Whita er, City Attorney ORDINANCE NO. 2301 • AN ORDINANCE AMENDING CHAPTER 8.22 OF THE MOSES LAKE MUNICIPAL CODE ENTITLED "NOXIOUS WEED CONTROL" THE CITY COUNCIL OF THE CITY OF MOSES LAKE, WASHINGTON ORDAINS AS FOLLOWS: Section 1. Chapter 8.22 of the Moses Lake Municipal Code entitled "Noxious Weed Control" is amended as follows: 8.22.010 Noxious Weeds: The weeds listed by Grant County Weed District No. 2 pursuant to RCW 17.04 are declared to be noxious weeds and as noxious weeds are found to be injurious to crops, livestock, and other property. A listing of weeds declared to be noxious weeds is available from the Community Development Department. 8.22.040 Enforcement Officer: The Code Enforcement Officer or his or her designee of the City of Moses Lake is hereby designated as the enforcement officer of this chapter. 8.22.060 Notice to Destroy: Whenever the Code Enforcement Officer or his or her designee finds that noxious weeds are present on any parcel of land and that the owner has not taken sufficient action to control the same, he shall notify the owner that a violation of this chapter exists by issuing a Notice of Violation and Order to Correct as provided in Chapter 1.20 giving the owner at least ten (10) days to correct the violation. 8.22.070 Action Upon Non-Compliance - Costs: Upon the failure, neglect, refusal of any owner so notified to abate a nuisance by controlling noxious weeds growing upon any lot, place, or area within the City of Moses Lake, after receipt of the written notice provided for in Section 8.22.060 above, the Code Enforcement Officer or his or her designee is hereby authorized and empowered to bring before the City Council a request for abatement of the nuisance as provided in Section 8.14.070 of this Code. 8.22.080 Recovery in Civil Action: When the City of Moses Lake has affected the control of such noxious weeds or has paid for their control, the actual cost of control, plus damages and other charges incurred by the City of Moses Lake shall be charged to the owner of such property. The costs, damages, and other charges incurred by the city shall be collected in the same manner as other debts owing to the city. 8.22.090 Provision Supplemental: This ordinance is intended to supplement the weed control provisions contained in the International Fire Code and Chapter 8.20. This ordinance is not intended and shall not impair the administration of the International Fire Code as it relates to weed control. Section 2.
