ANORDINANCE AMENDINGCHAPTER 18.40 OF THE MOSESLAKEMUNICIPALCODEENTITLED"INDUSTRIALZONES"
THE CITYCOUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON DO ORDAIN AS FOLLOWS:
Section 1.Chapter 18.40 of the Moses Lake Municipal Code entitled "Industrial Zones"is amended asfollows:
18.40.010 Purpose:The purpose of thischapter is toprovide for:
A.Business and manufacturingemployment opportunities for existing residents of thecity andthoseintheadjacentarea;
B.A variety of industrial uses,in limited and appropriate areas,to accommodate existing
industries and minimize adverse impacts tothe environmentand surrounding uses;
C.Protection of residential and other uses from adverse impacts from manufacturing andindustrialuses;
D.Protection ofindustrial areas from otheruses that may interfere withthe purpose and efficientoperationofthoseareas.
The Moses Lake Industrial Park (MLIP)Zone is intended to accommodate small scale lightindustrialusessuchascontractorshops,vehicle repair,storage,and distribution.
The Light industrial (L-I)Zone is intended to accommodate a variety of light industrial usesincludingbutnotlimitedtomanufacturing,warehousing,distribution operations,processing andfabricating,and topreserve land for such use.
Except thatthe Light Industrial zoned property withinonethousandfeet (1,000')ofWest Broadway
or Marinashall provide areas for all typesof service and commercial establishments in additiontolightindustrialuses.
The Heavy Industrial (H-I)Zone is intended toaccommodate heavy industrial.uses andtopreserveOlandforsuchusesatlocationsthatwillpermitlessrestrictiveindustrialperformancestandardsandbulkregulationsthanarerequiredintheL-1 Zone,thereby providing greater flexibilitytoaccommodateavarietyofheavyindustrialusesincludingbutnotlimitedtomanufacturing,fabricating,processing,warehousing,distribution operations,andassembly.(Ord.2144,12/9/03)
18.40.030 Allowed Uses:
A.The Industrial Land Uses table indicates where categories ofland uses may be permitted andwhetherthoseusesareallowedoutrightorbyconditionalusepermit.Only industrial zonesareincludedinthistable.Land uses not listed are prohibited unless allowedthroughthe
process specified in MLMC 18.40.030.E.Further interpretation of these zones may beobtainedasspecifiedinMLMC20.03.020.B.Land uses are also subject to any footnotescontainedwithinthischapter.
B.The uses are arranged in three (3)categories.There are primary uses,those uses theindustrialzonesweredesignedtoaccommodate;accessory uses;and other uses thatarecompatiblewithorsupporttheprimaryuses,or are not appropriatefor otherzones becauseofimpacts.
C.The symbols used in the table represent thefollowing:
1.An "A"ina tablecellindicates thattheuse is allowed subjecttotheapplicablestandardsinthiscodeinthezonelistedatthetopofthetable.
2.A "C"ina table cell indicates that the use is allowedby conditionaluse permit,subjecttotheconditionaluseprovisionsinMLMC18.51 and any additionalstandards specified.
3.An "X"in a table cellindicates the use is not allowed in the zone listed at the top of thetable.
D.Procedural requirements for permits are described in MLMCTitle 20.
E.Uses similar tothose listed may be established as allowed orconditionallyallowed throughtheinterpretationproceduresinMLMC20.03.020.B.In determining whether a use should bepermitted,theCommunity Development Director shall refertothepurpose statements foundin18.40.010 and the 1987 version of theStandard Industrial ClassificationManual

1.Incompliance withtheperformance standards ofthe State ofWashington siting criteria foron-site hazardous waste treatmentand storage facilities and therequirementsof this chapter;provided that,on-site hazardous waste treatmentand storage facilities are accessory toandsubordinatetoaprimaryusewhichisageneratorofhazardouswaste.
2.Previously prepared materials are those which have been subjectedto a process ofdilution,blending,separation,waste extraction,refinement,or similar process so that furtherpreparation,treatment,orprocessing does not generate raw refuse matter in quantity or formwhichwouldprecludepromptandeffectiveremovalofsuchmatterfromthesite.
3.Other thancontractors yards.
4.Construction storage facilities may be located ten (10)days prior to start of constructionandshallberemovedwithinten(10)days of finish of construction.Start of construction shall bedefinedasten(10)days prior to the physical presence of construction activityonthe site forwhichabuildingpermithasbeenissued.Finish ofconstructionshall be definedas thedateofissuanceofaCertificateofOccupancy.
5.The sole purpose of the dwelling is to furnish housing for an employee,including family,engaged in on-site security or maintenance.Only one such residence is allowedper site.
6.Allowed if allowedin the C-2,and conditional use ifa conditional use in the C-2
7.Wholesale sales only.
Section 2.This ordinance shall take effect and be in force five (5)days after its passage and publication of
its summary as provided by law.
