodfaithtosubmitthefinalplatwithinthethree(3)year period. 17.17.110 Acceals:Anydecision approving ordisapproving any preliminary major subdivision platshallbeOreviewableforunlawful,arbitrary,capriciousorcorruptaction ornon-action bywritof review beforetheSuperiorCourtofGrantCounty.Said application forawritofreviewshall be made tothe courtwithinthirty(30)days from any decision tobe reviewed.The cost of transcriptionof all recordsorderedcertifiedbythecourtforsuchreviewshallbebornebythepartyseekingreviewintheSuperiorCourtandnotranscriptsorrecordsshallbepreparedorprovidedpriortoreceiptofpaymentforthem. 17.17.120 Improvements: A.Followingapproval of thepreliminary plat bytheCouncil,the applicant shall filewith the PlatAdministrator,three (3)complete sets of preliminary construction plans and specificationspreparedbyaprofessionalengineerlicensedbytheStateofWashingtonshowingallstreetandutilityimprovementsasrequiredbytheCouncilingrantingapprovalofthepreliminaryplat.The construction plans and specifications shallbe accompaniedbya minimumplancheckfee as per the rate schedule established by the City Engineer.All construction plans andspecificationsshallbeinconformancewithcityDesignStandardsandtheCommunityStreetandUtilityStandards.Sheetsize shall betwenty-four inches (24")bythirty-sixinches (36")andshallhaveaborderofoneinch(1")ontheleft marginand onehalf inch (1/2")ontheremainingthreemargins.The scale shall be five feet (5')vertically and forty feet (40')horizontally. B.The preliminary constructionplans and specificationsshallbe forwarded totheCity Engineerwithintwo(2)workingdays of receipt by thePlat Administrator.Within twenty(20)days offilingoftheplanswiththePlatAdministratortheCityEngineershallapprove,conditionally approve,or disapprove the plans.The subdividershall submit one (1)set of permanentreproduciblemylarandthree(3)sets of specifications which have been approved for theCityEngineer's signature,records,and use. C.AftertheCityEngineerhas approved the construction plansandspecifications,thesubdividershallcompleteandinstallallstreetandutilityimprovementsrequiredbytheCouncilingranting O preliminaryplatapprovalpriortofilingof thefinal plat Aone (1)yearmaintenancebond shallberequiredintheamountofonehundredpercent(100%)oftheconstructioncost. D.The Engineering Division of the Municipal Services Department or a licensed professionalengineerorengineeringfirmhiredbythecityshallberesponsiblefortheinspectionofallsubdivisionimprovementstoinsureconformancewiththeapprovedplansandspecifications.The subdividershalldepositan inspection fee inthe amountoftwoanda half percent (21/2%)of theestimated construction cost.The inspection fee shall be based on the actual cost oflabor,materials,and equipment plus fifteen percent (15%)foroverhead.Ifthefinalcost is lessthantheamountdeposited,the difference willbe refunded. E.In lieuof completingand installing allrequired street and utilityimprovements prior tofilingofthefinalplatwiththePlatAdministrator,thesubdivider may post a subdivision bond or otherapprovedsecurityinaformsatisfactorytotheCityAttorney.The subdivision bond orapprovedsecurityshallbeinanamountequaltoonehundredfiftypercent(150%)oftheestimatedcostasdeterminedbytheMunicipalServicesDirector,of such improvements requiredby theCouncilingrantingapprovalofthepreliminaryplatIntheeventthatallstreetandutilityimprovementsarenotcompletedwithinthetimelimitspecifiedinthesubdivisionbondorapprovedsecurity,the bond or security may be forfeited and the city may undertake theinstallationandcompletionofallrequiredstreetandutilityimprovements. 1.AIIstreet and utility improvements listed in the subdivision bond must be installed,completed,and accepted bythe citywithin two(2)years of Council approval of the finalplat. 2.The Councilmay grant one (1)extension ofthesubdivision bond or security fora periodnottoexceedtwo(2)years provided thatthe request foran extension is filedwith thePlatAdministratoratleastsixty(60)days prior tothe expiration date of thebond or security. 3.Intheevent thata timeextension is granted,a newsubdivisionbond or other approvedOsecurityshallbesubmittedinanamountsufficienttocoveronehundredandfiftypercent(150%)ofthecost of completing utility extensions and street improvements.The bond willbeupdatedwithnewestimatesofcostonalluncompletedimprovementsandallincreasedcostestimatesshallbepassedontothebond.Ifthese increased costs are not acceptedbythesurety,then the city shall foreclose on the bond and the plat willbe held inabey-ance.Depaltments issuing recommendations for new subdivision bonds or otherapprovedsecurityshallnotmodifythetermsandrequirementsofthebondorsecurityotherthantopassonallincreasedcostestimatesasdeterminedbytheMunicipalServicesDirectortothebondorsecuritytocoverthecostofcompletingutilityextensionsandstreetimprovementswithoutthewrittenconsentoftheapplicant. F.Acertificate ofoccupancy forpermitted constructionshall not be issued prior tocomplyingwiththefollowingrequirements: Ordinance No.2143Page16 1.Street and utility improvements have been constructed to Community Standards andacceptedbytheCityCouncil. 2.The final major plat has been recorded withthe Grant County Auditor. 3.Upon final inspection thatthe building or structure complies with the provisions of theUniformBuildingCode. 17.17.130 Final Major Subdivision Plat Application: A.General Requirements: 1.The final majorsubdivisionapplication and plat willbe filedwith thePlat Administrator onformsprovidedbytheCommunityDevelopmentDepartment. 2.Allrequired street and utilityimprovements mustbe constructedbytheapplicantand mustbeacceptedbythecityorasubdivisionbondorotherapprovedsecurityshallbesubmitted inan amountsufficienttocover one hundred and fiftypercent (150%)of theestimated costofcompletingallrequiredutilityextensionsandstreetimprovementsasdeterminedbytheMunicipalServicesDepartment.Upon completion oftherequiredimprovementsand prior toacceptance bythe Council,thesubdivider/developermust submit a maintenancebond or alternativesecurity approved bytheCityAttorney in an amount determined bytheCity Engineer and approved by the Municipal Services Director.The maintenance bond amount shall be one hundred percent (100%)of the actual cost of construction.An alternative security shall be inan amount not less thantenpercent (10%)nor more than one hundred percent (100%)of theactual cost ofconstruction.The amount shall be determined on a case by case basis based upon the City Engineer's estimated cost of repair or maintenance should repair or maintenance be required.The subdividerldevelopershall submit documentationof thecost of constructionto the City Engineer for his review and approval and use in determining the required bond oralternativesecurityamount.Said bond shall be ineffectfor one (1)year from thedate of acceptance. 3.Required dedication ofallstreets,right-of-ways,parks,playgrounds,easements,reserva-tions,irrigationwater right-of-ways,and any area tobe dedicated topublic use,togetherwithanyrestrictionsorlimitationsthereonshallbesubmittedasapartofthefinalplat. 4.The applicationshallbe accompaniedby thefollowing: a.Aplatcertificatefrom a titlecompanylicensed todo business in theState ofWashing- tondated within thirty(30)days of thedate offilingof thefinalplat and applicationwith the Plat Administrator confirmingthatthetitleofthe lands as described and shown ontheplatisinthenameoftheownerssigningthesubdivisionplatorinstrumentofdedication. b.AcertificatefromtheGrant County Treasurer indicatingthatalltaxesand assessments on the property included in the finalplat,subdivision,or dedication have been paid according totheprovisionsof RCW 58.08.030 and RCW 58.10.040 as nowenacted or hereafteramended. c.A certificate fromthe city Finance Director indicating thatthereare no delinquent special assessments or liens on thepropertyincluded inthefinal plat,subdivision,ordedication. d.A check payable tothecity in theamount of four hundred dollars ($400)tocoverthecostofcheckingthefinalplat. e.Allcovenants proposed torunwiththeland. 5.The finalmajor plat (twelvesets ofprints plus theoriginaltracingand a reproducible mylar copy)shall include all items in Section17.17.130 B and any additional information and modifications requested in thepreliminary approval.The final plat shall be prepared inaneatandlegiblemannerinblackpermanentdrawinginkonhighgradetracingclothordraftingfilm.All documents,maps,and survey notes shall contain the name of thesubdivision,the name(s)ofthesubdivider(s),the name oftheregistered land surveyorresponsibletothesubdivider(s).The trimmedsize ofthefinal platshall be eighteen inches (18")by twenty-fourinches (24")with a one and a half inch (11/2")marginon the top orleftmarginandaonehalfinch(1/2")border on theremaining three(3)margins.The final plat shall be recordedon two(2)or more sheets ifthe scale necessary toaccommodate the map on one (1)sheet would unduly congestthe drawing. 6.The finalmajor subdivision platshall be approved or disapproved withinthe timelimitations as established by RCW 58.17.140. 7.Nofinal major subdivision plat maybe approved unless the citymakes awrittenfindingof fact that the proposed subdivision is in conformance withany applicable zoningordi- nances,or other land use controlswhichmay exist. 8.No final majorplatshall be approved for any subdivision whichlies in whole or in part in an irrigation district organizedpursuant to Chapter RCW 87.03 unless therehas been providedan irrigation waterright-of-waypursuantto RCW 58.17.310as now enacted or hereafter amended. F.CouncilAction: 1.The Councilshall,within thirty(30)days from thedate of filingof the final subdivisionapplicationandplat,approve ordisapprove thefinal plat unless thesubdivider consentstoanextensionofsuchtimeperiodinwriting. 2.If the Council finds that the subdivisionproposed for final plat approval conforms to alltermsofthepreliminaryplatapproval,the requirements of RCW Chapter 58.17,otherapplicablestatelaws,and any other requirementswhichwere in effect at thetime ofpreliminaryplatapproval,it shallapprovethefinal plat and by such action direct theCityManagertosigntheplat. G.A certificateofoccupancyshall not be issued untilthefinalmajor plat has been recorded withtheGrantCountyAuditor. 17.17.150 Final Plat Fees:UponCouncilapproval of the final plat,thesubdivider shall remit the followingfeespriortotheplatbeingofficiallysignedandrecordedwiththeGrantCountyAuditor: A.A check payable tothe Grant County Auditor sufficient tocover the recording fee. B.When applicable,voluntary payment inlieuofa dedication ofland or tomitigate a direct impactthathasbeenidentifiedasaconsequenceofaproposedsubdivisionasallowedbyandpursuanttoRCW82.02.020. C.When applicable,a certificate from theGrant County Auditor certifying that covenantstothepropertytitlehavebeenrecordedandfiledshallaccompanyfinalplatfees. 17.17.160 Filinq Final Plat: A.Upon receipt ofallrequiredfinalplat fees the plat shallbe signed bythefollowing officials: 1.CityEngineer 2.City Manager 3.Finance Department B.The PlatAdministrator shall transmitthe originalmylar plat totheCounty Auditorforfinalfiling.One reproducible copyshallbe forwarded withtheoriginaltobe confirmed and returned totheCityEngineerforhisrecords.One paper copy shall be filed with theCounty Assessor. 17.17.170 Vested Rights:A subdivisionshall be governedby theterms ofapprovalof thefinal plat,and thestatutes,ordinances,and regulations ineffectat thetimeof approvalpursuant to RCW 58.17.150(1)and (3)for a period offive (5)years after final plat approval unless the Councilfinds that achangeinconditionscreatesaseriousthreattothepublichealthorsafetyinthesubdivision.Anylotsinafinalplatfiledforrecordshallbeavalidlandusenotwithstandinganychangeinzoninglawsforaperiodoffive(5)years from the date offiling. 17.17.180 Acceals:Any decision approving or disapproving any final major subdivisionplat shall bereviewableforunlawful,arbitrary,capriciousor corrupt action or non-action bywritofreview beforetheSuperiorCourtofGrantCounty.Said application for a writof review shallbe made tothecourtwithinthirty(30)days from anydecision tobe reviewed.The cost of transcriptionsofallrecordsorderedcertifiedbythecourtforsuchreviewshallbebornebythepartyseekingreviewintheSuperiorCourtandnotranscriptsshallbepreparedorprovidedpriortoreceiptofpaymentforthem. Section 6.Binding Site Plan 17.26.010 Purpose:The procedures regulating Bindingsite Plans are established to provide an alternativeprocedurefortheorderlyandefficientdivisionofplattedlandintoparcelsforthepurposeofleaseorsaleforindustrialorcommercialusesofthelanduponwhichnoresidentialstructureswillbeplacedwhenmorethanone(1)principalbuilding is tobe constructed on one (1)lotof record;to Ordinance No.2143Page20 providean alternativeprocedurefor theorderlyand efficientdivision of platted land into parcels for the purpose oflease formanufactured homes or traveltrailers;topromote thegeneralhealth, safety,and welfare;and to substantially comply withthe provisionsof RCW Chapter 58.17.TheBindingSitePlanproceduresspecifiedhereinareavailableasacomplementtoothermethodsfor subdividing land for commercial and industrial development The Binding Site Plan shall be therequiredmethodofdevelopmentformanufacturedhomeparks.The BindingSite Plan procedures of thischapter shall have principalapplicationtocommercialand industrial parks and manufac- turedhome parks. 17.26.020 Binding Site Plan Conditionsand Reguirements: A.GeneralConditionsand Reguirements: 1.Binding SitePlans shall be filedas a recordofsurvey inthe Grant County Auditor's Office. 2.Acommercialor industrial Binding Site Plan authorizesa sale ortransferof a parcel.The Binding SitePlan and allofitsrequirementsshall be legally enforceableon thepurchaser orotherperson acquiring ownershipof theparcel.The sale or transferof such parcelin violation of theBinding Site Plan,orwithout obtaining a Binding Site Plan approval,shall be considered a violation of Chapter 58.17 RCW and shall be restrained by injunctive action and be illegal as providedin Chapter 58.17 RCW.The sale or other transferof ownershipof a parcel of a commercialor industrial BindingSite Plan shall be filedas arecordofsurveyintheGrantCountyAuditor's office. 3.Manufactured home park and recreational vehicle park Binding Site Plans shall not authorize the sale or transferofownership of a parcel oftheBinding Site Plan. 4.Alteration of an approved Binding Site Plan shall be accomplished by submitting anamendedBindingSitePlantotheSeniorPlanner.The amended Binding Site Plan shall be processed subject toalltheprocedures and requirements ofthischapter. 5.AIIimprovements (ie:water services,fire lines,building sewers,private access streets, etc,)within theBindingSitePlan boundaries shallbe privately held and maintainedbythepropertyowner/s.The BindingSite Plan shallmake adequate provisionforinternal private access streets,curbs,gutters,sidewalks,street lighting circuits,alleys,connection tomunicipalutilities(sewerand water)intheexisting dedicated street the Binding SitePlan adjoins,drainage ways,other publicways,or other municipalimprovements as deemed necessary in conformancewith theCity of Moses Lake's Community Street and Utility Standards and the City of Moses Lake's Design Standards in effect at the time of theBindingSitePlanapproval. 6.The Binding Site Plan shall front on an existingdedicated street.There shallbe adequate access to allparcels.Existing dedicated streets shall be improved to the City ofMoses Lake's Community Street and UtilityStandards.Private streets shall have direct accessontoadedicatedstreet. 7.The Binding Site Plan shall complywith allzoningand health regulations. 8.The Binding Site Plan shallbe consistent withthe City of Moses Lake's Comprehensive Plan. 9.The Binding Site Plan shall providefor irrigation water right-of-waysas now enacted orhereafteramended. 10.Environmental information shall be prepared and submitted in accordance with the guidelines established under the State Environmental Policy Act of 1971,as amended. Said information is a part ofand must accompany theBinding Site Plan application. 11.Unless an applicantfor a Binding Site Plan requests otherwiseand where the Senior Planner agrees,a BindingSite Plan shallbe processed simultaneously withtheapplication for platting,rezones,variances,planned unitdevelopments,site plan approvals,and similarquasi-judicial oradministrativeactions totheextentthat procedural requirements applicabletotheseactions permit simultaneous processing. 12.Binding Site Plans shall be approved,disapproved,or returned to the applicant for modificationwithin ninety (90)days from the date of filing unless theapplicant consents to an extensionofsuch timeperiod.Provided,thatifan Environmental Impact Statement is required as providedin RCW 43.210.030,the ninety (90)day period shall not include the timespent preparing and circulating the Environmental Impact Statementby thelocal governmentalagency. B.Specific Conditions and Reguirements: 1.Prior to submission of a Binding Site Plan applicationand map,the subdivideror thesubdivider's representative shall schedule a pre-application conference withthe Senior Planner and representatives of other affected City of Moses Lake departments.The subdivider shall present a conceptual idea of the Binding Site Plan.The Senior Planner and representatives of affectedCityof Moses Lake departments willrespond informally and address potential items ofconcerntoaid thesubdividerinpreparing theBinding Site Plan. 2.The BindingSite Plan applicationand map shall be filedwiththeSenior Planner onforms prescribed bytheCommunity Development DivisionoftheMunicipalServices Department. Said applicationshallbe accompaniedby twelve(12)copies ofthe BindingSite Planand map. Ordinance No.2143Page21 3.The BindingSitePlan [twelve(12)sets of printsplus theoriginaltracingand a reproduciblemylarcopy)shall be a neat and accurate drawing in black permanent ink prepared,stamped,and signedby a registeredprofessionalland surveyorlicensedbytheState ofWashington.The trimmedsize of theBindingSite Plan shall measure eighteen inches(18")by twenty-fourinches (24")witha one and a half inch (1 1/2")margin onthetoporleftmarginandahalfinch(1/2")border ontheremaining three(3)margins.The BindingSitePlanshallbedrawnontwo(2)ormoresheets ifthescale necessary toaccommodatethemaponone(1)sheet wouldunduly congest the drawing. 4.The Binding Site Plan shall bear all inscriptions or attachments settingforth appropriatelimitationsandconditionsfortheuseoftheland. 5.The Binding Site Plan shall contain provisionsmaking all developments conform with theBindingSitePlan. 6.Review fees per MosesLake Municipal Code Chapter 3.54. 7.AIIpublic dedications shown on the plat being overlayed shall also be shown on theBindingSitePlan. 8.The Binding Site Plan shallbe accompanied bythe following: a.Aplat certificate from a titlecompany licensed todo business inthe State ofWashing-tonand dated within thirty(30)days of the date offilingof the Binding Site Plan andapplicationwiththeSeniorPlannerconfirmingthatthetitleofthelandasdescribedandshownontheBindingSitePlanisinthenameoftheownerssigningtheBindingSitePlanorinstrumentofdedication. b.AcertificatefromtheGrantCountyTreasurer indicating thatalltaxesandassessmentsonthepropertyincludedintheBindingSitePlanordedicationhavebeenpaidaccordingtotheprovisionsofRCW58.08.030 and RCW 58.10.040 as now enacted or hereafter amended. c.AIIcovenantsproposed to run with the land. 9.The Binding Site Plan shallcontain the following: a.AIIdocuments,maps,andsurveynotes shallclearlyshowthe name ofthe BindingSitePlan,thename(s)of the subdivider(s)and the name of the registered land surveyorresponsibletothesubdivider(s). b.The titleshallincludethetypeof Binding Site Plan (commercial,industrial,manufac-tured home parkor recreational vehicle park)and read as follows; (TYPE OF)BINDINGSITEPLANof(NAME OF THE PLAT/SHORT PLAT)A Record of Survey c.The lines and names of all existing or plattedstreets or other public ways,parks,playgrounds,andeasements adjacentto the Binding Site Plan,ordedication,includingmunicipalboundaries,townshiplines,and sectionlines. d.Parce!Iocations including dimensions and number or letter designations. e.The lengths and bearings ofallstraightlines,curveradii,arcs,and semi-tangents ofallcurves. f.AIIdimensions along thelines ofeach parcel withthetruebearings and alsoanyotherdatanecessaryforthelocationofanyparcellineinthefield. g.Suitableprimary control points,approvedbythe CityEngineer or descriptions and tiestosuchcontrolpoints,towhichalldimensions,angles,bearings,and similar data given on theplan shall be referred. h.The location of all permanent monuments,property corners,and parcel corners. i.The names of all subdivisions immediately adjacent thereto. j.The date,true north point,scale,datum plane,and date of survey. k.The boundary of theBinding SitePlan,the courses and distances marked thereon,asdeterminedbyafieldsurveymadebyaregisteredandqualifiedlandsurveyorofthestate,and with an allowable error not to exceed one foot (1')in five thousand feet(5,000')and one foot (1')intenthousandfeet (10,000')in theCentral Business District I.The elevations of allpermanent monumentsbased on a datum plane approved by theCityEngineer. m.Certification by a registered land surveyor of accuracy of the Binding Site Plan mapandsurvey. C.Any recordofsurveyfiled as a Binding SitePlan whichdoes not bear the approvalofthe City Manager is nota validBindingSite Plan and shallnot confer any rights or privileges upon the propertyor its owners. 17.26.060 Certificate of Segregation -BuildingPermit: A.Priorto theissuance of any building permit for constructionwithin an approved Binding Site Plan,thatportionoftheBinding Site Plan for whichthebuilding permitis requested must be legally described and receivea certificateofsegregation fromtheCommunity Development Divisionofthe Municipal Services Department.Said certificateshall insure the segregation ofconstructioncomplements of theapproved Binding Site Plan. B.Approval oftheBindingSite Plan shallconstituteapproval for the Binding Site Plan applicant todevelopconstructionplans and specificationsforallon-site streetand utilityimprovements. 17.26.070 Vested Rights:ABinding Site Plan shallbe governed by thetermsof approval ofthe BindingSite Plan,and thestatutes,ordinances,and regulations ineffect atthe timeofapprovaland fora period of five(5)years after Binding Site Plan approval unless the Councilfinds that a change in conditions creates a serious threat tothepublic health or safety.Parcels in a Binding Site Plan filed for recordshallbe a valid land use notwithstandinganychange inzoning laws for a period of five (5)years from thedate offiling. 17.26.080 Acceals:Any decision approvingor disapproving any Binding Site Plan shall be reviewable as providedby law bywritofreviewbefore the Superior Court of GrantCounty.Said application for a writof reviewshallbe made tothecourt withinthirty(30)days from any decisiontobe reviewed. Section 7.Design Standards 17.28.010 Generallv: A.Land which thePlanningCommissionmay findtobe unsuitablefor subdivisiondueto flooding, bad drainage,excessive slopes,rockformations,high ground water,or other features likely tobe harmful tothesafety and general health ofthefuture residents,and which thePlanning Commissionconsidersinappropriate forsubdivision,shallnotbesubdivided,unlessadequate correctivemethodsapproved bytheCity Engineer are provided. OrdinanceNo.2143Page25 B.The proposed subdivisionshall include such requirements as are required by thecityStreetandUtilityStandards,ordinances,resolutions,and comprehensive plans. 17.28.020 Street and BlockLavout: A.Street layout shall conform tothe most advantageousdevelopment of subdivision,adjoiningareas,and theentireneighborhood,and shall providefor the following: 1.Continuity of appropriate streets and arterials. 2.Streets to boundaries of tract. 3.Streets generally following contour lines. 4.Streets intersecting atrightangles or as nearly as possible and Tintersectiondesign shallbeutilizedinsofaraspractical. 5.Allstreets dedicated shall be fullwidth except alongtheboundary lines oftheplat.HalfwidthstreetsmaybeacceptedwherethePlanningCommissionapprovesthedevelopmentofthestreetlocationonboundariesofthesubdivision. 6.Alleys shall be a minimum of twentyfeet (20')wide.Alleys may be required in residentialareasandtoserviceallpropertiesabuttingarterials.AIIeys may be required in allcommercialandindustrialareas. 7.Utilityeasements willbe permittedin lieuof alleys for property not adjacent toarterials inresidentialareas.Fire hydrants andwater mains must be located on right-of-wayintheseareas.Sewer mains,located in easements (suchas an alley)which cross a streetbetweeneasements,shall providea manhole or cleanoutat each right-of-way crossing.The terminationor end of the sewer main shall be located in the right-of-way and amanholeshallbeprovidedattheterminuspoint.An access easement tenfeet (10')wideshallbelocatedfromright-of-waytoutilityeasement at each manhole location withintheblock.The width of utilityeasements shall be determined by the CityEngineer. B.Where possible,blocks shall have sufficientwidth toprovide for two(2)tiersof lots,each ofwhichshallhaveaminimumdepthofonehundredusablefeet(100'). 1.Thelength ofblocks shall not exceed one thousandthreehundred and twentyfeet(1,320')wherethe average sizeoflots does not exceed two(2)acres in area. C.Alleys or easements for utilitiesmay be requiredalong rear or side lot lines and shall have atotalwidthoftwentyfeet(20')as required. E.Street pavementcenterlines shallcoincidewiththeright-of-way centerlineswhere practical. 17.28.040 ).ots: A.Every lot shall abut on a dedicated publicstreet exceptas provided for in residential unit development. B.Lots shall be a minimumofone hundred usable feet (100')in depth. C.Lots shallbe a minimumof sixty-fivefeet (65')inwidth at thefront building lines in residential areas.Lots inother zones shall have a minimumoffiftyfeet (50')of usable width. D.The ratioof thedepth of any lotto its widthshall not be greater thanthree (3)toone (1). E.Residential lots shallhave a minimum area ofseven thousandsquare feet (7,000')unless otherwise specified. F.Corner lots shallbe a minimumofseventyfeet (70')inwidth,and tenper cent (10%)greater area thanminimum required. G.Residential lots fronting on communityarterialsshall be at least one hundred and twentyfeet (120')indepth. H.Side lot lines shall be withintwentyper cent (20%)of perpendicular tothe front property line with which itintersects. l.Side and rear lotlinesshall be straight,orcomposed of straight line elements. J.Lots shallbe subdivided inconformitytorequirementsoftheZoningOrdinance ineffect at timeofsubdividing. 17.28.050 Street Lightina:AIInew subdivisionsshallberequired toallowfor andinstall street lightingcircuitry inaccordancewith plans and specifications prepared bythe Grant CountyPublic UtilityDistrictand approved by theCityEngineer. A.Itshall be theresponsibilityofthesubdivider,inconjunctionwiththePUD,toprovidecircuitry forallrequired street lightingto be located inthe proposed subdivision. B.The Grant CountyPUD shall prepare a street lighting plan for thenewsubdivision.Allplans and specifications must be approvedby theCityEngineer priortoinstallation ofsaid lighting circuitry. Section 8.Improvements 17.32.010 Procedure for Installinq Imorovements:The CityEngineer shall make availableStreet and Utility Standards andAmerican Public Works Association (A.P.W.A.)Standards tothesubdivider or his representatives.Also,comprehensive plans for the orderly development ofthecity's utilities and streets willbe availableto guide in preparation of preliminaryplats and specifications.The engineer may require a soiltest to insure adequate base designs for streets,retaining walls, utilities,and structureswithin thesubdivision. 17.32.020 Minimum Imorovements:Minimum improvements shall include the following: A.AIIstreets and alleys shall have alltrees and brush removed fromthe right-of-way. B.Allstreets and alleys shall be grubbed by the removal of all large rocks,roots,snags,logs, brush,etc.,uponthe surface ofthe ground and refilling allexcavations and holes left by the removal withinthe confines ofthe street 17.32.030 Water Mains: A.The subdivider shall install water mains as shown on drawings after approval by the City Engineer.The city shall make connectionbetween the existingwater maínand thenewly insta11edwater main.The subdivider or his contractor shall reimburse the cityfor all expensesintestingmainsandmakingconnections. B.Shouldthe subdividerbe required to install water mains larger thaneight inches (8")in diameter to implement thedevelopment of thecomprehensive plan for trunkmainstoserve areas other than thesubdivision,thecitywillnegotiate the installation of the required water main and reimburse thesubdividerfor theadditionalcost forthe larger water main,ifbids are required,a percentage of cost willbe determined prior to bid award. C.Fire hydrantsshall be located at fivehundred foot (500')tosix hundred foot(600')intervals along residential streets Firehydrant locations inother areas shall notexceed threehundred foot (300')intervals along streets. OrdinanceNo,2143Page27 D.When a subdivider isrequiredtoinstallawater main throughoradjacenttoproperty otherthanhisproposedsubdivision,he shall not be required to install fire hydrants other thanthoserequiredwithinhisproposedsubdivision.However,he shall be required to install T's in therequiredwatermainatappropriateintervalstofacilitatethefutureinstallationoffirehydrantswhenthepropertyadjoiningthisportionofthewatermainissubdividedordeveloped. 17.32.040 Sewer Mains: A.Sewer mains shallbe installed by thesubdivider or his contractoras shown on drawings asapprovedbytheCityEngineer.Sewer mains,manholes,lampholes,and liftstationsand forcemainswhenrequiredshallbeinstalledinallsubdivisionspriortoanywaterservicebeingconnectedtoanyimprovements. B.Should the subdividerbe required to install sewer mains larger than eight inches (8")indiameterorliftstationsandforcemainslargerthanhissubdivisionrequirementstoimplementthedevelopmentoftheComprehensivePlan,the citywillnegotiatetheinstallation of therequiredsewerfacilitiesandreimbursethesubdividerfortheadditionalcostforthelargerfacilities,Ifbids are required,a percentage of cost willbe determined prior tobid award. 17.32.050 Drainaae: A.Alldrainage inand throughthe subdivision shall be theresponsibility of thesubdivider. B.The subdivider may divert or enclose the natural drainage in his subdivisionafter providing adrainagesystemapprovedbytheCityEngineer.The subdividershallbear allcosts associatedwithdivertingorenclosingnaturaldrainage. C.AII drainage in right-of-ways must be in underground pipes and culverts except wherepermittedingutters. D.Drainage design and construction shall be similar to sewer requirements. E.Should thesubdivider be required toinstallstreet drainage facilities which are overand abovethesubdivisionrequirementstoimplementthedevelopmentoftheComprehensivePlan,thecitywillnegotiatetheinstallationoftherequireddrainagefacilitiesandreimbursethesubdividerfortheadditionalcostforthelargerfacilities.Ifbids are required,a percentage ofcostwillbedeterminedpriortobidaward. 17.32.060 Streets: O A.Excavation ofallstreets shall be to fullwidth oftheright-of-wayto subgrade.Retaining wallsmayberequiredinareasexceedingthreefeet(3')incut or fill. B.Street area shall be graveled withcrushed aggregate as shownonapprovedplans. C.Curbs shall be installed in accordance with Street and UtilityStandards. D.Streets shall be paved with an approved asphalt mix or a portland cement concrete asapprovedbytheCityEngineer. 17.32.070 A_lLeys: A.Alleys adjacent to properties zoned for uses other than residentialshall be paved in confor-mancewith theStreet and UtilityStandards. B.Alleys,when required in residential areas,shall be gradedand graveledin conformance withtheStreetandUtilityStandards. 17.32.080 Sidewalks: A.Sidewalks shall be required in allzonesand shallbe constructed as shown in theCommunityStreetandUtilityStandards.Sidewalksmay be located nexttothecurb.Sidewalks shall beconstructedsoastoavoidphysicalobstructionsunlesstheCouncilhaspreviouslyapprovedtheplacementofphysicalobstructionssuchasbutnotlimitedtolightpoles,fire hydrants,planter boxes,trees,or treewells inor onthearea reserved for sidewalks.Sidewalks shallbeconstructedsoastoavoidplacementoverwater,gas,sewer,orotherutilitylines. B.Sidewalk widths in the Central Business District Zone (C-1)shall be fulldimension,meaning thatallareabetweenthebackofthecurbandtheabuttingpropertylinesshallbeconstructedinconformancewiththeCommunityStreetandUtilityStandardsdescribingsidewalkconstruction. C.AIIsidewalk requirementsshallbe completed prior toan occupancy permit being granted foranynewbuilding. 17.32.090 Monuments:Monuments shall be placed at all street intersections,boundary angle points ofcurvesinstreets,and at such intermediate points as required by the City Engineer.The monu-ments shall be of concrete filled pipe or tile,weighing at least fifty (50)pounds,capped withstandardmarkers.Street monuments shall be set between six inches (6")and one foot (1')belowofficialfurnishedstreetgradesandinpavedstreetsshallbeenclosedinastandardmonumentcase.Ifa monument is placed in an open field or unpaved street,theland surveyor shall placeanironpininthecenteroftheconcreteortilepipe. Ordinance No.2143Page28 17.32.100 Conformity: A.Paved streets,curbs,and sidewalksshall be requiredon all dedicated street right-of-ways in all new subdivisions.All improvements shall be constructed in conformance with the Community Street and UtilityStandards and shallbe madefrom intersection tointersection, intersection to subdivisionboundary,or from subdivisionboundary tosubdivisionboundary unless the Council has previously approveda variation in conformity. B.On streets where a proposed subdivisionadjoins an existingsubdivisionor existing street dedication in mid-block and theexistingsubdivisionor existingstreet dedication is unpaved, thesubdividershallbe responsiblefor installing paving,curbs,and sidewalks on that portion ofthestreet right-of-way withinthe proposed subdivision. 17.32.110Arterials:Shouldthesubdividerberequired toconstructorreconstructa community arterialwithin a proposed subdivision and ifthatcommunityalterial is designed to serve areas ofthe cityother thanjustthe proposed subdivision,thecitymay participate inthe cost of construction.The City Council shall approvethe percentage ofparticipation priorto bonding or bid awardfor community arterial construction. A.The city'smaximum participationwillonlybe for therequired extra width and construction materials which are over and above the thirty-sixfeet (36')of pavement width requiredof aresidentialstreet B.In a residentialsubdivisioncontaining lots whichfronton a residential street and have an arterialstreet parallelto the residentialstreet andadjacent tothe backlotline,thoselotsshall bedefined as throughlots.The city'smaximumparticipationshall be fiftypercent (50%)of the sidewalkconstruction costs alongthearterial onallthroughlots. C.In no event should thisordinance be construedtoestablish an affirmative obligationuponthe citytoparticipate,ortoparticipate inany fixed percentageinanyproject The city'sparticipa- tionshall be limited by the funds available,priorityof projects throughoutthe city,and the desirability ofthe particular project 17.32.120 New Utilities:Where telephone,electricand cablevisionutilities are not existing in a proposed subdivision and additionalutility construction is required,all new utilityconstructionshall be undergroundimprovements. 17.32.130 Bicvcle Paths:The subdivider shall be requiredto provide bicycle paths for suitableand safe bicycle trafficwhere the city's Comprehensive Plan requires bicycle paths or lanes withinthe boundaries ofthesubdivision. 17.32.140 Special imorovements: A.The subdivider'sland surveyor or engineer shall submitall specificationsorcontract docu- ments to be used in constructionofall improvements withineasement and right-of-way of proposed plat Amaintenance bond as required by thecity and approved by the CityAttorney shall be included with contract documents. B.The CityEngineer shallapprove allstreet design,alignment,vertical curves,horizontal curves, waterdesign,sewer disposal methods,storm drains,and trafficcontrolrequired. Section9.ReimbursementforUtilityInstallations 17.36.010 Installation of UtilitiesReguired:The final subdivisionplat requirements ofthe city providethat water mains,sewer mainsand storm drains must be installed at theexpenseof thesubdividers. Inconnectionwiththe installation ofwater mains,sewermains,and storm drains,subdividers arerequiredtoextendexistingutilitiestothepropertybeingsubdivided.Extensions of water mains, sewer mains,and stormdrains may be requiredtobe extended through,or adjacent to,real estate owned by thirdparties. 17.36.020 General Reimbursement Procedure:The following sections establish the reimbursement procedure for connections to water mains,sewer mains,and storm drains which have been paid for by othersubdividers, 17.36.030 Subdivider's Requirements:Wherethesubdivideris requiredtoinstall utilitiesthroughor adjacent to property undeveloped or not subdivided and owned by others,a writtenstatement requesting future reimbursement for improvements and a certified copy of costs shall be filedwiththeCity Engineer.The CityEngineer willthendefine thetotalarea subjectto reimbursement fees and will establisha front foot or square foot cost to be paidthesubdividerprior to any future building, subdividing or other improvements on property abutting the subdivider installed utilities. 17.36.040 Subdivided and Undeveloped Areas: A.Sewer side lateral connections and water service connections shall be denied a subdivider, builder,or owner toexisting water mains,sewer mains,orstorm drain extensions whenthose extensions are throughor adjacent tosubdivided or undeveloped areas until thesubdivider, builder,or owner fileswiththe City Engineer a written acknowledgment from the original installer or his successor in interest,stating that satisfactory arrangements have been made for reimbursement of thatportionofthe water main,sewer main,or storm drain extension which extends through,or is adjacent to,the propertytobe served and for which request is made for hook up and connection. B.A platshall not be considered forfinalapprovaluntil satisfactoryreimbursement has been acknowledged bytheoriginal installer for existing water mains,sewer mains,and storm drain extensions required as a part of an existing subdivisionor development. Ordinance No.2143Page29 17.36.050 Reimbursement Time Limit:The citywilllimitallwaterserviceconnectionsand sewerside lateralconnectionstosubdividerinstalledlinesforaperiodoffifteen(15)yearsfrom date ofacceptance.Should theCity Clerk be unabletolocate by registeredorcertified mail prior to fifteen (15)yearlimitationthenallconnectionstosubdividerlinesshallbereleased. Section 10 Variances 17.40.010 Variances:There is established a procedure for granting a varianceofthe regulations containedinthistitle,as follows: O A.Any subdivider can make applicationto the Planning Commission for a variance of anyprovisioncontainedinthistitleprovidedtherequestisreceivedconcurrentlywiththeproposedsubdivisionordedication.Such applicationshall include any and all details necessary tosupporttheapplication.Allvariance requests must be forwarded totheCityCouncilwith thepreliminaryplatandthePlanningCommission's recommendation. B.The Planning Commissionshall not grant a variance of thesubdivision regulations unless itshallfindthatthefollowingconditionexistsineachcaseofarequest: Where,because ofthesize ofthe tractto be subdivided,its topography,the condition ornatureofadjoiningareas,or theexisting of unusual physical conditions,the strict compli-ance withtheprovisions of thistitlewould cause an unusual and unnecessary hardship onthesubdivider,thePlanning Commission mayvarythe requirements set forth inthistitle. Ingranting variances,the Planning Commission may require such conditions as willsecure,inso faras practicable,theobjectives ofthe requirement varied.Anyvariance authorizedshallbeenteredintheminutesofthePlanningCommissiontogetherwiththecircumstancesthatjustifythevariancegranted. C.If a short plat has not been approved as final withinsix (6)months after thevariance isgranted,that variance shall became nulland void. Section 11.Violations 17.44.010 ViolationDeemed Misdemeanor:Anyperson,firm,corporation,orassociation orany agentof anyperson,firm,corporation,or association who violates any provision of Chapters 17.04 through17.40 or any local regulations adopted pursuant thereto relating to the sale,offerfor sale,lease, or transferof any lot,tract or parcel of land,is deemed to have committed a civilinfraction andshallbesubjecttoaC-1 penalty as provided in Chapter 1.08 of thiscode and each sale,offerforsale,lease or transferof each separate lot,tract,or parcel ofland in violation ofany provision ofChapters17.04 through17.40 or any local regulation adopted pursuant thereto,is deemed aseparateanddistinctviolation. Section 12 Comprehensive Plan 17.48.010 Adootion ofComprehensive Plan Goals,Policies,and Maps:The Moses Lake Planning Commis-sionhas recommendedfor adoption a Comprehensive Planning Map,Plan,Goals,and Policies.That plan,map,goals,and policies are incorporated by reference and are made a part of thisordinanceasifsetforthfullyherein,and that plan,map,goals,and policies are adopted as a planforthephysicalandothergenerallyadvantageousdevelopmentofthecitytoencouragethemostappropriateuseofthelandthroughoutthecity,to lessen trafficcongestion and accidents,tosecuresafetyfromfire,toprovide adequate lightand air,to preventovercrowding of land,toavoidundueconcentrationofpopulation,topromote a coordinateddevelopment oftheunbuiltareas,toencouragetheformationofneighborhoodorcommunityunits,tosecure an appropriate allotmentoflandareainnewdevelopmentsfortherequirementsofthecommunitylife,to conserve andrestorenaturalbeautyandothernaturalresources,to facilitate the adequate provisionoftransportation,water,sewerage,and otherpublicuses and requirements.That plan,map,goalsandpoliciesshallbetheComprehensiveLandUsePlanandMapofthecityuntilappropriatelyamended,and upon any such amendmentor amendmentsbeing duly made,theplans,map,goalsandpoliciesoranyofthem,as may be appropriate from the nature oftheamendment,shallbedeemedchangedtoconformtoanysaidamendment 17.48.020 Amendment to Comprehensive Plan:An amendment has been recommended by the PlanningCommissiontoamendtheComprehensivePlanadoptedonApril28,1981,by Section 17,48,010.That amendment is incorporated into this section by reference as ifset forth fullyherein.Thatamendmentisapprovedandadopted.That amendment shall be incorporated intoand amend theComprehensivePlanasindicatedinitstextandmaps.
