ANORDINANCE AMENDINGCHAPTER 12.08 OF THE MOSESLAKEMUNICIPAL
CODE ENTITLED"COMMUNITYSTREET AND UTILITYSTANDARDS"
THE CITYCOUNCIL OF THE CITYOF MOSES LAKE,WASHINGTON DO ORDAINAS FOLLOWS:
Section 1.Chapter 12.08 of the Moses Lake Municipal Code entitled "Community Street and UtilityStandards"is amended as follows:
12.08.010 Standards Adopted:Inorderto provide for a uniform standard forall work performed bythe City
or on theirbehalf,the city adopts by reference all terms and conditions of the StandardSpecificationsasrevisedbytheAmericanPublicWorksAssociation,and with themodifications,additions,and exceptions included in the City of Moses Lake's Community Street and UtilityStandards.Copies of both the Standard Specifications and the CommunityStreet and UtilityStandardsareavailableforreviewattheengineeringcounteratcityhall.AIIcontracts and
agreements hereinafter entered into by the city or upon thecity's behalf shall be in compliancewiththeStandardSpecificationsasrevisedbytheAmericanPublicWorksAssociation,and withthemodifications,additions,and exceptions included in the Cityof Moses Lake's CommunityStreetandUtilityStandardsunlessadditionsordeletionsareapprovedbythecityinwriting.
12.08.020 Conditions for Construction:Itis unlawfulfor any person,firm,or corporationwhois not workingundercitypayrolltocommenceworkorconstructionwithinanymunicipalright-of-way ormunicipaleasement,todisturb any existing municipal improvement,or tocommence workon anyproposedmunicipalimprovementswithouthavingacquiredone(1)or more ofthefollowingitems:
A.Written Notice to Proceed that has been signed by the Engineer.
B.Street and UtilityConstruction Permit
C.Franchise Permit approved by the Municipal Services Director.
D.Franchise agreement with thecity thatallows work without a permit.
12.08.040 Violation -Penalty:Any person,firm,or corporation who violates or fails to complywith theprovisionsofthischaptershallberesponsibleforallliabilityresultingfromtheiractionsortheOomissionoftheiractions,and the violators shall make fullrestitution tothecity for all direct andindirectcosts,expenses,and damages.It is further provided thatthe same person,firm,orcorporationwhoengagesinthesameconductshallbedeemedtohavecommittedacivilinfractionsubjecttoaC-3 penalty as provided inthiscode.
Section 2.This ordinance shall takeeffect and be in forcefive(5)days after its passage and publicationofitssummaryasprovidedbylaw.
