2230_00001ORDINANCE NO.2230 ANORDINANCEAMENDINGCHAPTER 12.44 OF THE MOSES LAKEMUNICIPALCODEENTITLED"STREET VACATIONS" THE CITYCOUNCIL OF THE CITYOF MOSES LAKE,WASHINGTON DO ORDAINAS FOLLOWS: Section 1.Chapter 12.44 of the Moses Lake Municipal Code entitled "Street Vacations"is amended asfollows: 12.44.010 Authoritv:The cityis authorizedtovacate streets pursuant toRCW 35A.47.020 and RCW 35.79 as now in effect or hereinafter amended.The city is authorized to collect processing fees,appraisal costs,and compensation charges for all vacation requests in accordance withthischapter. 12.44.020 Processinq Fee:Anon-refundableprocessing fee oftwohundred dollars($200)shallaccompanyallpetitionsforastreetvacation.The petition shall not be presented to the City Council norprocessedfurtheruntiltheprocessingfeehasbeenpaid.The processing fee willnot be refundedtothepetitioner,regardless of whether or not City Council agrees to vacate the property.Thepetitionfeeisinadditiontoallappraisalfeesandcompensationchargendueforthevacationrequest. 12.44.030 Appraisal Deposit: A.An appraisal deposit shall accompany all petitions for a street vacation,or the petitioner shallprovideanappraisalthatispreparedbyanappraiserwhoiscertifiedbythestate,or thepetitionermayagreewiththecity's determination of thevalue oftheproperty.The petition forvacationshallnotbepresentedtotheCityCouncil,nor processed further,untilthe petitionerhaseitherpaidtheappraisaldeposit,or has provided a certified appraisal,or has agreed tothecity's determination ofthevalue of the propety. B.Where the petitioner options for the cityto have an appraisal completed,the amount of theappraisaldepositshallbeestablishedbytheMunicipalServicesDirectorandshallnotbelessthanfourhundreddollars($400).The appraisal deposit shall be inaddition toprocessing feesandcompensationchargesthataredueforavacationrequest.The cost of appraisingthepropertyshallbepaidfromtheappraisaldepositIfthecostfortheappraisalislessthanthe O appraisal deposit,thecity may refund the difference between the appraisaldeposit and theappraisalcosttothepetitioner,orthe difference may be applied to other fees or charges that are due for vacating the property.Appraisal costs will not be refunded to the petitioner,regardless ofwhether or not CityCouncil agrees to vacate the property, 12.44.040 Compensation:The petitioner shall compensate thecityforallvacated property pursuant toRCW35.79.020,unless waived by the CityCouncil.The compensation charge shall be in addition toprocessingfeesandappraisalcoststhataredueforvacatingtheproperty. Section 2.This ordinance shall take effect and be inforcefive (5)days after its passage and publication ofitssummaryasprovidedbylaw. Adopted by the City Council and signed by its Mayor o ,05.
