AN ORDINANCE CREATING CHAPTER 8.54 OF THE MOSES LAKEMUNICIPALCODEENTITLED"ABANDONEDVEHICLES AND JUNK"
THE CITYCOUNClL OF THE CITY OF MOSES LAKE,WASHINGTON DO ORDAIN AS FOLLOWS:
Section 1.Chapter 8.54 of the Moses Lake Municipal Code entitled "Abandoned Vehicles and Junk"iscreatedasfollows:
8.54.010 Purpose:The purpose of this chapter is to preserve the character and safety of the city'sneighborhoodsbyeliminatingaccumulatedjunkstoredonpropertywhichmaybecharacterized
as nuisances.
8.54.020 Definitions:For the purposes of this chapter the following words shall have the followingmeanings:
A."Abandoned Motor Vehicle"means any motorvehicle which has been abandoned and isunclaimedbyitsowneroranyotherpersonhavinglawfulpossession,
B."Disabled Motor Vehicle"means any motor vehicle which is disabled and incapable of beingoperatedorwhichhasbeenpermittedtoremainwithoutbeingoperatedandinastateofdisrepairforover30days.The term shall include any and all automotive parts,whether
assembled or not.
C."Junk"means all abandoned and disabled motor vehicles,allolddiscarded appliances,orpartsthereof,all old iron or other metal,glass,paper,cardboard,old lumber,old wood,oldmattresses,discarded furniture,and allother waste or discarded material.
8.54.030 Unlawful to Keep or Store Junk:It is unlawful for any person toaccumulate,keep,or store,orpermitanyotherpersontoaccumulate,keep,or store any junkon any privately owned propertywithinthecityortoaccumulate,keep,or store any junk in a building that is not wholly enclosed,except for doors for ingress and egress.
8.54.040 Notice ofViolation:Before any person is charged with a violation of thischapter,the BuildingOfficialorhisdesigneeshallcausenoticetobegivenintheformsetforthinMLMC8.14.050.
8,54.050 Nuisance Declared:Inadditiontobeing a violation of thischapter,the accumulation,keeping,orOstorageofjunkonanyprivatelyownedpropertywithinthecityisdeclaredtobeapublicnuisance
as set forth in MLMC8.14.
8.54.060 Not Applicable or Properly Zoned :This chapter shall not apply to any automobile wrecking
búsiness located ina proper zone nor shallitapplyto any appliance dealer who ina proper zonehascompliedwithallapplicablezoningrequirementsnortomaterialstoredonpremisesofanymanufacturingenterpriseforuseinconnectionwithsuchenterprisesolongastheenterpriseisconductedinaccordancewithzoningandotherordinances.
8.54.070 Penalty:Failure tocomply with any provision of this chapter shall subject the responsible persontothefollowingpenaltiesastheyaredefinedinChapter1.08 ofthiscode.Each violation shallconstituteaseparateviolation.Each day a violation exists constitutes a separate violation:
A.First offense C-17
B.Second offense withinany twelve(12)month period C-13
C.Third offense within any twelve(12)month period or forfailure toabateaparticularnuisanceafterbeingfoundguiltyofafirstoffense.C-6
D.Fourth offense within any twelve(12)month period or for failure toabateaparticularnuisanceafterbeingfoundguiltyofasecond
or subsequent offense.C-2
Section 2.This ordinance shall take effectand be in force five (5)days afterits passage and publication ofitssummaryasprovidedbylaw.
