2460• • ORDINANCE NO. 2460 AN ORDINANCE AMENDING CHAPTER 18.41 OF THE MOSES LAKE MUNICIPAL CODE ENTITLED "BP, BUSINESS PARK ZONE" THE CITY COUNCIL OF THE CITY OF MOSES LAKE, WASHINGTON ORDAINS AS FOLLOWS: Section 1. Chapter 18.41 of the Moses Lake Municipal Code entitled "BP, Business Park Zone" is amended as follows: 18.41.015 Additional Requirements: Additional requirements are found in other chapters of the Municipal Code and other adopted City regulations, including but not limited to the following: A.MLMC 18.10, Citywide Regulations B.MLMC 18.45, Conservation and Reclamation Zone C.MLMC 18.49, Site Plan Review D.MLMC 18.51, Conditional and Unmentioned Uses E.MLMC 18.53, Flood Hazard Areas F.MLMC 18.54, Off-Street Parking and Loading G.MLMC 18.57, Landscaping H.MLMC 18.58, Signs I.MLMC 19.03, Classification and Designation of Resource Lands and Critical Areas and Regulations for the Conservation and Protection of Resource Lands and Critical Areas J.MLMC 19.06, Classification and Designation of Wetlands and Regulations for the Conservation and Protection of Wetlands K.City of Moses Lake Shoreline Master Program 18.41.020 Permitted Uses: A.Only those uses listed below, and uses similar in nature as determined by the Community Development Director, may be permitted in the BP Zone. B.Uses listed below, or uses similar in nature, as determined by the Community Development Director, utilizing quantities of hazardous materials exceeding the quantities in State Building Code Table 3-D, Exempt Amounts of Hazardous Materials Presenting a Physical Hazard—Maximum Quantities Per Control Area, and Table 3-E, Exempt Amounts of Hazardous Materials Presenting a Health Hazard—Maximum Quantities Per Control Area, as presently constituted or subsequently amended, will require a conditional use permit pursuant to MLMC Chapter 18.51. npninit,kirE oAnn, u. Services, limited to the following: a.Business services (73) b.Engineering, accounting, research, management, and related services (87) c.Legal services (81) d.Medical and dental clinics and laboratories (801-804 and 809) e.Repair services (76), excluding repair of automobiles and other large or motorized vehicles f.Personal services (72) g.Recreational services, such as health clubs, athletic clubs, swimming pools, and tennis courts (791, 7991, and 7997), but not including theaters, bowling alleys, amusement arcades, and the like h.Museums and art galleries (841) i.Social services (83), including nursery schools and day care centers j.Educational institutions (82) k.Business associations, professional associations, fraternal lodges, and similar uses (861-865, 869) I. Churches and other religious institutions (866) m. Conference and meeting facilities (no SIC code) 2. Finance, insurance, and real estate institutions and services (60-67) 3. Small electrical equipment and components, such as appliances, lighting, electronics, and communication equipment (36 m.Measuring, analyzing, and controlling instruments; photographic, medical, and optical goods; watches and clocks (38) n.Toys, jewelry, musical instruments, signs, and other miscellaneous items (39) 4. Wholesale trade of general merchandise, products, supplies, materials, and equipment, including sales offices of these goods (50 and 51). However, motor freight transportation and warehousing (42), transportation by air (45), and packing and crating (4783) are prohibited. 5. Building and special trade contractors (15 and 17) 6. Retail trade, limited to the following: a.Restaurants (5812) b.Nurseries and greenhouses for the growing and sale of plants (5261) c.Retail uses selling products and providing services which are of a type and are located and designed to serve other business park tenants without attracting a significant number of patrons from outside the business park 7. Public facilities, including the following: a.Public park (no SIC code) b.Government offices and facilities (91-97) c.Public utilities (48 and 49), excluding the production or storage, other than for use by the utility, of petroleum products 8.Residential uses that are for the convenience of a resident watchman or custodian shall be permitted. Residential structures may only be permitted appurtenant to the primary use. • H. I ne following table sets forth the required development standards applicable to properties located in the BP Zone. See MLMC 18.41.050.0 Minimum landscaped setback from principal or minor arterial as designated in the comorehensive plan 25' B.Minimum Site Area: The minimum area of a business park eligible for master plan approval shall be twenty (20) acres unless the Planning Commission finds that a smaller area is consistent with the Comprehensive Plan, as well as the purpose and intent of the Business Park Zone. Business parks containing less than the minimum site area shall be allowed if the site adjoins a business park with a previously approved master plan and the application for the new business park is processed as an amendment to the previously approved master plan in accordance with MLMC 18.41.040.E.2. C.Setbacks: 1. Within the setback area shown on Table 2, no building or structure (as defined in 18.06.610) shall be allowed, except flagpoles, street furniture, transit shelters, signage, fencing, slope stability structures, and improvements less than thirty inches (30") above grade, including decks, patios, walks, and driveways. Some of these structures and improvements require a permit. D.maximum 01[W...11_11C ncitil IL. 1.Within the first thirty-five feet (35') of setback from an adjoining public street or residential zone, the maximum building height shall be equal to the proposed building setback. The maximum building height may be increased by one and a half feet (1.5') for each additional one foot (1') of setback in excess of thirty-five feet (35') up to a maximum of fifty feet (50'). 2.Building heights within required setbacks shall be measured from the grade of the public sidewalk or centerline of the public street adjoining the site, or from the grade of the property line adjoining a residential zone. For buildings or structures located more than five hundred feet (500') from any residentially-zoned property, the Planning Commission may allow such buildings or structures to be erected to an additional height following a public hearing and examination of the location and upon due proof to the satisfaction of the Commission that such additional height will not be detrimental to the surrounding properties.
