AN ORDINANCEAMENDINGCHAPTER 12.40 OF THE MOSESLAKEMUNICIPALCODEENTITLED"STREET CONSTRUCTION OR IMPROVEMENTREIMBURSEMENTCHARGES"
THE CITY COUNCIL OF THE CITYOF MOSES LAKE,WASHINGTON DO ORDAINAS FOLLOWS:
Section 1.Chapter 12.40 of the Moses Lake Municipal Code entitled "Street Constructionor improvementReimbursementCharges"is amended as follows:
12.40.010 Authority:Pursuant to RCW 35.72 the City of Moses Lake maycontract with developers for theconstructionofmunicipalstreetimprovements.Additionally,the city mayjoin in with propertyownersinthefinancingoftheconstructionofmunicipalstreetimprovements.
12.40.020 Reimbursement:
A.Developers who completemunicipalstreet improvements may be reimbursed for a portion ofthecostofthemunicipalstreetimprovementspursuanttoRCW35.72.Reimbursementcontractsmaybeacceptedbythecitytoprovideforthepartialreimbursementtothedeveloperforaportionofthecostsoftheprojectbyotherpropertyownersasfollows:
1.Property ownerswho own property within the assessment reimbursementarea pursuanttoRCW35.72.040.
2.Property owners who have a reimbursementshare based upona benefit to the propertyownerpursuanttoRCW35.72.030.
3.Property owners who did not contribute to the original cost of the municipal streetimprovementproject.
4.Property owners who subsequently develop theirproperty withinfifteen(15)years from thedateofCityCouncilacceptanceofthemunicipalstreetimprovements;and which propertyowners,at the time of their property development,are not required to install similarmunicipalstreetimprovementsbecausethemunicipalstreetimprovementsarealreadyprovidedforbytheprojectreferredtointhereimbursementcontract.
B.The city shallbe reimbursed in thesame manneras the developer ifthecityhas specifiedtheconditionsofitsparticipationinanordinance.As another alternative,the city may create anassessmentreimbursementareaonitsowninitiative,withouttheparticipation ofa developer;finance thecosts ofthe municipal street improvements;and becomethe sole beneficiaryofthereimbursementsthatarecontributed.
12.40.030 Assessment Reimbursement Area:Upon the requestof developers who have installed municipalstreetimprovements,or upon the city's own initiative as allowed in Section 12.40.020 of thischapter,theMunicipalServices Directorshall establishassessment reimbursementareas thatarebaseduponpropertiesandparcelsthatareadjacenttothemunicipalstreetimprovements.TheassessmentreimbursementareashallbepresentedtotheCityCouncilpriortonotifyingaffectedpropertyowners,
i 12.40.040 Reimbursement Charges for Street Construction:
A.Street improvements shall be classified as either developer funded and installed streetimprovementsoraspubliclyfundedandinstalledstreetimprovements.
B.Ifstreet improvements have been constructedat theexpense ofa developer,adjacent propertyownerswithintheassessmentreimbursementareashallnotbeallowedtohavetheirdevelopmentsapproveduntilallfeesrequiredbythecontractbetweenthecityandthedeveloperhavebeencollected,or untilthe contractexpires.These development limitationsshallbeenforcedforaperiodnottoexceedfifteen(15)years from the date thatCity Councilacceptsthestreetimprovements.If the Finance Director cannot locate the developer byregisteredorcertifiedmailpriortofifteen(15)years after acceptance of street improvements,the limitation fordevelopment shall cease.
12.40.050 Street Improvement Charqas -Wapato Drive:Street improvement charges in Section 33,Township 19 North,Range 28 East,W.M.,constructed with Cityfunds as part of the PeninsulaEstatesPhaseIVManufacturedHorneParkshallbereimbursedbythepropertyowneruponpropertysubdivisionorupondevelopment.Thereimbursement shall be inaddition toother permitfeesthataredue.A sixty-three dollar ($63)per front foot charge shall be assessed against thefollowingpropertyinSection33,Township 19 North,Range 28 East,W.M.:
The northeasterly one hundred feet (100')of Tract 64,Plat of Battery OrchardTracts frontingonWapatoDrive.
The per front foot reimbursement rate shallbe adjusted upward commencingon June 1,1999bythechangeintheJanuarytoJanuaryAllWestCostCitiesCPI-W Index issued in 1999,andshallbesoadjustedeachJune1thereafterusingthesameindex.

12.40.054 Street Improvement Charges -South Alder Street:Street improvement charges in Section 23,
Township 19 North,Range28 East,W.M.,constructedwith cityfunds as part of the Alder Street
Extension Project 2003 shall be assessed on the properties described below.The charge shall
be paid uponproperty subdivisionor application ofa building permit.The reimbursement shallbe
in additionto other permit fees that are due.
A.Lot 1,Bouma Short Plat $4,199
B,Lot 2,BoumaShort Plat $4,199
C.Tax Number 484-B $4,199
The above reimbursementrates shall be adjusted upward commencingonJune 1,2006 by the
change in January to January all West Coast Cities CPI-Index issued in 2005 and shall be so
adjusted each June 1 thereafterusingthe same index.
12.40.060 Street Improvement Charges-Signal at Grace Drive and Vallev Road:Street improvement
charges in Section 15,Township 19 North,Range 28 East,W.M.,constructedwith cityfunds as
part ofthe Crestview Court Planned Unit Development shall be reimbursedby the property owner
upon property subdivision or upon development The reimbursement shall be inaddition toother
permit fees that are due.A $0.01445per square foot charge shall be assessed against the
following properties in Section 15,Township 19 North,Range 28 East,W.M.:
A.Tract 32,Park Orchard Tracts,including tax parcels.
B.That portion of Tract 33,Park Orchard Tracts lying northof theBurkett Addition.
The square foot reimbursement rate shall be adjusted upwardcommencing on June 1,1999 by
the changein the January toJanuary AllWest CostCities CPI-W Index issued in 1999 and shall
be so adjusted each June 1 thereafterusingthesame índex.
12.40.070 Street Improvement Charges -UndergroundPower For Yonezawa Boulevard and Clover Drive:
Underground power charges in Sections 25 and 26,Township 19 North,Range 28 East,W.M.,
constructedwithcity funds as part ofthe Yonezawa Boulevard Project shall be reimbursed by the
property owneruponproperty subdivision or upon development.The reimbursementshall be in
additionto other permit fees that are due.The per front foot charges shallbe assessed against
the following properties.
A.AIIproperties abutting Yonezawa Boulevard,
located between Division Street and SR-17 $17.34 /front foot
B.Allpropertiesabutting Clover Drive,
located between Yonezawa Boulevard and SR-17 $4.08/frontfoot
The per front foot reimbursementrate shall be adjusted upward commencing on June 1,2003 by
the change inthe January to January AllWest Coast Cities CPI-W Index issued in2003,and shall
be so adjusted each June 1,thereafter usingthesame index.
12.40.080 Street improvement Charges -Interlake Drive:Street improvement charges inSections 28 and 33,
Township 19 North,Range 28 East,W.M.,constructedwith city funds as part of the Interlake
reconstruction project shall be reimbursed by the property owner upon property subdivision or
applicationfor a building permit.The reimbursement shallbe in additiontoother permit fees that
are due.

The above reimbursementrates shall be adjusted upward commencing on June 1,2004 by the
change in January to January all West Coast Citíes CPI-Index issued in 2003 and shall be so
adjusted each June 1 thereafter using the same inde×.
12.40.090 Street Improvement Charges -TrafficSignals at Paxson and VallevRoad:Street improvements
consisting of intersection improvements or trafficsignals constructed withcity funds shall be
reimbursed by the below referenced property owners upon property subdivision or upon
development.Intersection improvements or trafficsignals will be installed when warranted.
Reimbursement fees shall be collected before theintersection improvements or trafficsignalsare
completed.The assessment shall be in addition to the other permit fees that are due.Every
residential unit equivalent in the referenced reimbursement area as set forth below shall be
assessed a twohundred dollar($200)reimbursement fee.The reimbursement area shallinclude
the followingproperties:
