ORDINANCE NO. 2435
AN ORDINANCE AMENDING ORDINANCE NO. 2327 CREATING A PLANNED UNIT
RESIDENTIAL DEVELOPMENT DISTRICT OF MOSES LAKE PURSUANT TO MOSES LAKE
MUNICIPAL CODE 18.67
THE CITY COUNCIL OF THE CITY OF MOSES LAKE, WASHINGTON DO ORDAIN AS FOLLOWS:
Section 1. Ordinance No. 2327 creating the Greens Planned Unit Residential Development District #10 is
amended as follows:
Section 2. The following described property shall be permitted to develop as Planned Development District
No. 10, and shall be named The Greens Planned Unit Residential Development as recorded with
the Grant County Auditor.
A part of the SW 1/4 of Section 23, Township 19 North, Range 28 East, W.M., described as
follows:
Commencing in the center of the county road at a point where the road that runs from Neppel
to the Moses Lake Post Office crosses the north line of said quarter section; running thence
east along the north line of said quarter section, a distance of fifty rods, thence south at right
angle a distance of 40 rods, thence west at right angle a distance of fifty rods, to the center
of said road, thence north along the center of said road to the point of beginning.
Section 3. The Greens is a mixed use development. The land uses that are permitted are:
A.Single family detached dwellings
B.One community center with an associated parking lot. The community center may contain
a storage area within the building for tools and equipment used to maintain the
development's landscaping.
C.Common open space, including walkways, landscaping.
Section 4. The Greens PURD is an overlay zone. The requirements of the underlying R-1 and R-3 Zones
are modified as follows:
A. Overall development standards
1.The development shall be constructed essentially as presented to the Planning
Commission and Council.
2.A homeowners' association shall be required before the planned unit development major
plat is recorded with Grant County. The Codes, Covenants, and Restrictions for the
development shall be submitted to the City for review and shall be recorded concurrently
with the plat. The homeowners' association shall be responsible for the maintenance of
the site, including but not limited to landscaping, community center, off-street parking
areas, streets, utilities (water, sanitary sewer, and storm water facilities), and sidewalks.
3.The community center and associated parking and landscaping shall be completed
before a Certificate of Occupancy is issued for the 35th house in the development. If the
community center is not constructed, no additional building permits for houses will be
issued.
B. Streets, sidewalks, and utilities:

1.Streets and utilities shall be privately owned and maintained by the home owners
association.
2.Private street right-of-way width shall be 22'. A 5'-wide public utility easement shall be
granted on each side of all internal streets.
3.Streets shall be constructed to Community Standards for roadway, gutter, and curb,
except the minimum width of the roadway shall be 22' from back of curb to back of curb.
Type A (square) curb shall be used. Streets and utilities shall be constructed or bonded
for before submittal of the final planned development application.
4.Parking areas shall be privately owned and maintained by the homeowners' association.
5.Street lighting shall be designed and constructed in the same manner as a typical
residential subdivision.
6.Sidewalks shall be located in the common green space in front of the houses, generally
as shown on the landscape plan. All houses, off-street parking areas, and the
community center shall be connected by the sidewalk system. The sidewalks shall
connect to the public sidewalks on 9 th Avenue and Division Street and shall be
accessible to the public. Sidewalks shall be constructed per Community Standards at
no less than 5' width.
7.Sidewalks shall be privately owned and maintained by the homeowners' association to
the same standard as public sidewalks.
8.The developer shall provide pedestrian-scale lighting for the walkways. Walkway lighting
shall be maintained and paid for by the residents of the subdivision, either individually
or through the homeowners' association.
9.The houses are proposed to be built one small group at a time. No Certificate of
Occupancy for any house within a cluster of houses shall be issued until the sidewalks
are installed for that cluster, including sidewalk connections to 9th Avenue, Division, the
community center, and/or off-street parking areas, if any of these connections are in
proximity to the cluster of houses being built.
C. Bulk standards:
1.The maximum overall density of the development shall be 6.1 dwelling units per acre.
2.The minimum lot size shall be 3200 square feet. The minimum lot width for internal lots
shall be 40'. The minimum lot depth for internal lots shall be 80'. Minimum lot standards
for corner lots shall be generally the same as for internal lots, except that a full 40' x 80'
rectangle is not required, if the lot area is increased so that the proposed house fits on
the lot and meets all the required setbacks.
3.Minimum distance from the garage door to the internal street along the vehicle access
between the garage and the street shall be 18 . Minimum setback of other portions of
the building from the internal street shall be 5'. Minimum interior side yard setback for
the main portion of the house shall be 5'. Projections such as bay windows and
fireplaces may extend up to 2' into the side yard setback. Minimum setback of the front
porch from the common open space shall be 2'. Eaves, cornices, and awnings may
project into the required setback no more than 2'. No projection into public utility
easements is allowed. Projections into municipal easements are allowed only with the
permission of the City Council.•

4.Minimum separation from front of porch to front of porch, across a green space, shall be
30' for at least 90% of the buildings.
5.Minimum roof pitch of the main roof of residential structures shall be 8:12 (vertical :
horizontal).
6.Maximum size of residential units shall be fifteen hundred (1500) square feet of living
area on the ground floor. A loft not to exceed four hundred (400) square feet shall be
allowed in addition to the ground floor area.
7.Minimum setback of any building from the exterior boundaries of the development shall
be the same as the underlying zone.
D. Building design standards:
1.The Greens Planned Unit Residential Development was approved based on a very
specific appearance and quality of proposed dwelling unit. All dwelling units shall be
constructed in conformance with the building plans submitted by the developer, and
attached to this ordinance as Exhibits A through D. Minor changes to address building
code requirements shall be allowed, so long as the buildings appear essentially as
shown in the exhibits.
2.The appearance of the community center shall be compatible with the surrounding
residential uses. Elevation drawings of the building shall be submitted to the Planning
Commission for review and approval before a building permit will be issued.
3.Each dwelling unit shall have a front porch not less than 80% of the width of the building
and facing the common open space. Each dwelling unit shall have an attached two-car
garage, accessed from the internal streets of the development.
4.All external doors and windows shall have trim with a minimum width of 31/2".
5.Eaves of at least 18" shall be provided on at least two sides of all buildings.
6.The garage doors shall either contain windows or be separated into two doors.
7.Exterior siding materials for all buildings shall be wood, engineered wood, fiber cement,
stone, or masonry. Vinyl, aluminum, plywood, and steel shall not be allowed.
8.Roofing for all buildings shall be architectural shingles. Three-tab shingles shall not be
allowed.
9.Each house shall have an enclosure to screen its trash receptacle.
10.No accessory structures shall be allowed.
E. Landscaping and fencing:
1.Landscaping shall generally conform to the submitted landscape plan.
2.Perimeter treatments for the development shall be as follows:
a. Along the Division Street frontage, the developer shall install street frontage
landscaping at least 5' wide between the back of the Division Street sidewalk and the
curb of the internal street. Landscaping shall consist of street trees at 40' spacing
and live groundcover, at a minimum. The developer may install a hedge along with
the street trees and groundcover within the 5' landscape area. A fence may be

installed along with the street trees and groundcover within the 5' landscape area if
it meets all of the following requirements:
1. The fence shall meet all applicable requirements of MLMC 18.20.120.K,
Subdivision Fencing, including height, appearance, Planning Commission review,
maintenance, and irrigation.
Because the total amount of landscaping outside the fence is less than would be
required by MLMC 18.20.120.K, the fence shall be constructed of materials such
as wrought iron that allows the landscaping on the opposite side of the fence to
be seen. Chain link fencing shall not be allowed.
3.The fence shall be at least 1' from the right-of-way line.
4.Street trees shall be spaced 25' apart.
5.Street trees may be either inside or outside the fence. Live groundcover shall be
installed both inside and outside the fence.
Whether or not a fence or hedge is installed, all unpaved areas between the curb on
Division and the internal street shall be landscaped and maintained.
b. Along the 9th Avenue frontage, the developer shall install street frontage landscaping
at least 5' wide. At a minimum, landscaping shall consist of one street trees for every
40' of frontage, along with live groundcover. The developer may install a hedge along
with the street trees and groundcover within the 5' landscape area. A fence may be
installed along with the street trees and groundcover within the 5' landscape area if
it meets all of the following requirements:

c. Between the east property line and the internal street, there shall be a street frontage
buffer that meets the requirements of MLMC 18.57.040.A, at a minimum.
d. Along the south property line the developer may install a fence or decorative block
wall not to exceed 8' in height. The type and design of the fence or wall shall be
submitted to the Planning Commission for review. No landscaping is required along
this property line if a fence or wall is installed. If no fence or wall is installed, a 5'-wide
Type II landscape buffer per MLMC 18.57.050 is required.
3. Perimeter landscaping shall be installed or bonded for before issuance of a Certificate

4.Houses are proposed to be developed in clusters. Within a cluster, landscaping adjacent
to the houses and in the common area between houses shall be installed or bonded for
before issuance of a Certificate of Occupancy for any house within the cluster.
5.No internal fencing shall be allowed, except for the following:
a.an enclosure for storage of the trash receptacle for each house.
b.A picket fence enclosure, not taller than 3 feet, to screen the propane tank associated
with each house.
c.A picket fence, or similar, not taller than 3 feet, on the back door side of each house,
beginning no closer to the private street than the face of the garage and extending
no closer to the front of the house than 30'. The primary purpose of this enclosure
is to contain small pets.
F. Parking:
1.Parking for each dwelling unit shall be within the two-car garage of the unit. No other off-
street parking shall be required for the dwelling on each lot.
2.The development shall provide approximately 20 off-street parking spaces adjacent to
the community center. Approximately 58 additional off-street parking spaces shall be
provided throughout the development for visitor parking.
3.Because of the width of the streets, no on-street parking shall be allowed.
• 4. No storage of recreational vehicles, watercraft, or similar items shall be allowed unless
wholly within a garage.
Section 5. Steinhauer/Norman LLC or their successor in interest shall be bound to the uses and
modifications specified in this ordinance.
Section 6. This ordinance shall take effect and be in force five (5) days after its passage and publication as
provided by law.
