2186_00001ORDINANCE NO.2186 AN ORDINANCE CREATINGCHAPTER 17,52 OF THE MOSES LAKEMUNICIPALCODEENTITLED"BOUNDARYLINEADJUSTMENTS" THE CITYCOUNCILOF THE CITY OF MOSESLAKE,WASHINGTON DO ORDAINAS FOLLOWS: Section 1.Chapter 17.52 oftheMosesLake Municipal Codeentitled "Boundary LineAdjustments"is createdasfollows: O 17.52.010 Purpose:The purpose of thischapter is toprovide a methodfor summary approval of boundarylineadjustmentsbetweenplattedorunplattedlotsorboth,which do not create any additional lot,tract,parcel,site,or division,nordoes itcreate a lotcontaininginsufficient area and dimension tomeetminimumrequirementsforwidthandareaforabuildingsite,while insuring that suchboundarylineadjustmentsatisfiespublicconcernsofhealth,safety,and welfare. 17.52.020 Processing:Boundary lineadjustments are notproject permits,as defined inRCW 36.70B.020(4),and are not subjecttothe processing requirements pursuant toRCW 36.70B.104. 17.52,030 Aoplication and Fees:Boundary lineadjustmentapplications shallbe subrnittedtothe CommunityDevelopmentDepartmentforreviewandapproval,together with four (4)copies of the entirecontiguoustractownedbytheapplicant,and allinformation requested for short plat applications,as described inthis code.In addition,the applicant shall submit a non-refundableapplication feeassetforthinMLMCChapter3.54.These fees willbe used for administrativecosts incurred bythecity,andare not refundable.The applicant shall be responsible for allengineering,legal,andotherconsultingfeesandcostsincurredbythecitytotheextentsaidfeesandcostsexceedtheapplicationfees,andtheapplicantshall be advised ofthe costs by theCommunity DevelopmentDepartment.The applicant shallpay such costs before theboundary line adjustmentis recordedbytheCommunityDevelopmentDepartmentpursuanttoMLMC17.52.100. 17.52.040 Time Frame for Aporoval:The Community Development Director shall approve,disapprove,orreturntheboundarylineadjustmentincompliancewiththischaptertotheapplicantwithinthirty(30)days of thefiling thereof,unless the applicant consents toan extension of thetime period. 17.52.050 Notice: O A.Posting:A noticeofthe proposed boundary line adjustment shallbe posted in a conspicuousplaceonoradjacenttothesubjectlandorproperty,and a copy of such notice also shall bepostedinaconspicuousplaceattheCityHall. B.Mailed Notice:Noticesshall be sent to the owners of all real property within a radius of onehundredfeet(100')ofthesubject land or property.The requirementof thissubsection shallbesatisfiedifnoticesaremailedtothepersonorpersonsshowntobetheownersofsuchpropertyontherecordspertainingtheretointheofficeoftheGrantCountyAuditor,Iftheowneroftherealpropertysubjecttotheboundarylineadjustmentownsanotherparcelorparcelsofrealpropertywhichlieadjacenttotherealpropertysubjecttotheboundarylineadjustment,notice under thissection shall be given toowners ofreal property located within one hundred feet (100')of any portion of theboundaries ofsuch adjacently owned parcels ofrealpropertyownedbytheowneroftherealpropertytobesubdivided. C.Time of Notice:All notices shall be posted and sent not less thanseven (7)days afterapplicationhasbeenmadewiththecityfortheboundarylineadjustment. D.Form of Notice:Mailed and posted noticesshall state the name and street address of theapplicant,the legal description ofthe property involved,and describe thegeneral nature of theboundarylinerequested.Allposted notices shall containa sketch of all property within aradiusofonehundredfeet(100')from the property involved,and the sketch shall identifyclearlythepropertysubjecttotheboundarylineadjustment.Nosuch sketch ordrawing shallberequiredonmailednotices. E.Expense of Notice:AIIexpenses involved incarryingout theconditionsand requirementsofthissectionshallbebornebytheapplicant. O 17.52.060 Criteria for Aporoval:The Community Development Director shall approve an application for aboundarylineadjustmentifitisdeterminedthat: A.No additional lot,tract,parcel,site ordivision willbe created by the proposed adjustment. B.No lot is created which contains insufficient area and dimensions to meet the minimumrequirementsofthezoneinwhichthelotsaffectedaresituated. C.No lotis createdwhich does not have adequate drainage,watersupply,and sanitary sewagedisposal,and access for vehicles,utilities,and fire protection. OrdinanceNo.2186 Page 2 D.The boundary line adjustment is consistent with theapplicable provisions ofthecity's zoning code. 17.52.070 Acceals:Any person aggrieved by the decision of the Community Development Director to approve ordisapprove a proposed boundary line adjustment mayappeal thedecision to the City Council within ten (10)days following issuance of thedecision.Uponreceipt of theappeal,the City Council shall consider the matter de novo and may affirm or reverse the decision of the Community Development Director or mayremandthe application tothe Community Development Director with instructions toapprove or disapprove the same. 17.52.080 Recordation:The original approved boundary line adjustment shall be filed for record by the Community Development Department and shall not be deemed approved until so filed.Two (2) reproducible copies and one (1)paper copyshall be furnished by the applicanttothe Community Development Department. Section 2.This ordinance shalltake effect and be inforce five (5)days after its passage and publication of its summary as provided by law.
