AN ORDINANCE AMENDINGCHAPTER13.12 OF THE MOSES LAKEMUNICIPALCODEENTITLED"WATER AND SEWER RATES"
THE CITY COUNCIL OF THE CITYOF MOSES LAKE,WASHINGTON DO ORDAINAS FOLLOWS:
Section 1.Chapter 13.12 of theMoses Lake Municipal Code entitled "Water and Sewer Rates"is amended
as follows:
13.12.010 Residential Water Rates:
A.The following shall be the monthly rate charge for water from the city water system from allresidentiallivingunitswithinthecorporatelimitsofthecityandoutsidethecorporatelimitsofthecityafterMay1,2004:

A.The followingshall be the monthly rate charged for water from the city system for a dwellingwithtwo(2)separate livingunits withinthecorporate limitsofthecity and outside the corporatelimitsofthecitywithonlyone(1)meter servingtwo (2)livingunitsorfor two(2)houses on asinglelotservedbyone(1)meter after May 1,2004:

13.12.020 Commercial Water Rates:
A.The following shall be the monthly rate charged for water from the city water system for
commercial users and dwellings with three (3)or more livingunits served by one (1)meter
within the corporate limits of thecity and outside thecorporatelimits ofthe cityafter May 1,
2004:

13.12.030 Residential Sewer Rates:The following shall be the monthlyrate charged customers residing
within the corporatelimits ofthe city and outside the corporatelimits of the cityfor sewer service
from the citysewer system for single-family dwellings and each unit ofa duplex with separate
meters:flat rate,$26.65per monthafter May 1,2004.
13.12.035 Duplex Sewer Rates:The following shall be the monthly rate charged customers residing within
thecorporate limitsofthecityand outsidethe corporatelimits of thecityforsewer servicefrom the
city sewer system for duplexes with onlyone (1)meter servingtwo(2)livingunits or for two(2)livingunits ona singlelotserved byone (1)meter:flat rate,$53.30per month after May1,2004.
13.12.040 Commercial Sewer Rates:
A.The followingshall be the monthly ratechargedcustomers residing withinthe corporatelimits
of the cityand outside thecorporate limits ofthe city for all chargeable water discharged into
thecitysewer system by commercial users and dwellings with three (3)or more livingunits
served by one (1)meterafter May 1,2004:

B.For purposes of calculating sewer charges,chargeable water shall be defined as follows:
Chargeable water shall be measured by the water consumed on the premises,whateverthe
source of such water,and the same will be rnetered either by a public utilitymeter or oneinstalledandmaintainedbytheownerofthepremisesathisownexpenseandapprovedand
inspected by the city.As an option,if requested by the owner of the premises,the city will
install a watermeterwith the cost for the meter and installation being paid by theownerofthepremisesinaccordancewiththechargesassessedinMLMC13.08.020 for water/sewer
connections.Under such circumstances thewater meter becomes theproperty oftheowner
ofthe premises and allcosts ofreplacement and repair are the responsibility ofthe owner of
the premises.In allcircumstances where the water is metered bya privately owned water
meter and is used to determine sewer charges,the cityshallbe allowed access to themeter
inordertoread such meter.Where the use ofwater issuch thata portionofallthewater used
does not flowintothe sewer systern,forwhateverreason,but is lost byevaporation,irrigation,
sprinkling or is used in manufacturing or in a manufacturedproduct,or is lost for whatever
reason,and the person incontrolprovides proof ofthisfact and installs a meter or other mea-
suringdevice approved by the cityto measure the amount ofwater so used and so lost,or if

the cityis capable of determining theamountofsewage enteringthe city's sewer system by
some other mechanical means,thiswater may be deducted from theactualwaterconsumptionusedincalculatingthesewercharge.
The sewer charges for triplexesand apartments,mobilehome parks,schools,hospitals andothercommercialestablishmentswithincreasedusageforirrigation,only iftheirlandscapingexceedsfivethousand(5,000)square feet,shall be computed on theaverage consumptionduringthepreviousnon-irrigationseason,unless theuser elects toinstall,at his expense,anOapprovedmeasuringdevicetomeasurewaternotenteringthesewersystem.When a userhasaswimmingpoolorcoolingunitsdischargingtothesanitarysewer,he must install anapprovedmetertodeterminetheamountofwaterexemptfromsewerchargesduringtheirrigationseason.The irrigationseason shallbe defined as the period inwhich statements aremailedfortheAprilthroughNovemberbillingcycles.
C.Sewer rates for commercial uses discharged into the sewer system may be separatelydeterminedbytheCityCouncil,based upon both volume and chemical characteristics ofthesewage.The City Councilreserves the privilege to require pre-treatment of any materialdischargedintotheseweragesystem,or to prohibit discharge into the system of industrialwastesthat,because of either volume or concentration,will overload existing seweragefacilities.
D.AIIair-conditioningand refrigeration units thatare installed,replaced or that have capacityincreasedaftertheeffectivedateoftheordinancecodifiedinthischaptershallberequiredtoinstallrecirculatingunits.Disposal may not be accomplished by discharging intothesanitarysewersystem.
Section 2.This ordinance shall take effect and be in force five (5)days after its passage and publicationofitssummaryasprovidedbylaw.
