AN ORDINANCEAMENDINGCHAPTER 12.12 OF THE MOSESLAKEMUNICIPALCODEENTITLED"SIDEWALKCONSTRUCTION"
THE CITYCOUNCIL OF THE CITYOF MOSES LAKE,WASHINGTON DO ORDAIN AS FOLLOWS:
Section 1.Chapter 12.12 of the Moses Lake Municipal Code entitled"Sidewalk Construction"is amended
as follows:
12.12.010 Sidewalk Requirements:
A.Sidewalksshall be constructed whenever new curb is constructed.Allmunicipal sidewalksshallbeconstructedofnaturalcoloredPortlandcementconcreteinaccordancewiththeCommunityStreetandUtilityStandards,except that sidewalks in the Paver District shall beconstructedofconcretebrickpaversinaccordancewithplansdrawnbytheMunicipalServices
Department Municipalsidewalksinall residential zones shall be constructed adjacent toa fivefoot(5')planter area oradjacent tothe curb;however,inexistingdeveloped residential areas,reconstruction of sidewalks shallmatch existing sidewalk improvements.The planter areasshallbecoveredbyeightypercent(80%)living plant material and maintained in goodcondition.Inthe Paver District,the sidewalks shall be constructed for the full area betweentheback-of-curb and the right-of-way.
B.Sidewalks shall be constructed so as toavoid all physical obstructions with the exceptionofstopsignsandmailboxes.However,the Municipal Services Director mayallowutilitypoles,fire hydrants,treewells,trees,and trafficsignal controllersto beinstalled inthesidewalk areasthatarewithinthePaverDistrictandcommercialzones.In all cases,sidewalks shall beconstructedtoprovideaminimumoffivefeet(5')of clearance from all obstructions.
12.12.015 ActivityTrailSpecifications:Activity trails shall be installed along routes as directed or approvedbyCityCouncil.Activitytrailsshall be constructed per plans that are approvedby theMunicipalServicesDirector.Construction shall be consistent withrequirementsofthe CommunítyStreet andUtilityStandardswiththeexceptionthatactivitytrailsinthePaverDistrictshallbeconstructedwithconcretebrickpaversperSection12.12.010 ofthe Moses Lake Municipal Code.
12.12.020 Curb Requirements:AIIcurbs shall be constructed of natural coloredPortland cement concreteOandshallbeconstructedinaccordancewiththeCommunityStreetandUtilityStandards;however,in existing developed areas,curbs shall be constructed in accordance with existing curbimprovements.
12.12.025 Curb Ramps Reguired at Intersections:New curbconstructionorcurb replacement shall includetheinstallationofcurbrampsatintersections.At intersections where a single curb ramp is beinginstalled,at least one (1)additional curb ramp shall be installed on the opposite side of the street
as an egress ramp,if one (1)doesn't already exist.Curb ramps shall be constructed inaccordancewiththeCommunityStreetandUtilityStandards.
12.12.030 Rolled Curb Allowed:The Municipal Services Director may allow rolled curb and gutter to beinstalledonnewresidentialstreets.Rolled curb shall not be constructed on primary streets,secondarystreets,ortertiarycollectors.Rolled curb and gutter shall be constructedinaccordancewiththeCommunityStreetandUtilityStandards.
12.12.060 Duty to Maintain Sidewalks:
A.The owner or occupier of property that abuts sidewalksshallbear the duty and expense ofmaintainingsidewalksinagoodstateofrepair,free fromobstructions,and ina clean condition.However,the cityshall bear the duty and expense to repair sidewalks in thePaver Districtthatareconstructedwithconcretebrickpavers,and all sidewalks thatwereconstructed ofconcretebrickpaversthroughcityparticipation.For sidewalks to be in a good state of repair,thesidewalksshallnothaveanyverticaldifferencesofoneinch(1")orgreater;and theyshall nothaveanycontiguousareasofspallinggreaterthanfour(4)square feet.Exposed aggregateinexistingsidewalksshallbeconsideredspallingwhenthesurfacewearmeasuresone.quarterinch(1/4")or greater in differential elevation.
O B.The city may participate insidewalkrepairs forsidewalksthatare wider thansix feet (6').Suchparticipationmaybemadeforsidewalkrepairsthatarewithintheright-of-way and thatarebeyondthefirstsixfeet(6')ofsidewalk nearest to the curb.Such participation is valid onlyifthecityhasprovidedwrittenpre-approval for thesidewalkrepairs.When the city agrees toparticipatewithsidewalkrepairsforover-width sidewalks,theowner will pay thecontractor forthefullrepairs;andthecitywillmake payment directly tothe owner for pre-approved sidewalkrepairsaftertheownerhasprovidedapaidinvoicefromtheircontractor.
C.Chapter12.20 of the Moses Lake Municipal Code provides requirements for sidewalkservicerequirements.
12.12.062 Permit Requirements for Curb and Sidewalk Repairs:AIIcurb and sidewalkrepairs require aStreetandUtilityConstructionPermitinaccordancewithChapter12.16 of the Moses LakeMunicipalCode.However,a permit is not required ifsidewalk panels are eitherlifted or loweredtoeliminateahazard,provided that adjacent improvements are notdisturbed in theprocess.

12.12.065 Obstructions Allowed inthe Paver District:Owners inthe Paver District may place items such assmalltables,chairs,flower pots,and benches on the first three-foot(3')area of theirabutting
sidewalk as measured frorn the property line,but said sidewalksshall be nine feet (9')wide or
greater and shall provide a minimum of five feet (5')of clearance for clear passage.Advertisements,signs,and similar items are not permitted with this authorization.
12.12.080 Deviations:The CityCouncil rnay grant a deviation tothe standards set forth in thischapter upon
the findings that the granting of a deviation is in the best interest and welfare ofthe community.
12.12.090 Violation -Penalty:Any person,firm,or corporation violating or failing to comply with the
provisions ofthis chapter shall be deemed to have committeda civil infraction subject to a C-3
penalty.
Section 2.This ordinance shall takeeffect and be inforce five (5)days afterits passage and publication of
