2157_00001ORDINANCE NO.2157 ANORDINANCE AMENDINGCHAPTER"8.08"OF THE MOSES LAKEMUNICIPALCODEENTITLED"GARBAGE COLLECTION" THE CITYCOUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON DO ORDAINAS FOLLOWS: Section 1.Chapter 8.08 ofthe Moses Lake Municipal Code entitled "Garbage Collection"is amended asfollows: 8.08.010 Applicability:This chapter shallapplytoall territoryembraced withinthe corporate limitsofthe cityandtheareaofpolicejurisdictionthereof. O 8.08.020 Intent:The maintenanceof health and sanitation require,and itis the intention of thischapter tomake,the collection,removal,and disposal of garbage,refuse and dead animals within the citycompulsory.However,collection service is not required when written noticehas been given thecityrequestingacessationofservicewhereabuilding,whether commercial or residential,isvacantorifabuildingisusedforstorageorsimilartypeuseandhasnolivingquarters,no officefacilities,per se,or if thebusiness occupying thebuilding is closed for business and no garbage,rubbish,refuse,solid waste,or other waste material is produced. 8.08.030 Definitions:The followingwords and phrases shall apply in thischapter: 1."AgriculturalWaste"means allsolid waste generated by thegrowing,washing,or preparationformarketingofagriculturalproducts,without cooking,blanching,or other processing. 2."Ashes"means solidwaste products of coal,wood,orotherfuels used for heating and cooking,fromall public and private establishments and from allresidences. 3."Can"means a receptacle between fifteen (15)and thirty-two(32)gallon capacity which isdesignedforgarbagecollection.Itshall be strong,not easily corrodible,rodent-proof,insectproofandshallhavetwohandlesattachedforeasyhandling.It shall also be tapered fromtoptobottomsothatcontentsnaturallyemptywheninverted,There shall be an additionalchargeforanycanscollected. 4."Cart"means a ninety-six (96)gallon or less receptacle furnished by the city to be used fordisposalofgarbagethatisdesignedforhandlingbyanautomatedcollectionvehicle.Saidcartsshallbetheonlyresidentialreceptaclescollectedduringweeklypickupwithouttherebeingachargeforadditionalservice. 5."Collector ofRefuse"means theindividual,firm,association,copartnership,corporation,oranyotherentitywhatsoever,including theCity of Moses Lake which collects the garbage,rubbish,O refuse,solid waste,or other waste material inthe City of Moses Lake underanyarrangementwhatsoever. 6."Combustible Rubbish"or"Burnable Material"means,in general,the organiccomponentofrefuse,paper,rags,cartons,boxes,wood excelsior,furniture,bedding,rubber,plastics,leather,treebranches,lawn trimmings,and the like. 7."Commercial Refuse"means all solid wastes which originate in businesses,office buildings,stores,markets,theaters,and other buildings.The point at which any of therefuse becomessolidwasteandistheresponsibilityofthecitygarbagecontractorshallbedeterminedbytheSanitationTechnicianofthecity, 8."Compactor"means a container with a device which compresses the loaded material. 9."Compactor Collection Truck"means an enclosed vehicle provided with special mechanicaldevicesforloadingtherefuseintothemaincompartmentofthebody,for compressing theloadedmaterials,and for distributing the refuse within thebody. 10."Construction and Demolition Wastes"means building materials and rubble resulting fromconstruction,remodeling,repair and demolition operations on houses,commercial buildings,pavements,and other structures. 11."Containers"means smallreceptacles (one-toten-cubicyard capacity)that can be emptiedbycompactorcollectiontrucksonsite. 12."Disposal Site"means thelocation where any treatment,utilization processing or depositionofsolidwasteoccurs. 13."DropBoxSite"means a loading site where small loads ofsolid waste are dumped into a largecontainerfortransporttoaprocessingand/ordisposal site. 14."Functional Standards"means the criteria for solidwaste handling expressed in termsofexpectedperformance. 15."Garbage"meansallputrescible material includingallputrescible animal and vegetablewastesresultingfromthehandling,preparation,cooking,and consumption offood;swilland carcassesofdeadanimals,except sewage,sewage sludge and human body wastes. 16."Groundwater"means water in theground that is inthe zone of saturation, 17."Hazardous Wastes"means dangerous wastes requiringspecialhandlingincluding,but is notlimitedto,explosives,pathological wastes,radioactive materials and chemicals. Ord.2157Page2 18."Industrial Solid Waste"means all solid wastes which result from industrial processes and manufacturing operations such as factories,processing plants,repairand cleaning establish- ments,refineries and rendering plants. 19."InstitutionalSolid Waste"means solid waste generated by hospitals,nursinghomes,schools, prisons,reformatories,or other buildings housing an organizationhaving social,educational, or religious purpose. 20."Jurisdictional Health Department"means Grant County HealthDistrict. 21."Landfill"means the solid waste disposal process using land for the final disposal site. 22."Noncombustible Rubbish"means material that is unburnable at ordinary incinerator temperatures (onethousand three hundred totwo thousand degrees Fahrenheit).For the most part,it is the inorganic component of refuse,such as tin cans,heavy metal,mineral matter,glass,crockery,dust,metal furniture,ashes,and the like. 23."Offal"means intestine and discarded parts from the slaughter of animals. 24."On-Site Disposal"includes allmeans ofdisposalor,more usually,volume reduction,of refuse on premises before collection.Examples are garbage grinding,burning or incineration,burial, compactionor slurring at homes and commercial establishments. 25."Open Burning"means the burning of solid wastes inan open area or burning ofsolidwastes in a typeofchamber orvessel which is not approved in regulations. 26."Open Dumping"means thedepositing of solid wastes into a body or stream ofwater,or onto the surface ofthe ground without compactingthewastes and covering with suitable material to a suitable depth thatwould prevent vector nuisance and pollution problems. 27."Pathogen"means any infective agent capable of producing disease;it may be a virus, rickettsia,bacteria,protozoan,etc. 28."Person"means an individual,firm,association,copartnership,political subdivision,govern-ment agency,municipality,industry,public or private corporation,or any other entitywhatsoever. 29."Pollution"means thepresence intheenvironment or portionoftheenvironmentofcontaminat- ing substances,materials,forms of animals or plant lifein sufficientquantities and of suchcharacteristicsandduration,as is or is likelytobe,injurious tohumans,toother plant oranimal life,or property,or which unreasonably interferes withenjoyment of life and property, 30."Processing of Waste"means the operation of solid waste which converts a waste into something useful,leaving theterm"handling"to describe what is done to prepare itfor dis- posal. 31."Pull-on Container"means a detachable containersystem inwhich a large container (aroundtwentytofiftycubicyards)is pulled onta service vehicle mechanically and carried to disposal site for emptying. 32."Putrescible"means capableofbeing decomposed by micro-organisms withsufficient rapidity as to cause nuisances fromodors,gases,etc.Kitchen wastes,offal,and dead animals areexamplesofputresciblecomponentsofsolidwaste. 33."Refuse"means "Solid Waste"as defined in subsection 41 ofthissection. 34."Refuse Fill"means "Landfill"as defined in subsection 21 of thissection. 35."Rendering"means a process ofsalvagingfats and oils,animal feed and otherproducts from animal waste by cooking.Dead animals,fish andwastes from slaughter houses and butcher shops are commonlyused. 36."Rubbish"means all discarded nonputrescible solid waste except ashes,including paper,cardboard,tincans,wood,glass,bedding,yard clippings,etc. 37."Salvage"means reclaimable solidwaste such as paper,metal,bottles,or other objects saved for the purpose of sale orotheruse not prohibited by law,rule,or regulation. 38."Sanitary Landfill"means a method of disposing ofrefuse on land without creating nuisances or hazards to public health or safety,by utilizingthe principles of engineering to confine the refusetothe smallest practical area,toreduce ittothe smallest practical volume,and to cover itwith a layer of earth at the conclusion of each day's operation or at such more frequent intervals as may be necessary. 39."Sanitation Technician"means thecityofficialoremployee ofthecitydelegated andauthorized to administer this chapter. 40."Scavenging"means the uncontrolled picking ofmaterials. 41."Solid Waste"means allputrescible and nonputresciblesolid and semisolidwastes,including garbage,rubbish,ashes,industrial wastes,demolition and constructionwastes abandoned vehicles or parts thereof,discarded home and industrial appliances,manure,vegetable or animalsolid and semisolid wastes and other discarded material.The point at which anyofthe above becomes solid waste and is the responsibility of the city garbage contractor shall be determined by the Sanitation Technician of the city. Ord.2157Page3 42."SolidWaste Disposal"means final disposition of solid waste by acceptable means. 43."SolidWaste Handling"means the storage,collection,transportation,treatment,utilization,processing,andfinal disposal of solidwastes. 44."Special Wastes"means wastes difficultor unusual in the characteristics of quantities orcompositiontohandle. 45."Street Refuse"means material picked up by manual and mechanical sweeping of streets andsidewalks,litterfrom public litter receptacles,and dirt removedfrom catch basins. O 46."SurfaceWater"means a body ofwater whose top surface is exposed to theatmosphereincludingaflowingbodyaswellasapondorlake. 47."Swill"means thesemiliquid animal or vegetablewaste of kitchens,marketor stores. 48."Transfer Station"means a loading sitewhere solid waste is transferredfrom one vehicle toanotherfortransfertoafinaldisposalsite. 49."Trash"means "Rubbish",as defined in subsection 36 of this section. 50."UnsanitaryCondition"means any situation which negatively effects the health and generalwelfareofhumansorisofsuchacharactersoastobelikelytobeinjurioustohumans,plantoranimallife,or property,or which unreasonably interferes with theenjoyment of life orproperty. 51."Vacant"means not lived inor occupied. 52."Vector"(ofdisease)means a livinginsect or other arthropod,or animal(nothuman),whichtransmitsinfectiousdiseasesfromonepersonoranimaltoanother. 53."Waste"means useless,unused,unwanted,or discarded materials.Waste includes solids,liquids,and gases.The gases are principallyindustrial fumes and smoke;the liquids consistmainlyofsewageandthefluidpartofindustrialwastes,the solids are classed as refuse orsolidwastes 8.08.040 City Sanitarv Division: A.For thepurpose ofcarrying into effect theprovisions and aimsof thischapter,there iscreatedandestablishedadivisiontobeknownasthecitysanitarydivision. O B.The City Manager is empowered and authorizedand may appoint a suitable and qualifiedpersonasSanitationTechnicianandthispersonshallhavefullchargeandcontrolofalltheworkprovidedforandcontemplatedunderthischapterandasmaybeprovidedforbyrulesandregulationssubsequentlyadopted.The Sanitation Technician shall also have charge ofallcollectionsandtheenforcementofallchargesforservicesrendered.Intheabsence of theappointmentofaSanitationTechnician,the City Manager may designate an individualemployedbythecityoracitydepartmenttoperformthefunctionsofaSanitationTechnician. 8.08.050 Sanitation Fund:There is created and established a special fund known and designated as theSanitationFund,intowhich all sums collected under thischapter shall be deposited and kept bytheTreasurerofthecityandfromwhichallexpensesoftheadministrationandoperationofthischaptershallbepaid. 8.08.055 Collection -Contract: A.The CityCouncil mayauthorize the enteringinto ofa contractwith a contractor orcontractorsforthecollection,removal,and disposal of all garbage,rubbish,refuse,solid waste,or otherwastematerial;provided,however,thatthe CityCouncil may,at its option,authorize theCityofMosesLaketohandlethecollection,removal,and disposal of garbage,rubbish,refuse,solid waste,and other waste materialby the CityofMoses Lake. B.The contractor shall be a person who,in the mindsof the City Council,is responsibleandqualifiedtoperformthedutiesrequiredunderacontractforsolidwastecollection.Suchcontractshallbemadeatleasteveryten(10)years or more frequently if desired.Thecontractormayberequired,at thediscretion of theCity,tofurnish a corporatesuretybond tothecityinasumsetunderthecontract,conditioned upon the faithful performance of hiscontractandincompliancewithallordinancesofthecityandallrules,regulations,laws,andstatutesrelatingtohisbusinessincludingtheprovisionsofthischapterandinadditionprovideforpaymenttoalllaborers,mechanics,and subcontractors and materialmen,andall personswhoshallsupplysuchcontractorwithprovisionsandsuppliesforcarryingonsuchwork. C.Any contractwith the contractor may be terminated by the city at any time for cause,or forfailuretocomplywiththetermsofthecontractwiththecityortheprovisionsofthischapterandreasonableregulationsimposedpursuantthereto.Inanyconflicts between thisordinance andthecontract,thecontractshall prevail 8.08.060 Container Requlations: A.Itshall be the duty of every person in possession,charge or in controlof any dwelling,flat,roominghouse,apartment house,or eating place orinpossession,charge,or control ofanyshop,place ofbusiness,or manufacturingestablishmentat all times,tokeep or cause tobekept,portable containers,carts,or garbage cans ofapproved size,type,and construction,andtodepositorcausetobedepositedtherefusetherein. Ord.2157Page4 B.Refuse or garbage containers shall not be filled with liquid or semi-liquid wastes.Such containers,carts,and cans shallbe kept in a sanitary condition with theoutside thereofclean and free from accumulative grease and decomposing material.Putrescible waste shall be placed in sealed bags prior tobeing placed in a cart,container,or can. C.For residential service every cart on the day designated for collection,shallbe placed within fivefeet (5')ofthe traveledright-of-way and at least fivefeet (5')from anyobstruction with the front facing the street or alley.Where alley access is available,meaning that the alley has sufficient height and width clearances for the collector of refuse's equipmentto negotiate the alleywithoutinterference,all containers shall be placed at the alley line.Where no alley access is available,all containers shall be placed at thecurb line on the day designated for collection and on allother days shall be removedfromstreet view.For commercialservice, accounts shall have theircontainersplaced on a solid surface ina location accessible to the collectorofgarbage and refuse without its having tomovethecontainer up grades.Safety and maneuverabilityofthe co11ectorof refuse's vehicles shall be prime considerations,but notthe only considerations,in determining accessibility.TheSanitation Technician,afterconsulting withthe property ownerifrequired,shall be thedeterminer ofaccessibilityafter conferringwith the collector of garbage and refuse.Ifthere is a dispute between the Sanitation Technician and the collector of garbage and refuse as to accessibility,the CityManager shall make the determination as towhether a location is accessible.The decision of the CityManager shall be final.Provided there is access to thecontainer,the collector of garbage and refuse shall pick up all commercial accounts where thecontainer is located whether the location is on private or publicly ownedproperty. D.Each container,cart,or can shall be kept clean inside and out so that no odor nuisance shall exist.Itshallbe the responsibility oftheperson using any container,cart,or can tokeep them clean unless thisresponsibility is altered by contract between the cityand the collector of garbage and refuse.In such a situation,the contract shall control.The area around the containers shall be kept ina neatandsanitary condition.The Sanitation Technician may place tags on garbage containersfound tobe inviolation of this subsection and notifythe property owner when theareas aroundthecontainer are not being kept ina nest and sanitary condition. AIItags and notifications shallbe dated and signed by the Sanitation Technician.Two (2)or more violations of this provision of this section shall subject the person responsible to the penalties described inChapter 1.08 of this code. E.Those containers or cans found tobe defective or illegal(defectivebottoms,crushed so thatlidswillnotfit,fifty-five (55)gallon barrels,waste baskets,paper drums,etc.)or any other containers thatare found to be illegal shall be subject to impounding and/or disposal.If a container received two(2)violations withina thirty(30)day period,the Sanitation Technician ofthe citymayauthorizeits destruction or impoundment. The container or can shall be stored bythecitynot to exceed ten (10)days.Ifafter ten (10)days the owner has not claimedand agreed to repair the illegal container or can,it willbe disposed of by thecity.The impoundment of an illegal container shall not relieve the owner from compliance with regulations inthis chapter. F.No garbage or refuse cart,can,or container shall contain earth,rocks,orheavy refuse.Any cart,can or container requiring a person to liftit shall not exceed fifty (50)pounds in total weight of container and refuse. G.Customers must restrain vicious dogs beyond reach ofthe garbage containers,carts,orcansandpreventanyinterferencewiththepickuppersononthisaccount. H.Large,suitablecontainers for collectionof garbage and refuse may,withthe approvaloftheSanitationTechnician,be used inthebusiness and commercialzones.Such containersshall be supplied by the collector of garbage and refuse ifthe collector of garbage and refuse is sorequiredbyhiscontractwiththecity,however,thatdoes not preclude anyperson from owning theirowncontainer(s)iftheyso desire. I.Compactors for industrial and commercial users shall be designed tobe compatiblewíthlocal sanitationtransportationequipment.The Sanitation Technician shall approve allcompactors used for commercial or industrial uses. J.AIIcarts,cans,containers,or compactors,shall complywith the Consumer Products Safety Commission laws and regulations.Itshall be theresponsibilityof theaccountholder assigned any container,or compactor to load itso thatitcan be legallyhauled on publichighways by the contractor ofgarbage and refuse.Containers shall not be loaded heavier thanfive hundred (500)pounds gross per cubic yard ofcapacity and inno event more thantwothousand(2,000)pounds. K.Itshall be the duty of every person in possession,charge,or control of any dead animal or upon whose premises the same may be located,toforthwith cause the same to be removed and disposed of. L.No person shall place theirgarbage,rubbish,refuse,solid waste,or other waste material in the container or garbage can of another. M.Itshall be the responsibility of each account holder or customer to managethecarts under theircustodyand control.The repair or replacementof allcarts damaged,destroyed,stolen, or lost as a result of the negligence of the account holder or customer shall be billed to the account holder or customer. Ord.2157Page5 8.08.070 Unlawful Disposal -Permits -Compost: A.It is unlawful for any person toburn,dump,collect,remove,or in anyother manner,disposeofgarbage,rubbish,refuse,solid waste,otherwastematerial,or swillupon any streets,alleys,publicplace or privateproperty within thecityotherwisethanas provided in thischapter. B.No personshallmaintainonhis premises inany residential zone in thecityany receptacle foroutdoorbumingofwastepaper,boxes,rubbish,paper,or cardboard.Persons in any zonemayburnbrush,leaves,grass,wood,limbs,weeds,or other vegetable typematter inthe openorinareceptaclesolongasanopenburningpermitisobtainedfromtheMosesLakeFireDepartmentandallotherlocal,state and federal laws are observed.In commercialandOindustrialzonesincineratorsmaybeconstructedinaccordancewithstandardssetbytheBuildingOfficialasadministeredundercontrolsoftheUniformBuildingCode. C.No compost pile shall be kept or maintained unless sufficient appropriate material orsubstance,approvedby the Sanitation Technician,is used toprevent the presence of flies,insects,bugs,rodents,or other pests ormenaces to public health and welfare. 8.08.080 Collection Frequencv:The collector of garbage and refuse shall collect,remove,and dispose ofallgarbageandrefuseintheresidentialsectionsofthecityatleastonceeachweek,and in thebusinessandcommercialzonesofthecityasrequired. 8.08.085 Ownership of Collected Waste:The collector ofgarbage and refuse shallhave titletoall garbage,rubbish,refuse,solid waste,and other waste material afterthe materialhas been collected bythecollectorofgarbageandrefuse. 8.08.090 Separation of Garbage:The city reserves the right to and may have the option to require theseparationofpaperorswillorothercomponentpartsofrefuse,and may require thedepositthereofinseparatecansorreceptaclesandmayprescribethemethodofdisposalthereof. 8.08.100 Imoermissible Actions:Itisunlawfulfor any person,firm,or corporationtodeposit,throw,orplaceswillorotherrefusematterinalane,alley,street,or other publicplace,or todeposit,throw,orplaceanyswilluponanyproperty,regardless ofownership,unless theswillis enclosed invessels or tanksof typeapproved by the Sanitation Technician,and whichare perfectly watertight andhavetightlyfittingcovers,which covers shall not be removed,except when absolutely necessaryforthedepositingandremovalofswill.Such vessels or tanks shall be kept in the rear of thepremisesorinthebasement,or other place authorizedbythe Sanitation Technician,so as to bereadilyaccessibleforcollectionandshallnotbekeptuponthestreet,alley,or sidewalkor publicplace.Allsuch tanks or vessels shall be promptly delivered tothe collector when called for andshallberetumedbyhimwithoutunnecessarydelay,and no person,except for the purpose ofcollectionunderlicense,shall inany manner interfere with thevessels or tanks or with contentsOthereof.Swill,offal,and other liquid or semi-liquid waste may not be placed in dumpsters orcontainershandledbythecollectorofrefusewithoutpermissionofthecollectorofgarbageandtheSanitationTechnician. 8.08.105 Construction and Demolition Waste:Construction and demolition waste maybe removed bythepersonorhisagentproducingsuchwasteortheymayhavethewasteremovedbythecollectorofrefuse. 8.08.108 Hazardous Waste:Hazardous waste shall notbe the responsibilityof thecollectorofgarbage andrefuseandshallbedisposedofinaccordancewithalllocal,state,and federal law directly bythepersonproducingsuchwaste.Whether waste is considered hazardous waste is the decision oftheSanitationTechnicianandhisdecisionisfinal. 8.08.110 Disposal of Garbage and Other Refuse:AIIdisposal of refuse shall be by sanitary fillmethodormethodsspecificadyapprovedbythestateDepartmentofHealth;provided,thatthemethod ormethodsshallincludethemaximumpracticablerodent,insect,and nuisance controlat theplaceofdisposal;and,provided further,thatanimal offalandcarcasses ofdead animalsshall be buriedorcrematedasdirectedbytheSanitationTechnicianorshallberenderedatforty(40)poundspersquareinchsteampressureorhigher,or heated by equivalent cooking. 8,08.120 Comoliance:Every person shall be responsible for disposal ofallgarbage promptly according tothetermsofthischapterandrulesandregulations. 8.08.130 Duties:Itshall be the duty of every person or companytocause theirgarbage and refuse to beremovedanddisposedofonlybythecollectorofgarbageandrefuse. 8.08.133 Billina-Service Charges: A.The city shall perform all billingof customers,the collectionof charges,service initiation,O changes in service and service deletions and willpay the contractor in accordance with hiscontract.The citymaywithholdpaymenttothecontractor ofanybillsdisputed by a customerforanyreasonuntilthedisputeisresolved. B.Charges forrefusecollectionand disposal may bebilledinconjunctionand simultaneously withstatementsissuedbythecityforwaterandsewerservice,ifany,unless theowner of the realestatewishesthegarbageseparated.Ifthe owner of the real estate wishes the garbage billseparated,the ownerof the real estate first must execute a form provided for by the City ofMosesLakeindicatinghisdesires.Theform shall contain,ata minimum,theowner ofthe realestate's nameand address,theaddress towhich he wishes the billsent,and a statement thatifthepersonattheaddresstowhichthebillissentmovesandleavesanunpaidbalance,theowneroftherealestaterecognizeshisresponsibilityforthebill.Ifgarbage charges becomedelinquenttheymaybetransferredtoandaddedtothewateraccountatthesameproperty, Ord.2157Page6 if a water account exists.However,the form of billingshall be at the city's discretion.If charges for refuse collection and disposal are billed in conjunction and simultaneous with statements issued by thecityfor water and sewer charges,all payments received from a customer shall be credited first to past due garbage charges,then theremainder,iftherebe any,first topast due sewer charges then to past due water charges.Payments on current accounts shall be credited first to garbage charges then the remainder,ifthere be any,to sewer charges then to water charges. C.The billingfor garbage service shallbe made in the name of the owner ofthe real estate served or a tenant at the direction of the ownerofthe real estate.Ifthe ownerof the real estate wishes the billsent to anotheraddress,the ownerofthe real estate first must execute a waiver form provided for by the Cityof Moses Lake.The form shall contain,at a minimum, the owner ofthe real estate's name and address,the address towhich he wishes the billsent, and a statement thatifthe personatthe address towhich the billissent moves and leaves an unpaid balance,the owner of the real estate recognizes his responsibility for the bill. D.The charges or accounts shall be paid at the cityhall thirty(30)days afterthedate of billing, and if notpaid,shall become delinquent on thethirty-first(31s)tdayafter the date of billing, Service may be suspended for nonpayment of such accounts.Such suspension shall not relieve theperson owing such account from theduty ofcomplyingwith the provisionsofthis chapter.Such suspension shall render thepremises where such service issuspended,subject tocondemnation for sanitary reasons. E,Upon failure topay the charges for garbage collection and disposal,the amount thereofshall become a lien against the real estate as provided for by law. F.New garbage accounts,changes of occupant,and changes in garbage service shall be submitted on forms prescribed by the cityFinance Department. G.The servicecharge toestablish a newgarbage account ortochange the occupant shall be the same as 13.12.085,Subsection C.Onlyone service charge shall be imposed iftheaccount includes jointchargingfor water,sewer,garbage service,or any combinationthereof. H.Adelinquent service charge shall applyto each garbage accounttobe thesame as 13.12.085, Subsection B.Only one delinquent service charge shall be imposed ifthe account includes jointcharging for water,sewer,garbage service,or any combination thereof. I.Property served by morethan one accountmust keep allaccounts current.Any charges for garbage service which are billed on accounts separate from the water account may be transferred to the water account at the same property if the garbage account becomes delinquent. 8.08.135 UtilityTax Passthrough: A.Section3.30.050 provides inpartfor thecollectionofa utilitytaxuponeveryperson,including the city,who engages in or carries on the business of sellingor furnishing sanitation orgarbagefacilitiesand/or servicefor domestic or industrial use.As a result of theoperationof the city sanitary division,the cityis subject to the utilitytax imposed by Section 3.30.050. B.The city is authorized to collect the percentage of gross income portion of the utility taximposedbySection3.30.050 from the users ofthe city's sanitary services byincluding oneach user's billingthe sum the citywould be liable to pay as a utilitytax on that basis. 8.08.140 Fee Schedule:Commencing with billingdates afterApril1,1993,except as otherwiseprovided, services and charges for garbage collectionshall be as follows (The garbage service description ineffect at the timethegarbage billis prepared shall be printed on the utilitybillfor each account with garbage service.): A.Residential Rates:Regular service at the curb or alley for collection of one ninety-six (96)gallon or less cart once per weekshall be as set forth on Schedule Aadopted in conjunction withthisordinanceand attached hereto.Additional items shallbe collected for the fee as set forth in Schedule A adopted in conjunctionwiththis ordinance.The charge as set forth in Schedule A per bag,bundle,or box shall be paid in cash in advance at the Moses Lake Finance Department withthe purchase of a coupon whichwillbe attachable and attached to the extra item.Service fees for duplexes shall be in accordance with the service fees as shown on Schedule A adopted in conjunction with thisordinance which willbe found on file in theofficeoftheFinance Director.Service fees forcondominiumsshall be the same as therate for regular residential service and shall be effective with billingdates after April1,1993 orasinthefuturerevisedbyindexing.Residentialrates may apply to mobilehome parks and planned unitdevelopments (PUDs). B.Commercial Rates:Service fees for,including but not limitedtoapartments,motels,planned unit developments,and mobilehome parks shall be in accordance with theservicefees asshowninScheduleAadoptedinconjunctionwiththisordinancewhichwillbefoundonfilein the Office of the Finance Director,except as modified by 8.08.140 A. C.Additional or Special Services:Additionalor special services desired by residential or commercial customersshall be arranged withthegarbage contractor andpaid tothecityat the rates for special garbage service in accordance with Schedule Aadopted in conjunctionwith this ordinancewhich willbe found on file in the Office of the Finance Director. D.Droo Boxes and Compactor Rates:Ifdrop box and compactor rates,other than 1 x month or 1 x monthtogetherwith extra pickup rates,are used;the rates are for an annual basis not to be adjusted seasonally.Compensation for unused pickups,ifany,are included in a reduced Ord.2157Page7 rate.Extra pickups when applicablemay be used with any service rate.Contractor willbepaidaminimumofone(1)timeper month servicefor drop boxes and compactorswhich shallincludeone(1)pickup per monththenthecontractor shallbe paidforadditional actual pickups. The garbage contractor shallsubmitall charges for special garbage service and alldrop boxandcompactorpickupsonformsprescribedbythecityFinanceDepartment. 8.08.150 Administration: A.If a home occupation is carried on in a residential zone as allowed by the CommunityDevelopmentDirectororothersimilarpositionordesigneeundertheMosesLakeMunicipalOCode,the resident shall pay only for residential service so long as thereis never more thanone(1)cart per week putout for collection.Intheeventa dispute arises over whether a homeoccupationshouldberequiredtopayresidentialorcommercialrates,theSanitation Technicianshallmakethedeterminationastowhatserviceisbeingusedorshouldbeusedandthereforwhatserviceistobecharged.The decision ofthe Sanitation Technician shall be final. B.Ifa commercialbuildingwith a single entrance,exclusive offire exits,has multiple tenants,theowneroftherealestateshallhavetheoptionofpayingforserviceforallthetenantsortheowneroftherealestateuponnotifyingtheCityofMosesLakeonaformprovidedbythecitycanrequirethetenantstopayforindividualservices.The form shall provide thatinthe eventthetenantfailstopayfortheservicerendered,the owner of the real estate shallassumeresponsibilityforthedebtandagreetopaythesame. C.Iftwo(2)or more typesofservice are available to a garbage account,both which adequatelyandsatisfactorilyservetheaccount,the ownerof the real estate or the partyreceiving theservice,depending upon thecircumstances,shall have the optionofselectingtheservice hewishestoreceivesolongasnounsanitaryconditioniscreatedasaresultoftheserviceselectionoftheowneroftherealestateorthepartyreceivingtheservice,if a dispute arisesbetweentheowneroftherealestateorthepartyreceivingtheserviceandthecollectorofrefuseconcerningthetypeofcollectionserviceanaccountshouldbereceiving,theSanitationTechnicianshallmakethedeterminationastowhattypeofserviceistobecharged.ThedecisionoftheSanitationTechnicianisfinal. D.The type of service to be utilized by commercialaccounts and the attendant fee shall beagreeduponbytheowneroftherealestateservedorthepartyreceivingtheservice,depending upon thecircumstances.Ifa dispute arises between theownerof the realestateorthepartyreceivingtheserviceandthecollectorofrefuseconcerningthetypeofcollectionseiviceanaccountshouldbereceiving,the SanitationTechnician shall make thedeterminationastowhattypeofserviceistobecharged.The decision oftheSanitation Technician shall be E. aeLmonthly rates established inScheduleA areallinclusiveand intended as annualrates forresidentsandbusinessesdesiringlongtermserviceofatleastone(1)year,Residents orbusinesseswantingtemporaryservicewillberequiredtopayindividualchargesforcontainerdelivery,dumping,and pickupper Schedule A. F.The cityshall havethepower,from tirnetotime,by resolution or afterCouncil considerationbymotiondulymadeandpassed,to set forth and determine additional rules and regulationsandothermattersasmaybenecessaryinthediscretionoftheCityCouncilforthepropere×ecutionofthischapter. 8.08.160 Violation-Penalty:Aviolation ofthissection shallbe punishable as defined inChapter 1.08 of theMosesLakeMunicipalCode.
