ANORDINANCE AMENDINGCHAPTER 12.28 OF THE MOSESLAKEMUNICIPALCODEENTITLED"FENCES,WALLSANDHEDGES"
THE CITYCOUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON DO ORDAINAS FOLLOWS:
Section 1.Chapter 12.28 of the Moses Lake Municipal Code entitled "Fences,Walls,and Hedges'isamendedasfollows:
12.28.010 UniformFencing Standards:The MunicipalServices Director may allowfences,walls,and hedgestobeinstalledorplantedinpublicplaces;provided that,the fences,walls,and hedges shallcomplywiththefollowingconditions.
A.Afence permit is required in accordance withTitle 18 (Zoning Ordinance)of theMosesLakeMunicipalCodepriortoconstructionofanyfence.
B.The fence,wall,orhedge shallcomplywith all height regulations of the zoning ordinance.
C.The fence,wall,or hedge shall not cause a traffichazard by obstructingviews of trafficorpedestrianmovements.
D.The city and the public utilitycompaniesmay remove the fence,wall,or hedge for installation,
repair,or replacement of municipal improvements and public utilities without being requiredtoreconstructthefence,wall,or hedge.However,the ownermay have the fence,wall,orhedgereconstructed;provided,that the ownerpays for all reconstruction costs.
E.The fence,wall,orhedge shall be constructed behind the municipalsidewalk ifsidewalksareinstalled.
F.The fence,wall,or hedge shall be constructed at least six feet (6')behind thecurband shallprovideforaminimumsixfeet(6')of clearance when sidewalks do not exist
G.The fence,wall,or hedge shall be constructed to avoid placement over public utilities andmunicipalimprovements.
O H.The fence,wall,or hedge shall not block the view of signs thatare installed behind the curborsidewalk.
I.The Municipal Services Director shall have approved the installation and location ofthefence,wall,orhedge priortoconstruction.
12.28.020 Fence Locations:The person who is installing a fence or a wall,or who is planting a hedge,shallberesponsibleforlocatingthepropertylineforfenceandwallconstruction,or for planting a hedge.The citywillnot inspect for nor have any responsibility to locate theproperty line.
12.28.030 Penaltv:Any person,firm,or corporationviolating orfailing tocomply with any ofthe provisionsofthischaptershallbedeemedtohavecommittedacivilinfractionsubjecttoaC-4 penalty.
Section 2.This ordinance shall take effect and be in force five (5)days after its passage and publication ofitssummaryasprovidedbylaw.
