CODE ENTITLED "FIRE DEPARTMENT PERMIT FEES*"
THE CITYCOUNCIL OF THE CITYOF MOSES LAKE,WASHINGTON DO ORDAINAS FOLLOWS:
Section 1.Chapter 16.40 of the Moses Lake Municipal Code entitled "Fire Department Permit Fees"is
created as follows:
16.40.010 Permit:Apermit shallbe obtained from the Moses Lake Fire Department prior toengaging inthefollowingactivities,operations,practices,orfunctions:
A.Aerosol product storage (level2 or 3 above 500 lbs)$$0
B.Aircraft Refueling Vehicle $50
C.Battery Systems Exceeding 50 Gallons $50
D.Carnivalsand Fairs $50
E.Dust Producing Operations as defined in Chapter 13,I.F.C.$50
F.Explosives or Blasting Agents -storage $50
G.Flammable and Combustible Liquids as Listed in I.F.C.Section 105.6.17

16.40.020 Permit Applications:Applications for permits shallbe made to the Moses Lake Fire Department
Fire Prevention Divisioninsuch form anddetail as prescribed bythe city.Applications for permits
shall be accompanied by such plans as required by the city.When more than one permit is
required for the same location,such permits may be consolidated into a single permit.
16.40.030 Permission Granted by Permit:Apermit constitutes permission tomaintain,store,use,or handle
materials,or toconductprocesses which produce conditions hazardous tolife or property,or to
install equipment used inconnection with such activities.Such permission shall not be construed
as authorityto violate,conceal,or set aside any of the provisions ofthis chapter.
16.40.040 Compliance with International Fire Code:Permit applicants and the applicants'agents and
employees shall carryoutthe proposed activity incompliance withthe International FireCode and
other laws and regulations which are applicable,whether or not specified inthis chapter,and in
completeaccordance with approved plans and specifications.
16.40.050 Postinq of Permit:Permits shallbe kepton the premises designated within the permit atalltimes
andshallbe posted ina conspicuous location onthepremises ina location designated bythe Fire
Chief.Permits shall be subject to inspection at all times by an officer of the Fire or Police
Department or other persons authorized by the Fire Chief.
16.40.060 Permit Revocation:A permit shall continue until revoked or for such a period of time as
designated within the permit at the timeofissuance.Permits shall not be transferred and any
change in use,occupancy,operation,or ownership shallrequire a new permit.The Fire Chief is
authorized to suspend or revoke a permit when it is determined by theChief that:
A.The permit was used by a person other thanthe person towhom the permit was issued.
B.The permit was used for a location other than that for which itwas issued.
C.Any ofthe conditions or limitations set forth in the permit have been violated.
D.The Permittee failed,refused,or neglected tocomply withtheorders or notices duly served
inaccordance with theprovisions ofthe International Fire Code withinthe timeprovided within
the International Fire Code.
E.There has been a false statement or misrepresentation as toa material fact inthe application
or plans on which the permit or application was based.
F.The permit was issued in error or inviolation of an ordinance,regulation,or the International
Fire code.
Any revocation by the FireChief can be appealed to the Moses Lake CityCouncil within ten (10)
days of receivingthe revocation notice,
Section2.This ordinance shall takeeffectand be in force five(5)days after its passage and publication of
its summary as provided by law.
