ANORDINANCE DELETING CHAPTER 13.06 OF THE MOSES LAKEMUNICIPALCODEENTITLED"WATER REGULATIONS"ANDCREATING CHAPTER 13.07 OFTHEMOSESLAKEMUNICIPALCODEENTITLED"WATER REGULATIONS*"
THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON DO ORDAINAS FOLLOWS:
Section 1.Chapter 13.06 of theMoses Lake Municipal Code entitled "Water Regulations"is deleted in itsentirety.
O Section 2.Chapter 13.07 of the Moses Lake Municipal Code entitled"Water Regulations"is created asfollows:
13.07.010 Water Rationing:
A.Purpose:Water rationing may be necessary when theMunicipal Services Director determinesthatthecitywatersystemisinsufficienttomeettheforecasteddemandforanywaterdistributionzoneofthecitywatersystem.
B.Notice to Begin Water Rationing:The Municipal Services Director willplace a notice in thelocalnewspaperandprovideapublicannouncementtotheradiostationsthatareinthearea.The noticewillstate the restrictions for individuals or organizations for irrigating and washingvehicles.Water rationing willbe effective immediately upon publication and broadcast.
C.Restrictions:Addresses with odd numbers shall be allowedto irrigate and wash vehiclesonodd-number calender days.Addresses witheven numbers willbe allowedto irrigate andwashvehiclesoneven-numbered calender days.Properties with irrigation meters thataretwoinches(2")and larger willbe restrictedto irrigate from midnight to 8:00 a.m.or on ascheduleapprovedbytheMunicipalServicesDirector.
D.Notice to End Water Rationing:The Municipal Services Director willplace a notice inthelocal
newspaper and provide a public announcement to the radio stations thatare inthe area thatstateswaterrationingisnolongerrequired.
13.07.020 Connection to City Water System:
A.Purpose:The requirement toconnect tothecitywater system isto reduce the need for GroupAandBwatersystems;and to reduce well bore holes,which are potential contamination
sources.
O B.New Buildings:Allnewly constructed buildings thatwillhave human occupancy,as definedinthebuildingcode,shall be connected tothecitywatersystem.
C.Existing Buildings:Owners of allexistingbuildings that have human occupancy,as definedbythebuildingcode,that are withintwohundred feet (200')of thecitywater system shall berequiredtoconnecttothecitywatersystemwithinsix(6)months of city notification;providedthat,single and duplex residences willnot be requiredtoconnect ifthe cost of making theconnectionexceedssixthousanddollars($6,000).AIIconnections shall be at the owner's
expense.
D.Private Water Systems:Properties that are connected to a private water system that isapprovedbytheDepartmentofHealthareexemptfromMLMCChapter13.07.
13.07.030 Water Main Extensions:When water mains are extended,the water mains shall be installed attheexpenseoftheprospectiveuser,and the water mains shall be installed forthefullfrontageofpropertybeingserved.All water main extensions are required to be constructed perconstructionplansthatareprovidedbytheprospectiveuser,as submitted by a professionalengineer,and approved by the Municipal Services Department
13.07.040 Water Service Turn On and Off:Water services shall not be turned on untilall systemdevelopmentcharges,tappingfees,reimbursement,and other fees due tothecity have been paidinfull;any necessary extraterritorial agreements have been signed;and all zoning and buildingcodesaremet.The city may turn off water services that do not conform with any of theaforementionedrequirements.
13.07.050 Ownership:
A.City Ownership ofWater Mains:The City shall have ownership of all water mains thatarelocatedwithinright-of-wayor a municipal easement,provided thatthe watermainshave beenacceptedbytheCityCouncil.City ownership for water mains that extend onto private
O property withouta municipaleasement terminates at thedownstream side ofthe isolationvalvelocatedinright-of-way,or at the right-of-way linewhen there is no isolation valve.
B.City Ownership of Service Lines:City ownership extends from the water main to thedownstreamsideofthemetertilewhenthemetertileislocatedwithinright-of-way or amunicipaleasement.Cityownership extends from thewater main tothe isolation valve intheright-of-way when the meter is located on private property;or totheright-of-way line whenthereisnoisolationvalveintheright-of-way.
C.Cityownershipofmeters:The cityshall ownallmeters regardless ofwhether theyare locatedwithinright-of-way or on private property.
D.Private Ownership of Water Mains,Service Lines,and Appurtenances:All water mains,servicelines,and appurtenances thatare notdescribed inAand Bofthissectionare privatelyowned.All maintenance,repairs,and operations on private water mains and service linesaretheowner's responsibility.

13.07.060 Water Use:
A.Wasting water as a resultof leaking pipesand using water for purposes otherthan whatwouldbenormallyusedtoservicethepropertyisprohibited.
B.No connectionwillbe made to allow supplying water from one property toanother property.
13.07.070 Water Service Connection:
A.Allwater service connectionsshallbe metered,and allseparate buildings shall be separatelyconnectedtothecitywatersystem;exceptthat separate buildings whích are an integral partofasinglebusinessorindustryorareundersingleownershipmaybeservedbyamaster
meter serving the property.The charges listed in Moses Lake Municipal Code Chapter 3.58
shallbe made by the city for a water service connection,and the charges shall be paid in full
before a connection is made tothe city-owned meter.
B.The property owner is responsible to supply and install the service line,saddle,setter,tile,ring,lid,and all fittingsfor connectingto the water main per Community Street and UtilityStandards.Itshall be theresponsibility ofthe property ownertoschedulethe actualtap tothewatermainandtheinstallationofthemeterwiththeWaterDivision.
C.Should water consumption exceed therated capacity ofthe water meter,the city may replacethemeterwithalargermeter.Costs assessed shall be as listed in Moses Lake MunicipalCodeChapter3.58.
D.Meters larger than twoinches (2")shall be purchased and installed by owner,consistent withtheCommunityStreetandUtilityStandards.
E.The charges listed in Moses Lake Municipal Code Chapter 3.58 shall be made on newlyconstructedwatermainsforwaterpuritysamples,fillingand flushing mains,and connecting
to existing mains.
13.07.080 Private Use of Fire Hydrants:The Municipal Services Director may approve fire hydrants to beusedasatemporarysourceofwaterforconstructionwork,for fillingswimming pools,and for
special events.Fire hydrants shall not be approved for irrigation,for businesses,or for long-term
usage.Allwater users who are approved for temporary use of a fire hydrant shall obtain ahydrantmeterfromtheWaterDivision,or use a meter that has been approved by the WaterDivision.This meter shall be used whenever a connection is made to the fire hydrant In theeventthattheWaterDivisiondoesnothaveawatermeteravailableandtheuserdoesnothavetheirown,the Water Divisionshall issue a placard thatindicates the dates that the user can usethefirehydrant.The approved user shall attach theplacard tothefire hydrant when using the firehydrant.Allhydrant users shall follow the guidelines for hydrantuse per the CityofMoses LakeCommunityStreetandUtilityStandards.
13.07.090 Insufficient Water Suppiv:The city reserves the right at any time,without notice,to shut offthe
water supply for repairs,extension,nonpayment ofrate,orfor any other reason;and thecityshall
notbe responsible for any damage such as bursting of boilers supplied by direct pressure,thebreakingofnewpipesorfixtures,any damage toproperty caused byfire on account ofinsufficient
water supply or pressure,orfor any other damage resulting from the shutting offofwater or from
the insufficiency of the supply of water or pressure.
13.07.100 Tampering with System:Tampering withor connectingto the City water or sewer system andtheirappurtenancesisnotauthorizedwithoutwrittenapprovalfromtheCity.Approval maybe
obtained by makinga request on forms that are provided by the City.
13.07.110 Liabilityfor Expense or Damage:
A.Damage resulting from an accident,from unauthorized use,orfrom improper use of the city
water facilities shall become an obligation against the agency or person causing such
damage.
B.Additionally,any person violating any of the provisions of thischapter shall become liable tothecityforallexpense,joss,or damage occasioned to the city by reason ofsuch violation.
The cityshall be compensated forsuch loss withinthirty(30)days ofnotification totheviolator
of the costs.Ifnot satisfied by thattime,the costs shall be filed as a lien against the property.
13.07.120 Notice to Cease Violation:Any person found tobe violating any provision of thischapter shall be
served by thecitywithwritten notice stating the nature ofthe violation and providing a reasonable
time limit for the satisfactory correction thereof.The offender shall permanently cease allviolationswithintheperiodoftimestatedinsuchnotice.
13.07.130 Penalty for Continued Violation:Any person who continues any violation beyond the time limit
provided for in Section 13.07.130 is deemed to have committed a civil infraction,and uponconvictionthereof,shall be subjectto a C-13 penalty and punishable as defined in Chapter 1.08
of the Moses Lake Municipal Code.Each day inwhichany such violation continues is deemed
a separate offense.Failure or refusal tocomply shall constitute grounds for discontinuing water
service to the premises untilthe Municipal Services Director determines thatsuch requirements
have been satisfactorilymet.

Section 2.This ordinance shall take effectand be in force five (5)days afterits passage and publication of
