AN ORDINANCE AMENDING CHAPTER 8.20 OF THE MOSES LAKE MUNICIPAL
CODE ENTITLED "WEED CONTROL"
THE CITY COUNCIL OF THE CITY OF MOSES LAKE, WASHINGTON ORDAINS AS FOLLOWS:
Section 1. Chapter 8.20 of the Moses Lake Municipal Code entitled "Weed Control" is amended as follows:
8.20.020 Notice to Comply: The Building Official is authorized and empowered to make inspections of all
property, lots, places, or areas, either vacant or occupied, within the corporate limits of the city to
determine whether the obligations imposed by this chapter are being fulfilled. In the event a
property, lot, place, or area is discovered which is not in compliance with this chapter, the Building
Official shall prepare a Notice of Violation and Order to Correct as provided under Chapter 1.20.
8.20.030 Action Upon Non-Compliance: In the event that any property, lot, place, or area is not brought into
compliance with this chapter by the owner or occupant or the agent of the owner or occupant after
receiving the Notice of Violation and Order to Correct, the City of Moses Lake, under the direction
of the Building Official, may seek an injunction in a court of competent jurisdiction or proceed as
provided to hold a hearing before the City Council as provided in Section 8.14.050 of this Code.
The proceedings for bringing any property, lot, place, or area into compliance shall be initiated by
resolution of the City Council which shall describe the property, lot, place, or area involved and
shall authorize the Building Official to do what is necessary to bring any property, lot, place, or area
into compliance. The work which must be performed in order to bring any property, lot, place, or
area into compliance may be done by the agents and employees of the City of Moses Lake, or by
independent contractors, as the Building Official may deem appropriate. Careful account of the
cost of such work shall be kept and reported to the Finance Director when the work is completed.
The cost to the city of such work shall be and become a charge against the owner of such
property, lot, place, or area and shall be collected in the same manner as other debts owing to the
city.
8.20.060 Provision Supplemental: This chapter is intended to supplement the weed control provisions
contained in the International Fire Code as administered by the Fire Department. This chapter is
not intended and shall not impair the administration of the International Fire Code as it relates to
weed control. The Fire Department shall continue to administer the International Fire Code as it
pertains to weeds and fire hazards.
Section 2. This ordinance shall take effect and be in force five (5) days after its passage and publication of
its summary as provided by law.
