ANORDINANCE AMENDINGCHAPTER 18.20 OF THE MOSES LAKEMUNICIPALCODEENTITLED"RESIDENTIALZONES"
THE CITYCOUNCIL OF THE CITYOF MOSES LAKE,WASHINGTON DO ORDAIN AS FOLLOWS:
Section 1.Chapter 18.20 of the Moses Lake Municipal Code entitled "Residential Zones"is amended asfollows:
18.20.060 Accessory Uses,Buildings,or Structures:
O A.Allaccessory uses,buildings,and structuresmust be customarilyincidental andsubordinatetotheprincipalbuildingoruseofthelotuponwhichitislocated.
B.Where there is a question regarding the inclusion or exclusion of a particular accessory usewithinanyzoneclassification,the Community Development Director shall have theauthoritytomakethefinaldetermination.The determination shall be based upon the generalstandardsofthissectionandonananalysisofthecompatibilityoftheuseorstructurewiththepredominantsurroundinglandusepatternandwiththepermittedprincipalusesofthe
zone classification,
C.The followingstructures are customarily incidental to residential uses:
1.Carports or garages for the sole use of occupants of premises and theirguests,attached
or detached,for storage of motorvehicles,boats,and/or recreational vehicles.
2.Greenhouses,private and non-commercial.
3.Storage buildings foryard maintenance equipment and household goods.
D.Accessory uses,buildings,and structures,other than fences and retaining walls,areprohibitedfrombeinglocatedonalotpriortoalegalprincipaluse.
E.Inthe R-4 Zone,accessory buildings orstructures intended for the keeping and maintenanceoflivestockshallbeincompliancewithSection18.20.160.G of this chapter.
F.Detached accessory buildings or structures are permitted in compliance withtheuse andbulkregulationsandperformancestandardsofthischapter,provided that:
1.The height of theaccessory building or structure shall not exceed the maximumheightlistedinTable2.
2.Detached accessory buildings or structures shall complywith the front and side yardsetbackrequirementsofthischapter.
3.There shall be no required rear yard setback except as required by the State BuildingCode.For the purposes of this section only,on a through lot,the CommunityDevelopmentDirectormaydeterminethatoneofthefrontagesofathroughlotfunctions
as a rear lot line and therefore does not require a rear yard setback for a detachedaccessorystructure.In making such a determination,the Community DevelopmentDirectorshallconsidertheorientationoftheprimarystructureonthelotandthedevelopmentofotherlotsinthesameareaorneighborhood.
4.No detached accessory building or structure shall be constructed on or over right-of-wayoronoroverapubliceasement.
5.For structures accessory to residential uses in the R-1,R-2,and R-3 Zones,the totalgroundareaofaccessorystructuresmaynotexceed60percent(60%)ofthe totalareaoftheprimarydwellingunit,unless all of the following conditions are met:
a.The total area of all detached accessory structures does not exceed the size of theprimarydwellingunit,or 850 square feet,whichever is less.
b.No morethan 35%of the lot may be covered by buildings.
c.The roof pitch ofthe accessory building(s)shall be at least 3 vertical to12horizontal.
6.The accessory building shall be at least five feet (5')from theprimary building on the lot.Separation between accessory buildings shall be as regulated bytheState Building Code.
Section 2.This ordinance shall take effectand be in force five (5)days after its passage and publicationof
